ALLGEMEINE VERMIETBEDINGUNGEN<br />
1. Mietpreis<br />
Es gelten die Preise der bei Anmietung jeweils gültigen Preisliste. Erfüllt der<br />
Mieter die Voraussetzungen eines besonderen Tarifes nicht, ist der Normaltarif,<br />
bei Einwegmieten der Einweg tarif, zu zahlen. Dieser ist auch zu zahlen, wenn<br />
ein LKW vereinbarungs widrig an einer anderen als der An mietstation abgegeben<br />
wird. Bei Rückgabe eines Fahrzeugs auf der Insel Sylt oder im Ausland<br />
werden Rück führungskosten berechnet, deren Höhe vom Ab ga be ort abhängt.<br />
Kosten für Kraftstoff und Betankungsservice gehen zu Lasten des Mieters,<br />
sofern das Fahrzeug nicht mit vollem Tank zurückgegeben wird. Der Mieter<br />
haftet für alle im Zusammenhang mit der Nutzung des Fahrzeuges anfallenden<br />
Gebühren, Abgaben, Bußgelder und Strafen für die der Vermieter in<br />
An spruch genommen wird. Europcar erhebt dafür als Ausgleich für den Verwaltungsaufwand<br />
je Vorgang eine Bearbeitungspauschale von c 9,50. Ebenso<br />
trägt der Mieter etwaige anfallende Mautgebühren nach dem Autobahnmautgesetz.<br />
Für die Zahlung des Anhänger-Sammelzuschlages ist ausschliesslich der<br />
Mieter des LKW bzw. der Halter des Anhängers verantwortlich.<br />
2. Rückgabe des Fahrzeuges<br />
Der Mieter ist verpflichtet, das Fahrzeug bei Ablauf der Mietzeit Europcar am vereinbarten<br />
Ort während der Öffnungszeiten von Europcar zurückzugeben.<br />
3. Zahlungsweise<br />
Bei Anmietung ist eine Anzahlung mind. in Höhe des zu erwartenden Endpreises<br />
zu leisten. Der Restbetrag ist bei Rückgabe des Fahrzeuges zu zahlen.<br />
Soweit der Mietpreis aufgrund einer vertraglichen Vereinbarung kreditiert<br />
wird, ist er 14 Tage nach Rücknahme des Fahrzeuges fällig. Nach Verzugseintritt<br />
wird für jede Mahnung eine Gebühr von c 4,00 erhoben. Kommt der<br />
Mieter in Verzug, beträgt der Verzugszins 5 % über dem jeweiligen Basiszinssatz,<br />
mind. aber 6 % jährlich. Der Mieter kann einen geringeren Verzugsschaden<br />
nachweisen. Wird bei Verzug des Mieters die Beauftragung eines<br />
Inkassobüros erforderlich, so hat der Mieter die dadurch entstandenen Kosten zu<br />
tragen, sofern er nicht erkennbar zahlungsunfähig oder unwillig war und auch<br />
sonst keine Einwendungen gegen den Anspruchsgrund erhoben hat.<br />
4. Reservierung, Übernahme und Abbestellung<br />
Reservierungen sind nur verbindlich für Preisgruppen, nicht für Fahrzeugtypen.<br />
Das Fahrzeug ist spätestens 1 Std. nach der vereinbarten Zeit zu übernehmen,<br />
danach ist Europcar an die Reservierung nicht mehr gebunden. Abbestellungen<br />
müssen spätestens 24 Std. vor Mietbeginn erfolgen. Geschieht das<br />
nicht, ist ein Tagesgrundpreis zu zahlen, es sei denn, das Fahrzeug konnte anderweitig<br />
vermietet werden.<br />
5. Berechtigter Fahrer<br />
Das Fahrzeug darf nur vom Mieter selbst, dem im Mietvertrag angegebenen<br />
Fahrer, den beim Mieter angestellten Berufsfahrern in dessen Auftrag, sowie<br />
von Familienangehörigen des Mieters gelenkt werden, sofern diese das festgesetzte<br />
Mindestalter haben und im der Besitz einer gültigen Fahrerlaubnis<br />
sind. Der Mieter ist verpflichtet, auf Verlangen Europcar Namen und Anschrift<br />
aller Fahrer des Fahrzeuges bekanntzugeben, soweit diese nicht im Mietvertrag<br />
selbst genannt sind. Die Fahrer sind Erfüllungsgehilfen des Mieters.<br />
6. Verbotene Nutzungen, Einreisebeschränkungen<br />
I. Dem Mieter ist untersagt, das Fahrzeug zu verwenden:<br />
a. zur Teilnahme an motorsportlichen Veranstaltungen, Fahrzeugtests und<br />
Fahrsicherheitstrainings,<br />
b. zur Beförderung von leicht entzündlichen, giftigen oder sonstigen gefährlichen<br />
Stoffen,<br />
