BEWARE
IF THERE IS NO PATENT NUMBER!
New Turkish IP Code No. 6769 (valid since January
10, 2017) has clarified many practices in the field of
intellectual property. Within this context, one of the most
notable articles of this Code is Article 106. Considering
the increasing importance of the patent registration,
the clauses 3, 4, and 5 of the Article require the utmost
attention of patent holders.
The aforementioned clauses are as
follows: “(3) Rights originating from a
patent application or a patent, unless
registered dully, cannot be enforced
against bona fide third parties.
(4) The person, who wishes to enforce
his patent rights against third parties,
is obligated to notify the third parties
about the patent application’s or patent’s
number.
(5) If there are any declarations
giving the impression that there
is patent protection on a product
and its labels, packaging,
promotional materials,
advertisements, and related
published material, the person
making such declarations shall
indicate the number of the said
patent application or patent
therein.”
Grup Ofis Marka Patent Patent
Attorney Duygu Çakı interprets
the matter as follows: “In the
light of these clauses of Article
106, if a patent owner wants
to claim his rights against third
parties, it becomes essential
to certainly indicate the patent
number on the products or its
package. Otherwise, it seems
that the claimant third parties
may be prevented from claiming
their rights based on their patent
rights based on this Article.”
IT IS INSTAGRAM’S TURN TO BE A
WELL-KNOWN
TRADEMARK
One of the first platforms that comes
to mind upon hearing the term social
media, Instagram, has filed a well-known
trademark application in Turkey.
Instagram, as a very popular social networking
platform, is announced to be recently acquired
by Facebook for 1 Billion Dollars. Without losing
its momentum, it has been coming up with
new features and improvements. In line with
these developments, Instagram recently filed
an application for well-known trademark in
Turkey following its trademark applications in
Australia, Brazil, European Union, Israel,
Japan, Norway, Singapore, South Korea,
Switzerland and many other countries.
We are curious to see what will be the
outcome of the examination process at the
Turkish Patent and Trademark Office for this
application.
EXCAVATIONS SURFACED
A 2000-YEAR-OLD BRAND
“A.N.T.” stamp which was surfaced during
an archaeological excavation in Antalya,
Turkey, shed light on the history of brands.
The earliest records of branding date back to
19th century early American cattle farmers who
used branding as an identifying mark on their
livestock. Similarly, stamps on pottery and tools
found during the archaeological excavations are
thought to be the first examples of branding in
antiquity.
During recent archaeological excavations in
Antalya, it was found that an “A.N.T.” stamp was
used on potteries made in kilns. These goods
date back to at least 2000 years, and the “A.N.T.”
stamps on them belongs to the Roman and
Byzantine period. This gives us a clue about the
history of branding.
Branding and brand positioning have a
prominent place in today’s society. When
their history is considered, A.N.T. stamped
pottery shows that the use of branding
dates back to ancient times, contrary to
what is believed.
The Madrid System reached to 100 members with
the accession of Indonesia.
Administered by the World Intellectual Property
Organization (WIPO), the Madrid System, allows
trademark holders to obtain and maintain protection
in multiple territories with a single international
application. The Madrid System has been expanding
with the addition of new member states every year.
In recent years, with the addition of Algeria, Gambia,
Laos, and Taiwan, the number of member states has
reached to 99. In addition to these countries, Indonesia
will now be on the list of countries to be designated for
trademark applications as the 100th member of the
Madrid System starting from January 2, 2018.
The effort to show the audience and consumers
that the trademark is one step ahead of the rivals
in the sense of a mild competition brings about
the concept of “comparative advertising.”
GRUP OFİS MARKA PATENT
EXPERT OPINION
COMPARATIVE
ADVERTISING
PROHIBITION
HAS ENDED
IN TURKEY
Advertising and promotion
are one of the most efficient
functions of the trademark.
Trademark holders, desiring
to enter and keep their
permanence in the sector,
know that being sustainable
and unforgettable mostly
depend on promotion
and advertisement of the
trademark.
The new IP Code
states that
a registered
trademark holder
has the right to
prohibit illegal use
of his trademark
in comparative
advertisings.
