Foreword<br />

LANGO CULTURAL FOUNDATION<br />

In Lango, over 93% of the l<strong>and</strong> is under the customary l<strong>and</strong> tenure system,<br />

to be managed <strong>in</strong> accordance with Lango pr<strong>in</strong>ciples, practices, rights <strong>and</strong><br />

responsibilities (PPRR), as provided for by the Constitution. While Lango<br />

PPRR <strong>in</strong> l<strong>and</strong> tenure management is well known amongst the Langi; its<br />

underst<strong>and</strong><strong>in</strong>g <strong>and</strong> clarity with<strong>in</strong> the new Langi generation is not as clear as<br />

it is with the earlier generations due to the effect of time <strong>and</strong> change. For<br />

some parts of Lango, the situation has been made worse by the 20 years of<br />

<strong>in</strong>security <strong>and</strong> the effects of displacement. In addition, the courts of law <strong>and</strong><br />

other non Langi with<strong>in</strong> Ug<strong>and</strong>a <strong>and</strong> beyond do not underst<strong>and</strong> with adequate<br />

clarity the Lango PPRR <strong>in</strong> l<strong>and</strong> tenure management. Furthermore, there is<br />

lack of written Lango PPRR <strong>in</strong> l<strong>and</strong> tenure management, leav<strong>in</strong>g it to be<br />

passed from one generation to another through actual practices, verbal <strong>and</strong><br />

folklore.<br />

In the face of the challenges of population <strong>in</strong>crease, people return<strong>in</strong>g home<br />

from displacement <strong>and</strong> the need for harmonisation of all stakeholders’<br />

underst<strong>and</strong><strong>in</strong>g of the Lango PPRR <strong>in</strong> customary l<strong>and</strong> tenure system, Lango<br />

Cultural Foundation through its M<strong>in</strong>istry of <strong>L<strong>and</strong></strong>s, Natural Resources<br />

<strong>and</strong> Physical Plann<strong>in</strong>g has documented the Pr<strong>in</strong>ciples, Practices, Rights<br />

<strong>and</strong> Responsibilities of customary tenure <strong>in</strong> Lango, with support from our<br />

development partners, particularly <strong>L<strong>and</strong></strong> <strong>and</strong> <strong>Equity</strong> <strong>Movement</strong> <strong>in</strong> Ug<strong>and</strong>a<br />

– <strong>LEMU</strong> <strong>and</strong> those who support them. We believe that it will provide a lot of<br />

useful guidance to our people, those <strong>in</strong>volved <strong>in</strong> l<strong>and</strong> management <strong>in</strong> Lango,<br />

courts of law, <strong>and</strong> other stakeholders. We also believe this PPRR will help to<br />

reduce the many problems currently faced by people with l<strong>and</strong> rights under<br />

customary tenure <strong>in</strong> Lango such as:<br />

i. Boundary disputes<br />

ii. <strong>L<strong>and</strong></strong> grabb<strong>in</strong>g from unmarried daughters, sons born out of marriage,<br />

divorced women who return to parents <strong>and</strong> people who are away<br />

from home. <strong>The</strong> l<strong>and</strong> grabb<strong>in</strong>g is sometimes unfortunately done by<br />

the very clan members who have the responsibility to protect the<br />

l<strong>and</strong> rights.<br />

iii. Irresponsible sale of l<strong>and</strong> without knowledge <strong>and</strong> consent of the<br />

clan leaders; without consider<strong>in</strong>g future generations; for money for<br />

alcohol, luxuries <strong>and</strong> gambl<strong>in</strong>g; without knowledge <strong>and</strong> consent of<br />

the spouse, children <strong>and</strong> other family members<br />

iv. Sale of the same l<strong>and</strong> more than once due to greed for money with<br />

resultant consequences that sometimes cause death.


LANGO CULTURAL FOUNDATION<br />

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

v. Secret sale of l<strong>and</strong> belong<strong>in</strong>g to others, the community or public l<strong>and</strong><br />

such as wetl<strong>and</strong>s.<br />

vi. Conflict caused by people who migrated <strong>and</strong> resettled <strong>in</strong> some other<br />

place a long time ago but return to home of orig<strong>in</strong> for l<strong>and</strong> to sell.<br />

vii. Conflict caused by the retraction of l<strong>and</strong> gifts given by deceased<br />

relatives from other people <strong>and</strong> <strong>in</strong>stitutions such as health units,<br />

market, forest, play grounds <strong>and</strong> worship places.<br />

viii. <strong>The</strong> chas<strong>in</strong>g from l<strong>and</strong> of widows, orphans <strong>and</strong> children by some<br />

clan leaders, family members <strong>and</strong> neighbours<br />

ix. Some leaders tak<strong>in</strong>g l<strong>and</strong> by force <strong>in</strong> the name of development but<br />

without giv<strong>in</strong>g the legally required compensation – purchase price,<br />

disturbance allowance <strong>and</strong> improvements on the l<strong>and</strong><br />

x. Conflict brought about by court rul<strong>in</strong>gs made without underst<strong>and</strong><strong>in</strong>g<br />

customary l<strong>and</strong> tenure.<br />

<strong>The</strong> challenge ly<strong>in</strong>g ahead is adequate dissem<strong>in</strong>ation to all key stakeholders;<br />

adherence to the PPRR <strong>and</strong> receiv<strong>in</strong>g necessary feedback for cont<strong>in</strong>uous<br />

improvement.<br />

<strong>The</strong> process of document<strong>in</strong>g <strong>and</strong> ensur<strong>in</strong>g the accuracy <strong>and</strong> authenticity of the<br />

PPRR of customary tenure <strong>in</strong> Lango was through a Work<strong>in</strong>g Group consist<strong>in</strong>g<br />

representatives of clan heads <strong>and</strong> women female clan representatives that I<br />

appo<strong>in</strong>ted, <strong>and</strong> <strong>LEMU</strong> staff. <strong>The</strong> Work<strong>in</strong>g Group drafted the PPRR based on<br />

<strong>in</strong>formation from over 60 clan heads. <strong>The</strong> f<strong>in</strong>al draft of the Work<strong>in</strong>g Group<br />

document was laid before more than 100 clan heads for ratification.<br />

I am hereby duty-bound to call upon all the Langi, <strong>L<strong>and</strong></strong> key stakeholders,<br />

actors, Ug<strong>and</strong>a Government, Local Governments, Members of Parliament,<br />

faith-based organizations, clans <strong>and</strong> community leaders, elders, bus<strong>in</strong>ess<br />

people <strong>and</strong> <strong>in</strong>vestors <strong>and</strong> all the people of Lango to jo<strong>in</strong> h<strong>and</strong>s <strong>and</strong> work<br />

together <strong>in</strong> order to ensure that we formalise Lango PPRR <strong>in</strong> l<strong>and</strong> tenure<br />

management <strong>in</strong> the adherence to the Constitutional provisions. To reach<br />

all stakeholders, we have produced the PPRR, both <strong>in</strong> Lango <strong>and</strong> the<br />

English languages. To the clan leaders at various levels, Civil Society<br />

Organisations <strong>and</strong> our development partners, we appeal for support for<br />

dissem<strong>in</strong>ation, entrench<strong>in</strong>g the PPRR <strong>and</strong> gather<strong>in</strong>g <strong>and</strong> giv<strong>in</strong>g feedback on<br />

This is to document Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities<br />

(PPRR) of customary l<strong>and</strong> tenure <strong>in</strong> Lango region; to regulate l<strong>and</strong><br />

rights <strong>and</strong> management <strong>and</strong> to provide for other related <strong>and</strong> <strong>in</strong>cidental<br />

matters.<br />

Section<br />

Part 1 :<br />

Prelim<strong>in</strong>ary<br />

1.This Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities of customary<br />

tenure <strong>in</strong> Lango Region may be cited as the PPRR number 1 of 2009.<br />

2. This PPRR is subject to the Laws of Ug<strong>and</strong>a but specifically to:<br />

a) Article 237(3) of the 1995 Constitution of Ug<strong>and</strong>a which po<strong>in</strong>ts out that<br />

customary tenure is one of the four l<strong>and</strong> tenure systems <strong>in</strong> Ug<strong>and</strong>a.<br />

