IF THERE IS NO PATENT NUMBER!<br />

New Turkish IP Code No. 6769 (valid since January<br />

10, 2<strong>01</strong>7) has clarified many practices in the field of<br />

intellectual property. Within this context, one of the most<br />

notable articles of this Code is Article 106. Considering<br />

the increasing importance of the patent registration,<br />

the clauses 3, 4, and 5 of the Article require the utmost<br />

attention of patent holders.<br />

The aforementioned clauses are as<br />

follows: “(3) Rights originating from a<br />

patent application or a patent, unless<br />

registered dully, cannot be enforced<br />

against bona fide third parties.<br />

(4) The person, who wishes to enforce<br />

his patent rights against third parties,<br />

is obligated to notify the third parties<br />

about the patent application’s or patent’s<br />

number.<br />

(5) If there are any declarations<br />

giving the impression that there<br />

is patent protection on a product<br />

and its labels, packaging,<br />

promotional materials,<br />

advertisements, and related<br />

published material, the person<br />

making such declarations shall<br />

indicate the number of the said<br />

patent application or patent<br />

therein.”<br />

the matter as follows: “In the<br />

light of these clauses of Article<br />

106, if a patent owner wants<br />

to claim his rights against third<br />

parties, it becomes essential<br />

to certainly indicate the patent<br />

number on the products or its<br />

package. Otherwise, it seems<br />

that the claimant third parties<br />

may be prevented from claiming<br />

their rights based on their patent<br />

rights based on this Article.”<br />

IT IS INSTAGRAM’S TURN TO BE A<br />

WELL-KNOWN<br />

TRADEMARK<br />

One of the first platforms that comes<br />

to mind upon hearing the term social<br />

media, Instagram, has filed a well-known<br />

trademark application in Turkey.<br />

Instagram, as a very popular social networking<br />

platform, is announced to be recently acquired<br />

by Facebook for 1 Billion Dollars. Without losing<br />

its momentum, it has been coming up with<br />

new features and improvements. In line with<br />

these developments, Instagram recently filed<br />

an application for well-known trademark in<br />

Turkey following its trademark applications in<br />

Australia, Brazil, European Union, Israel,<br />

Japan, Norway, Singapore, South Korea,<br />

Switzerland and many other countries.<br />

We are curious to see what will be the<br />

outcome of the examination process at the<br />

Turkish Patent and Trademark Office for this<br />

application.<br />

EXCAVATIONS SURFACED<br />

A 2000-YEAR-OLD BRAND<br />

“A.N.T.” stamp which was surfaced during<br />

an archaeological excavation in Antalya,<br />

Turkey, shed light on the history of brands.<br />

The earliest records of branding date back to<br />

19th century early American cattle farmers who<br />

used branding as an identifying mark on their<br />

livestock. Similarly, stamps on pottery and tools<br />

found during the archaeological excavations are<br />

thought to be the first examples of branding in<br />

antiquity.<br />

During recent archaeological excavations in<br />

Antalya, it was found that an “A.N.T.” stamp was<br />

used on potteries made in kilns. These goods<br />

date back to at least 2000 years, and the “A.N.T.”<br />

stamps on them belongs to the Roman and<br />

Byzantine period. This gives us a clue about the<br />

history of branding.<br />

Branding and brand positioning have a<br />

prominent place in today’s society. When<br />

their history is considered, A.N.T. stamped<br />

pottery shows that the use of branding<br />

dates back to ancient times, contrary to<br />

what is believed.<br />

THE MADRID SYSTEM<br />

KEEPS EXPAND<strong>ING</strong><br />

The Madrid System reached to 100 members with<br />

the accession of Indonesia.<br />

Administered by the World Intellectual Property<br />

Organization (WIPO), the Madrid System, allows<br />

