NSW GOVERNMENT HOUSING CODE –<br />

THE REAL FACTS<br />

<strong>The</strong> NSW Government has made changes to Council’s planning controls that could result in more than<br />

60,000 additional residents in the City of Ryde. <strong>The</strong> City of Ryde would like to respond to claims made by<br />

the NSW Government, in relation to the new Low Rise Medium Density Housing Code and Design Guide.<br />

<strong>The</strong> NSW Government says: Councils remain in control<br />

of the type of development that is allowed in their local<br />

government area.<br />

FACT: <strong>The</strong> NSW Government has added additional<br />

development types, such as Manor Houses (blocks of<br />

three or four flats), in low density housing areas despite<br />

the City of Ryde’s objection.<br />

<strong>The</strong> NSW Government says: <strong>The</strong> new code allows Dual<br />

Occupancies, Terraces and Manor Houses to a<br />

maximum of two storeys only where Council already<br />

permits medium density housing.<br />

FACT: Council did not permit Terraces nor Manor Houses,<br />

and objects to the NSW Government’s additions.<br />

<strong>The</strong> NSW Government says: <strong>The</strong> new code will apply to<br />

all councils across the state.<br />

FACT: <strong>The</strong> new code does not apply to all councils equally<br />

from 6 July <strong>2018</strong>.<br />

<strong>The</strong> NSW Government says: <strong>The</strong> Department of<br />

Planning and Environment has consulted with<br />

stakeholders including the City of Ryde, architects and<br />

industry to develop design and building standards for<br />

multi-dwellings and Dual Occupancies in NSW.<br />

FACT: Council received no response to its detailed<br />

objection, which was submitted to the NSW Government<br />

in December 2016.<br />

<strong>The</strong> NSW Government says: It is up to the City of Ryde,<br />

not the Department of Planning and Environment,<br />

to change the permitted areas for multi-dwelling<br />

housing if it wishes to.<br />

FACT: <strong>The</strong> NSW Government has made the changes<br />

without our consent. <strong>The</strong> NSW Government has the power<br />

to reverse them at any time.<br />

<strong>The</strong> NSW Government says: <strong>The</strong> code provides clarity<br />

and certainty for suburbs because it only allows this<br />

form of housing when it complies with the code and<br />

Council permits it.<br />

FACT: Clarity and certainty existed under Council’s<br />

previous controls and all Medium Density Housing<br />

developments required council approval. Under the NSW<br />

Government’s new code, Medium Density Housing<br />

developments will be approved by Private Certifiers<br />

without the need for Council approval, with minimal<br />

notification and no requirement for any resident objections<br />

to be considered.<br />

<strong>The</strong> NSW Government says: <strong>The</strong> code will allow for<br />

faster approvals for much needed housing where<br />

Council allows and standards in the code are met.<br />

FACT: <strong>The</strong> City of Ryde has more than delivered its fair<br />

share of housing diversity. <strong>The</strong> City of Ryde’s housing<br />

target is significantly higher than any other council in our<br />

District and we are well on track to meeting this target<br />

without the need for these changes.<br />

<strong>The</strong> NSW Government has already imposed<br />

additional residential developments on the<br />

residents of Ryde, with minimal supporting<br />

infrastructure. This has resulted in traffic<br />

congestion and loss of amenity. This latest<br />

intervention by the NSW Government is<br />

unnecessary, unreasonable and unsustainable.<br />

Of greatest concern to Council is the<br />

introduction of Manor Houses (block of flats)<br />

to the City’s Low Density Residential zones.<br />

<strong>The</strong> new Code comes into effect in the<br />

City of Ryde on 6 July <strong>2018</strong>.<br />