<strong>The</strong> other be<strong>in</strong>g (i) Mailo l<strong>and</strong> (ii) Freehold <strong>and</strong> (iii) Leasehold.<br />

b) Article 246(3) of the 1995 Constitution of Ug<strong>and</strong>a provides for the<br />

existence of cultural <strong>in</strong>stitutions, their powers <strong>and</strong> roles.<br />

c) Section 3 (1) of the 1998 <strong>L<strong>and</strong></strong> Act which describes customary l<strong>and</strong><br />

with reference to Section 27 of the same act.<br />

d) Section 27 of the 1998 <strong>L<strong>and</strong></strong> Act which says “Any decision taken <strong>in</strong><br />

respect of l<strong>and</strong> held under customary tenure, whether <strong>in</strong> respect of<br />

l<strong>and</strong> held <strong>in</strong>dividually or communally, shall be <strong>in</strong> accordance with the<br />

customs, tradition <strong>and</strong> practice of the community concerned, except<br />

that a decision that deny women or children or persons with disability<br />

access to ownership, occupation or use of l<strong>and</strong> or impose conditions<br />

which violate Section 33, 34 <strong>and</strong> 35 of the 1995 Constitution of<br />

Ug<strong>and</strong>a of any ownership, occupation or use of l<strong>and</strong> shall be null<br />

<strong>and</strong> void.”<br />

e) Section 88 of the <strong>L<strong>and</strong></strong> Act 1998 which says “Noth<strong>in</strong>g <strong>in</strong> this part<br />

shall be taken to prevent or h<strong>in</strong>der or limit the exercise by traditional<br />

authorities of the functions of determ<strong>in</strong><strong>in</strong>g dispute over customary<br />

tenure on act<strong>in</strong>g as mediator between persons who are <strong>in</strong> dispute<br />

over any matters aris<strong>in</strong>g out of customary l<strong>and</strong> tenure”.<br />

f) Section 39 of the 1998 <strong>L<strong>and</strong></strong> Act which states that no person shall<br />

sell, exchange, transfer, pledge, mortgage, or lease any l<strong>and</strong> except<br />

with prior written consent of the spouse.


LANGO CULTURAL FOUNDATION<br />

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

3. In this PPRR, unless the context otherwise requires:-<br />

“Awitong” means the head of each clan <strong>in</strong> Lango region.<br />

“Committee” means customary l<strong>and</strong> committee established under<br />

section 20 of the PPRR.<br />

“Customary <strong>L<strong>and</strong></strong> rights” means l<strong>and</strong> rights acquired through birth,<br />

marriage, purchase, gift <strong>and</strong> be<strong>in</strong>g a member of the community on<br />

l<strong>and</strong> managed <strong>and</strong> protected by clan leaders for the good of the<br />

village.<br />

“Customary tenure <strong>in</strong> Lango” has the same mean<strong>in</strong>g as <strong>in</strong> the<br />

<strong>L<strong>and</strong></strong> Act 1998 <strong>and</strong> also means l<strong>and</strong> that has no paper title or l<strong>and</strong><br />

taken out of customary tenure by state laws.<br />

“Clans” mean<br />

“Clan committee” means sub-parish clan committee headed by a<br />

chief called Wonpaco; Sub-county clan committee headed by a<br />

chief called Jago; county clan committee headed by a chief called<br />

Rwot, Clan committee at Lango level called Awitong, <strong>and</strong> Lango<br />

cultural foundation (LCF) Committee headed by His Highness <strong>The</strong><br />

Won Nyaci.<br />

“Divorce” means return of dowry or a letter from any of the spouse<br />

<strong>and</strong> their clans stat<strong>in</strong>g that they have divorced.<br />

“Freehold” has the same mean<strong>in</strong>g as is <strong>in</strong> the <strong>L<strong>and</strong></strong> Act (CAP 227)<br />

“Head of family” means a married man on his father’s clan l<strong>and</strong> if<br />

born dur<strong>in</strong>g a marriage, married man on mother’s clan l<strong>and</strong> if born<br />

out of marriage, a widow, with or without children on husb<strong>and</strong>’s clan<br />

l<strong>and</strong> if <strong>in</strong> marital home <strong>and</strong> if she returns home then on her fathers<br />

clan l<strong>and</strong>, a divorced woman on parents clan l<strong>and</strong>, an orphan if<br />

appo<strong>in</strong>ted as head of household by the clan on fathers clan l<strong>and</strong>,<br />

unmarried woman on fathers clan l<strong>and</strong> <strong>and</strong> an uncle as a temporal<br />

head of household for orphans, if appo<strong>in</strong>ted until the orphans grow<br />

up.<br />

“Leasehold” has the same mean<strong>in</strong>g as is <strong>in</strong> the <strong>L<strong>and</strong></strong> Act (CAP<br />

227)<br />

“Lango Cultural Foundation - (LCF)” means the Lango region clan<br />

organization headed by the Paramount chief or Won Nyaci of Lango<br />

as per their Constitution.<br />

“<strong>L<strong>and</strong></strong> transaction” means l<strong>and</strong> sale or exchange, transfers,<br />

pledges, mortgages, rentals or leases, l<strong>and</strong> gifts or donation.<br />

“Marriage” means engagement followed by any marriage<br />

celebration.<br />

“Mailo” l<strong>and</strong> tenure has the same mean<strong>in</strong>g as is <strong>in</strong> the <strong>L<strong>and</strong></strong> Act (CAP 227)

Part 2 :<br />

<strong>L<strong>and</strong></strong> rights <strong>and</strong> l<strong>and</strong> hold<strong>in</strong>g.<br />

4. <strong>L<strong>and</strong></strong> rights of head of family.<br />

LANGO CULTURAL FOUNDATION<br />

All Married men, Unmarried adult girls, with or without children, married<br />

women, the children born by un married girls, Widows, who have not<br />

remarried, Widows who voluntarily choose to return to their parents<br />

homes, Orphans <strong>and</strong> all daughters who were once married but divorced<br />

<strong>and</strong> returned to their parents’ homes have rights to l<strong>and</strong> as <strong>in</strong>dividuals<br />

<strong>and</strong> the responsibility to manage l<strong>and</strong> as head of family on behalf of all<br />

family members.<br />

5. <strong>L<strong>and</strong></strong> Rights of unmarried girls <strong>and</strong> of orphans.<br />

a) It shall be assumed that all girls will be married <strong>and</strong> move to get l<strong>and</strong><br />

rights from their marital homes, but when it is unlikely that a girl will<br />

marry, or the moment a girl has a child out of marriage, the head of<br />

family must allocate l<strong>and</strong> to the girl to respect her l<strong>and</strong> rights <strong>and</strong> her<br />

as a head of family.<br />

b) It shall be assumed that the l<strong>and</strong> or orphans shall be protected by<br />

a relative appo<strong>in</strong>ted by the clan but where there is no appo<strong>in</strong>tment<br />

made or where the appo<strong>in</strong>ted person abuses the l<strong>and</strong> rights of the<br />

orphan, the l<strong>and</strong> rights of the family l<strong>and</strong> shall pass to the orphan as<br />

head of the family to manage <strong>and</strong> protect customary l<strong>and</strong> for him/her<br />

on behalf of the family <strong>and</strong> the clan.<br />

6. <strong>L<strong>and</strong></strong> rights of children.<br />

a) Children born to married parents shall have l<strong>and</strong> rights to the l<strong>and</strong> of<br />

their father.<br />

b) Children born out of marriage shall have right to the l<strong>and</strong> of their<br />

mother’s family unless the biological father claims their heritage<br />

by pay<strong>in</strong>g compensation to the mothers’ clan. Once compensation<br />

is paid <strong>and</strong> accepted by the girls’ family, the children born out of<br />

marriage shall have rights to the l<strong>and</strong> of their biological father.<br />

c) It is the responsibility of the clans of the unmarried girl <strong>and</strong> the clan<br />

of the biological father of the children to ensure that children know<br />

where their l<strong>and</strong> entitlement is before the children become adults.<br />

d) It is the responsibilities of the clans of divorced women or widows<br />

who return to their maiden homes to ensure that children born <strong>in</strong>

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

marriage but liv<strong>in</strong>g with their mothers are shown their l<strong>and</strong> <strong>in</strong> their<br />

fathers homes <strong>and</strong> their rights are protected until they are old enough<br />

to live on their l<strong>and</strong>. <strong>The</strong> clan members of the divorced women <strong>and</strong><br />

widows must ensure the l<strong>and</strong> is shown to the children by their fathers<br />

