One significant recent change was<br />

the introduction of new insurance<br />

requirements following the terrible<br />

tragedy in Lac-Mégantic. The Agency<br />

is responsible for administering the<br />

new regime. It is to the credit of<br />

the railways that they were so<br />

responsive during the informationgathering<br />

phase.<br />

I would also note the Agency’s<br />

mediation services have historically<br />

been undersubscribed. If there is a<br />

disagreement between a shipper<br />

and a freight rail company, they can<br />

come to us for adjudication. We act<br />

just like a court. But we can also try<br />

to resolve the matter through neutral,<br />

confidential mediation. It costs less<br />

money for everybody, creates less<br />

strain in relationships, and it’s typically<br />

faster. We will continue to encourage<br />

the use of mediation.<br />

How will the Agency’s Regulatory<br />

Modernization Initiative (RMI) affect<br />

the railways?<br />

Regulations on costing,<br />

interswitching and operational terms<br />

…all of this will be on the table<br />

for consultation.<br />

The objective of the RMI is<br />

to produce regulations that are<br />

relevant, not only to current<br />

industry practices, but also to what<br />

we can reasonably anticipate as<br />

emerging in the future.<br />

How would you describe the<br />

Agency’s relationship with<br />

the railway industry now<br />

and going forward?<br />

The Agency and the industry<br />

have been intertwined for over 110<br />

years, playing a significant role in<br />

one another’s development.<br />

Our relationship will increasingly<br />

need to be characterized by a<br />

rich and ongoing dialogue as the<br />

pace of change accelerates and<br />

the world becomes increasingly<br />

networked.<br />

I think the Agency should be as<br />

transparent as possible about its<br />

thinking and processes, and the<br />

industry should be as transparent<br />

as possible about the directions it’s<br />

heading in and what it’s doing to<br />

meet the expectations Parliament<br />

has laid out in legislation.<br />

Canada will always need a fully<br />

functioning transportation system<br />

across the entire supply chain from<br />
