Trustee Barbara Delaney supported allowing the item to go on the agenda, however, on the advice of the board’s attorney Gary Mueller the item was voted down, four to one. Mueller said the item could not be voted on at the annual meeting because, unlike calling for an advisory referendum (as was done in 2018), amending or submitting an ordinance does not fall into the State-issued list of 40 topics on which resident electors have the power to take action. “This doesn’t mean people can’t talk about this issue at the meeting, or that we shouldn’t listen to their concerns,” Mueller said. “That’s what these discussions are for, it’s just not in their power to vote on this.” In light of the complaints and the failure to get Cannaday’s item on the annual meeting agenda, Delaney motioned to reject the proposed ordinance until the issue could be thoroughly resolved. Her motion also included a provision to issue a new RFP, specifically requesting an opt-out for the impacted subdivisions, as well as a requirement to include a township lawyer in the entire bid and contract process. Mueller said that passing the ordinance would not approve the contract, but Delaney said the process was so flawed that at this point, “I will not accept this ordinance.” “We need to consider all the residents here,” said Trustee Greg Bickus, in support of Delaney’s motion. “Everyone came into this with good intentions, but we failed when it came time to put pen to paper. The intent of the referendum isn’t represented by the current contract, and I think we need to start over.” Despite Alberico’s insistence that the board should pass the ordinance as written to at least start the process, even if the contract approval was delayed, Trustee Dean Morelli agreed with Delaney and Bickus. “I was under the impression since last year there would be a chance for residents who had pickup already to be able to keep it,” he said. “I’m kind of leaning towards reissuing the RFP and delaying the process at this point, and hopefully there’s a rainbow at the end of this tunnel.” Though Alberico cautioned that reissuing the RFP would likely delay the implementation of a contract until fall, the board voted three to two in favor of Delaney’s motion to reject the ordinance, and by default the contract, which could not be approved without the ordinance passing. Alberico and Trustee Barb Boyce voted to move forward with the ordinance. For now, the issue is on hold until a new RFP can be issued and new bids are submitted. “I’m very encouraged that the trustees are willing to make sure their promises are considered,” Cannaday said. “We’re going to continue to work with the Township and get this where it needs to be for the whole community.”