The concept “comparative advertising” means to
exhibit the superior properties of the promoted
trademark compared to its rivals. Sometimes
this situation creates an aggressive competition
environment among the trademarks in the
same sector. Trademark holders may even pave
the way for transforming their advertisements
into a smear campaign by intentionally or
unintentionally damaging and denigrating their
rival trademarks so as to bring qualities of their
trademarks forward. This is a very sensitive topic
to be focused on. Trademark holders should
particularly pay attention to this very point when
promoting their trademarks, and they should
also avoid offensive and humiliating expressions
and images against the rivals when bringing
the superior qualities of their own trademarks
in comparative advertisements. It has been
more than a necessity and has also become a
legal obligation for trademark holders to keep
the sensitive balance within the scope of fair
competition principals.
Until recently, promoting and therefore
comparatively advertising the trademarks which
are not only directly addressing, but also using
marks reminding of the rival trademark and even
depending on perceptual referring on the rivals
were prohibited in Turkey. In an environment in
which thousands of new products try to enter
into the market and keep its presence therein,
since trademark holders and advertisers could
not make comparative advertisements, they
had to develop strategies to raise awareness,
be attractive and survive through trademark
promotions.
In the end, along with the promulgation
of Commercial Advertisement and Unfair
Commercial Practices Regulation in the 29232
numbered and 10.01.2015 dated Official Gazette,
the concept “comparative advertising” whose
examples we had followed for years in abroad
has literally been legal in Turkey as well. A year
later, a regulation pertaining to using names,
trademarks, logos and other distinguishing
figures or expressions along with commercial
names or company names belonging to rivals in
comparative advertisings was also carried out.
The conditions for making a comparative
advertisement is regulated with a regulation
and these conditions can be summarized as
follows:
1. It is not misleading or deceiving,
2. It does not lead to unfair competition,
3. It compares goods or services having the
same characteristics meeting the same needs
or intended for the same purpose,
4. It compares a feature that benefits the
consumers,
5. It objectively compares one or more financial,
material, verifiable and typical features of those
goods and services compared, including the
price,
6. It makes objective and quantifiable claims
based on numerical data proved by scientific
tests, reports, or documents,
7. It does not discredit or denigrate the
intellectual property, commercial title, trade
names, other distinguishing marks, goods,
services, activities or circumstances of a
competitor,
8. Goods or services belong to the same
geographical region in comparisons of goods or
services whose designation of origin has been
given,
9. It should meet requirements so as not to
create confusion between the advertiser and
a competitor regarding trademarks, commercial
names, trade names or other characteristic marks
or goods or services.
Additionally, within the framework of Turkish
Industrial Property Code No. 6769, registered
trademark owners can bar others from using their
trademark improperly and illegally in comparative
advertisements.
It is our hope that soon we will get to enjoy high
quality advertisements that are creative, smart,
honest, realistic, in compliance with competitive
principals, not discrediting and denigrating the
competitors, lasting without being misleading and
deceiving the customers.
Attractiveness, efficiency and
distinctiveness of the advertising
makes the advertised trademarks
have a catchy effect in consumers’
mind.
Who would have thought that Google, which
started as a research project of Stanford
doctoral students Larry Page and Sergey Brin
in 1998, would become a tech giant?
Initially Page and Brin named the
prototype search engine “Backrub.”
Then, through a word-play on
“googol,” they ended up with
“Google.” They chose “googol” as a
starting point since it is equivalent
to 10 raised to the power of a
100, and such a high number
might give the impression that the
engine would be a source of vast
information. With this thought in
mind, they filed an application to
register Google as a trademark
at the USPTO. Similarly, they
registered the Google logo in 2001.
What sets Google apart from other
search engines is that traditional
search engines rank search results
based on how many times the
search term is found on that page
while Google ranks the search
results based on how many times
that particular website was chosen
for that search term.
Initially starting as a search engine,
expanding its portfolio of services
and products that make our lives
easier by making big moves from
of Google’s expansion strategy.
The first Doodle
Without doubt, one of Google´s best
investments was the Android operating
system, released in 2008. Android is
the most used operating system in
the world, having a market share of
90% of mobile phones in developing
markets. Google has had a great market
share since the release of the Android
operating system, a system continuously
being improved. App developers release
their applications through the Google
Play store for Android users. According
to a report published by StatCounter in
2017, Android ranks in first place with a
share of 37.97%, while Windows comes
in at second place with 37.91%.
