Okowa of Delta has<br />
said that the new University of<br />
Science and Technology, Ozoro,<br />
would take off <strong>in</strong> September.<br />
Speak<strong>in</strong>g at Ozoro on Wednesday<br />
dur<strong>in</strong>g the grand f<strong>in</strong>ale of<br />
the Peoples Democratic Party,<br />
PDP, campaign rally for Saturday's<br />
House of Assembly by<br />
election <strong>in</strong> Isoko North constituency<br />
where over 100 APC<br />
members defected to the party,<br />
Okowa expressed satisfaction<br />
with the facilities currently <strong>in</strong><br />
the <strong>in</strong>stitution.<br />
Announc<strong>in</strong>g that a Project<br />
Management Committee had<br />
been <strong>in</strong>augurated to ensure<br />
smooth take-off of the <strong>in</strong>stitution,<br />
he said "With the extent<br />
of the facilities they have, I am<br />
conv<strong>in</strong>ced that the place is<br />
ready to go fully as a University<br />
of Science and Technology.<br />
"There is no doubt that we<br />

Cape Verde: Why Africa<br />
should be worried over<br />
deta<strong>in</strong>ed diplomat<br />

On June 12, 2020, a<br />
Venezuelan diplomat,<br />
Mr Saab Moran was<br />
deta<strong>in</strong>ed <strong>in</strong> Cape Verde by<br />
Interpol over allegations of<br />
money launder<strong>in</strong>g. Saab is<br />
a Colombian national but<br />
has Venezuelan and Antiguan<br />
citizenship. He was on<br />
a mission to procure food,<br />
medical supplies and other<br />
goods for the care of Venezuelan<br />
Covid-19 pandemic<br />
but was arrested dur<strong>in</strong>g a<br />
technical stopover <strong>in</strong> Cape<br />
Verde. This was notwithstand<strong>in</strong>g<br />
the fact that there<br />
was no code red <strong>in</strong> Interpol<br />
system at the time.<br />
After Saab’s arbitrary arrest,<br />
Interpol issued an untimely<br />
arrest warrant on<br />
June 13 to justify the detention,<br />
without regard to the<br />
diplomatic immunity granted<br />
to an agent of a sovereign<br />
government under <strong>in</strong>ternational<br />
law. Worried by<br />
the action of Interpol, Venezuela<br />
us<strong>in</strong>g diplomatic<br />
channels sought the release<br />
of Saab but to no avail.<br />
Late last year, human<br />
rights lawyer, Femi Falana,<br />
SAN, filed a suit before the<br />
ECOWAS court <strong>in</strong> Abuja,<br />
Nigeria challeng<strong>in</strong>g the arbitrary<br />
arrest and detention<br />
of the diplomat and argued<br />
that as a diplomat, Saab<br />
should have enjoyed diplomatic<br />
immunity and should<br />
not be subjected to imprisonment<br />
and legal proceed<strong>in</strong>gs<br />
by Cape Verde.<br />
Deliver<strong>in</strong>g judgment on<br />
the matter on March 15,<br />
2021, the ECOWAS court<br />
described Saab’s arrest and<br />
subsequent detention as illegal<br />
and ordered Cape Verde<br />
to release him while halt<strong>in</strong>g<br />
all processes of extradition<br />
to the United States.<br />
The court also directed the<br />
Cape Verdean government<br />
to pay him $200,000 as<br />
compensation for his<br />
illegal arrest and detention<br />
and ‘discont<strong>in</strong>ue all proceed<strong>in</strong>gs<br />
and processes<br />
aimed at extradit<strong>in</strong>g the<br />
Applicant to the USA’.<br />
In a sharp contrast to the<br />
ECOWAS court order, the<br />
Cabo Verde’s Supreme<br />
Court on March 18, 2021<br />
gave an order authoriz<strong>in</strong>g<br />
the extradition of Saab to<br />
the US. The court held that<br />
Cape Verde was not legally<br />
bound by the regional<br />
court’s decisions.<br />
From all <strong>in</strong>dications, it is<br />
clear that Cape Verde is determ<strong>in</strong>ed<br />
to go aga<strong>in</strong>st all<br />
<strong>in</strong>ternationally recognized<br />
norms and treaties to extradite<br />
Saab to US. Saab maybe<br />
a Venezuelan diplomat<br />
but the greater implication<br />
of Cape Verde’s action is<br />
that any African diplomat<br />
can be arrested, deta<strong>in</strong>ed<br />
and extradited to the West<br />
without regards to diplomatic<br />
norms. The impunity<br />
displayed by Cape Verde <strong>in</strong><br />
underm<strong>in</strong><strong>in</strong>g the age long<br />
immunity of diplomats of<br />
sovereign nations should<br />
also be source of worry for<br />
all Africa nations. It is pert<strong>in</strong>ent<br />
to note that Cape Verde<br />
had earlier obeyed a rul<strong>in</strong>g<br />
of ECOWAS court order<strong>in</strong>g<br />
the relocation of<br />
Saab from detention<br />