c. zur Begehung von Zoll- und sonstigen Straftaten, auch wenn diese nur nach<br />
dem Recht des Tatortes mit Strafe bedroht sind,<br />
d. zur Weitervermietung,<br />
e. für sonstige Nutzungen, die über den vertraglichen Gebrauch hinausgehen.<br />
II. Die Benutzung des Fahrzeuges ist nur innerhalb Europas gestattet:<br />
a. In den Ländern Großbritannien, Irland, Italien, Polen, Slowakei, Slowenien,<br />
Tschechien und Ungarn dürfen aus schließlich Fahrzeuge der Klassen Mini,<br />
Economy, Compact, Untere Mittelklasse und Mittelklasse benutzt werden.<br />
b. In den Ländern Albanien, Balearen, Baltische Republiken, Bulgarien,<br />
Griechenland, Island, Kanaren, Korsika, Kroatien, Malta, Rumänien, Sardinien,<br />
Sizilien, Türkei und den sonstigen Nachfolgestaaten von Jugoslawien (außer<br />
Slowenien) und der UdSSR ist die Benutzung untersagt.<br />
7. Reparaturen<br />
Reparaturen, die notwendig werden, um die Betriebs- und Verkehrssicherheit<br />
des Fahrzeuges zu gewährleisten, dürfen vom Mieter bis zum Preise von c<br />
50,- ohne weiteres, größere Reparaturen nur mit Einwilligung von Europcar in<br />
Auftrag gegeben werden. Die Reparaturkosten trägt Europcar gegen Vorlage<br />
der entsprechenden Belege, soweit der Mieter nicht für den Schaden haftet<br />
(siehe Ziff. 10).<br />
8. Verhalten bei Unfällen und sonstigen Schadensfällen<br />
Der Mieter hat nach einem Unfall, Brand, Diebstahl, Wild- oder sonstigen<br />
Schaden sofort die Polizei zu verständigen. Dies gilt auch bei selbstverschuldeten<br />
Unfällen ohne Mitwirkung Dritter. Gegnerische Ansprüche dürfen nicht anerkannt<br />
werden. Der Mieter hat Europcar, selbst bei geringfügigen Schäden, unverzüglich<br />
einen ausführlichen schriftlichen Bericht unter Vorlage einer Skizze zu erstatten.<br />
Der Unfallbericht muß insbesondere Namen und Anschrift der beteiligten<br />
Personen und etwaiger Zeugen sowie die amtlichen Kennzeichen der beteiligten<br />
Fahrzeuge enthalten.<br />
9. Kreditkartenzahlung<br />
Für eine Transaktion, bei der die Währung der Kreditkarte des Karteninhabers<br />
von der Währung des Anmietlandes abweicht, gilt folgendes:<br />
Der Mieter kann bei Anmietung wählen, ob er den Mietzins in der Währung des<br />
Anmietlandes oder der Währung der Kreditkarte zahlen will.<br />
Erfolgt die Zahlung in der Währung der Kreditkarte, wird der Rechnungsbetrag von<br />
Europcar von der Währung des Anmietlandes umgerechnet.<br />
Der nachfolgende Hinweis wird auf den Mietvertrag gedruckt: „Der Rechnungsbetrag<br />
wird in die Währung der Kreditkarte unter Angabe des 3-Letter-Codes<br />
zur Identifizierung der jeweiligen Währung (z. B. USD, GBP, EUR) umgerechnet“.<br />
Der endgültige Rechnungsbetrag wird auf Basis des am Tag der Fahrzeugrückgabe<br />
von Reuters vorgegebenen Wechselkurses zzgl. einer Gebühr von 2,75%<br />
umgerechnet. Bei allen nachträglichen oder geänderten Kosten wird die vom<br />
Mieter ausgewählte Währung zugrunde gelegt und zwar auf Basis des gültigen<br />
Wechselkurses am Tag der eingegangenen Kostenforderung. Der Multi-<br />
Währungs-Umrechnungs-Service wird vom Monnex Financial Service zur<br />
Verfügung gestellt.<br />
Eine Änderung der gewählten Währung kann der Mieter nur dann bei Abgabe<br />
(Check in) verlangen, wenn er eine Liste der anfallenden Kosten anfordert.<br />
Ansonsten ist die bei Anmietung gewählte Währung bindend.<br />
Kann die Umrechnung -gleich aus welchem Grund- von Europcar nicht vorgenommen<br />
werden oder wird diese vom Karteninhaber bei Anmietung rückgängig<br />
gemacht, wird die Rechnung in der Währung des Anmietlandes<br />
erstellt und danach von der kartenausstellenden Bank auf Basis ihrer Bedingungen<br />
umgerechnet.<br />
ALLGEMEINE VERTRAGSBEDINGUNGEN FÜR DIE AUTOMATENANMIETUNG<br />
