16th Amendment
verdict: Awami
League awaits
president’s
response
• Pavel Haider Chowdhury
POLITICS
The ruling Awami League has
placed its hopes in the president’s
ability to resolve the ongoing
crisis over the Supreme
Court’s 16th Amendment verdict.
“We have shared our stance
on the verdict with the president
and Chief Justice. We
informed them that the people
of the country have not
accepted the verdict. We hope
the president will come up
with a solution,” several senior
leaders of the Awami League
told the Bangla Tribune.
The president has the opportunity
to provide a solution
as he is the guardian of the
state, the Awami League leaders
said, adding that the Chief
Justice can also recall the verdict
or invoke the suo moto
rule to resolve the matter.
“We want an acceptable
solution,” they said.
Awami League Presidium
Member Mohammad Nasim
said: “The people rejected the
16th Amendment verdict and
we have conveyed their sentiments
to the president. He will
definitely end this crisis.”
According to ruling party
policymakers, the president
has advised the Chief Justice
to recall the verdict.
Party sources said that the
Chief Justice has the jurisdiction
to recall the verdict and he
can declare that the ambiguity
in the verdict’s observation
will be cleared by recalling it.
“This is the easiest way to
resolve the crisis. The alternatives
are too complex,” Awami
League policymakers said.
Sources have hinted that the
Awami League may review the
verdict if there are any assurances
of a positive outcome.
Awami League stalwarts
and stakeholders have been
criticising the verdict while
the Bangladesh National Party
says the verdict had exposed
the misdeeds of the government.
A seven-member bench
of the Appellate Division,
led by Chief Justice Surendra
Kumar Sinha, had upheld a
High Court judgment that had
scrapped the amendment, rejecting
an appeal filed by the
state back on July 3.
The Supreme Court on August
1 released the full text of
the verdict. Following the full
text’s release, several government
stakeholders, including
many ministers and Awami
League office bearers expressed
their discontent with
the verdict. •