trademark holders to obtain and maintain protection<br />

in multiple territories with a single international<br />

application. The Madrid System has been expanding<br />

with the addition of new member states every year.<br />

In recent years, with the addition of Algeria, Gambia,<br />

Laos, and Taiwan, the number of member states has<br />

reached to 99. In addition to these countries, Indonesia<br />

will now be on the list of countries to be designated for<br />

trademark applications as the 100th member of the<br />

Madrid System starting from January 2, 2<strong>01</strong>8.<br />

The Madrid System which is expected to include South<br />

Africa, Canada and Hong Kong as members in the<br />

upcoming years.<br />

RUBIK’S CUBE<br />

STARTS ITS JOURNEY TO<br />

BECOME WELL-KNOWN<br />

Rubik’s cube is one of the world’s most recognized<br />

toys which tests our patience while we try to prove<br />

our intelligence. This toy has now started its journey<br />

to become a well-known trademark in Turkey.<br />

Various applications were filed for Rubik’s cube,<br />

named after its inventor Hungarian architect<br />

and sculptor Erno Rubik, in Bosnia Herzegovina,<br />

Belarus, China, Croatia, Egypt, Iran, Norway,<br />

Russia, Serbia, South Korea, Turkey and Ukraine.<br />

In Turkey, the decision on the well-known<br />

trademark application is expected to be received<br />

after the examination of the Turkish Patent and<br />

Trademark Office.<br />

Advertising and promotion<br />

are one of the most efficient<br />

functions of the trademark.<br />

Trademark holders, desiring<br />

to enter and keep their<br />

permanence in the sector,<br />

know that being sustainable<br />

and unforgettable mostly<br />

depend on promotion<br />

and advertisement of the<br />

trademark.<br />

The new IP Code<br />

states that<br />

a registered<br />

trademark holder<br />

has the right to<br />

prohibit illegal use<br />

of his trademark<br />

in comparative<br />

advertisings.<br />

The concept “comparative advertising” means to<br />

exhibit the superior properties of the promoted<br />

trademark compared to its rivals. Sometimes<br />

this situation creates an aggressive competition<br />

environment among the trademarks in the<br />

same sector. Trademark holders may even pave<br />

the way for transforming their advertisements<br />

into a smear campaign by intentionally or<br />

unintentionally damaging and denigrating their<br />

rival trademarks so as to bring qualities of their<br />

trademarks forward. This is a very sensitive topic<br />

to be focused on. Trademark holders should<br />

particularly pay attention to this very point when<br />

promoting their trademarks, and they should<br />

also avoid offensive and humiliating expressions<br />

and images against the rivals when bringing<br />

the superior qualities of their own trademarks<br />

in comparative advertisements. It has been<br />

more than a necessity and has also become a<br />

legal obligation for trademark holders to keep<br />

the sensitive balance within the scope of fair<br />

competition principals.<br />

Until recently, promoting and therefore<br />

comparatively advertising the trademarks which<br />

are not only directly addressing, but also using<br />

marks reminding of the rival trademark and even<br />

depending on perceptual referring on the rivals<br />

were prohibited in Turkey. In an environment in<br />

which thousands of new products try to enter<br />

into the market and keep its presence therein,<br />

since trademark holders and advertisers could<br />

not make comparative advertisements, they<br />

had to develop strategies to raise awareness,<br />

be attractive and survive through trademark<br />

promotions.<br />

In the end, along with the promulgation<br />

of Commercial Advertisement and Unfair<br />

Commercial Practices Regulation in the 29232<br />

numbered and 10.<strong>01</strong>.2<strong>01</strong>5 dated Official Gazette,<br />

