Dear Friends,<br />

This letter is usually the one that reflects on the prior year and looks ahead to the<br />

excitement of what lies before us in the New Year to come. Again, this letter will reflect,<br />

but the reflection will be about one of the most amazing people I have ever known, my<br />

mother, Elisabeth “Libby” Jones Grueninger.<br />

It is with great sadness that I’m announcing the passing of my beloved mother, Libby, on<br />

December 4, 2020 at the age of 88 after a brief illness.<br />

Rhine Falls, Switzerland<br />

I was so fortunate to see my mom nearly every day of her life until recently. As my Mom,<br />

she was always there for me. But then, I had the luxury of seeing her every day as we<br />

worked together for almost 25 years. I don’t recall a day going by without seeing her face.<br />

If I missed her at work, then we found ourselves discussing travel over dinner at their<br />

house or mine, only a trip could give this exception. I have been more fortunate than most<br />

to have had both a personal and business relationship with my mother and my father,<br />

Othmar, until they retired in 2016.<br />

Libby and Othmar were true visionaries; they revolutionized travel from the Hoosier state<br />

of Indiana. As Othmar was the face of the company, Libby tirelessly directed behind the<br />

scenes to ensure every trip exceeded every guest’s expectations. For the next 64 years, side<br />

by side, they brought the world to many Hoosiers both personally and professionally.<br />

Paris, France<br />

Libby met her husband, Othmar, on his very first European tour of which he coordinated<br />

for fellow students at DePauw University back in 1954. That tour ignited their love for each<br />

other, their passion for travel and their lifelong pursuit of exploring the world together. As<br />

a couple, they founded Grueninger Travel Service, pioneering the global travel business<br />

from Indianapolis. Their innovation transformed the business through specialization<br />

in group tours, cruises and adventure excursions. Year after year, Libby and Othmar’s<br />

dedication fueled the company’s growth and expansion.<br />

Under Libby and Othmar’s vision and leadership, they successfully lead 6-10 week long<br />

European tours. Their continued desire to fulfill travel dreams led to the creation of 12<br />

branch offices in Indiana and 3 in Massachusetts. This same desire drove a diversified<br />

expansion of product. To best exceed expectations in journeys to the Canadian Rockies<br />

and the 1967 World Expo, they took on ownership of 3 Pullman train cars. From train cars<br />

to privately owned motorcoaches for motorcoach tours, they also incorporated student<br />

travel, student performance travel and charters, both off season air to Spain and cruises<br />

on the Great lakes. Immersive experiences didn’t end there. Whether it be the beautiful<br />

Black Forest & Switzerland, (Othmar’s native home) or unveiling the mysteries of India,<br />

South Africa and China, Libby and Othmar mapped a way to share the world. Their one<br />

last expansion found them investing in the travel dreams of Ambassadair Travel Club<br />

members, which is still going strong today!<br />

For over 25 years, Libby’s devotion to music and theatre focused her attentions on<br />

New York City theatre tours. Mastering the art of picking the perfect show, the perfect<br />

restaurant and sharing her interest and insight in Broadway created unparalleled<br />

experiences by the many who travelled with Libby every year.<br />

In the early 1960’s Libby and Othmar’s keen eye recognized growing interest in ski<br />

equipment and European imports. Once again, seeking to fulfill a customer need, they<br />

founded a ski and import store, the Alpine Haus in Broad Ripple. Then in 1975, Libby not<br />

venturing far from her love of theatre, owned and operated the landmark Carmel Theatre<br />

in Carmel for nearly a decade after taking over proprietorship from her father, Harry.<br />

In addition to travel and theatre, Libby’s lifelong passion and talent was painting. Her<br />

watercolor paintings could be found on display in regional exhibitions. She was a member<br />

of the prestigious Indiana Artists Club, the Watercolor Society and the Hoosier Salon.<br />

She was often inspired by her journeys including Italy, Greece and Germany where she<br />

discovered her favorite subjects to paint, landscapes and floral scenes. The extraordinary<br />

artistry displayed in her depiction of the Bass Harbor Head Lighthouse in Arcadia National<br />

Park in Maine, graces this magazine cover, as well as hangs in the dining room of my<br />

home. My sisters, Christie and Heidi, and I are so lucky to have many of Mom’s paintings<br />

so we can feel her talent and love around us at all times.<br />

Mediterranean Cruise<br />

Libby, importantly referred to as GG, by her ten grandchildren, was an unbelievable<br />

grandmother. She would be the first to call and congratulate a success while beaming with<br />

joy in all the details. Your stomach was never empty if you stopped to see her – always<br />

something offered, on a beautiful platter she found on one of her many travels. She<br />

believed that travel and experiences were an extremely important part of a fulfilled life.<br />