1. Mietverträge können im Rahmen der Europcar Automatenanmietung unter<br />
Verwendung einer von Europcar akzeptierten Kreditkarte oder der von Europcar<br />
dem Kunden übergebenen Europcar Karten (First, Privilege Preferred) geschlossen<br />
werden. Voraussetzung ist, dass der Kunde bei jeder Anmietung im<br />
Besitz eines gültigen Führerscheines ist. Der Kunde wird bei Erstanmietung<br />
seinen Führerschein vorlegen, bei jeder Folgeanmietung den unveränderten<br />
Führerscheinstatus bestätigen und jede Änderung des Führerscheinstatus und/<br />
oder seine personenbezogenen Daten Europcar umgehend mitteilen.<br />
Verstößt der Kunde gegen eine der oben genannten Verpflichtungen, haftet er<br />
gegenüber Europcar für alle daraus entstehenden Nachteile und Schäden und<br />
wird Europcar von allen Ansprüchen Dritter, insbesondere Regreßan-sprüchen<br />
des Haftpflichtversicherers freihalten.<br />
2. Der Mietvertrag kommt zustande<br />
a. mit dem Kunden, dessen Europcar Karte in den Europcar Automaten eingeführt<br />
wird, zu dem Zeitpunkt, zu dem die Fahrzeugschlüsselübergabe erfolgt,<br />
b. für das Fahrzeug für das der vom Automaten zur Verfügung gestellte<br />
Fahrzeugschlüssel bestimmt ist, zu dem für dieses Fahrzeug vereinbarten Tarif<br />
und für die im Automaten eingegebene Mietdauer.<br />
3. Der Kunde ermächtigt Europcar, sämtliche Forderungen aus dem über den<br />
Automaten geschlossenen Mietvertrag inklusive der Selbstbeteiligung bei einem<br />
von ihm verschuldeten Unfall über die von ihm angegebene Kreditkarte einzuziehen.<br />
4. Der Kunde hat seine Europcar Karte sorgfältig aufzubewahren. Bei Abhandenkommen<br />
und mißbräuchlicher Verwendung hat er Europcar unverzüglich entweder<br />
telefonisch unter Tel. (24 Std.): 0180/5 8000 (0,14c/Min. aus dem dt.<br />
Festnetz, Mobilfunkpreise ggf. abweichend) oder per Fax unter 040 - 520 18-11<br />
7400 zu informieren, damit Europcar die Karte sperren lassen kann.<br />
5. Der Kunde verpflichtet sich, sämtliche Ansprüche von Europcar aus einem<br />
Automatenmietvertrag, der unter Verwendung der Europcar Karte oder einer<br />
von Europcar akzeptierten Kreditkarte geschlossen wurde, zu erfüllen, unabhängig<br />
davon, ob der Kunde selbst oder eine nicht befugte dritte Person,<br />
der die Verwendung der Karte nicht gestattet war, diese zur Automatenanmietung<br />
benutzt hat. Der Kunde haftet dann nicht für die durch die mißbräuchliche<br />
Verwendung der Europcar Karte entstandenen Kosten, wenn er Europcar<br />
so rechtzeitig über das Abhandenkommen seiner Europcar Karte informiert<br />
hat, dass die Karte von Europcar vor ihrer mißbräuchlichen Verwendung hätte<br />
gesperrt werden können.<br />
6. Es gelten ergänzend die Allgemeinen Vermietbedingungen der Europcar<br />
Autovermietung GmbH in ihrer jeweils bei Abschluß des Automatenmietvertrages<br />
geltenden Fassung.<br />
7. Der Kunde kann den Vertrag – unbeschadet des Rechts zur fristlosen<br />
Kündigung aus wichtigem Grund – während der Gültigkeitsdauer der Karte<br />
jederzeit durch schriftliche Anzeige gegenüber Europcar mit einer Frist von einer<br />
Woche kündigen.<br />
wesentlicher Vertragspflichten und bei einer zwingenden Haftung nach dem<br />
Produkthaftungsgesetz haftet Europcar auch bei leichter Fahrlässigkeit. In diesem<br />
Fall ist die Haftung dem Umfang nach auf den Ersatz der vertragstypisch<br />
vorhersehbaren Schäden begrenzt.<br />
12. Verjährung<br />
Sofern der Unfall polizeilich aufgenommen wurde, werden Schadensersatzansprüche<br />
von Europcar gegen den Mieter erst fällig, wenn Europcar Gelegenheit<br />
hatte, die Ermittlungsakte einzusehen. Der Lauf der Verjährungsfrist<br />
beginnt spätestens sechs Monate nach Rückgabe des Fahrzeuges. Im Falle<br />
