THE KOSOVO WAR: WARTIMESEXUAL VIOLENCEJURISPRUDENCE AND STATEACTION TOWARD RECOVERYIlana DuchanABSTRACTThe Kosovo War (February 1998?June 1999) was a brutal conflict characterized by the strategic implementation of sexualviolence as a weapon of war against ethnic Albanian Kosovars. Over 20 years later, Kosovo?s more than 20,000 survivorsof weaponized rape are dealing with the far-reaching effects of such trauma. This paper provides a legal and historicalanalysis of the Kosovo War, with a focus on how the codification of rape as a weapon of war both fits within aninternational legal framework and provides a novel conception of human rights. It explores the jurisprudence surroundingthe illegality of such egregious human rights violations and then discusses how Kosovo under the leadership of formerPresident Atifete Jahjaga offers one promising model of how to support and rehabilitate victims of wartime sexualviolence.Brown Undergraduate Law Review7
