Well, now that it’s already<br />

Augtober now,<br />

all I want to do is put<br />

up my Fall decorations,<br />

and start sweater<br />

weather. I don’t know<br />

about you, but I am so<br />

over this heat.<br />

Can you believe we are<br />

almost already in September? It’s been a busy<br />

month for us at the Rojas household. The kids<br />

started school a couple weeks ago. I can’t believe<br />

I already have a freshman in high school and a<br />

fifth grader. Where has the time gone?<br />

My daughter will be cheering at her first football<br />

game this Friday, and my son just did his first<br />

football jamboree this past weekend. I am so<br />

proud of my kids.<br />

Another important piece of news is, that after six<br />

years of working with Bosco Company, a new<br />

Our July 20 luncheon was<br />

intended to feature our<br />

annual Recertification<br />

of the Department of<br />

Insurance Fair Claims<br />

Settlement Practices Act<br />

regulations for all claims<br />

professionals.<br />

Regrettably, our planned<br />

presenter for this year, local attorney and past<br />

MVCA Member Mike Kronlund, with Quinn &<br />

Kronlund suffered the loss of his mother just prior<br />

to the event. We offer our deepest sympathies<br />

and hope to see Mike sometime in the near future.<br />

What did come out of that was our members and<br />

guests filling the room at Dave Wong’s with the<br />

sounds of folks who were all very pleased to see<br />

each other and have an opportunity to converse.<br />

We conducted the business of the association,<br />

starting with going around the room so everyone<br />

could introduce themselves and share just<br />

This Presidents message<br />

comes as we<br />

approach the end of<br />

summer and the beginning<br />

of the next<br />

school year and I write<br />

this with a mixed emotion’s<br />

as it has been<br />

an incredibly summer<br />

personally and professionally with both high<br />

spots and low spots.<br />

From the birth of an amazing granddaughter to<br />

the passing of my mom all in the same week it<br />

allows one a moment to pause and reflect on life.<br />

On the business side our Golf Event which ended<br />

up being a scene from a movie with a fugitive<br />

on the loose and all of us having to evacuate<br />

the course for our collective safety. This in turn<br />

allowed a lot of networking to occur as we had to<br />

wait this out and in the end we ended up having<br />

an amazing day and I personally thank all of our<br />

adventure arose that I could not pass up. I am so<br />

excited to announce that I have accepted a position<br />

at Blusky, Restoration and Contractors. As much as<br />

I loved working for Bosco, and working for Richard<br />

Schaper, I am so ready for this new chapter in life.<br />

I am lucky to be working alongside some amazing<br />

people, including Diane Viodes.<br />

Who’s ready for CCNC? I know I am. I’m honored to<br />

be President again this year, and to working alongside<br />

some fabulous board members. There’s a core group<br />

of us that have been working day and night to make<br />

sure our last year in Tahoe is a memorable one. If<br />

you haven’t registered yet, you’re missing out! You<br />

Coming up for EBCA we are very pleased to have<br />

our own Vice President, John Ehlert, of JR Structural,<br />

as our featured presenter at the October 11,<br />

Earthquake and Fire Damage Related Claims. This<br />

a bit about what they do. We included a review of the June golf<br />

tournament, along with announcements for the upcoming claims<br />

conference, as well as our September MVCA Bowling tournament,<br />

and a talked about doing more with our sister organizations. We held<br />

our 50/50 raffle and door prize drawings, and then just let people chat.<br />

We had one attendee who said he specifically came for the recertification.<br />

He wound up winning the 50/50 and a door prize, and<br />

had such a great time getting to know the members better that he<br />

said rather joyously how glad he was that he came. Many of our<br />

claims professional members had actually just completed a course<br />

with their company by Zoom. I want to acknowledge and thank our<br />

members for their flexibility, their involvement, and their humanness.<br />

We do hope to bring back the recertification at some point, and we<br />

wish Mr. Kronlund and his family all the best.<br />

We are looking forward to participating in the annual Claims<br />

Conference of Northern California, and applaud the gallant efforts<br />

of all those involved in organizing this event. This will be the final<br />

year of the CCNC contract at the Palisades facility in Tahoe. The<br />

planning committee members, including reps from MVCA, has already<br />

renewed a relationship with the Hyatt Regency in Sacramento<br />

for next year’s event.<br />

September 21 marks the date for the fourth annual MVCA Bowling<br />

Tournament. Gather up your teams and let’s go!<br />

Going forward you will notice that this is the<br />

second newsletter that has information about all<br />

three associations in our region. This is due to<br />

the combined and collective effort of all three<br />

Presidents getting together and agreeing that<br />

this is the best approach for the growth and<br />

increased visibility for all of our <strong>Association</strong>s<br />

letting all our members see what is going on<br />