<strong>and</strong> their clans.<br />

e) Where the parents <strong>and</strong> the clans fail to show the children where their<br />

l<strong>and</strong> is, they must accept this failure <strong>and</strong> must not chase the affected<br />

children but shall give them l<strong>and</strong> to hold <strong>in</strong> perpetuity.<br />

f) If the families of the divorced women or widows who return to their<br />

maiden homes want to give l<strong>and</strong> rights to the children of their divorced<br />

<strong>and</strong> widowed daughters, no one shall remove these rights.<br />

g) Children born to a wife who is separated but not divorced have rights<br />

to the clan l<strong>and</strong> of the husb<strong>and</strong> whether or not the biological father<br />

of the child is or is not a clan member of the husb<strong>and</strong>. <strong>The</strong> husb<strong>and</strong><br />

<strong>and</strong> the clan of the husb<strong>and</strong> must give l<strong>and</strong> to the children.<br />

h) Children of a widow who has not remarried whether or not the<br />

biological father of the child is or is not a clan member of the<br />

husb<strong>and</strong>, have rights to l<strong>and</strong> of the widow’s husb<strong>and</strong>. <strong>The</strong> family of<br />

the husb<strong>and</strong> must give l<strong>and</strong> to the children.<br />

Part 3 :<br />

<strong>L<strong>and</strong></strong> rights of widows, <strong>and</strong> divorced women.<br />

7. <strong>L<strong>and</strong></strong> rights of widows <strong>and</strong> their protection.<br />

0<br />

a) A widow becomes a head of family over the l<strong>and</strong> which was allocated<br />

to her at marriage <strong>and</strong> when her husb<strong>and</strong> still lived.<br />

b) At the last funeral rite of the husb<strong>and</strong> a widow must make her<br />

choice known to the clan <strong>in</strong> writ<strong>in</strong>g or <strong>in</strong> the presence of trusted<br />

clan members <strong>and</strong> members of the LC 1 executives. A widow may<br />

choose if she wants to return to fathers l<strong>and</strong> or rema<strong>in</strong> <strong>in</strong> her marital<br />

l<strong>and</strong> with or without a man <strong>in</strong> her life.<br />

c) Widows who voluntarily leave their marital homes to get married <strong>in</strong><br />

another clan must appo<strong>in</strong>t one of the children as the head of family<br />

<strong>and</strong> leave the l<strong>and</strong> to her/him or leave the l<strong>and</strong> to the clan of her<br />

husb<strong>and</strong> if she has no children or if the children are young.<br />

d) Women who are separated with their husb<strong>and</strong>s <strong>and</strong> return to their<br />

fathers l<strong>and</strong> or remarry <strong>in</strong> another clan must leave the l<strong>and</strong> to her<br />

husb<strong>and</strong> or the clan of the husb<strong>and</strong>.<br />

e) Women who are separated from their husb<strong>and</strong>s but who are not<br />

divorced have the right to return to her l<strong>and</strong> <strong>in</strong> her marital home. <strong>The</strong>

husb<strong>and</strong> <strong>and</strong> the clan must return the l<strong>and</strong> to them.<br />

f) A divorced woman who returns to her parents or re-marries to a man<br />

of another clan shall leave the marital l<strong>and</strong> of the former husb<strong>and</strong> to<br />

her children <strong>and</strong> their clans.<br />

Part 4 :<br />

<strong>L<strong>and</strong></strong> rights after long absence <strong>and</strong> rights of IDPS.<br />

8. <strong>L<strong>and</strong></strong> rights after a long absence from family l<strong>and</strong>.<br />

a) Any person, family or community that lived away from their orig<strong>in</strong>al<br />

home for a very long time without visit<strong>in</strong>g the orig<strong>in</strong>al home, <strong>in</strong>form<strong>in</strong>g<br />

neigbours or local leaders of their <strong>in</strong>tention to reta<strong>in</strong> l<strong>and</strong> rights over<br />

the orig<strong>in</strong>al home, shall have no right to re-claim the l<strong>and</strong> if on return,<br />

they f<strong>in</strong>d their orig<strong>in</strong>al home had already been occupied by other<br />

persons who genu<strong>in</strong>ely believed that this l<strong>and</strong> was virg<strong>in</strong> <strong>and</strong> vacant<br />

l<strong>and</strong>, without orig<strong>in</strong>al owner(s). <strong>The</strong> exceptions to the above are only<br />

if:<br />

i. <strong>The</strong> people who have occupied the l<strong>and</strong> are other relatives who<br />

knew or should have known that the l<strong>and</strong> belonged to the person,<br />

family or community that lived away from the l<strong>and</strong><br />

ii. If the people on the l<strong>and</strong> are neighbours or friends of the neighbours<br />

to the l<strong>and</strong> of the people who lived away from the family l<strong>and</strong><br />

iii. If people who occupied the l<strong>and</strong> are children or gr<strong>and</strong> children of the<br />

person who had given this l<strong>and</strong> to the family who lived away from the<br />

l<strong>and</strong>.<br />

iv. On return, they f<strong>in</strong>d the l<strong>and</strong> is still vacant or the l<strong>and</strong> is occupied<br />

after 1998 when the <strong>L<strong>and</strong></strong> Act was passed.<br />

v. <strong>The</strong> people who left their home to stay away were m<strong>in</strong>ors; persons<br />

<strong>in</strong> prison; students at school; refugees outside Ug<strong>and</strong>a; had left the<br />

family l<strong>and</strong> due to war/political <strong>in</strong>stability or are m<strong>in</strong>ors who did not<br />

know of the existence of this l<strong>and</strong>.<br />

b) If the person, family or community that lived away from the orig<strong>in</strong>al<br />

l<strong>and</strong> <strong>in</strong> question is claim<strong>in</strong>g rights to this l<strong>and</strong> to sell it they will not<br />

have the right to do so. It will be construed that the <strong>in</strong>tention of their<br />

stay<strong>in</strong>g away from their orig<strong>in</strong>al family l<strong>and</strong> was to permanently<br />

migrate <strong>and</strong> settle elsewhere. <strong>The</strong> l<strong>and</strong> must rema<strong>in</strong> with the people<br />

who occupied it <strong>and</strong> not with family or community reclaim<strong>in</strong>g it.

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

9. <strong>L<strong>and</strong></strong> rights of Internally Displaced Persons (IDPS)<br />

a) <strong>The</strong> provisions of section 8 of this PPRR shall not apply to the l<strong>and</strong><br />

of Internally Displaced People (IDP) who ran away from their homes<br />

s<strong>in</strong>ce1986.<br />

b) <strong>The</strong> people liv<strong>in</strong>g on the l<strong>and</strong> of IDPs must vacate the l<strong>and</strong> for the<br />

owners either voluntarily or on request by the IDPs.<br />

c) Any person, family or community who wants to cont<strong>in</strong>ue stay<strong>in</strong>g on<br />

the l<strong>and</strong> of an IDP host must agree <strong>in</strong> writ<strong>in</strong>g with the owner.<br />

d) Those who occupied the l<strong>and</strong> of the <strong>in</strong>ternally displaced persons <strong>in</strong><br />

error must leave the l<strong>and</strong> <strong>and</strong> unconditionally surrender the l<strong>and</strong> to<br />

the IDPs on their return to the orig<strong>in</strong>al family l<strong>and</strong>. In this case, the<br />

return<strong>in</strong>g IDPs shall give the occupants reasonable time for them to<br />

move <strong>and</strong> re-settle else where.<br />

e) A person, family or community that was host to IDPs shall not chase<br />

them as long as the homes of the IDPs from where they ran are still<br />

considered <strong>in</strong>secure. <strong>The</strong> hosts will have the rights to <strong>in</strong>form the<br />

government of their <strong>in</strong>tention to have the IDPs leave their l<strong>and</strong>.<br />

