California is now the third largest insurance market in the world and remains the largest insurance market in the United States. “As the regulator of the largest insurance market in the nation, I am committed to protecting consumers and making sure they have access to a healthy insurance market offering products to meet consumer and business needs,” said Insurance Commissioner Dave Jones. “Insurance is the one product that touches our lives from the moment we are born to beyond our last breath. Whether it is health, auto, home, business, workers’ compensation, disability or life, insurance is an integral part of our lives-we rely on it to protect ourselves, our families, our assets and our businesses. Insurance provides financial protection and peace of mind for millions of Californians.” As reported by the CDI, based on the most recent data available, California insurance companies now collect $332 billion in premiums every year. In California, there are more than 24 classes of insurance, sold by more than 1,300 companies. More than 410,000 agents, brokers, adjusters, and business entities are licensed to sell insurance in the state. Jones urges Trump Administration to withdraw rule that encourages discrimination SACRAMENTO, Calif. — Insurance Commissioner Dave Jones submitted a letter to the U.S. Department of Health and Human Services March 27, 2018 strongly urging the Trump Administration to withdraw its proposed rule that would allow medical providers, medical facilities, insurers and others to discriminate against patients, delay or deny access to health care, and harm those whose medical care they are entrusted with. “The Trump Administration’s proposed rule conflicts with state and federal anti-discrimination protections and will harm patients and deny them needed medical care. This proposed rule interferes with California’s strong civil rights protections for our residents. The Trump rule elevates the personal beliefs of some medical providers, insurers, and other health care entities over the rights of patients to access essential health care services. The Trump Administration rule encourages discrimination and should be immediately withdrawn, so that no patient has to worry that the federal government will deny them their rights to obtain medically necessary health care services. If not withdrawn, we will sue to stop the Trump rule from going into effect.” California looks to pass on insurer tax savings to consumers Consumer Federation prompts all states to do so SACRAMENTO, Calif. — Commissioner Jones directed his department in January to commence a regulatory review of insurers’ rates and other lines of business where insurers would benefit from the federal tax cuts. The purpose of that review is to identify specific legal authority and necessary amendments to rate formulas and the procedures for addressing insurers’ rates to pass the decrease in taxes on to California policyholders where authorized. “The recent revision to the Federal Tax Schedule for 2018 reduced the corporate tax rate from 35 percent to 21 percent. That means,” Jones stated, “that, nationally, insurers will now be able to retain even more of policyholder premiums as profit. “However, in California,” he went on to explain, “the prior approval process that applies to property and casualty insurance rates limits insurer profits. I have directed my staff to commence a regulatory review of these insurers’ rates given the major tax windfall under the new federal tax rules. I have also directed staff to consider and identify possible actions in other lines of business where insurers will benefit from the tax cut to see if we can enable their policyholders to also benefit from the lower corporate taxes paid by their insurers.” Days later, the Consumer Federation of America issued a letter to Commissioner Jones and other insurance regulators on this very issue asking them to require insurers to file lower rates to reflect the federal tax legislation passed by Congress. In a letter to Insurance Commissioners across the country, Consumer Federation shared examples of the impact of the reduced tax rates on insurers profitability and asked the Commissioners to ensure these significant savings be passed on to insurance consumers. “Insurers will now realize significant savings from these recent tax reductions,” said Commissioner Jones. “Policyholders should also benefit from the reduced taxes paid by insurance companies.”
