6—Vanguard, WEDNESDAY, MACRH 20, 2019 Tarfa’s trial stalled by illness By Onozure Dania LAGOS—THE trial of a Senior Advocate of Nigeria, Rickey Tarfa (SAN) accused of perversion of the course of justice and falsification of age, before a Lagos High Court sitting in Igbosere, was yesterday stalled again, due to his illness. Tarfa is standing trial on a 26-count charge bordering on offering monetary gratification to two judges of the Federal High Court—Justices Hyeladzira Nganjiwa and Mohammed Yunusa. At the resumed hearing of the case yesterday, the defendant’s counsel, Mr. Jelili Owonikoko (SAN), told the court that the defendant was in the court’s premises but could not enter the court room due to the severity of his illness. He informed the court that they had filed a medical recommendation notifying the court about the medical leave that had been given to the defendant for a period of three months to enable him recuperate. Owonikoko said that the defendant was in a vehicle inside the court premises. However, the defendant’s counsel, the Economic and Financial Crimes Commission, EFCC, prosecuting team headed by Mr Usman Buhari and the court’s registrar went to the vehicle to see the defendant. When they came back, the EFCC prosecutor, Buhari who stood in for Mr Rotimi Oyedepo, told the court that they saw the defendant in the vehicle. He also said the medical report was served on them and therefore had no objection for more time to be given to the defendant to recuperate. Justice Adedayo Akintoye, however advised that the defendant must not travel outside the country without court’s knowledge. Consequently she adjourned the case till May 8 and 9 for continuation of trial. At the last adjourned date, on March 11, the case could not go on as the judge was away on an official duty. It will also be recalled that on January 21, the trial did not go on because of the absence of the defendant. Tarfa’s counsel, Owonikoko (SAN), had told the court that his client traveled outside the country for medical treatment. He said the condition of his client was so bad that he had to travel for surgical operations. Otema is standing trial before the court over a three-count charge of rape and assault occasioning harm. The offences contravene Sections 173 and 260(1)(2) of the Criminal Law of Lagos State, 2015. The defendants are facing an eight-count charge of conspiracy, stealing, forcible entering, malicious damage, threat to life, breach of peace, assault and attempted murder, Dlandi said: “After he confirmed that the suspects had died, he took his bike and headed for a clinic, but died on the road after losing much blood.” It was obvious that the Police were unaware of the incident, as no officer was seen around the scene. He, however, insisted on having sex with her. “The defendant had sex with her during that period and later dropped her off at campus at 11.30p.m.” While being cross-examined by Mr. Fred Onyeka, Otema’s defence counsel, the IPO revealed that the defendant’s car was still in police custody. “One of the complainants said he had sex with her in the vehicle, so the vehicle is with the exhibit keeper at the Adeniji Police Station,” she said. During Ejelonu’s evidence-inchief, the IPO’s report was rejected as an exhibit by the court based on Onyeka’s objection that the prosecution did not include it in their proof of evidence. Following the rejection of the report by the court, Momoh- Ayokanbi, the state prosecutor asked the court to declare the Police officer a hostile witness on the grounds that she was in communication with the defence. She said: “I want to seek the leave of the court to declare the witness a hostile witness. When she came to court, she was asking if I was for the defence. “I also noticed that she was having conversations with the defence counsel and the defendants. During her evidence, she did not disclose specific details that were in her report. This is why I wanted it to be admitted into evidence.” Justice Abiola Soladoye declined Momoh-Ayokanbi’s request, noting that the court would declare a witness to be hostile by watching the witness’s body language and not due to whom the witness was presumed to be communicating with. She then adjourned the matter till May 9 for continuation of trial.

It was learned that trouble started after a team of policemen on surveillance raided the community, following a tip-off that suspected cultists that specialised in kidnapping and killing people for ritual, were hibernating in the area. On sighting the Police, the suspects allegedly opened fire and equally used some of their hostages as human shields, forcing the Police to retaliate. In the process Hadiyat Sikiru was allegedly hit by a stray bullet. The death of Hadiyat Sikiru, a Senior Secondary School, SSS, 1 student sparked off protest, as youths in the area forced the Police to abandon their operational vehicle and took to their heels. They succeeded in seizing a Police patrol vehicle and setting it ablaze. According to an eyewitness, Joel Yusuf, “policemen from the Imota Police Division stormed the Adamo area yesterday (Monday) evening and raided suspected criminal hideouts.” Yusuf claimed that as soon as some suspected hoodlums sighted the policemen, they opened fire and the police responded, noting that “unfortunately, a secondary school student was hit by a stray bullet. The death of the girl sparked off protest from an angry mob that went after the policemen. “The policemen fired sporadically to scare the mob and escaped, abandoning their patrol vehicle. The mob then set the vehicle ablaze.” Yusuf said the policemen should have known that the cultists were using innocent people as shield. His words: “I watched how the earlier requested for more security in the area owing to ongoing crisis in his community and that when he saw the kidnappers, he was extending a handshake when they told him they came to take him away.