Whether it was baking, taking a trip to the zoo or working in the garden, GG’s desire was to<br />

spend her most valuable gift, her time, with each grandchild. She created memories that<br />

will never fade nor be forgotten.<br />

Beyond the loss of my mother, it is an understatement to say that 2020 was a difficult year.<br />

The world has been turned upside down by a pandemic that changed everything about<br />

the lives we knew and how we live them. The travel industry as a whole has been dealt a<br />

significant blow, but through resiliency, it is holding strong and on the road to recovery.<br />

We were thrilled to have resilient guests travel with us on a number of trips during the last<br />

three months of 2020. We worked diligently to keep them safe on these adventures while<br />

they managed to escape into great times and experiences.<br />

As we settle into <strong>2021</strong>, we look promisingly to the future. Ambassadair is excited to be<br />

Broadway show, try something at least once even if you don’t do it again, give table scraps<br />

to the dogs, squeeze as much into a day as possible, enjoy every form of art and of course,<br />

For Grueninger Cruises and Tours, Inc., (d/b/a Ambassadair, Grueninger<br />

Music Tours, Ambassadair Groups and Incentives, Grueninger Tours,<br />

Grueninger Travel Group, Amber Travel) (collectively “Grueninger”)<br />

By registering for a trip and/or making a payment for the trip,<br />

you, as the Traveler or Parent/Legal Guardian of Traveler (the<br />

“Traveler”, “You”), hereby accept the following Terms and Conditions<br />

and agree to be bound by them. You represent that you are 18<br />

years of age or older. Grueninger Cruises and Tours, Inc., d/b/a<br />

Ambassadair, Grueninger Music Tours, Ambassadair Groups and<br />

Incentives, Grueninger Tours, Grueninger Travel Group, Amber<br />

Travel (“Grueninger”) provides you the detailed travel plans per the<br />

trip pages on our website, ambassadair.com, conditioned on your<br />

acceptance, without modification of the terms, conditions and notices<br />

contained herein. Traveler acknowledges and agrees that Grueninger<br />

may change these General Terms and Conditions at any time and those<br />

changes become effective immediately. Grueninger is not responsible<br />

for any traveler’s unawareness of the General Terms and Conditions.<br />

Traveler agrees to be bound by the General Terms and Conditions that<br />

are in effect at the time of travel or by cancellation.<br />

PRICE Prices are in U.S. dollars and are based on operating costs,<br />

fuel prices, taxes, and exchange rates at the time of contracting with<br />

vendor partners. Should these increase, you may be notified and<br />

asked to pay these additional costs. All prices are subject to change<br />

without notice. Prices listed in this publication are per person based on<br />

two people sharing a room (double occupancy) or one person (single<br />

occupancy). For triple, child, and other pricing, refer to our website or<br />

contact a Grueninger Travel Counselor. Room occupancy limits vary<br />

among hotel properties and/or destinations. Triple rooms are based<br />

on three people sharing two beds; rollaway beds are not included in<br />

the price. Package prices do not include any fees or service charges<br />

The “Package with Air” price includes round trip economy class airfare<br />

from Indianapolis (unless otherwise noted), all accommodations,<br />

airport transfers or motorcoach transportation, sightseeing and<br />

admissions, meals, hotel baggage handling (one suitcase per person),<br />

and gratuities as noted in the itinerary. All airfare and departure taxes<br />

are included unless this is not allowed by the country to be visited. If<br />

there is an increase you will be notified prior to departure. “Land Only”<br />

prices can be found online at ambassadair.com and do not include air<br />

travel, airline fees, airport or departure taxes, or transfers.<br />

Cruise pricing includes all inclusions per the trip page at ambassadair.<br />

com and all taxes and fees at the time of print. Complete pricing may<br />

be found at show tool bar or by calling a Grueninger Travel Counselor.<br />

We reserve the right to re-invoice you in case an error is made in<br />

computing your price. We cannot be responsible for typographical<br />

errors, misprints, and misquotes.<br />

We are not responsible for travel arrangements you have made on<br />

your own. Grueninger reserves the right to cancel or re-schedule any<br />

trip departure. Grueninger’s only liability will be to refund to the<br />

traveler the amount it has received for the “Land Only” reservation<br />

(less any applicable fees). Any air tickets or other travel arrangements<br />

purchased outside of the trip package purchased from Grueninger<br />

will not be the liability of Grueninger in the case of trip cancellation or<br />