der Akteneinsicht wird Europcar den Mieter über den Zeitpunkt der Akteneinsicht<br />
unverzüglich benachrichtigen.<br />
13. Gerichtstand<br />
Gerichtsstand ist Hamburg.<br />
10. Haftung des Mieters<br />
a. Bei Unfallschäden, Verlust, Diebstahl oder unsachgemäßer Bedienung des<br />
Fahrzeuges oder Verletzung vertraglicher Obliegenheiten gemäß Ziff. 5, 6<br />
und 8 dieser Bedingungen haftet der Mieter für die Reparaturkosten, bei<br />
Totalschaden für den Wiederbeschaffungswert des Fahrzeuges abzüglich<br />
Restwert, sofern er oder der Fahrer den Schaden zu vertreten hat. Daneben<br />
hat der Mieter auch etwaige anfallende Folgeschäden, insbesondere Wertminderung,<br />
Abschleppkosten, Sachverständigengebühren und eine Verwaltungskostenpauschale<br />
zu ersetzen.<br />
b. Wird eine Haftungsbefreiung gegen Zahlung eines zusätzlichen Entgeltes vereinbart,<br />
stellt Europcar den Mieter nach den Grundsätzen einer Vollkaskoversicherung<br />
mit nachfolgender Selbstbeteiligung zuzüglich einer Kostenpauschale von c<br />
29,50 für Schäden am Mietfahrzeug frei. Die Haftungsbefreiung erfasst die<br />
Beschädigung durch Unfall, d.h. durch ein unmittelbar von außen her plötzlich<br />
mit mechanischer Gewalt einwirkendes Ereignis; Brems-, Betriebs- und reine<br />
Bruchschäden sind keine Unfallschäden. Von der Haftungsbefreiung sind daher<br />
insbesondere Schäden nicht erfasst, die durch eine unsachgemäße Behandlung<br />
und/oder Bedienung des Fahrzeuges, etwa durch einen Schaltfehler oder eine<br />
Falschbetankung oder durch das Ladegut entstanden sind. Die Selbstbeteiligung<br />
für PKW je Schaden beträgt c 750,- bis zur oberen Mittelklasse; aber c 950,- für besonders<br />
wertvolle Fahrzeuge der oberen Mittelklasse (z.B. BMW 525d), Fahrzeuge<br />
der Luxusklasse (z.B.Audi A6) sowie Mini-Busse (z.B. VW Sharan). Für Mieter/<br />
Fahrer unter 23 Jahren (ausgenommen beauftragte Firmenfahrer und bei<br />
Unfallersatz- oder Schutzbriefanmietung) beträgt sie c1.100,-.<br />
Für LKW bis Gruppe 4 beträgt sie c 750,-, für Gruppe 5 (z.B. MAN 8.180)<br />
c 1.000,- für Gruppe 6+7 (schwere LKW) c 1.500,- je Schaden. Eine Liste<br />
der für das jeweilige Fahrzeug geltenden Selbstbeteiligung ist am Ort des<br />
Vertragsschlusses erhältlich. Diese Selbstbeteiligungen gelten nur, soweit keine<br />
davon abweichende individuellen Vereinbarung getroffen wurden.<br />
c. Die Haftungsbefreiung entbindet nicht von den Verpflichtungen in Ziff. 5, 6<br />
und 8 dieser Bedingungen. Der Mieter haftet voll bei Verletzung der vertraglichen<br />
Verpflichtungen, insbesondere für Schäden, die bei Benutzung durch einen nicht<br />
berechtigten Fahrer (Ziff. 5) oder zu verbotenem Zweck (Ziff. 6) entstehen. Hat der<br />
Mieter Unfallflucht begangen oder seine Pflichten gemäß Ziff. 8 verletzt, haftet er<br />
ebenfalls voll, es sei denn, die Verletzung hat keinen Einfluss auf die Feststellung<br />
des Schadenfalles.<br />
Ferner haftet der Mieter voll, wenn er den Schaden vorsätzlich verursacht.<br />
Verursacht er den Schaden grob fahrlässig, haftet er in einem die Schwere seines<br />
Verschuldens entsprechenden Verhältnis.<br />
d. Bei Abschluss eines Teilkaskoschutzes haftet der Mieter insbesondere bei<br />
Glas,- und Haarwildschäden, Brand, Entwendung und Elementarschäden mit<br />
einer Selbstbe-teiligung von c 160,- je Schaden.<br />
e. Im übrigen bleibt es bei der gesetzlichen Regelung.<br />
11. Haftung von Europcar<br />
Jegliche Haftung von Europcar wegen der Verletzung ihrer vertraglich geregelten<br />
Pflichten ist auf Vorsatz und grobe Fahrlässigkeit einschließlich von Vorsatz<br />
und grober Fahrlässigkeit der Vertreter und Erfüllungsgehilfen beschränkt.<br />
