Copyright<br />
Copyright is protected <strong>in</strong> <strong>Austria</strong> by the Copyright Act and the<br />
copyright owner has the exclusive rights to license others <strong>in</strong> regards to<br />
copy<strong>in</strong>g the work; perform<strong>in</strong>g it <strong>in</strong> public; broadcast<strong>in</strong>g, publicis<strong>in</strong>g and<br />
adapt<strong>in</strong>g the work. Copyright materials created outside of <strong>Austria</strong> are<br />
also protected under the <strong>Austria</strong>n Copyright Act as a result of <strong>Austria</strong>’s<br />
obligations under various <strong>in</strong>ternational treaties.<br />
Trade Marks<br />
The Trade Marks Act gives the exclusive use of a registered<br />
trademark to its registered proprietor. Owners of trademarks <strong>in</strong> other<br />
countries must register them <strong>in</strong> <strong>Austria</strong> to benefit from the protection.<br />
Trade Names<br />
Trade names registered <strong>in</strong> the <strong>Austria</strong>n register of companies cannot<br />
be used by others <strong>in</strong> <strong>bus<strong>in</strong>ess</strong> if likelihood of confusion occurs. When<br />
register<strong>in</strong>g a company the court checks on possible conflicts with<br />
exist<strong>in</strong>g trade names focussed on the same <strong>in</strong>dustry and the same<br />