schedule change.<br />

PRICE EXCLUSIONS Package prices do not include any items other<br />

than those listed in the trip itinerary. Visas, passport fees, incidental<br />

charges (snacks, laundry, phone calls, internet access, etc.), beverages,<br />

meals not mentioned, medical testing, immunizations, inoculations,<br />

a travel protection plan, items of a personal nature and gratuities<br />

for your travel director, motorcoach driver, hotel staff, cruise ship<br />

staff or other service provider are not included. Airline fees such as<br />

checked and/or excess baggage or seat selections and /or upgrades<br />

are not included. The price does not cover costs and travel expenses<br />

if you leave the trip whether of your own volition, our decision<br />

based on behavior that disrupts the trip, due to illness, action by any<br />

government or other reason. This list is illustrative and not a complete<br />

list of every item not included.<br />

RESERVATIONS & PAYMENT Based on the price of the trip, a<br />

per person deposit of $150 or greater is required to confirm your<br />

reservation. Upon confirmation of reservation, balance of payment<br />

is due 60 to 90 days prior to departure date, or earlier if specified.<br />

Deposit amounts, final payment dates and cancellation dates and<br />

fees vary by trip, and details can be found on the specific trip page at<br />

ambassadair.com. For reservations made within the final payment<br />

date, full payment is due immediately; a deposit or full payment may<br />

be taken if you are placed on a waitlist. All personal checks should be<br />

made payable to Ambassadair or Grueninger Travel Group. We also<br />

accept MasterCard, Visa, and Discover. Grueninger reserves the right to<br />

cancel any reservation and impose cancellation fees if any payment Is<br />

not received per the payment schedule found on the specific trip page<br />

at ambassadair.com.<br />

CANCELLATION & REFUND You have the right to cancel your<br />

reservation and receive a full refund, less a per person cancellation<br />

fee if applicable, any time prior to final payment. Trip cancellation<br />

fees and final payment dates vary by trip, and details can be found<br />

on the specific trip page at ambassadair.com. Travelers who cancel<br />

after final payment will forfeit the total amount of the reservation,<br />

unless otherwise stated on the trip page. All refunds will be processed<br />

according to the manner in which you paid. Unless stated otherwise in<br />

these terms and conditions, please allow thirty (30) days for refunds to<br />

be processed. Grueninger reserves the right to cancel any reservation<br />

and impose cancellation fees if any payment is not received per the<br />

payment schedule found on the specific trip page at ambassadair.com.<br />

To avoid cancellation fees, we recommend optional travel protection<br />

or Cancellation Waiver.<br />

TRAVEL PROTECTION/CANCELLATION WAIVER Grueninger strongly<br />

recommends that travelers purchase a travel protection plan. Travel<br />

protection safeguards your travel investment, your belongings, and<br />

most importantly, you. Your travel protection plan should cover at<br />

a minimum, cancellation, curtailment, medical, emergency travel<br />

and personal accidents, and damage or loss to personal belongings.<br />

Travel protection with Cancel for Any Reason coverage is available<br />

and Grueninger recommends you research this coverage prior to<br />

purchasing travel protection.<br />

Grueninger is not qualified to answer technical questions about<br />

the benefits, exclusions, and conditions of travel protection plans.<br />

Grueninger cannot evaluate the adequacy of the prospective insured’s<br />

existing insurance coverage. If you have any questions about your<br />

travel protection, call the travel protection company directly.<br />

Declining travel protection plan coverage could result in the loss of<br />

your travel cost and/or require more money to correct the situation.<br />

You also acknowledge that without this coverage, there may be no<br />

way to recoup any losses, costs or expenses incurred. If a traveler<br />

chooses to travel without adequate travel protection, Grueninger will<br />

not be liable for any of your losses howsoever arising, which would<br />

have been covered by adequate travel protection.<br />

For trips that travel protection is not offered including charter flights<br />

and motorcoach day trips, Cancellation Waiver may be offered. This<br />

covers any cancellation fees incurred by changes or cancellation up<br />

to 48 hours prior to departure of air and/or ground components. It<br />

does not cover the Cancellation Waiver premium, non-refundable<br />

optional tours, one-way travel, or voluntary changes made to your<br />

plans that result in a price increase. The Cancellation Waiver may only<br />

be purchased at the time of booking and deposit and is valid for new<br />

bookings only on selected trips per the trip page on ambassadair.<br />

com. If the Cancellation Waiver is desired, it must be purchased by<br />

each paying passenger on the reservation and each person sharing<br />

accommodations.<br />

CHANGES Any changes you make regarding your reservation are<br />

subject to a per person change fee plus any applicable cancellation<br />

charges or increases in the package price.<br />

ITINERARIES Grueninger continually strives to improve travel<br />

itineraries. If such improvements can be made, we reserve the right<br />

to vary itineraries and to substitute accommodations. Grueninger<br />

strives to operate trips as advertised, but if unforeseen circumstances<br />

beyond our control make changes necessary, we will make every effort<br />

to substitute accommodations, sightseeing or other inclusions with<br />

options of a similar standard and location whenever possible.<br />

CANCELLATION BY GRUENINGER Grueninger reserves the right<br />

to cancel any trip at its sole discretion. In the unlikely event a trip is<br />

canceled by Grueninger and Grueninger is unable to reschedule, all<br />