the concept “comparative advertising” whose<br />

examples we had followed for years in abroad<br />

has literally been legal in Turkey as well. A year<br />

later, a regulation pertaining to using names,<br />

trademarks, logos and other distinguishing<br />

figures or expressions along with commercial<br />

names or company names belonging to rivals in<br />

comparative advertisings was also carried out.<br />

The conditions for making a comparative<br />

advertisement is regulated with a regulation<br />

and these conditions can be summarized as<br />

follows:<br />

1. It is not misleading or deceiving,<br />

2. It does not lead to unfair competition,<br />

3. It compares goods or services having the<br />

same characteristics meeting the same needs<br />

or intended for the same purpose,<br />

4. It compares a feature that benefits the<br />

consumers,<br />

5. It objectively compares one or more financial,<br />

material, verifiable and typical features of those<br />

goods and services compared, including the<br />

price,<br />

6. It makes objective and quantifiable claims<br />

based on numerical data proved by scientific<br />

tests, reports, or documents,<br />

7. It does not discredit or denigrate the<br />

intellectual property, commercial title, trade<br />

names, other distinguishing marks, goods,<br />

services, activities or circumstances of a<br />

competitor,<br />

8. Goods or services belong to the same<br />

geographical region in comparisons of goods or<br />

services whose designation of origin has been<br />

given,<br />

9. It should meet requirements so as not to<br />

create confusion between the advertiser and<br />

a competitor regarding trademarks, commercial<br />

names, trade names or other characteristic marks<br />

or goods or services.<br />

Additionally, within the framework of Turkish<br />

Industrial Property Code No. 6769, registered<br />

trademark owners can bar others from using their<br />

trademark improperly and illegally in comparative<br />

advertisements.<br />

It is our hope that soon we will get to enjoy high<br />

quality advertisements that are creative, smart,<br />

honest, realistic, in compliance with competitive<br />

principals, not discrediting and denigrating the<br />

competitors, lasting without being misleading and<br />

deceiving the customers.<br />

Attractiveness, efficiency and<br />

distinctiveness of the advertising<br />

makes the advertised trademarks<br />

have a catchy effect in consumers’<br />

mind.<br />

Who would have thought that Google, which<br />

started as a research project of Stanford<br />

doctoral students Larry Page and Sergey Brin<br />

in 1998, would become a tech giant?<br />

Initially Page and Brin named the<br />

prototype search engine “Backrub.”<br />

Then, through a word-play on<br />

“googol,” they ended up with<br />

“Google.” They chose “googol” as a<br />

starting point since it is equivalent<br />

to 10 raised to the power of a<br />

100, and such a high number<br />

might give the impression that the<br />

engine would be a source of vast<br />

information. With this thought in<br />

mind, they filed an application to<br />

register Google as a trademark<br />

at the USPTO. Similarly, they<br />

registered the Google logo in 20<strong>01</strong>.<br />

What sets Google apart from other<br />

search engines is that traditional<br />

search engines rank search results<br />

based on how many times the<br />

search term is found on that page<br />

while Google ranks the search<br />

results based on how many times<br />

that particular website was chosen<br />

for that search term.<br />

Without doubt, one of Google´s best<br />

investments was the Android operating<br />

the most used operating system in<br />

operating system, a system continuously<br />

being improved. App developers release<br />

their applications through the Google<br />

Play store for Android users. According<br />

to a report published by StatCounter in<br />

2<strong>01</strong>7, Android ranks in first place with a<br />

share of 37.97%, while Windows comes<br />

in at second place with 37.91%.<br />

Aiming to have fun with all their products<br />

and services, Google shows their<br />

sense of humor with the code names<br />

for each Android version as well. Each<br />

version was named after a dessert in<br />

alphabetical order: Apple Pie, Banana<br />

Bread, Cupcake, Donut, Eclair, Froyo,<br />

Gingerbread, Honeycomb, Ice Cream<br />

Sandwich, Jelly Bean, Kitkat, Lollipop,<br />

Marshmallow, and Nougat.<br />

Not only the names of their Android<br />