facility to house arrest<br />
Speak<strong>in</strong>g recently with<br />
journalists on the grave implications<br />
of Cape Verde’s<br />
action, President of African<br />
Bar Association, Uwaifo<br />
Hannibal warned that<br />
unless the Cape Verdean<br />
authorities are immediately<br />
called to order and pursue<br />
the path of the Rule of<br />
Law and respect for the<br />
Vienna Convention, the<br />
ECOWAS region and the AU<br />
will soon be thrown <strong>in</strong>to a<br />
crisis of monumental proportion<br />
which may turn the<br />
sub-region and the cont<strong>in</strong>ent<br />
<strong>in</strong>to a laugh<strong>in</strong>g stock with<br />
dire consequences for the<br />
diplomatic community.<br />
He said: “The illegal behaviour<br />
of the Cape Verde<br />
Government may not only<br />
br<strong>in</strong>g ECOWAS and the AU<br />
<strong>in</strong>to disrepute, but also open<br />
the way for big countries to<br />
violate the diplomatic status<br />
of our diplomats for<br />
flimsy excuses or political<br />
convenience. This<br />
unacceptable situation may<br />
also encourage other countries<br />
with<strong>in</strong> ECOWAS and<br />
the AU to succumb to illegal<br />
pressures, violate ECOWAS<br />
Protocols and treaties and<br />
the Geneva Convention.<br />
“This <strong>in</strong> turn will lead to<br />
chaos and a total breakdown<br />
of our much-cherished<br />
cohesion as a sub-regional<br />
group. AFBA f<strong>in</strong>ds this situation<br />
embarrass<strong>in</strong>g as defenders<br />
and custodians of<br />
the rule of law and due process<br />
<strong>in</strong> the ECOWAS Region<br />
and African Cont<strong>in</strong>ent.<br />
“In defense of Africa’s<br />
much cherished non-aligned<br />
position the African Bar Association<br />
calls on the President<br />
of the African Union<br />
Commission to take<br />
immediate steps to ensure<br />
that the diplomatic privileges<br />
of African Diplomats are<br />
not put <strong>in</strong> jeopardy as Ambassador<br />
Saab am accredited<br />
Diplomat to the African<br />
Union is currently be<strong>in</strong>g deta<strong>in</strong>ed<br />
<strong>in</strong> an African Country,<br />
Cape Verde.”<br />
Also express<strong>in</strong>g worries<br />
over the implications of Cape<br />
Verde’s position, Femi Falana<br />
said Cape Verde’s behavior<br />
is unacceptable and flies<br />
<strong>in</strong> the face of its <strong>in</strong>ternational<br />
obligations as well as centuries-old<br />
<strong>in</strong>ternational law<br />
govern<strong>in</strong>g the movement of<br />
diplomats and political<br />
agents.<br />
“If Cape Verde is allowed<br />
to cont<strong>in</strong>ue down the path<br />
which it is currently travell<strong>in</strong>g<br />
the consequences for the<br />
conduct of global diplomacy<br />
will be catastrophic.”<br />
He also highlighted some<br />
clauses why the Supplementary<br />
Protocol 2005 which authorises<br />
ECOWAS Court to<br />
hear human rights cases<br />
emanat<strong>in</strong>g from member<br />
states is b<strong>in</strong>d<strong>in</strong>g on Cape<br />
Verde.