funds collected from any traveler will be refunded in full. Money is<br />

refunded to the original payer. Grueninger shall not be responsible for<br />

any refund and will pay no damages in the event of cancellation due<br />

to Force Majeure.<br />

FORCE MAJEURE Grueninger shall not be responsible for, and<br />

shall make no refund for, events beyond its control, such as,<br />

without limitation, acts of God, strikes, acts of war, terrorism or<br />

civil disturbance, government restrictions, changes of schedules or<br />

operational decisions of air carriers, terrorist activity or the threat<br />

thereof, industrial action, natural or nuclear activity, epidemic and/<br />

or pandemic or the threat thereof, illness, physical injury, quarantine,<br />

medical or customs or immigration regulation, delay, or cancellation,<br />

adverse weather conditions, fire, or for acts or omission of Third Parties<br />

or other parties not under the control of Grueninger and all similar<br />

events outside our control.<br />

TRIP DOCUMENTS Final documents will be issued electronically or by<br />

mail approximately 10-14 days prior to departure. Documents will not<br />

be delivered without full payment on a reservation.<br />

Grueninger issues airline tickets, hotel confirmations and other<br />

travel documents for such services as an agent for the companies<br />

that provided these services directly. Group airline tickets and group<br />

hotel accommodations are subject to all terms and conditions of the<br />

respective vendor partners (airlines, hotel chains, etc.) regarding<br />

group travel. These vendor partners may limit or exclude the accrual<br />

of frequent flyer or reward program points. It is the traveler’s sole<br />

responsibility to review these documents for accuracy. Grueninger will<br />

not be liable for inaccuracies in any travel documents.<br />

DESTINATIONS AND REQUIRED TRAVEL DOCUMENTS Obtaining<br />

and carrying the appropriate travel documentation is the sole<br />

responsibility of the traveler. Grueninger bears no responsibility for<br />

such information and will not be responsible for advising and/or<br />

obtaining required travel documentation for any guests, or for any<br />

delays, damages and/or losses including missed portions of the trip<br />

due to improper documentation. Prior to planning a trip, travelers<br />

should always visit http://www.travel.state.gov and look at the<br />

specific destination information and current requirements.<br />

Travel to and from certain destinations may involve greater risk than<br />

others. Grueninger urges traveler to remain informed on a daily basis<br />

as to current news events, as well as to review travel prohibitions,<br />

warnings, announcements and advisories issued by the United States<br />

Government prior to booking travel to international destinations.<br />

Information on conditions in various countries and the level of risk<br />

associated with travel to particular international destinations can<br />

be found at http://www.travel.state.gov. In addition, Traveler<br />

should consult with government websites to ensure that you are in<br />

compliance with all requirements for admittance into that country as<br />

well as understanding local laws that govern travel within a country.<br />

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS,<br />

GRUENINGER DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO<br />

SUCH POINTS IS ADVISABLE OR WITHOUT RISK. SHOULD TRAVELER<br />

CHOOSE TO TRAVEL TO A COUNTRY THAT HAS BEEN ISSUED A TRAVEL<br />

WARNING OR ADVISORY, INCLUDING COVID WARNINGS, GRUENINGER<br />

SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT<br />

MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. TRAVELER’S<br />

PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT<br />

TRAVELER’S OWN RISK.<br />

In the case of international travel, traveler and any minors traveling<br />

with traveler must be in possession of a machine-readable passport<br />

valid for 6 months after their trip return date along with applicable<br />

visas. Some countries require that traveler passport have two to<br />

four blank visa/stamp pages. Some airlines will not allow traveler to<br />

board if this requirement is not met. For information about passport<br />

requirements, traveler can visit the State Department’s website<br />

at https://travel.state.gov/content/travel/en/passports.html. It is<br />

traveler’s sole responsibility to secure and/or pay for any and all visas,<br />

reciprocity fees, affidavits, immunizations, inoculations, vaccinations,<br />

medical testing or other Items that are required to be permitted entry<br />

into each destination. In some countries traveler may be subject to<br />

entry (reciprocity) fees and/or departure taxes/ exit fees which will be<br />

collected at the airports upon entry/departure by local government<br />

authorities. Please note that entry to any country may be refused even<br />

if the required information and travel documents are complete.<br />

Some countries require visas to enter. Without a valid visa, traveler<br />

may be denied entry into the country. Traveler can find out if a visa<br />

is required by visiting the embassy website of the country traveler<br />

will be traveling to. Although traveler can always contact Grueninger<br />

with questions, it is traveler’s responsibility to ensure traveler has all<br />

the proper travel documents, to include traveler visa(s). Grueninger<br />

is happy to refer to traveler a third-party visa processing company if<br />

traveler so desires.<br />

Children traveling with one parent, or someone who is not a parent/<br />

legal guardian, or children traveling in a group may require additional<br />

travel documentation. Foreign border officials may require custody<br />

documents or written consent from the other parent/both parents.<br />

Requirements vary by country; visit website at https://travel.state.gov/<br />

for detailed information. It is the traveler’s responsibility to understand<br />

