Terms of Use
Returns, Refunds, and Exchanges
Steel & Fence Supply allows returns or exchanges so long as they meet the following requirements:
For Returns:
You must notify Steel & Fence Supply either via email or phone within 14 days of the purchase date to request a return;
Items must be in original condition;
Must have original invoice number; and
Items must not be special order or deemed custom in any way by Steel & Fence Supply.
For Exchanges:
You must notify Steel & Fence Supply either via email or phone within 30 days of purchase date to request an exchange;
Items must be in original condition;
Must have original invoice number; and
Items must not be special order or deemed custom in any way by Steel & Fence Supply.
If the request for return is deemed, by Steel & Fence Supply, to fulfill these requirements, you will be given the options of either a refund or an
exchange, so long as the materials are delivered back to Steel & Fence Supply in original condition, at the expense of you, the returnee of the
materials or items in question. If an exchange is chosen, all shipping costs associated with the delivery of the replacement items or materials
must be paid for by you. All returns for refund will be charged a 25% restocking fee, in order to cover time and materials associated with issuing
and fulfilling the refund. Under no circumstances will Steel & Fence Supply return materials or items that are special order or deemed custom
in any way by Steel & Fence Supply. For all returns, refunds, and exchanges, Steel & Fence Supply does not take title for the items or materials
until they arrive at our distribution center.
Risk of Loss
Steel & Fence Supply cannot be held liable for damages or losses occurring after items have been conveyed to the shipment provider of your
choosing. Every item purchased from Steel & Fence Supply, therefore, is delivered pursuant to a shipment contract between you and the
shipment provider. At the time of our delivery to the carrier of your choosing, risk of loss and title for each item passes to you, the purchaser.
Governing Law
By visiting Steel & Fence Supply’s website, you agree that applicable federal law and the laws of the state of California, without regards to
principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute of any sort that might arise between you and
Steel & Fence Supply.
Disputes
All disputes and/or claims that are a result, in any way, of your visitation to Steel & Fence Supplies website, or purchase of the items it sells or
the services it provides, must be instituted within one year from the date upon which such claims or cause arose or accrued and may only be
brought before the state and Federal courts located in Santa Clara County, California. In addition, you agree to submit fully to the exclusive
personal jurisdiction of such courts and hereby appoint the Secretary of the State of California as your agent for service of process. We each
agree that any claim/dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or
representative action. We each also agree to waive any right to a trial by jury. You agree to hereby waive any objection, and/or the right to raise
any future objection, that the state or Federal courts of Santa Clara County, California, are an inconvenient venue for the resolution of any
dispute or claim that arises under this Terms and Conditions.
Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent
jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and
effect and continue to be binding and enforceable.
