The contract is signed on behalf <strong>of</strong> the County by Dobbert. 14<br />

In other words, from Mercer’s perspective in working for the County, Dobbert was the<br />

County. As Soderstrom has testified, in his mind, “Gary Dobbert and the<br />

County are synonymous.” 15<br />

Dobbert concedes that he was Mercer’s contact person for purposes <strong>of</strong> dealing with<br />

County on matters relating to the 2000-2001 labor negotiations and the benefit enhancements at<br />

issue in this case. Karen Ordinans (“Ordinans”), the Chairman <strong>of</strong> the County Board <strong>of</strong><br />

Supervisors at the time <strong>of</strong> the benefit enhancements, confirmed that the County was represented<br />

in the Mercer contract by Dobbert. Clifford Van Beek(“Van Beek”), a member <strong>of</strong> the Pension<br />

Board at the time <strong>of</strong> the 2000-2001 benefit enhancements, also confirmed that there were two<br />

separate contracts with Mercer, one with the ERS and one with the County, and that Dobbert<br />

controlled access to Mercer. 16<br />

Dobbert’s discussions <strong>of</strong> pension benefit enhancements with Mercer in 2000 were always<br />

in his role as Milwaukee County Director <strong>of</strong> Human Resources. Guy Stuller (“Stuller”), a<br />

member <strong>of</strong> the Pension Board at the time, confirmed that Mercer’s work on the 2000-2001<br />

pension benefit enhancements would not have been “within the bounds” <strong>of</strong> the Pension Board’s<br />

contract with Mercer, but would have come under Dobbert’s separate contract with Mercer. 17<br />