all requirements and have the appropriate documentation.<br />

When travelling domestically or internationally, the U.S.<br />

Transportation Security Administration (TSA) and U.S. Department<br />

of Homeland Security (DHS) advise that everyone carry at least two<br />

forms of acceptable identification in order to board a flight. Examples<br />

include but are not limited to REAL I.D., DHS designated enhanced<br />

driver’s license, US Passport or a foreign government passport. The<br />

name, date of birth and gender that appears on the identification<br />

card must exactly match the same such data that is listed on airline<br />

ticket(s) and booking records. For more information, traveler can visit<br />

the TSA website at https://www.tsa.gov/travel/security-screening/<br />

identification.<br />

Obtaining and carrying the appropriate travel documentation is the<br />

sole responsibility of the traveler. Grueninger bears no responsibility<br />

for such information and will not be responsible for advising and/or<br />

obtaining required travel documentation for any guests, or for any<br />

delays, damages and/or losses including missed portions of the trip<br />

due to improper documentation.<br />

Recommended immunizations, inoculations and medical testing<br />

for travel may change and traveler should consult their provider<br />

traveler’s responsibility to ensure that traveler meets all health entry<br />

requirements, obtain the recommended immunizations, inoculations,<br />

and medical testing, take all recommended medication, and follow all<br />

medical advice in relation to traveler’s trip. Some locations may require<br />

you to have a vaccination or proof of specific medical testing. Traveler<br />

must be aware of restrictions and have all appropriate documentation<br />

for any stopover destinations. On return home, there may be<br />

additional requirements. Traveler is responsible for understanding<br />

all of these requirements and must not rely on Grueninger to provide<br />

of State website https://www.travel.state.gov/.<br />

BAGGAGE ALLOWANCE & LIABILITY Baggage allowance and<br />

fees vary and are not covered in the cost of the trip. For specific<br />

allowances and fees, see specific airlines or cruise lines and refer to<br />

Grueninger’s documents, issued approximately 10-14 days before the<br />

trip. Questions regarding baggage restrictions on commercial carriers<br />

should be directed to that particular airline or cruise line.<br />

Although every effort is made to handle traveler’s luggage as carefully<br />

as possible, Grueninger is not responsible for and does not assume<br />

liability or accept claims for loss of or damage to luggage due to<br />

breakage, theft or tear through handling by various vendor partners.<br />

It is recommended for your own self-interest and protection that you<br />

have adequate insurance to cover these eventualities.<br />

AIR CARRIERS All trips are via commercial air carriers unless otherwise<br />

noted. Grueninger acts as a sales agent for air carriers and reserves the<br />

right to designate any air carrier, including commuters and charter<br />

services, connecting routing and schedule. Tickets issued are highly<br />

restrictive and may not be reissued, revalidated, or exchanged for<br />

another carrier or routing.<br />

AIR SCHEDULE Flight schedules are confirmed by Grueninger as<br />

early as 60 days prior to departure date. A tentative flight schedule<br />

may be given. You will receive your air schedule with your final<br />

documents approximately 10-14 days prior to departure. However,<br />

these schedules and air carriers are subject to change without notice<br />

prior to departure.<br />

SEAT AND ROOM ASSIGNMENTS Airline seating and hotel room type<br />

requests made at the time of booking will be considered; however,<br />

these are requests, not guarantees. Although your preferences are<br />

forwarded to our vendor partners, they cannot always honor these<br />

requests and pricing does not include assigned, purchased or upgraded<br />

seats or room types.<br />

TRAVEL DIRECTORS All departures designated as “Escorted” and with<br />

20 travelers or more will have a Grueninger Travel Director throughout<br />

the trip.<br />

ACTIVITY LEVEL The amount of activity varies according to the trip.<br />

In general, European destinations require more walking over uneven<br />

surfaces. Please call a Grueninger Travel Counselor who can answer<br />

questions regarding the activity level per trip. By taking part in such<br />

activities, you incur and assume all of the risks that such activities<br />

present. Grueninger is not qualified to evaluate your fitness; you must<br />

evaluate your fitness for any given trip or activity. Grueninger assumes<br />

no liability or responsibility for any damages which may result from<br />

your participation in any activity during the trip.<br />

TRAVELERS NEEDING SPECIAL ASSISTANCE Travelers needing<br />

special assistance are welcome and must always be accompanied by<br />

a companion capable of providing all required and needed assistance<br />

and must not require assistance from Grueninger or its vendor<br />

partners. The traveler must notify Grueninger of any special assistance<br />

needed, in writing no later than the payment of the first deposit, and<br />

of status and identity of the non-discounted, paid travel companion<br />

who will be responsible for providing all necessary assistance. The<br />

traveler should notify Grueninger if ADA accessible accommodations<br />

and/or transportation are needed as soon as possible but no later than<br />

the payment of the first deposit. Grueninger will make all reasonable<br />

