Trademark maintenance
3.3.5.1 PROOF OF USE OF TRADEMARKS
If a registered trademark is not used in the respective country for the registered goods or services, the
trademark can be deleted by a third party or by the patent office.
Certain patent offices ask regularly for a proof of use:
In the respective country (US or India)
For the registered class(es)
Within a certain period of time (mostly last 5 years)
The marketing department will contact you, if your help is needed in order to collect proof of use of
your trademark.
3.3.5.2 MANAGEMENT OF TRADEMARKS
Trademarks = brand value
Please treat them like a product in itself with a value that must be protected and managed. In order to
prepare ourselves for any legal challenge, you must keep digital or printed records of the use of the
trademarks (i.e. hold on to brochures, images, car logos, any marketing material or other material
where you use the trademark) and use photographs to document your usage in non-AVL
controlled media channels (i.e. take pictures of advertisements in magazines or published white
papers where the trademark is referenced).

3.3.6.1REGISTERED “WORD” TRADEMARKS (AVL PAID FOR REGISTRATION)

Example:
If “Fire” only was registered, then the TM should go directly after “Fire” → Fire TM . Any Version
referencing should go after the TM → Fire TM 2.0
Example:
If “Fire 2.0” was registered, then the TM should go directly after the versioning → Fire 2.0 TM
3.3.6.2NON-REGISTERED “WORD” TRADEMARKS (NOT PAID FOR, BUT WE USE THE TM SIGN FOR BASIC
PROTECTION)

sign should go directly after the official name (in case of Software: official name + generation) of
the product.