in our area and culminates with the annual<br />

combined Claims Conference of Northern<br />

California (CCNC).<br />

Lastly, as the old saying goes there are two<br />

things that are certain in life “death and taxes” I<br />

would ask that everyone who is taking time out<br />

of their day to read my message to either visit,<br />

pick up the phone and text or call someone that<br />

love as life is precious and we get an opportunity<br />

to live every day and we only die once. From<br />

one of my favorite songs If today was your last<br />

day the lyric goes “Each day’s a gift and not a<br />

given right”. So I ask all of you what are you<br />

going to do with your gift of life today?<br />

Ms. Ciurar has officially<br />

joined CSAA (a AAA insurer) as a<br />

Senior Field Adjuster, covering the greater<br />

Sacramento region.<br />

As a Senior Claims Examiner, Fe is able to<br />

utilize her experience as a Field Inspector<br />

and Property Claims professional handling<br />

all perils.<br />

She joined the Sacramento Claims <strong>Association</strong><br />

in 2021 and the board in 2022 while<br />

with The Hartford. She serves on the SCA<br />

Education and Social Committees, and is<br />

a representative for the SCA to the Claims<br />

Conference of Northern California’s planning<br />

committee.<br />

SCA Looks to Fill Out Year with blend<br />

of Education & Social Activities<br />

Coming out of a restful Summer, the Sacramento<br />

Claims <strong>Association</strong> has plans to<br />

fill out the balance of the year in strong<br />

fashion. First up is the SCA Family Night<br />

at the Rivercats Friday, September 15. A<br />

mostly annual event, this event has been<br />

a strong draw in past years. Coming together to cheer on<br />

the local AAA team for the Giants in September rather than<br />

the standard heat of July in the past, the planning committee<br />

set about getting a spot for the group not so directly<br />

in the late afternoon sun. This one promises to be a fun<br />

family adventure.<br />

Thursday, October 12 is the next scheduled Educational<br />

Luncheon meeting, scheduled to be held back at LionsGate<br />

Conference Center. Details are forthcoming, so stay tuned.<br />

Come November 9, the SCA is pleased to present the 3rd<br />

annual Cornhole Tournament! This popular event is slated<br />

to return to Elk Grove Park in the mid-afternoon. Gather up<br />

your partners and join us for a fun time.<br />

We will round out the year with our annual Cathrin Nevin<br />

Memorial Holiday Charitable Giving Luncheon festivities.<br />

Plans are to return to The Firehouse in Old Sac.<br />

All are invited to join in. Our association thrives with your<br />

Storm Hilary moved out of California,<br />

and the state begins the recovery<br />

process, Insurance Commissioner Ricardo<br />

Lara advised everyone <strong>August</strong><br />

21, <strong>2023</strong> to stay safe and take action<br />

necessary to prevent their property<br />

from further damage.<br />

The CDI states that if a consumer’s<br />

or business’ property is damaged due<br />

to the storm, they should file a claim<br />

with their insurance company. For<br />

insurance company or agent or broker.<br />

CDI Commissioner Lara provides Insurance Information for those<br />

affected by Tropical Storm Hilary<br />

“This once in a lifetime storm brought<br />

rainfall and wind damage, so it is<br />

crucial consumers understand their insurance<br />

coverage and know they have<br />

options and support,” said Commissioner<br />

Lara. “I have alerted insurance<br />

companies to follow California law<br />

requiring they cover any mudslide,<br />

debris flow, or other damage that is<br />

caused by our recent wildfires so that<br />

people can recover quickly.”<br />

Most homeowners’ and commercial<br />

insurance policies include wind and<br />

storm damage. Damage caused from<br />

fallen trees also is generally covered<br />

under all standard homeowner<br />

policies.<br />

Many people may not be aware<br />

that homeowners’ and commercial<br />

insurance policies typically exclude<br />

flood, mudslide, debris flow, and other<br />

similar disasters — unless they are<br />

directly or indirectly caused by a recent<br />

wildfire or another peril covered<br />

by the applicable insurance policy.<br />

The Department of Insurance has<br />

posted a fact sheet for consumers to<br />

answer questions about what their<br />

policies cover. The Department of<br />

Insurance assures folks they are here<br />

to help. Consumers should contact the<br />

Department at 800-927-4357 or online<br />

at insurance.ca.gov for assistance<br />

on what may or may not be covered<br />

by their policies.<br />

Commissioner Lara issued a formal<br />

Notice to insurance companies earlier<br />

this year reminding them of their<br />

legal duty to cover damage from any<br />

future mudslide or similar disaster<br />

that is caused by recent wildfires that<br />

weakened hillsides.<br />

$50.5 Million in Grants Awarded Statewide to Assist<br />

Law Enforcement in Efforts to Fight Fraud<br />

SACRAMENTO, CA — Insurance Commissioner<br />

Ricardo Lara announced<br />

June 29, <strong>2023</strong> that he has awarded<br />

$50,545,239 in grants to 34 district<br />

attorney offices representing 44 counties<br />

in California to combat insurance<br />

fraud. In an official release, the CDI<br />