releases, but also their Doodles show their<br />

whimsical side. Doodles are temporary<br />

alterations to the Google logo for holidays,<br />

events, achievements, and important<br />

days. The first Doodle was made for the<br />

Burning Man Festival in 1998. The first<br />

Doodle relating to Turkey was made to<br />

celebrate April 23 rd National Sovereignty<br />

and Children’s Day on April 22 nd , 2007.<br />

Google has taken such a place in the world today that<br />

phrases such as “to google” and “google it” are used<br />

in our daily life. While the word “google” didn’t make<br />

any sense to anyone 19 years ago, nowadays it is<br />

universally understood as the term for searching for<br />

something on the internet.<br />

calculator since 42 is the answer to<br />

the final question pertaining to life, the<br />

universe and everything according to<br />

the “Hitchhiker’s Guide to the Galaxy” by<br />

It seems that the company, which recently<br />

celebrated the 19 th year of its foundation,<br />

will continue to lead technology for a long<br />

time with their investments, inventions and<br />

specific sense of fun.<br />

Google’s sense of fun draws attention<br />

in their offices through outstanding<br />

designs. Google provides its employees<br />

with numerous opportunities and<br />

entertaining activities such as<br />

playgrounds, massages and spa<br />

services, driverless vehicle services, and<br />

Google, leading the future with not only<br />

its office contents but also its inventions<br />

JIGSAW PUZZLE:<br />

John Spilsbury, a mapmaker<br />

in London, created the<br />

first puzzle in 1760 as an<br />

educational tool for<br />

teaching<br />

geography.<br />

He adhered a world map to a flat wood<br />

surface and used a saw to cut along the<br />

borders of the countries. Thus, the jigsaw<br />

puzzle was born.<br />

Although John Spilsbury has been<br />

recognized as the inventor of the jigsaw<br />

puzzle, patent applications filed with similar<br />

subject matter years after his date of<br />

invention say the opposite since there are<br />

no known patent applications filed under his<br />

name.<br />

Generally, a tool for relaxation, this invention<br />

also tests our patience. In 1989, an<br />

inventor named Karen Meyer filed a patent<br />

application claiming an invention close to<br />

the modern-day jigsaw puzzles. The said<br />

invention can be described as having outer<br />

straight edge and interior puzzle pieces<br />

with wholly irregular concave and convex<br />

features fitted together to form orthogonal<br />

columns and rows. Moreover, having interior<br />

straight edge pieces to define an interior<br />

polygon proportionate to the outer polygon<br />

to increase the number of possible fitting<br />

connections and the difficulty.<br />

When the characteristics of the said patent<br />

are considered, it is obvious that it has the<br />

same structure as the classic puzzle of<br />

today.<br />

As the popularity of puzzles has increased, the<br />

variety and features of puzzles have increased<br />

as well and patent applications for versions<br />

with distinctive features have taken their place<br />

in history. In 20<strong>01</strong>, INVENTI LTD filed a patent<br />

application claiming a new type of a puzzle<br />

“a two-dimensional jigsaw puzzle including a<br />

plurality of pieces, each of the pieces having<br />

a main body made of a foam with memory.”<br />

The said invention has a layer of adhesive<br />

extending over to the main body and a flexible<br />

sheet bonded thereto. In other words, the<br />

patent granted to INVENTI LTD for this puzzle<br />

type can be characterized as being a twodimensional<br />

puzzle that is capable of being<br />

bent without any of its pieces detaching from<br />

the puzzle.<br />

As well as the aforementioned<br />

inventions, many other types of<br />

puzzles are already in use; threedimensional<br />

or magnetic puzzles are<br />

just a few to mention. Although, the<br />

increasing number of pieces and the<br />

decreasing size of the pieces tests our<br />

patience, dear puzzle lovers: “Don’t<br />

VOLKSWAGEN<br />

Volkswagen, carrying out business<br />

in the sector since 1930s, is one of<br />

the most well-known motor vehicle<br />

companies. Well known in Turkey<br />

and globally, Volkswagen is also the<br />

owner of various trademarks that<br />

are registered in many countries<br />

along with Turkey. Aiming to never<br />

fall behind, Volkswagen took its place<br />

among distinctive trademarks both by<br />