efforts to accommodate this request, but cannot be responsible if<br />

ADA transportation and/or accommodations are not available. Any<br />

accommodations provided will be at the sole expense of the traveler.<br />

Neither Grueninger nor its vendor partners may physically lift or assist<br />

traveler into transportation vehicles. Any traveler that uses oxygen<br />

must work with the airline or other vendor partners directly to obtain<br />

approval.<br />

SPECIAL DIETARY REQUIREMENTS Grueninger, its representatives<br />

and its vendor partners will do their best to accommodate<br />

special dietary requests. However, for safety and liability reasons,<br />

Grueninger and its representatives cannot be responsible for<br />

directly accommodating any food allergies, or dietary requirements<br />

and restrictions, and is not responsible for any issues or problems<br />

associated with the same. All scenarios and special dietary requests<br />

regarding food and drink, including allergies, or dietary requirements<br />

and restrictions, are the sole responsibility of the traveler. While most<br />

meal establishments can offer general options, Grueninger cannot<br />

guarantee that options will be available. Just in case, Grueninger<br />

recommends packing extra food/snacks if accommodations cannot<br />

be met.<br />

HEALTH AND SAFETY For the safety of our travelers, Grueninger<br />

reserves the right to request health information prior to travel and to<br />

exclude any travelers it deems unfit for travel at its sole discretion.<br />

PERSONAL CONDUCT Grueninger and its vendor partners reserve the<br />

right in its or their sole discretion to terminate any traveler who does<br />

not abide by its or their rules and regulations, and/or whose conduct<br />

is deemed to be such as to endanger the traveler, the welfare of other<br />

travelers, staff members and/or third parties or the success of the<br />

program. In the event of such termination, traveler will be required<br />

to leave the trip at the expense of the traveler. In the event of such<br />

termination, there will be no refund whatsoever.<br />

When you book with Grueninger, traveler accepts responsibility for<br />

any damage or loss caused by traveler. Full payment for any such<br />

damage or loss (reasonably estimated if not precisely known) must be<br />

paid directly at the time to the accommodation owner or manager or<br />

other supplier. Traveler must indemnify Grueninger for the full amount<br />

of any claim (also including legal costs) made against Grueninger.<br />

Traveler agrees to and shall indemnify and hold harmless Grueninger<br />

and each of our officers, directors, employees and agents, from<br />

any expenses, losses, liabilities, damages, judgments, settlements<br />

and costs (collectively, “damages”) involved with or incurred by<br />

Grueninger (including, without limitation, reasonable attorneys’<br />

fees and the advancement of same) with respect to any claims, law<br />

suits, arbitrations, or other causes of action, which result, directly or<br />

indirectly, from any traveler’s breach or violation, or threatened breach<br />

or violation, of this Agreement.<br />

PHOTOGRAPHY ON TOUR Unless an opt-out waiver is requested, all<br />

travelers assign permission to Grueninger, and its photographer(s), to<br />

use the images in any media for any purpose (except pornographic,<br />

defamatory, libelous or otherwise unlawful) which may include,<br />

among others, advertising, promotion, marketing and packaging for<br />

any product or service. Images may be combined with other images,<br />

text and graphics, and cropped, altered or modified. All paid and<br />

complimentary travelers acknowledge and agree with consent to<br />

publication. Traveler’s retention of tickets, reservations, or bookings<br />

after issuance shall constitute consent to the above, as well as an<br />

agreement on traveler’s part to convey the contents hereof to his or<br />

her travel companions or group members.<br />

VENDOR PARTNERS’ LIABILITIES Grueninger makes arrangements<br />

with air carriers, hotels, cruise lines, car rental companies, and other<br />

independent parties to provide you with travel services you purchase.<br />

These services are subject to the conditions imposed by these vendor<br />

partners, and their liability may be limited by their tariffs, conditions of<br />

carriage, and international agreements.<br />

RESPONSIBILITY CLAUSE Grueninger Cruises and Tours, Inc.,<br />

(d/b/a Ambassadair, Grueninger Music Tours, Ambassadair Groups<br />

and Incentives, Grueninger Tours, Grueninger Travel Group, Amber<br />

Travel) its employees, shareholders, subsidiaries, affiliates, officers<br />

and directors, (collectively “Grueninger”) does not own or operate<br />

any person or entity which is to or does provide goods or services for<br />

traveler’s trip, including, for example, lodging facilities, transportation<br />

companies, local ground handlers, food service or entertainment<br />

providers, etc. All tickets, receipts, coupons, and vouchers are issued<br />

subject to the terms and conditions specified by each vendor partner,<br />

and by accepting the coupons, vouchers, and tickets, or utilizing<br />

the services, all customers agree that neither Grueninger, nor its<br />

employees, agents, or representatives are or may be liable for any loss,<br />

injury, or damage to any traveler or their belongings, or otherwise, in<br />

connection with any service supplied or not supplied resulting directly<br />

or indirectly from any occurrence beyond the control of Grueninger.<br />

Grueninger is not liable for any negligent or willful act or failure to act<br />