Aiming to have fun with all their products
and services, Google shows their
sense of humor with the code names
for each Android version as well. Each
version was named after a dessert in
alphabetical order: Apple Pie, Banana
Bread, Cupcake, Donut, Eclair, Froyo,
Gingerbread, Honeycomb, Ice Cream
Sandwich, Jelly Bean, Kitkat, Lollipop,
Marshmallow, and Nougat.
Not only the names of their Android
releases, but also their Doodles show their
whimsical side. Doodles are temporary
alterations to the Google logo for holidays,
events, achievements, and important
days. The first Doodle was made for the
Burning Man Festival in 1998. The first
Doodle relating to Turkey was made to
Google has taken such a place in the world today that
phrases such as “to google” and “google it” are used
in our daily life. While the word “google” didn’t make
any sense to anyone 19 years ago, nowadays it is
universally understood as the term for searching for
something on the internet.
the US8078349 numbered US patent
application “transitioning a mixed-mode
vehicle to autonomous mode” in 2011.
Google has contributed to the
development of technology in many fields
such as allowing data storage centers
to cool by means of sea water and being
moveable on the water, and devices which
allow us to draw blood from patients
without using a needle.
Effects hidden in some words, except for
Doodles, are also used within Google.
For example, when “do a barrel roll” is
written in the search bar, the results
page whirls around once and reverts
back. When “askew” is written, the
results page is shown askew. When
the sentence “the answer to life, the
universe, and everything” is written,
the result “42” is shown on the Google
calculator since 42 is the answer to
the final question pertaining to life, the
JIGSAW PUZZLE:
THE FUN FOR ALL AGES
PATENT STORIES
John Spilsbury, a mapmaker
in London, created the
first puzzle in 1760 as an
educational tool for
teaching
geography.
He adhered a world map to a flat wood
surface and used a saw to cut along the
borders of the countries. Thus, the jigsaw
puzzle was born.
Although John Spilsbury has been
recognized as the inventor of the jigsaw
puzzle, patent applications filed with similar
subject matter years after his date of
invention say the opposite since there are
no known patent applications filed under his
name.
Generally, a tool for relaxation, this invention
also tests our patience. In 1989, an
inventor named Karen Meyer filed a patent
application claiming an invention close to
the modern-day jigsaw puzzles. The said
invention can be described as having outer
straight edge and interior puzzle pieces
with wholly irregular concave and convex
features fitted together to form orthogonal
columns and rows. Moreover, having interior
straight edge pieces to define an interior
polygon proportionate to the outer polygon
to increase the number of possible fitting
connections and the difficulty.
When the characteristics of the said patent
are considered, it is obvious that it has the
same structure as the classic puzzle of
today.
As the popularity of puzzles has increased, the
variety and features of puzzles have increased
as well and patent applications for versions
with distinctive features have taken their place
in history. In 2001, INVENTI LTD filed a patent
application claiming a new type of a puzzle
“a two-dimensional jigsaw puzzle including a
plurality of pieces, each of the pieces having
a main body made of a foam with memory.”
The said invention has a layer of adhesive
extending over to the main body and a flexible
sheet bonded thereto. In other words, the
patent granted to INVENTI LTD for this puzzle
type can be characterized as being a twodimensional
puzzle that is capable of being
bent without any of its pieces detaching from
the puzzle.
As well as the aforementioned
inventions, many other types of
puzzles are already in use; threedimensional
or magnetic puzzles are
just a few to mention. Although, the
increasing number of pieces and the
decreasing size of the pieces tests our
patience, dear puzzle lovers: “Don’t
I HAVE AN OPPOSITION
POWER OF THE
WELL-KNOWNESS:
VOLKSWAGEN
Volkswagen, carrying out business
in the sector since 1930s, is one of
the most well-known motor vehicle
companies. Well known in Turkey
and globally, Volkswagen is also the
owner of various trademarks that
are registered in many countries
along with Turkey. Aiming to never
fall behind, Volkswagen took its place
among distinctive trademarks both by
continuously improving its designs and
meeting needs of the new generations.