continuously improving its designs and<br />

meeting needs of the new generations.<br />

Volkswagen’s efforts to protect its<br />

trademarks show its commitment to<br />

industrial property.<br />

The German firm has never hesitated<br />

to spend and invest to preserve its<br />

share of the market and IP rights.<br />

Consequently, they were able recoup<br />

their efforts in the recent opposition<br />

proceeding at the Turkish Patent<br />

and Trademark Office. Volkswagen’s<br />

Caravelle, which was produced from<br />

1950 to 1967, was part of a logo of<br />

the recent 2<strong>01</strong>6/42052 numbered<br />

“Succuk Abi” trademark registration<br />

application made by Sevtap Eren.<br />

The basis of the opposition made<br />

against the cited application was that,<br />

albeit the contents of the classes are<br />

not identical, the drawing of the bus<br />

used in the logo that is subjected to<br />

likelihood of confusion between the<br />

trademarks according to Article<br />

8/1 although Volkswagen has logo<br />

trademark registrations similar to<br />

the bus on the other logo. However,<br />

according to Article 8/4 “it was<br />

found that the opposed trademark<br />

has the potential to be detrimental<br />

to the distinctive character or the<br />

reputation of the earlier trademark<br />

and make improper gains as the<br />

earlier trademark has reached a level<br />

of reputation in public view.” And the<br />

opposed trademark was rejected in<br />

total.<br />

Every investment made to increase<br />

the visibility of a trademark and its<br />

customer awareness is a crucial step<br />

towards trademark protection efforts.<br />

As can be seen in the case of the<br />

Volkswagen trademark, common use<br />

and investment allows for fighting only<br />

with the reputation against trademark<br />

applications, that are not in similar<br />

classes and not seen identical enough<br />

to make confusion.<br />

application<br />

As the one and only intellectual property<br />

magazine dedicated to obsessively reporting<br />

headlines, news, and events in Turkey, GOssIP<br />

is justifiably proud of guiding and leading the<br />

sector. In this issue, we look into our opposition<br />

against a similar trademark application to our<br />

trademark in Turkey.<br />

An inherently distinctive trademark GOssIP, is<br />

a combination of two abbreviations: GO refers<br />

to our holding company “Grup Ofis Marka<br />

Patent,” while IP refers to our area of expertise<br />

“Intellectual Property.”<br />

“GOssIP” aimed to protect its own trademark<br />

right, besides being a magazine operating in<br />

Intellectual Property field, and has opposed<br />

against the similar “GOZZIP” trademark<br />

application.<br />

When the GOssIP and GOZZIP trademarks are<br />

compared, the latter trademark replaces SS with<br />

letters ZZ. However, these differences are unlikely<br />

to be enough to avoid the likelihood of confusion.<br />

In terms of pronunciation, there is no difference<br />

between GOssIP and GOZZIP. The letters S and<br />

VS. GOZZIP<br />

Z sound phonetically the same, the syllables (GO<br />

and IP) that are emphasized while pronouncing<br />

the words are identical. These similarities<br />

increase the likelihood of confusion.<br />

Visual and phonetic similarities of two<br />

trademarks are not enough to prove that the said<br />

trademarks are confusingly similar. In addition to<br />

these similarities, the classes of the trademarks<br />

should be similar as well. When the scopes of the<br />

said trademarks are compared, the appealed<br />

trademark GOZZIP claims similar goods and<br />

services as GOssIP, that is, “preparing any media<br />

such as books, magazines, newspapers for<br />

publishing and services for delivering the said<br />

published materials to their readers.”<br />

The Turkish Patent and Trademark Office<br />

examined the appeal under the light of the<br />

aforementioned evidence and ruled that<br />

likelihood of confusion between the two<br />

trademarks exists, and GOZZIP trademark’s<br />

services should be limited by deleting “the<br />

preparation of any media such as books,<br />

magazines, newspapers for publishing and<br />

services for delivering the said published<br />

materials to their readers.”<br />

Ann Makosinski<br />

is the inventor of<br />

thermoelectric<br />

flashlight which<br />

operates by utilizing<br />

the heat of human<br />

hand, and the<br />

E-Drink cup which<br />

charges mobile<br />

phones using the<br />

heat from hot<br />

beverages like tea<br />