Part 5 :<br />

<strong>L<strong>and</strong></strong> transactions.<br />

10. No right to sell l<strong>and</strong> under customary tenure<br />

a) No person shall sell l<strong>and</strong> under customary l<strong>and</strong> without follow<strong>in</strong>g the<br />

provisions of this PPRR.<br />

b) No head of family shall sell l<strong>and</strong> under customary tenure without<br />

follow<strong>in</strong>g the provisions of this PPRR<br />

c) <strong>The</strong> committee charged with management of l<strong>and</strong> shall not allow<br />

the sell<strong>in</strong>g of l<strong>and</strong> under customary tenure without follow<strong>in</strong>g the<br />

procedure <strong>in</strong> this PPRR.<br />

d) <strong>L<strong>and</strong></strong> under customary tenure will not be sold except under<br />

unavailable circumstances such as serious illness, need for dowry,<br />

food dur<strong>in</strong>g fam<strong>in</strong>e, school fees at a crucial time of school<strong>in</strong>g <strong>and</strong> for<br />

<strong>in</strong>vestment.<br />

11. <strong>The</strong> procedure for sale of customary l<strong>and</strong> shall be as follows;<br />

a) All the adult family members with rights to l<strong>and</strong> shall meet <strong>and</strong> agree<br />

or reject the sale of the l<strong>and</strong>.

b) If there is agreement to the sale, the family members shall sign a<br />

written agreement to that effect.<br />

c) If a wife or husb<strong>and</strong> disagrees to the sale, it will be assumed that<br />

there is no agreement to the sale. Any sale shall therefore be null<br />

<strong>and</strong> void.<br />

d) <strong>The</strong> family agreement to l<strong>and</strong> sale shall be duly signed by all adult<br />

family members <strong>and</strong> a copy shall be forwarded to clan sub-parish<br />

chief together with attached letter request<strong>in</strong>g for permission to sell<br />

the l<strong>and</strong>.<br />

e) <strong>The</strong> clan sub-parish chief shall convene a meet<strong>in</strong>g of sub-parish<br />

committee to assess reason to sell l<strong>and</strong>.<br />

f) If they agree to the sale, the committee shall write their<br />

recommendation <strong>and</strong> duly sign it.<br />

g) <strong>The</strong> clan sub-parish chief shall submit the family application letter,<br />

together with their recommendation to clan sub-county chief.<br />

h) <strong>The</strong> clan sub-county chief shall either endorse the decision of the<br />

sub parish chief or convene a meet<strong>in</strong>g of his committee to assess<br />

the application. Whatever the decision, it shall be remitted to the<br />

clan parish-chief for appropriate action, <strong>and</strong> copied to clan county<br />

chief for <strong>in</strong>formation.<br />

i) If permission to sell is given, the clan sub-parish chief shall take all<br />

the approval documents to the chairperson LC1 of the area where<br />

the l<strong>and</strong> is situated for proceed<strong>in</strong>g with the sale.<br />

j) When the buyer <strong>and</strong> seller have agreed the price for sell<strong>in</strong>g l<strong>and</strong>,<br />

the chairperson LC1 shall liaise with the clan sub-parish chief to<br />

be witnesses to the sale of l<strong>and</strong> <strong>and</strong> ensure that all the approval<br />

documents from the family, the sub-parish chief, sub county chief (if<br />

any) are duly signed <strong>and</strong> stamped.<br />

k) At the time of sale, the LC1 chairperson <strong>and</strong> the sub parish chief must<br />

ensure that all members of the family sell<strong>in</strong>g the l<strong>and</strong> are present;<br />

all neighbours – men, women <strong>and</strong> children, whose l<strong>and</strong> borders the<br />

one on sale; elders who know the boundary of the l<strong>and</strong> be<strong>in</strong>g sold;<br />

people with <strong>in</strong>terests <strong>and</strong> knowledge of the l<strong>and</strong> be<strong>in</strong>g sold, <strong>and</strong> that<br />

there is no dispute over the l<strong>and</strong> be<strong>in</strong>g sold.<br />

l) <strong>The</strong> chairman LC1 shall measure the size of the l<strong>and</strong> <strong>and</strong> draw a<br />

map show<strong>in</strong>g boundaries <strong>and</strong> size of the l<strong>and</strong> on sale; list names of<br />

the neighbours whose l<strong>and</strong> borders the l<strong>and</strong> on sale on the map <strong>and</strong><br />

attach copies of request letter for sell<strong>in</strong>g the l<strong>and</strong> duly signed by all<br />

adult family members; Clan sub-parish committee approval of the<br />

sale duly signed by members <strong>and</strong> Clan sub-county chiefs’ approval<br />

to sell l<strong>and</strong> duly signed <strong>and</strong> stamped. <strong>The</strong> LC1 <strong>and</strong> the Won Paco<br />

must also ensure that the agreed boundary trees (i.e.omara omara,

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

etuba <strong>and</strong> oligo) are planted along the boundary of l<strong>and</strong> be<strong>in</strong>g sold.<br />

m) <strong>The</strong> chairperson LC1 shall write the sale agreement with details<br />

of the price of l<strong>and</strong> agreed, down payments already made <strong>and</strong><br />

balances still pend<strong>in</strong>g <strong>and</strong> stamp it. <strong>The</strong> agreement shall <strong>in</strong>clude<br />

names <strong>and</strong> signatures of the seller (s), buyer (s); wife/wives of<br />

seller <strong>and</strong> buyer, neighbours, LC1 Chairperson <strong>and</strong> clan sub-parish<br />

chief as witnesses. <strong>The</strong>y should all sign the agreement, <strong>and</strong> those<br />

with stamps, to stamp it. (A Format for the rental agreement <strong>in</strong><br />

the schedule to the PPRR may be used as a guide for all l<strong>and</strong><br />

transactions)<br />

n) <strong>The</strong> LC1 chairperson shall make copies of the l<strong>and</strong> sales agreement<br />

<strong>and</strong> give one each to the seller(s), buyer(s), clan sub-parish chief<br />

of seller <strong>and</strong> buyer, clan Sub-county chief, Local government Subcounty<br />

chief <strong>and</strong> LC1 chairperson, a file copy<br />

o) <strong>The</strong> sales agreements filed with the government sub county chief<br />

are public documents open to the public on request.<br />

12. <strong>L<strong>and</strong></strong> Gifts <strong>and</strong> donations.<br />

a) <strong>The</strong> procedure for l<strong>and</strong> sales <strong>in</strong> this PPRR govern<strong>in</strong>g sales shall<br />

apply to l<strong>and</strong> exchange, transfers, pledges, mortgages, rentals or<br />

lease <strong>and</strong> l<strong>and</strong> gifts or donat<strong>in</strong>g l<strong>and</strong> under customary tenure.<br />

b) A person, family or a community may donate l<strong>and</strong> to a relative, a<br />

friend, the poor, the community or <strong>in</strong>stitutions such as school,<br />

health units, for use such as forests, Road reserves, <strong>and</strong> places of<br />

worship.<br />

c) Those who are donat<strong>in</strong>g l<strong>and</strong> must do so <strong>in</strong> writ<strong>in</strong>g <strong>and</strong> all must sign<br />

the agreement.<br />

d) After this PPRR, any donation of l<strong>and</strong> without a written agreement<br />

will be assumed to be given for good <strong>and</strong> no one will have the right<br />

to retract the donation <strong>and</strong> reclaim the l<strong>and</strong>.<br />

e) <strong>L<strong>and</strong></strong> that was donated, sold or given before the documentation of<br />

this PPRR must not be reclaimed by any relatives from the person/<br />

people/<strong>in</strong>stitution to whom it was donated, sold or given if the person,<br />

family members who donated, sold or gave the l<strong>and</strong> are already<br />

dead <strong>and</strong> cannot give evidence.