Volkswagen’s efforts to protect its
trademarks show its commitment to
industrial property.
The German firm has never hesitated
to spend and invest to preserve its
share of the market and IP rights.
Consequently, they were able recoup
their efforts in the recent opposition
proceeding at the Turkish Patent
and Trademark Office. Volkswagen’s
Caravelle, which was produced from
1950 to 1967, was part of a logo of
the recent 2016/42052 numbered
“Succuk Abi” trademark registration
application made by Sevtap Eren.
The basis of the opposition made
against the cited application was that,
albeit the contents of the classes are
not identical, the drawing of the bus
used in the logo that is subjected to
opposition is exactly the illustration of
Opposing Trademark
Volkswagen 1st ve 6th
Generation Caravelle Vehicles
the bus “Caravelle” - a well-known old
model of which the 6 th generation is in
the market.
The decision with regard to the
opposition stated that there is no
likelihood of confusion between the
trademarks according to Article
8/1 although Volkswagen has logo
trademark registrations similar to
the bus on the other logo. However,
according to Article 8/4 “it was
found that the opposed trademark
has the potential to be detrimental
to the distinctive character or the
reputation of the earlier trademark
and make improper gains as the
earlier trademark has reached a level
of reputation in public view.” And the
opposed trademark was rejected in
total.
Every investment made to increase
the visibility of a trademark and its
customer awareness is a crucial step
towards trademark protection efforts.
As can be seen in the case of the
Volkswagen trademark, common use
and investment allows for fighting only
with the reputation against trademark
applications, that are not in similar
classes and not seen identical enough
to make confusion.
Opposed Trademark
The opposed trademark
application
As the one and only intellectual property
magazine dedicated to obsessively reporting
headlines, news, and events in Turkey, GOssIP
is justifiably proud of guiding and leading the
sector. In this issue, we look into our opposition
against a similar trademark application to our
trademark in Turkey.
An inherently distinctive trademark GOssIP, is
a combination of two abbreviations: GO refers
to our holding company “Grup Ofis Marka
Patent,” while IP refers to our area of expertise
“Intellectual Property.”
“GOssIP” aimed to protect its own trademark
right, besides being a magazine operating in
Intellectual Property field, and has opposed
against the similar “GOZZIP” trademark
application.
When the GOssIP and GOZZIP trademarks are
compared, the latter trademark replaces SS with
letters ZZ. However, these differences are unlikely
to be enough to avoid the likelihood of confusion.
In terms of pronunciation, there is no difference
between GOssIP and GOZZIP. The letters S and
VS. GOZZIP
Z sound phonetically the same, the syllables (GO
and IP) that are emphasized while pronouncing
the words are identical. These similarities
increase the likelihood of confusion.
Visual and phonetic similarities of two
trademarks are not enough to prove that the said
trademarks are confusingly similar. In addition to
these similarities, the classes of the trademarks
should be similar as well. When the scopes of the
said trademarks are compared, the appealed
trademark GOZZIP claims similar goods and
services as GOssIP, that is, “preparing any media
such as books, magazines, newspapers for
publishing and services for delivering the said
published materials to their readers.”
The Turkish Patent and Trademark Office
examined the appeal under the light of the
aforementioned evidence and ruled that
likelihood of confusion between the two
YOUNG INVENTOR OF THE
SOURCE IN OUR PALMS:
ANN MAKOSINSKI
INVENTOR STORIES
Ann Makosinski
is the inventor of
thermoelectric
flashlight which
operates by utilizing
the heat of human
hand, and the
E-Drink cup which
charges mobile
phones using the
heat from hot
beverages like tea
and coffee.
The inventor of these practical
products is quite young. Born in
1997, Makosinski, even before
the age of 20 has become so
successful that she has already
given 5 TEDx talks, has twice
been a guest on Jimmy Fallon’s
talk show, and was named as
one of Time’s 30 Under 30 for
2013. She has also won and
been nominated for many
awards. It seems like we will
be hearing a lot more about
Makosinski and her inventions.
Her youth is not the only
surprising fact about her.