and coffee.<br />

The inventor of these practical<br />

products is quite young. Born in<br />

1997, Makosinski, even before<br />

the age of 20 has become so<br />

successful that she has already<br />

given 5 TEDx talks, has twice<br />

been a guest on Jimmy Fallon’s<br />

talk show, and was named as<br />

one of Time’s 30 Under 30 for<br />

2<strong>01</strong>3. She has also won and<br />

been nominated for many<br />

awards. It seems like we will<br />

be hearing a lot more about<br />

Makosinski and her inventions.<br />

Her youth is not the only<br />

surprising fact about her.<br />

Ann does not have a science<br />

or engineering educational<br />

background contrary to<br />

expectations. Her major is<br />

English Literature. This catches<br />

many by surprise and she<br />

responds to those by saying “I<br />

think it is important to have a<br />

balance of science and arts to<br />

be able to be accessible in either<br />

field. It just attracted my interest,<br />

but I still do all my science and<br />

business outside of school.”<br />

As a young child, Ann would<br />

spend hours trying to create<br />

new things. She was especially<br />

interested in electronics and<br />

cameras, and she says she<br />

would spend hours tinkering<br />

and experimenting. When she<br />

was 15 years old, she created<br />

a prototype for her flashlight<br />

which she powered with the<br />

heat of her hand for a ninthgrade<br />

science project. Her<br />

main goal was to provide a<br />

practical solution to people<br />

with limited access to power<br />

and electricity.<br />

One day, a friend from<br />

Philippines told her that<br />

she was failing her classes<br />

because she was not able<br />

to afford electricity and<br />

consequently was not able to<br />

study at night. So this friend<br />

became Ann´s inspiration to<br />

invent this flashlight and gain<br />

the world’s attention. She<br />

wanted to provide light for her<br />

friend and other people like<br />

her.<br />

Makosinski’s invention, the<br />

Hollow Flashlight, produces<br />

energy utilizing the Peltier<br />

effect; one side of the device<br />

heats up while the other side<br />

remains cool. This flashlight<br />

can produce enough energy<br />

to power a LED light for<br />

20 minutes using only the<br />

warmth of the human hand.<br />

The flashlight was recognized<br />

and received awards from the<br />

2<strong>01</strong>3 Canada Science Fair, the<br />

2<strong>01</strong>3 Google Science Fair, and<br />

the 2<strong>01</strong>4 International Science<br />

and Engineering Fair.<br />

As a part of another science<br />

project in high school, Ann<br />

created a coffee mug called<br />

“E-Drink.” This insulated mug<br />

captures thermal energy from<br />

the hot beverage inside and<br />

makes it available to charge<br />

an external device such as a<br />

mobile phone. For example,<br />

with the mug’s current battery,<br />

an iPhone’s battery life can be<br />

extended 10 to 30 minutes.<br />

Along with all these, she has<br />

also caught the attention<br />

of publishers’ as well. She<br />

is currently working on two<br />

books: a memoir and a<br />

cartoon series.<br />

This successful young<br />

inventor’s advice to other<br />

inventors and innovators<br />

is also worth noting: “Start<br />

now. There’s nothing holding<br />

you back! Some students at<br />

colleges or universities or<br />

even in high school [think],<br />

‘Oh, I’m just a student in<br />

college, so I don’t need to<br />

do anything else.’ The truth<br />

is, you can do a lot of other<br />

things, you can do whatever<br />

you want. Just don’t be afraid<br />

to reach out to people.”<br />

It seems like this young<br />

inventor will continue to light<br />

the future of many through her<br />

inventions and statements.<br />

two wooden wheels but no pedals.<br />

Similarly, a housewife named W.A.<br />

Cockran invented an electricpowered<br />

dishwasher precursor. The<br />

dishes were cleaned using highpressure<br />

inconvenience.<br />

The Lumière brothers are mentioned<br />

as one of the first to invent the film<br />

camera. The Lumière brothers were<br />

photographers like their father, and<br />

they were interested in film and<br />

photography. In 1894, they developed<br />

the first film camera. This three-inone<br />

device could record, develop, and<br />

project motion pictures, which set it<br />

apart from the other inventions. They<br />

named the device the Cinematograph<br />

and it could project 16 frames per<br />