<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

Part 6 :<br />

Control of l<strong>and</strong> use.<br />

13. <strong>The</strong> committees must not agree to the sale of l<strong>and</strong> if:<br />

a) <strong>The</strong>re is no written consent of widow(s), husb<strong>and</strong>s, children <strong>and</strong><br />

a one third of adult family members.<br />

b) Person/persons <strong>in</strong>tend<strong>in</strong>g to sell the l<strong>and</strong> once sold l<strong>and</strong> for one<br />

purpose but used the money for another purpose for which it<br />

had been agreed.<br />

c) <strong>The</strong> committee of the clan sub-county considers that not<br />

much l<strong>and</strong> is available for the family <strong>and</strong> what is left should be<br />

preserved for the livelihoods of the family members <strong>and</strong> for the<br />

future generation.<br />

d) <strong>The</strong> clan committee considers the reason for sell<strong>in</strong>g l<strong>and</strong> is<br />

not good enough i.e. for dr<strong>in</strong>k<strong>in</strong>g <strong>and</strong> fees for a child <strong>in</strong> lower<br />

classes.<br />

e) <strong>The</strong> clan considers that reasons for sale of the l<strong>and</strong> <strong>in</strong> question<br />

will make further sales of l<strong>and</strong> imm<strong>in</strong>ent <strong>and</strong> will lead to<br />

l<strong>and</strong>lessness of the family members.<br />

f) <strong>The</strong> people seek<strong>in</strong>g to sell l<strong>and</strong> have not followed the procedures<br />

<strong>in</strong> this PPRR.<br />

<strong>L<strong>and</strong></strong> management.<br />

14. <strong>The</strong> management bodies for l<strong>and</strong> under customary tenure shall be<br />

heads of families, clan committees <strong>and</strong> Lango Cultural Foundation<br />

(LCF).<br />

15. <strong>The</strong> Head of Family must:<br />

a) Protect the rights of family members who are women, children,<br />

sick <strong>and</strong> weak people, old <strong>and</strong> weak people <strong>and</strong> protect l<strong>and</strong><br />

from irresponsible l<strong>and</strong> transactions,<br />

b) Manage family l<strong>and</strong> <strong>and</strong> determ<strong>in</strong>e <strong>and</strong> mediate on family l<strong>and</strong><br />

disputes without discrim<strong>in</strong>ation.<br />

c) Allocate l<strong>and</strong> fairly to <strong>in</strong>dividual members of the family<br />

d) Ensure l<strong>and</strong> is used for livelihoods of family members.

e) Demarcate l<strong>and</strong> boundaries <strong>in</strong> consultation with the clan elders<br />

<strong>and</strong> committee responsible.<br />

f) Make objective decisions regard<strong>in</strong>g l<strong>and</strong> but subject to the<br />

<strong>in</strong>terests of the family members.<br />

g) Render assistance to the family <strong>and</strong> clan members where<br />

necessary.<br />

h) Seek consent from family members as regards their l<strong>and</strong> rights.<br />

i) Seek consent of family members <strong>and</strong> clan leaders for any l<strong>and</strong><br />

transactions.<br />

j) Ensure that orphans are shown the l<strong>and</strong> boundary of all their<br />

late father’s l<strong>and</strong>.<br />

k) Ensure that l<strong>and</strong> rema<strong>in</strong>s <strong>in</strong> the family pool, unallocated to give<br />

to divorced <strong>and</strong> widowed daughters who may return to parents’<br />

clan l<strong>and</strong>.<br />

16. Responsibility of the clan to protect rights of widows <strong>and</strong> orphans.<br />

a) <strong>The</strong> father <strong>in</strong> law of the widow, the eldest brother <strong>in</strong> law to the widow<br />

or the closest clan relatives must appo<strong>in</strong>t a man of <strong>in</strong>tegrity <strong>and</strong> good<br />

behaviour to protect the rights of a widow, whether she has children<br />

or not.<br />

b) A man appo<strong>in</strong>ted by the clan to be the widow’s protector must protect<br />

the l<strong>and</strong> rights of the widows <strong>and</strong> her children.<br />

c) <strong>The</strong> clan must appo<strong>in</strong>t <strong>in</strong> writ<strong>in</strong>g the nearest <strong>and</strong> oldest clan relative<br />

with <strong>in</strong>tegrity <strong>and</strong> good behaviour as the temporal head of family of<br />

the orphan, to manage the l<strong>and</strong> of the orphan until the orphan is old<br />

enough to become head of family.<br />

d) <strong>The</strong> father <strong>in</strong> law, brother <strong>in</strong> law <strong>and</strong> closest relatives of a deceased<br />

husb<strong>and</strong> <strong>and</strong> parents must plant boundary trees as mark, draw maps<br />

of the l<strong>and</strong> of a widow <strong>and</strong> orphan <strong>and</strong> keep copies with the widow,<br />

orphan <strong>and</strong> the sub parish clan committee.<br />

e) <strong>The</strong> l<strong>and</strong> rights of the widow, children <strong>and</strong> orphans do not pass on to<br />

the widow’s protector or the appo<strong>in</strong>ted orphans’ protector.<br />

f) <strong>The</strong> clan need not appo<strong>in</strong>t a protector if the widow has grown up <strong>and</strong><br />

responsible sons who can protect their mother.<br />

g) <strong>The</strong> clan member who appo<strong>in</strong>ts a protector of the widow <strong>and</strong> orphan<br />

must dismiss them <strong>and</strong> appo<strong>in</strong>t another if the protector abuse his<br />

office.

17. Clan rights <strong>and</strong> responsibilities over customary l<strong>and</strong>.<br />

LANGO CULTURAL FOUNDATION<br />

a) Each clan shall have, among others, the follow<strong>in</strong>g rights <strong>and</strong><br />

responsibilities over customary l<strong>and</strong>:i.<br />

Protect<strong>in</strong>g customary l<strong>and</strong><br />

ii. Know<strong>in</strong>g the overall size of clan l<strong>and</strong><br />

iii. Ensur<strong>in</strong>g that l<strong>and</strong> is not sold without knowledge <strong>and</strong> consent<br />

of the clan.<br />

iv. Gett<strong>in</strong>g alternative means to solve the problems such as<br />

need for school fees, dowry, compensation, repay<strong>in</strong>g loans<br />

so that l<strong>and</strong> is not sold.<br />

v. Protect<strong>in</strong>g <strong>and</strong> respect<strong>in</strong>g the rights of widows, orphans,<br />

women, the aged, the sick <strong>and</strong> the disabled so that their<br />

l<strong>and</strong> <strong>and</strong> other properties are not grabbed from them.<br />

vi. Ensur<strong>in</strong>g that customary l<strong>and</strong> is preserved for the future<br />

generation.<br />

vii. Inform<strong>in</strong>g people of <strong>in</strong>formation regard<strong>in</strong>g customary l<strong>and</strong>.<br />

viii. Protect<strong>in</strong>g community l<strong>and</strong> such as graz<strong>in</strong>g <strong>and</strong> hunt<strong>in</strong>g<br />

l<strong>and</strong>, forests <strong>and</strong> water po<strong>in</strong>ts.<br />

ix. Protect<strong>in</strong>g l<strong>and</strong> vested <strong>in</strong> the government to hold on behalf<br />

of the public such as forest, roads, <strong>and</strong> road reserves,<br />

wetl<strong>and</strong>s <strong>and</strong> game reserves.<br />

x. Ensur<strong>in</strong>g that customary l<strong>and</strong> is managed <strong>in</strong> strict adherence<br />

to this PPRR.<br />

xi. Protect<strong>in</strong>g l<strong>and</strong> boundaries by plant<strong>in</strong>g agreed trees.<br />

xii. Mediat<strong>in</strong>g on l<strong>and</strong> conflicts but referr<strong>in</strong>g them to clan<br />

committees, where they fail.<br />

18. Mark<strong>in</strong>g l<strong>and</strong> boundaries to reduce l<strong>and</strong> conflicts<br />

a) All clan sub parish chiefs must proactively promote the plant<strong>in</strong>g<br />

of agreed boundary trees along l<strong>and</strong> boundaries so as to reduce<br />

boundary disputes.<br />

b) <strong>The</strong> agreed trees are omara-omara, etuba <strong>and</strong> oligo. Omara omara<br />

or Oligo shall be planted <strong>in</strong> the middle of etuba that are to be planted<br />

at the corners of the l<strong>and</strong>.<br />

c) Tree plant<strong>in</strong>g shall proceed as here under;<br />

i) Either the chairperson LC1 or the sub parish chief of each clan,<br />

of the area where the l<strong>and</strong> is shall convene a meet<strong>in</strong>g of a team<br />

composed of: people with rights to the l<strong>and</strong>, clan members,<br />

neighbours to l<strong>and</strong> be<strong>in</strong>g demarcated, elders who know the<br />

boundaries of the l<strong>and</strong> <strong>and</strong> the persons with <strong>in</strong>terest <strong>in</strong> the<br />

l<strong>and</strong>.