Ann does not have a science
or engineering educational
background contrary to
expectations. Her major is
English Literature. This catches
many by surprise and she
responds to those by saying “I
think it is important to have a
balance of science and arts to
be able to be accessible in either
field. It just attracted my interest,
but I still do all my science and
business outside of school.”
As a young child, Ann would
spend hours trying to create
new things. She was especially
interested in electronics and
cameras, and she says she
would spend hours tinkering
and experimenting. When she
was 15 years old, she created
a prototype for her flashlight
which she powered with the
heat of her hand for a ninthgrade
science project. Her
main goal was to provide a
practical solution to people
with limited access to power
and electricity.
One day, a friend from
Philippines told her that
she was failing her classes
because she was not able
to afford electricity and
consequently was not able to
study at night. So this friend
became Ann´s inspiration to
invent this flashlight and gain
the world’s attention. She
wanted to provide light for her
friend and other people like
her.
Makosinski’s invention, the
Hollow Flashlight, produces
energy utilizing the Peltier
effect; one side of the device
heats up while the other side
remains cool. This flashlight
can produce enough energy
to power a LED light for
20 minutes using only the
warmth of the human hand.
The flashlight was recognized
and received awards from the
2013 Canada Science Fair, the
2013 Google Science Fair, and
the 2014 International Science
and Engineering Fair.
As a part of another science
project in high school, Ann
created a coffee mug called
“E-Drink.” This insulated mug
captures thermal energy from
the hot beverage inside and
makes it available to charge
an external device such as a
mobile phone. For example,
with the mug’s current battery,
an iPhone’s battery life can be
extended 10 to 30 minutes.
Along with all these, she has
also caught the attention
of publishers’ as well. She
is currently working on two
books: a memoir and a
cartoon series.
This successful young
inventor’s advice to other
inventors and innovators
is also worth noting: “Start
now. There’s nothing holding
you back! Some students at
colleges or universities or
even in high school [think],
‘Oh, I’m just a student in
college, so I don’t need to
do anything else.’ The truth
is, you can do a lot of other
things, you can do whatever
you want. Just don’t be afraid
to reach out to people.”
It seems like this young
inventor will continue to light
the future of many through her
inventions and statements.
DID YOU KNOW?
The world’s first product
that could be bought by
installments was a sewing
machine patented in 1790.
In order to boost their sales,
Singer Sewing Machines
implemented installment
plans and became the
biggest sewing machine
manufacturer in the United
States.
Tiffany & Co. is well
known for its jewelry and
designer items but it was
a stationary shop when
it first opened its doors.
Monopoly is the first
its designer a millionaire.
Monopoly was the most
sold and played board
game of the 21 st century
and made its designer
Charles Darrow a
millionaire.
When first founded
in 1806, Colgate was
producing soap, starch,
and candles. The
company produced its
first toothpaste in 1873.
Incubators were designed
for animals before they
were ever used for premature
babies. Although
it was patented by the
French obstetrician
Étienne Stéphane Tarnier
in 1880, the originator
was a zoologist and a zoo
director.
BIcycle
The first bicycle patent was granted
to French national Jeon Theson. This
patent did not resemble the modernday
bicycle, it was an odd-shaped
bicycle precursor with four wheels.
In 1690, “celerifere” was invented
by Comte Mede de Sivrac; it had
two wooden wheels but no pedals.
However, the modern-day bicycle
originates from “draisine” invented in
1817.
Every housewife is an inventor.
Similarly, a housewife named W.A.
Cockran invented an electricpowered
dishwasher precursor. The
dishes were cleaned using highpressure
water through a sprinkler
and saved housewives from a great
inconvenience.
The Lumière brothers are mentioned
as one of the first to invent the film
camera. The Lumière brothers were
photographers like their father, and
they were interested in film and
photography. In 1894, they developed
the first film camera. This three-inone
device could record, develop, and
project motion pictures, which set it
apart from the other inventions. They
named the device the Cinematograph
and it could project 16 frames per
second.
From the lethal combination of
electricity and water, Arthur Leslie
Large invented the electric tea kettle
in 1923. The tea was brewed until it
became ready to drink using a system
comprised of a pipe with a wire through
it. However, whenever the device
malfunctioned, it heated up not only the
water but also the user. Eventually, this
device was improved to eliminate this
problem.
