Can police just bust into your home? 

It’s 4:00 am, and your condo apartment 

neighbour has cranked up the volume on 

their stereo. The security guard has asked 

them to turn it down. When that didn’t 

work, he called the police. They show up 

and, once the door is answered, take a 

step inside to have a word with the owner. 

They see there are about 10 people inside. 

The owner refuses to identify himself to 

the police. After a minor altercation, he 

tells the cops to leave so he can shut the 

door. When they don’t, he pushes one of 

them in the shoulder. He’s arrested after 

a minor scuffle and criminally charged 

with mischief (playing loud music) and 

assaulting police. 

Effective police work? Police just doing 

their job? Not really, though maybe you 

can’t help but sympathize with the cops 

here or the long-suffering neighbours. 

By the time the case came before an appeal 

court, the police had dropped the 

mischief charge. And the owner was appealing 

his conviction of “assault police” 

– arguing the police had overstepped 

their rights. 

The court looked at what went on and 

said some fundamental principles came 

into play here. These might not jump out 

at you at first glance. That’s why a good 

criminal defence lawyer is always a good 

idea if you’re facing a criminal charge. 

The defence argued that the expression “a 

man’s home is his castle” reflects a long 

standing law. The cops had broken it and

executing their duty when the physical 

push of the police officer occurred. For 

the charge of “assault police” to stick, that 

key element (of being in execution of 

their duty) was missing here, they argued. 

The prosecution responded by arguing 

that the police had implied consent 

to enter. They were pursuing a criminal 

investigation of mischief and had valid 

safety concerns as to what would happen 

if they left and the apartment door 

was shut – one of the occupants had left 

the apartment and was standing behind 

them in the hallway. 

But the court agreed with the defence 

and overturned the “police assault” conviction. 

It accepted that the long-standing 

“sanctity of home” principle came 

into play. Unless police have a warrant, 

they can generally only come into your 

home if invited (and have to leave if you 

ask them to – even if you let them in at 

first). There are some exceptions to this 

principle, but those didn’t apply here. 

This meant that the police had in fact 

trespassed here, and the defence succeeded. 

The prosecution’s implied consent 

argument also didn’t wash – that 

rule means there’s implied consent to go 

up and knock on the door of a residence 

(going through a garden gate to the front 

door to knock, say), but it doesn’t allow 

going inside.

The event includes a collaborative mural painting which 

engaged several people who are supported by Castlegar 

Mental Health and Substance Use services. A key component 

of this event is to raise awareness about mental health 

issues and provide the public with access to resources. 

Artists of the event are showcasing their therapeutic 

creative works which have contributed to their health 

and well-being. The Open House will host practitioners 

to help inform the public about accessing therapeutic 

resources and also includes performances, experiential 

practices and a panel of people with lived mental health 

experiences. Opportunities to view the works, read artist 

bios, hear people’s stories and support artists with their 

goods for sale are at the following: 

The mural installation Art Exhibit and Artist Vending 

Shop will run for two weeks from September 26 through 

October 10 at 1010 4th Street, Castlegar. Hours are

rooted in western lore, are stirring new audiences of all ages. 

In celebration of the historic anniversary, the Pioneers have 

also released their first album in eight years, 85 Years of Harmony, 

to wide acclaim. 

When Roy Rogers (then Leonard Slye) and gifted songwriters 

Bob Nolan and Tim Spencer began developing their trademark 

“Pioneer sound” in the 1930s, little did they realize they 

were launching a juggernaut that would become one of the 

most decorated and longest-lived groups in American music 

history. Since then, 47 official members have rotated through 

to keep the Pioneers’ musical campfire burning brightly. 

“We stay true to the music – so many of these songs are 

masterpieces – and audiences just get really excited,” says 

Nallie, the current leader and only the fourth “trail boss” 

in the group’s history. Another development that Rogers – 

whose storied film, TV and recording career earned him the 

sobriquet “King of the Cowboys”– might not have foreseen is 

the recent addition of his son, Dusty, into the group in 2018. 

“How many guys get to join their father’s group that their dad 

started 85 years ago?” says Rogers. “I think it’s almost unheard 

of.” 

The Pioneers are the most decorated group in western 

music, winning honours such as the Country Music Hall 

of Fame, the Western Music Association Hall of Fame, the 

National Cowboy Hall of Fame, the Texas Swing Hall of Fame, 

and the Hollywood Walk of Fame, to name a few. The group’s 

renditions of Tumbling Tumbleweeds and Cool Water have 

been inducted into the Grammy Hall of Fame, and the Smithsonian 

Institution has named the group one of America’s 

National Treasures.

September 5, 2019 at the age of 87. He was born in 

Yahk, BC in 1932. He worked for BC Forestry for many

Herb’s knowledge of and passion for horses has touched 

many people. He enjoyed backcountry riding, giving sleigh

to learn anything about horses. He was involved in many

1130 that the Council of the Village of Kaslo will consider a 

resolution to approve a Temporary Use Permit TUP-01-2019 

at its meeting on Tuesday, October 8, 2019 in Council 

Chambers at Kaslo City Hall, 413 4th Street in the Village of