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

ii) <strong>The</strong> team attend<strong>in</strong>g the meet<strong>in</strong>g shall <strong>in</strong>spect <strong>and</strong> ensure correct<br />

border mark<strong>in</strong>g.<br />

iii) <strong>The</strong> people with rights to the l<strong>and</strong> shall proceed to plant etuba<br />

trees <strong>in</strong> the corners of the l<strong>and</strong> <strong>and</strong> omara omara <strong>in</strong> between<br />

etuba trees.<br />

iv) <strong>The</strong> chairperson LC1 or the sub parish chief of the clan shall<br />

draw a map of this l<strong>and</strong>, not<strong>in</strong>g on it the size <strong>and</strong> l<strong>and</strong> marks.<br />

v) All people who participate shall sign their names <strong>and</strong> signatures<br />

on the maps drawn to confirm that boundary tree plant<strong>in</strong>g went<br />

on well without any compla<strong>in</strong>ts from people with l<strong>and</strong> rights <strong>and</strong><br />

their neighbours.<br />

vi) Each copy of the map duly signed shall be distributed to; People<br />

with l<strong>and</strong> rights, LC1 chairperson; Clan Sub County Chief, Clan<br />

Sub Parish Chief <strong>and</strong> Government sub-county chief.<br />

19. Protect<strong>in</strong>g boundary of customary l<strong>and</strong>.<br />

a) It shall be the responsibility of the owner (s) of the l<strong>and</strong> <strong>and</strong> their<br />

neighbours, the LC1 chairperson to ensure boundary markers<br />

are protected.<br />

b) No body shall <strong>in</strong> secret uproot the official boundary trees<br />

planted.<br />

c) Any person who <strong>in</strong>tentionally removes or destroys boundary<br />

markers without the consent of the owners, commits an offence<br />

under the Penal Code of Ug<strong>and</strong>a.<br />

d) Before report<strong>in</strong>g the person responsible for uproot<strong>in</strong>g or<br />

destroy<strong>in</strong>g the boundary trees, the person will be requested <strong>and</strong><br />

expected to:<br />

i. Replace the tree uprooted <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> it to grow to<br />

maturity.<br />

ii. Provide good food to the people who participated <strong>in</strong> the<br />

orig<strong>in</strong>al boundary tree plant<strong>in</strong>g <strong>and</strong> dispute resolution<br />

meet<strong>in</strong>gs.<br />

iii. Carry out any other punishment deemed necessary by<br />

the clan elders dur<strong>in</strong>g the meet<strong>in</strong>g.<br />

e) On refusal to comply with these corrective measures, the person<br />

who uprooted the boundary trees will be reported to the Police<br />

for the offence committed.<br />

f) <strong>The</strong> LC1 chairperson <strong>and</strong> clan sub parish chief of the area<br />

where the l<strong>and</strong> is situated shall keep records of the wrongs<br />

committed.

Part 8 :<br />

Management of clan committees.<br />

20. <strong>L<strong>and</strong></strong> committees for manag<strong>in</strong>g l<strong>and</strong> under customary tenure<br />

a) Clan committees are those at the levels of clan sub-parish, clan<br />

sub-county, clan county clan, sub clan of Lango <strong>and</strong> under Lango<br />

Cultural Foundation.<br />

b) <strong>The</strong> leaders or clan heads of these committees are called Won Paco<br />

for sub parish, Jago for sub County, Rwot for County, Awitong for<br />

sub clan <strong>and</strong> Won Nyaci for Lango region.<br />

c) All committees <strong>and</strong> the leaders are responsible for the affairs of their<br />

clans <strong>and</strong> not only for l<strong>and</strong> matters.<br />

d) Members of the committees of the clan sub-parish, <strong>and</strong> clan sub<br />

county levels shall be elected by universal adult suffrage of their clan<br />

members.<br />

e) Members of the clan sub county <strong>and</strong> sub clans shall be elected by<br />

electoral colleges from elected office bearers.<br />

f) Members of the committee of Lango Cultural Foundation <strong>and</strong> Won<br />

Nyaci will be elected accord<strong>in</strong>g to the constitution of Lango Cultural<br />

Foundation.<br />

g) Clan committees shall be body corporate <strong>and</strong> may sue <strong>and</strong> be<br />

sued.<br />

21. Membership of the clan committees.<br />

a) <strong>The</strong> clan committees shall consist of (9) members compris<strong>in</strong>g of<br />

a Chairperson; Vice chairperson; Secretary; Treasurer; Officer<br />

responsible for compensation; Women representative; Youth<br />

representative; Chief for l<strong>and</strong> affairs; Officer for Security.<br />

b) <strong>The</strong> office for vice chairperson, treasurer <strong>and</strong> women representative<br />

must be reserved <strong>and</strong> filled by women.<br />

22. Election of clan sub-parish committee.<br />

a) <strong>The</strong> sub-parish committee is the lowest committee <strong>in</strong> the structure.<br />

b) <strong>The</strong> sub-parish chief shall be the chairperson of this committee <strong>and</strong><br />

responsible for the election of the members.<br />

c) For the election of vice chairperson, the sub parish chief shall<br />

organize clan members above 18 years <strong>in</strong> the area of his jurisdiction<br />

to meet <strong>in</strong> a convenient place of his choice for election of the n<strong>in</strong>e

members which will start with the election of the vice chairperson.<br />

d) Different members shall nom<strong>in</strong>ate different female c<strong>and</strong>idates <strong>and</strong><br />

if seconded the chairperson shall record as many names as are<br />

deemed sufficient<br />

e) <strong>The</strong> nom<strong>in</strong>ated c<strong>and</strong>idates must be given some time to campaign by<br />

tell<strong>in</strong>g the people what she can do if elected.<br />

f) <strong>The</strong> chairperson shall request the c<strong>and</strong>idates to leave to allow clan<br />

members present to give their op<strong>in</strong>ions of them.<br />

g) <strong>The</strong> people who nom<strong>in</strong>ated the c<strong>and</strong>idates will be asked to give<br />

reasons for their nom<strong>in</strong>ation <strong>and</strong> the electorate will discuss the<br />

c<strong>and</strong>idates.<br />

h) <strong>The</strong> chairperson shall call the c<strong>and</strong>idates to return <strong>and</strong> ask the<br />

electorate or voters who support them to st<strong>and</strong> beh<strong>in</strong>d them.<br />

i) <strong>The</strong> chairman shall ask the secretary selected for the function to<br />

count the number of voters l<strong>in</strong>ed beh<strong>in</strong>d each c<strong>and</strong>idate.<br />

j) <strong>The</strong> c<strong>and</strong>idate with the highest vote will be declared the vice<br />

chairperson. Where there is a draw, either the chairperson shall cast<br />

his vote or the clan members present shall aga<strong>in</strong> l<strong>in</strong>e up beh<strong>in</strong>d the<br />

c<strong>and</strong>idates.<br />

k) On recount<strong>in</strong>g the number l<strong>in</strong>ed beh<strong>in</strong>d the c<strong>and</strong>idates, the chair<br />

shall declare the person with the highest number of people l<strong>in</strong>ed up<br />

as the w<strong>in</strong>ner <strong>and</strong> the vice chairperson.<br />

l) <strong>The</strong> election of the treasurer, the officer for compensation, women<br />

representative, youth representative, officer for l<strong>and</strong> affairs <strong>and</strong><br />

officer for security shall follow the same procedure as that of the<br />

vice chairperson, except that for the posts of treasurer <strong>and</strong> women<br />

representative, the people nom<strong>in</strong>ated <strong>and</strong> elected must be women.<br />

m) Where clan committees are already <strong>in</strong> place before the writ<strong>in</strong>g <strong>and</strong><br />

launch of this PPRR, the committee shall reta<strong>in</strong> the membership but<br />

the chairperson must adjust the titles of the office bearers, <strong>and</strong> the<br />

number of women.<br />

n) <strong>The</strong> secretary of the committee will automatically be the head of the<br />

digg<strong>in</strong>g group of the area where the l<strong>and</strong> is.<br />

o) <strong>The</strong> chairpersons must send the names of the sub clan committees<br />

of Awitong who will send or take them to the office of the Lango<br />

Cultural Foundation.<br />

23. Rights <strong>and</strong> responsibilities of sub-parish clan committees are to:<br />

a) Protect community-owned l<strong>and</strong> <strong>in</strong> the area of their jurisdiction. Where<br />

the l<strong>and</strong> falls beyond his jurisdiction, the chairperson must ensure<br />

that all the relevant clan committees come together to elect people

to manage the community l<strong>and</strong> on behalf of the community.<br />

b) Determ<strong>in</strong>e <strong>and</strong> mediate on l<strong>and</strong> disputes without bias, hear<strong>in</strong>g both<br />

parties, hear<strong>in</strong>g witnesses, record<strong>in</strong>g <strong>and</strong> writ<strong>in</strong>g judgments, <strong>and</strong><br />