of any such person or entity, or of any act of any other third party not<br />

under its control. Grueninger in its sole discretion reserve the right to<br />

decline to accept any traveler as a member of these trips.<br />

Without limiting the foregoing, Grueninger is not responsible for<br />

injury, delay, inconvenience, damage, or death which results from<br />

criminal activity, weather or other acts of God, acts of government,<br />

disease, epidemics and/or pandemics or the threat thereof, illness,<br />

the provision of inappropriate or no medical attention or delayed<br />

access to appropriate medical attention, the demands of indoor<br />

or outdoor activities, strikes, political or civil unrest, overbooking,<br />

structural or other defective conditions in hotels or other lodging<br />

facilities, acts of terrorism or the threat thereof, attacks from or bites<br />

by animals, insects or pests, transportation failures of any kind or the<br />

failure of any transportation mechanism to arrive or depart timely<br />

or safely, insurrection or revolt, or any other event beyond its direct<br />

control. Additionally, both the U.S. State Department and the Centers<br />

for Disease Control publish and update important country-specific<br />

information for travelers. Grueninger strongly recommends that all<br />

travelers review these notices currently located at https://travel.state.<br />

gov/content/passports/en/alertswarnings.html and https://www.cdc.<br />

gov/travel/notices.<br />

No refunds will be made for features on the trip not utilized. The<br />

cost of replacing lost or stolen coupons, vouchers or tickets is the<br />

responsibility of the traveler. If a flight or transfer by other means<br />

of transportation is missed, whether by weather or other conditions<br />

beyond Grueninger’s control, traveler is responsible to make his or<br />

her own arrangements and to pay all charges associated therewith.<br />

Grueninger may cancel any trip because of insufficient enrollment or<br />

for any other reason. The terms set forth in this agreement constitute<br />

the entire agreement between the traveler and Grueninger.<br />

ADDITIONAL RISK Traveler expressly acknowledges that naturally<br />

occurring diseases and viruses (including, but not limited to, the<br />

currently widespread COVID-19) may be present and actively<br />

occurring in all environments in which this trip will take place.<br />

Traveler acknowledges the novel coronavirus, COVID-19, has been<br />

declared a worldwide pandemic by the World Health Organization.<br />

COVID-19 is extremely contagious and is believed to spread mainly<br />

from person-to-person contact (however the exact method of<br />

spread remains unknown). Traveler also understands that if they<br />

are older or have underlying conditions, the traveler may be more<br />

prone to serious infection and death due to COVID-19. As a result of<br />

the highly infectious nature of this disease, federal, state, and local<br />

governments and federal and state health agencies recommend social<br />

distancing, wearing of PPE (including masks), and have, in many<br />

locations, prohibited the congregation of groups of people. Grueninger<br />

may require the completion of a waiver(s) stating that the traveler<br />

understands and accepts the risk of traveling in such environments.<br />

Traveler, any minors traveling with traveler, and on behalf of any<br />

traveler and their heirs, assigns, personal representatives and next of<br />

kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Grueninger<br />

Cruises and Tours, Inc., (d/b/a Ambassadair, Grueninger Music Tours,<br />

Ambassadair Groups and Incentives, Grueninger Tours, Grueninger<br />

Travel Group, Amber Travel), its officers, agents, and/or employees,<br />

vendor partners, and other travelers (RELEASEES), from any and<br />

all claims, demands, losses, and liability arising out of or related to<br />

any INJURY, DISABILITY, DEATH OR ANY OTHER LOSS traveler may<br />

suffer due to exposure, infection, or spread of COVID- 19 or any other<br />

naturally occurring disease and virus, WHETHER ARISING FROM THE<br />

NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent<br />

permitted by law.<br />

Traveler assumes all inherent risks involved in the use of any exercise<br />

equipment and/or swimming pool and/or any other body of water,<br />

which risks include, but are not limited to bodily injury, sickness,<br />

disease or death from using the exercise equipment, swimming pool<br />

or body of water. Travelers also acknowledge and understand that use<br />

of any exercise equipment, swimming pool or other body of water is<br />

potentially dangerous and that there exists a risk of injury or death<br />

when using any equipment, swimming pool or any other body of<br />

water. TRAVELER UNDERSTANDS THERE WILL BE NO LIFEGUARD ON<br />

DUTY AND IF THE TRAVELER CHOOSES TO SWIM OR USE A HOT TUB OR<br />

SPA, TRAVELER WILL DO SO AT THEIR OWN RISK.<br />

Additional risks and dangers may arise including, but not limited<br />

to, hazards of travel by train, automobile, motorcoach, aircraft and<br />

other means of conveyance, animal interactions, swimming, forces<br />

of nature, political unrest, other unrest, risks associated with water,<br />

food, plants, insects and differing animal regulation, and acts of<br />

national and local governments and unrest and acts of others against<br />

governments. These risks are not an exhaustive list but are examples<br />

of many kinds of risks. Traveler is voluntarily participating in these<br />

activities with the knowledge that there are significant dangers<br />

involved, and traveler hereby agrees to accept any and all risks. As<br />

lawful consideration for the agreement with Grueninger to participate<br />

in such trips and activities traveler agrees traveler will not make a<br />

claim against Grueninger, its related companies or its personnel or sue<br />

for bodily injury, emotional trauma, death, property loss or damage<br />

or other loss, cost or expense, however caused, as a result of or related<br />

to traveler contracting for, traveling to or from, or in any and every<br />

other way participating in the trip. Traveler releases Grueninger, its<br />

related companies and its personnel from any and all claims, known<br />

or unknown, arising from contracting for, traveling to or from, and<br />

in any and every way participating in a trip. This release of liability<br />

and assumption of risk agreement is entered into on behalf of you<br />

and all members of your family and party, also including minors. This<br />

agreement also binds your heirs, legal representatives and assigns.<br />

Where the traveler occupies a motorcoach seat fitted with a safety<br />

belt, neither Grueninger nor the Operator nor its agents or cooperating<br />

organizations or service providers will be liable for any<br />

injury, illness or death or for any loss or damages or claims whatsoever<br />

arising from any accident or incident, if the safety belt is not being<br />

worn at the time of such an accident or incident. This exclusion and<br />

limitation of liability shall not be used to imply that the Operator or its<br />

agents or affiliated entities are liable in other circumstances.<br />

ERRORS AND OMMISSIONS While every effort is made to ensure<br />

the accuracy of information in our brochures, on our websites or<br />

communicated by our staff, errors and omissions are possible and<br />

Grueninger is not responsible for such error. If a mistake is made in<br />

price and/or inclusion quoting or billing, we reserve the right to correct<br />

the invoice and you will be responsible for proper payment.<br />

SEVERABILITY If any provision of these terms and conditions shall be<br />

held unenforceable, such provision shall be struck and the remainder<br />

shall remain enforceable.<br />

CHOICE OF LAW This agreement is governed in all respects by<br />

the laws of the state of Indiana without regard to conflicts of law<br />

principles. All traveler claims must be submitted in writing and<br />

received by Grueninger no later than sixty (60) days after the<br />

completion of the Grueninger trip. Traveler claims not submitted and<br />

received within this time shall be deemed waived and barred.<br />