states that, under Commissioner Lara’s<br />

leadership, these grants, which are<br />

funded through annual employer assessments,<br />

support law enforcement<br />

efforts in investigating and prosecuting<br />

fraud and increase outreach to California<br />

communities.<br />

Commissioner Lara also awarded an<br />

additional $400,000 in grants to protect<br />

consumers, the majority of whom are<br />

seniors, from abuse involving the sale<br />

of individual life and annuity products<br />

as part of the Life and Annuity Consumer<br />

Protection Program.<br />

“Insurance fraud continues to be a drain<br />

on our economy. Partnership between<br />

my Department’s investigators and<br />

local law enforcement is crucial in<br />

fighting fraud and educating the public,”<br />

said Commissioner Lara. “These<br />

annual grants continue to show my Department’s<br />

long-standing commitment<br />

to investigating and working with our<br />

law enforcement partners to combat<br />

fraud and protect consumers, businesses,<br />

and the insurance marketplace.”<br />

Since Commissioner Lara took office in<br />

2019, the Department has particularly<br />

focused these grants on increasing outreach<br />

throughout the state, especially<br />

to the state’s diverse and underserved<br />

communities, the statement reads.<br />

These grants also fund essential outreach<br />

programs for individual district<br />

attorney offices to deter fraud and<br />

increase consumer awareness.<br />

Consumers are sometimes unaware of<br />

their rights or are reluctant to exercise<br />

them. Outreach programs will educate<br />

them of those rights and of best anti-fraud<br />

practices to protect themselves<br />

and their loved ones. The CDI website<br />

offers information on scams consumers<br />

and business may be susceptible to.<br />

The other focus for these grants is combating<br />

workers’ compensation fraud.<br />

A large part of these grants will go to<br />

the investigation and prosecution of<br />

medical provider fraud in the workers’<br />

liability coverage is required by law,<br />

they should consider comprehensive<br />

The California FAIR Plan, the state’s<br />

insurer of last resort, currently does<br />

not cover any storm-related damage<br />

unless a consumer has purchased a<br />

supplemental “difference in conditions”<br />

(DIC) policy from another<br />

insurance company.<br />

With any storm damage, you should<br />

call your insurance company to report<br />

it and take pictures and keep records<br />

of all clean up and repair costs.<br />

who are unwittingly ensnared<br />

in schemes to bill for unnecessary or<br />

profit motivated medical treatment. A<br />

recent example of this type of fraud<br />

sited in the release was the sentencing<br />

of former doctor, Julien Omidi, to 84<br />

months in federal prison after a joint<br />

investigation with the Department and<br />

law enforcement partners found that<br />

he defrauded insurance companies by<br />

fraudulently submitting nearly $120<br />

million in claims.<br />

Department investigators also work<br />

with law enforcement partners to target<br />

employer premium fraud, employer defrauding<br />

employee fraud, insider fraud,<br />

claimant fraud, uninsured employers<br />

operating within the underground<br />

economy, and exploitation of workers.<br />

These investigations are said to level<br />

the playing field for honest businesses<br />

and are intended to discourage future<br />

fraudulent activity, and protect all<br />

Californians.<br />

A recent sited example of this was the<br />

plea agreement reached with Golden<br />

Foods Inc. where the company admitted<br />

to a litany of labor violations, which<br />

included over $437,000 in stolen wages<br />

ultimately paid back to more than 30<br />

California workers.<br />

The grants awarded through the Life<br />

and Annuity Consumer Protection<br />

Program seek to protect all California<br />

consumers through the investigation of<br />

life and annuity transactions involving<br />

theft, embezzlement, twisting and<br />

churning, forgery, material misrepresentations,<br />

advanced commission<br />

schemes, and identity theft.<br />

The successful investigation and prosecution<br />

of these insurance crimes play<br />

an important role in protecting consumers<br />

and deterring fraudulent activities,<br />

the statement concludes.<br />

In a recent investigation, two co-conspirators<br />

were convicted of grand theft<br />

and ordered to pay a total of $500,000<br />

in restitution to the family of their victim,<br />

who they defrauded and convinced<br />

to purchase unnecessary annuities.<br />

EBCA to Resume luncheon in October before Bowling in<br />

November and Holiday luncheon in December<br />

The East Bay Claims <strong>Association</strong> plans to follow CCNC with an important<br />

educational program focusing on Earthquake and Fire Claims Wednesday,<br />

October 11, <strong>2023</strong>. This luncheon meeting will feature a presentation<br />

by our own John Ehlert, of JR Structural.<br />

John brings a wealth of information from an engineering perspecive<br />

in line with the International ShakeOut month. Everyone, everywhere<br />

should know how to protect themselves during an earthquake, and those of us in the property<br />

and casualty claims field should be well prepared for such an event.<br />