<strong>in</strong>form<strong>in</strong>g of <strong>and</strong> allow<strong>in</strong>g appeals.<br />

c) Inform l<strong>and</strong> owners about the provisions <strong>in</strong> the PPRR especially the<br />

procedures of sell<strong>in</strong>g l<strong>and</strong>.<br />

d) Inform clan members on the role of the central government <strong>in</strong> the<br />

management of public l<strong>and</strong> such as wetl<strong>and</strong>, forest reserves, road<br />

reserves, game reserves <strong>and</strong> game park, among others.<br />

e) Proactively promote the plant<strong>in</strong>g of omara omara <strong>and</strong> oligo trees<br />

along the boundaries <strong>and</strong> Etuba trees on the corners of the l<strong>and</strong>, to<br />

reduce boundary disputes.<br />

f) Facilitate the writ<strong>in</strong>g of community regulations for manag<strong>in</strong>g <strong>and</strong><br />

protect<strong>in</strong>g communally owned l<strong>and</strong> where clans have l<strong>and</strong> rights<br />

g) Ensure that all members of the family, especially wife/wives <strong>and</strong><br />

children have agreed to sell l<strong>and</strong> <strong>and</strong> it is not only the decision of the<br />

head of family.<br />

h) Give consent for orphans, the disabled to sell their l<strong>and</strong> if they have<br />

good reasons <strong>and</strong> the clan is not <strong>in</strong> a position to assist them with<br />

their problem.<br />

i) Refer appeal cases <strong>and</strong> cases he has failed to resolve to the sub<br />

county committee.<br />

j) Assist those who appeal to the sub county committees with their<br />

appeal.<br />

k) Inform the parties to a l<strong>and</strong> case before them of their right to appeal<br />

to the clan sub-county committee <strong>and</strong> assist them to access the clan<br />

sub-county committee.<br />

l) Keep records of l<strong>and</strong> that the clans own as a community <strong>and</strong> keep<br />

check<strong>in</strong>g the l<strong>and</strong>.<br />

m) Write proceed<strong>in</strong>gs for l<strong>and</strong> cases they hear <strong>and</strong> send them to the<br />

sub county clan committee if they fail to solve a l<strong>and</strong> dispute or if<br />

there is an appeal.<br />

n) Act on any requests from other clan committees from higher<br />

levels.<br />

o) Hear appeals from heads of families.<br />

p) Keep records of all l<strong>and</strong> disputes they h<strong>and</strong>le.<br />

24. Clan sub-county committee<br />

a) <strong>The</strong>re shall be clan sub-county committees at sub county levels.<br />

b) <strong>The</strong> procedure for elect<strong>in</strong>g members of the clan sub-parish committee<br />

shall apply to the sub-county committee.

<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

c) <strong>The</strong> rights <strong>and</strong> responsibility of clan sub-parish committee shall<br />

apply to the clan sub-county committee.<br />

d) <strong>The</strong> clan sub-county committee shall receive appeal from the clan<br />

sub-parish committee.<br />

e) Communally owned l<strong>and</strong> that is located <strong>in</strong> more than one sub parish<br />

shall be managed by the clan Sub-county committee.<br />

25. Clan county committee.<br />

a) <strong>The</strong>re shall be clan county committees at county levels.<br />

b) <strong>The</strong> procedure for elect<strong>in</strong>g members of the clan sub-county<br />

committees shall apply to the clan county committee, except that the<br />

county committee members will be elected by the representatives of<br />

elected members of the lower clan committees<br />

c) <strong>The</strong> rights <strong>and</strong> responsibilities of sub-county clan committee shall<br />

apply to the clan county committees at county level.<br />

d) <strong>The</strong> clan county chief shall ensure that clan members, sub parish<br />

chiefs <strong>and</strong> their committee members, sub county chiefs <strong>and</strong> their<br />

committee members <strong>and</strong> county committee members are <strong>in</strong>formed<br />

of the PPRR <strong>and</strong> l<strong>and</strong> vested <strong>in</strong> the government to manage for the<br />

good of Ug<strong>and</strong>ans <strong>and</strong> to ensure that the l<strong>and</strong> is protected from<br />

encroachers.<br />

e) <strong>The</strong> clan county chief must submit situational <strong>and</strong> periodic reports<br />

about l<strong>and</strong> disputes from heads of families, clan sub parish, clan<br />

sub-county <strong>and</strong> clan county committees to their clan heads.<br />

26. Lango sub clan committee.<br />

a) <strong>The</strong>re shall be Lango sub clan committee of the same clan.<br />

b) <strong>The</strong> procedure for elect<strong>in</strong>g members of the clan county committees<br />

shall apply to the Lango sub clan committees.<br />

c) <strong>The</strong> responsibilities of the Lango sub clan committees will be same<br />

as that of the clan county committees.<br />

d) <strong>The</strong> Lango sub clan heads shall give the reports received from<br />

the lower clan committees to the committee of Lango Cultural<br />

Foundation.<br />

e) <strong>The</strong> Lango sub clan heads who usually live outside Lango Region<br />

may appo<strong>in</strong>t his temporal representative to ensure the provisions of<br />

this PPRR are implemented.


<strong>The</strong> Pr<strong>in</strong>ciples, Practices, Rights <strong>and</strong> Responsibilities (PPRR) of Customary Tenure <strong>in</strong> Lango Region<br />

27. <strong>The</strong> committee of Lango Cultural Foundation (LCF)<br />

LANGO CULTURAL FOUNDATION<br />

a) <strong>The</strong>re shall be a committee for the whole of Lango formed under the<br />

Lango Cultural Foundation Constitution.<br />

b) <strong>The</strong> rights <strong>and</strong> responsibilities of all the committee shall be to:<br />

i. Hear appeals of l<strong>and</strong> cases from the sub clan heads.<br />

ii. Ensure that graz<strong>in</strong>g l<strong>and</strong>, wetl<strong>and</strong>s, forest reserves, game<br />

reserves, <strong>and</strong> game parks, road reserves, sport <strong>and</strong> play<strong>in</strong>g<br />

ground, schools, health units, markets, <strong>and</strong> places of worship<br />

are protected.<br />

iii. If the l<strong>and</strong> to be protected falls beyond the jurisdiction of<br />

more than one sub clan, the different sub clan committees<br />

will elect office bearers to protect the l<strong>and</strong>.<br />

iv. Ensure <strong>L<strong>and</strong></strong> rights of people such as widows, orphans,<br />

children <strong>and</strong> other vulnerable people are protected <strong>and</strong> their<br />

l<strong>and</strong> is not grabbed.<br />

v. Inform government of customary l<strong>and</strong> matters.<br />

vi. Forge <strong>and</strong> build relationships <strong>and</strong> mutual underst<strong>and</strong><strong>in</strong>g<br />

between local <strong>and</strong> central government <strong>in</strong> respect to<br />

customary l<strong>and</strong>.<br />

vii. Play a lead<strong>in</strong>g role <strong>in</strong> l<strong>in</strong>k<strong>in</strong>g l<strong>and</strong> local <strong>and</strong> central<br />

government, developers or <strong>in</strong>vestors to l<strong>and</strong> owners so<br />

they negotiate l<strong>and</strong> agreements to stimulate economic<br />

development <strong>in</strong> Lango sub-region.<br />

viii. Forward l<strong>and</strong> cases they fail to resolve to the state’s courts<br />

of Laws.<br />

ix. Be witnesses <strong>in</strong> court procedures.<br />

x. Ensure the people of Lango know of this PPRR, government<br />

laws <strong>and</strong> policies on l<strong>and</strong>.<br />

xi. Monitor the implementation of the PPRR <strong>in</strong> Lango to draw<br />

lessons on what part of the PPRR should be amended <strong>and</strong><br />

which judgments should be used as precedence <strong>in</strong> Lango.<br />

xii. Act on any requests concern<strong>in</strong>g l<strong>and</strong> management from the<br />

