NSW GOVERNMENT HOUSING CODE –
THE REAL FACTS
The NSW Government has made changes to Council’s planning controls that could result in more than
60,000 additional residents in the City of Ryde. The City of Ryde would like to respond to claims made by
the NSW Government, in relation to the new Low Rise Medium Density Housing Code and Design Guide.
The NSW Government says: Councils remain in control
of the type of development that is allowed in their local
government area.
FACT: The NSW Government has added additional
development types, such as Manor Houses (blocks of
three or four flats), in low density housing areas despite
the City of Ryde’s objection.
The NSW Government says: The new code allows Dual
Occupancies, Terraces and Manor Houses to a
maximum of two storeys only where Council already
permits medium density housing.
FACT: Council did not permit Terraces nor Manor Houses,
and objects to the NSW Government’s additions.
The NSW Government says: The new code will apply to
all councils across the state.
FACT: The new code does not apply to all councils equally
from 6 July 2018.
The NSW Government says: The Department of
Planning and Environment has consulted with
stakeholders including the City of Ryde, architects and
industry to develop design and building standards for
multi-dwellings and Dual Occupancies in NSW.
FACT: Council received no response to its detailed
objection, which was submitted to the NSW Government
in December 2016.
The NSW Government says: It is up to the City of Ryde,
not the Department of Planning and Environment,
to change the permitted areas for multi-dwelling
housing if it wishes to.
FACT: The NSW Government has made the changes
without our consent. The NSW Government has the power
to reverse them at any time.
The NSW Government says: The code provides clarity
and certainty for suburbs because it only allows this
form of housing when it complies with the code and
Council permits it.
FACT: Clarity and certainty existed under Council’s
previous controls and all Medium Density Housing
developments required council approval. Under the NSW
Government’s new code, Medium Density Housing
developments will be approved by Private Certifiers
without the need for Council approval, with minimal
notification and no requirement for any resident objections
to be considered.
The NSW Government says: The code will allow for
faster approvals for much needed housing where
Council allows and standards in the code are met.
FACT: The City of Ryde has more than delivered its fair
share of housing diversity. The City of Ryde’s housing
target is significantly higher than any other council in our
District and we are well on track to meeting this target
without the need for these changes.
The NSW Government has already imposed
additional residential developments on the
residents of Ryde, with minimal supporting
infrastructure. This has resulted in traffic
congestion and loss of amenity. This latest
intervention by the NSW Government is
unnecessary, unreasonable and unsustainable.
Of greatest concern to Council is the
introduction of Manor Houses (block of flats)
to the City’s Low Density Residential zones.
The new Code comes into effect in the
City of Ryde on 6 July 2018.