Government.<br />

28. Committee meet<strong>in</strong>gs.<br />

a) Committee meet<strong>in</strong>gs at various levels shall be convened accord<strong>in</strong>g<br />

to the need to meet.<br />

b) <strong>The</strong> quorum shall be 1/3 of the members.<br />

c) <strong>The</strong> committee shall record proceed<strong>in</strong>g of respective meet<strong>in</strong>gs <strong>and</strong><br />

keep the m<strong>in</strong>utes <strong>in</strong> their files.

d) <strong>The</strong>tenureofoffice,discipl<strong>in</strong><strong>in</strong>gofcommitteemembers,replacements,<br />

dismissal of committee members <strong>and</strong> any other provisions that are<br />

not provided for <strong>in</strong> this PPRR will be <strong>in</strong> accordance with each clan<br />

constitution <strong>and</strong> the Constitution of the Lango Cultural Foundation.<br />

Part 9 :<br />

Miscellaneous<br />

29. Fees for l<strong>and</strong> transactions.<br />

a) <strong>The</strong> seller of the l<strong>and</strong> shall pay fees as prescribed by the<br />

government.<br />

b) <strong>The</strong> chairman LC 1 shall receive this fee from the seller <strong>and</strong> issue<br />

receipt of acknowledgement.<br />

c) <strong>The</strong> fees shall be divided between the offices as directed by the<br />

Government.<br />

d) It shall be the responsibility of the chairperson LC1 to distribute the fees<br />

to the respective offices <strong>and</strong> receive receipts of acknowledgement.<br />

30. Wrongs for not follow<strong>in</strong>g the PPRR for any l<strong>and</strong> transaction.<br />

a) After the 1 st day of May 2009 when this PPRR comes <strong>in</strong>to effect, any<br />

l<strong>and</strong> transaction that does not follow the procedures here<strong>in</strong> shall be<br />

null <strong>and</strong> void.<br />

b) Any person, family or community responsible for tak<strong>in</strong>g l<strong>and</strong> away<br />

from the clan for any l<strong>and</strong> transaction without follow<strong>in</strong>g the procedure<br />

laid down <strong>in</strong> this PPRR shall refund to the clan parish chief <strong>and</strong> his<br />

committee the money received from the transaction which money is<br />

to be given back to the other party to the l<strong>and</strong> transaction <strong>and</strong> the<br />

l<strong>and</strong> to be given back to the family from which the l<strong>and</strong> was taken.<br />

c) <strong>The</strong> clan sub parish chief <strong>and</strong> his committee of the person who sold/<br />

gave out l<strong>and</strong> without their consent shall discipl<strong>in</strong>e him accord<strong>in</strong>g to<br />

their rules.<br />

d) <strong>The</strong> person, family or community who takes l<strong>and</strong> to transact must<br />

return the money to the party from whom s/he received the money if<br />

the l<strong>and</strong> transaction is null <strong>and</strong> void under the PPRR.<br />

e) If a party to the l<strong>and</strong> transaction who receives the money cannot be<br />

found before return<strong>in</strong>g the money to the buyer, the party who paid<br />

the money for the l<strong>and</strong> will lose his/her money.

f) <strong>The</strong> burden of prov<strong>in</strong>g that consent for the l<strong>and</strong> transaction was<br />

given will be on the party claim<strong>in</strong>g that consent was given <strong>and</strong> s/he<br />

must produce all the documents of consent required by the PPRR.<br />

31. Abuse of <strong>L<strong>and</strong></strong> Rights of others.<br />

a) Any person who cuts down trees, grass, harvests red <strong>and</strong> white<br />

ants, picks ant hill mushrooms, collects fruits such as shear nuts,<br />

mangoes or other wild edible fruits without the consent of the l<strong>and</strong><br />

owners commits a wrong under this PPRR.<br />

b) Consent for Section 31(a) is to be given either <strong>in</strong> writ<strong>in</strong>g or verbally<br />

when <strong>in</strong> the presence of witnesses.<br />

c) Any person who commits a wrong under section 31(a) shall be asked<br />

by the sub parish chief <strong>and</strong> his committee to pay for the items taken<br />

at the cost of market value <strong>and</strong> also pay for other damage caused.<br />

d) <strong>The</strong> payment of damages will be <strong>in</strong> accordance with each clan<br />

rules.<br />

32. Commencement of the PPRR.<br />

a) For purposes of referr<strong>in</strong>g to the PPRR for any work or l<strong>and</strong> disputes,<br />

the date of commencement of the PPRR is the first day of May,<br />

2009.<br />

b) S<strong>in</strong>ce most of the provisions of this PPRR is the pr<strong>in</strong>ciples. practices,<br />

rights <strong>and</strong> responsibilities <strong>in</strong> use <strong>in</strong> Lango, any one who wants to,<br />

may use it to solve l<strong>and</strong> disputes already registered with them but<br />

not to change the decisions made <strong>in</strong> past cases.<br />

c) After the com<strong>in</strong>g <strong>in</strong>to force of the PPRR, all the people <strong>in</strong> Lango<br />

must abide by the provisions of this PPRR.<br />

33. Amendment of the PPRR.<br />

a) This PPRR shall be amended from time to time as <strong>and</strong> when deemed<br />

necessary.<br />

b) <strong>The</strong> amendment shall be by the General Assembly of Lango Cultural<br />

Foundation.<br />

c) Notice of the proposed amendment shall be circulated by the m<strong>in</strong>ister<br />

of l<strong>and</strong> of Lango Cultural Foundation to members of the general<br />

assembly three months before the general assembly, stat<strong>in</strong>g clearly<br />

the parts to be amended, reasons for amend<strong>in</strong>g <strong>and</strong> the proposed<br />

amendment.

d) Three quarters of the members of the general assembly shall effect<br />

approval of the Lango cultural Foundation committee amend the<br />

Schedule to the PPRR.

e. To behave at all times as a good neighbour, <strong>and</strong> not to allow<br />

anyone to do someth<strong>in</strong>g which would be a nuisance to those liv<strong>in</strong>g<br />

around the l<strong>and</strong>.<br />

f. To return the l<strong>and</strong> with no squatters when this agreement ends<br />

g. Not to do anyth<strong>in</strong>g to the l<strong>and</strong> that will permanently degrade or<br />

reduce the value of the l<strong>and</strong>. E.g. use the l<strong>and</strong> for burial, or cut<br />

down big trees.<br />

2. THE LANDLORD AGREES:<br />

a. That the Tenant shall enjoy the <strong>L<strong>and</strong></strong> until the end of the<br />

agreement without any <strong>in</strong>terruption from the <strong>L<strong>and</strong></strong>lord or people<br />

he sends.<br />

b. If at any time dur<strong>in</strong>g the agreement the <strong>L<strong>and</strong></strong>lord wishes to sell the<br />

<strong>L<strong>and</strong></strong>, he shall give priority to the tenant.<br />

c. To provide the Tenant with reasonable notice before any <strong>in</strong>spection<br />

of the <strong>L<strong>and</strong></strong>.<br />

3. TERMINATION OF AGREEMENT<br />

a. <strong>The</strong> agreement shall end at the expiry of the Tenancy.<br />

b. Any breach (do<strong>in</strong>g anyth<strong>in</strong>g that is not allowed) of part or the whole<br />

of this agreement shall entitle the aggrieved party to term<strong>in</strong>ate the<br />

agreement.<br />

c. At the end of the tenancy, if the l<strong>and</strong>lord wants to rent the l<strong>and</strong><br />

aga<strong>in</strong> <strong>and</strong> the tenant had obeyed the terms of the agreement, the<br />

tenancy agreement will be extended on the same terms or new<br />

terms.<br />

4. DISPUTE RESOLUTION<br />

If the parties have any dispute perta<strong>in</strong><strong>in</strong>g to the <strong>L<strong>and</strong></strong>, the matter should be<br />

directed to the customary authorities of both parties as agreed. If there is no<br />

agreement the matter should be taken to the state court for l<strong>and</strong>, currently
