1.0 INTRODUCTION<br />

<strong>Waste</strong> Corporation of <strong>Arkansas</strong> (WCA) owns and operates the RoIling Meadows Landflil<br />
(Landfill) located in Prairie County, <strong>Arkansas</strong>. WCA is currently in the process of preparing a<br />
solid waste pennit modification application to expand the existing pennitted area and capacity at<br />
the LandfilL<br />
The purpose of this document is to present all information and documentation necessary<br />
to meet <strong>Arkansas</strong> Department ofEnvironmental Quality (ADEQ) and <strong>Central</strong> <strong>Arkansas</strong> <strong>Regional</strong><br />
<strong>Solid</strong> <strong>Waste</strong> <strong>Management</strong> <strong>District</strong> (CARSWMD) requirements for the issuance of a Class I<br />
landfill Certificate ofNeed (CON) to address the planned expansion at the LandfilL <strong>Arkansas</strong><br />
Regulation 22 requires that landfills requesting an increase in penni tted capacity must obtain a<br />
CON from the appropriate <strong>Regional</strong> <strong>Solid</strong> <strong>Waste</strong> <strong>Management</strong> <strong>District</strong> before the applicant can<br />
be considered for an increase in pennitted capacity.<br />
'Ine <strong>Central</strong> <strong>Arkansas</strong> <strong>Regional</strong> <strong>Solid</strong> <strong>Waste</strong> <strong>Management</strong> Board (CARSWMB) has<br />
adopted specific requirements for the evaluation of any landfill applicant seeking a CON within<br />
their jurisdiction. These requirements are specified in the CARSWMB's "Policies, Procedures,<br />
and Criteria for Certificate ofNeed Review for <strong>Solid</strong> <strong>Waste</strong> Landfill Facilities", adopted<br />
October 28, 1999. The information provided in the following application is organized to<br />
correspond with each ofthe applicable sections of the CARSWMB's requirements. Section VIII<br />
ofthe CARSWMB requirements summarizes the specific items in the application process for<br />
obtaining a CON. This document is intended to fulfill all ofthese requirements, and thereby<br />
constitutes a complete application for a CON.<br />
WCA understands that the CARSWMB will determine the completeness of this<br />
application within 30 days onts receipt, as specified by Section V oftheir policy document<br />
According to Section VI ofthe CARSWMB's requirements, the CARSWMB will provide for the<br />
specified public notice period and opportunity for public comments associated with the<br />
application for a CON. WCA also understands that the application process is intended to take<br />
60 days after notification to the applicant ofcompleteness of the application or the date that the<br />
public notice appears in the newspapers, whichever is later,<br />

2.0 CARSWMB REQUIREMENTS FOR A CON PETITION<br />
As described previously, the CARSWMB has adopted specific procedures and<br />

requirements for the consideration of a CON. These requirements are found in the CARSWMB<br />
document titled "Policies, Procedures, and Criteria for Certificate of Need Review for <strong>Solid</strong><br />
<strong>Waste</strong> LandfIll Facilities" adopted October 28,1999.<br />
2.1 CARSWMB Notice of Intent<br />
Section III of the CARSWMB requirements states that a Notice of Intent (NO!) must be<br />
submitted to the CARSWMB 30 days prior to submitting the formal petition (application) for the<br />
CON. The Landfill submitted a NOI to petition for a CON on July 29, 2010 fulfilling the<br />
requirements of Section Ill. The NOI and all related attachments including CARSWMB'g NOI<br />
acceptance lener and CON timeline are provided in Appendix A<br />
2.2 CARSWMB CON Petition Requirements<br />
Section IV ofthe CARSWMB policy document details the minimum requirements for an<br />
application or petition for a CON. The CARSWMB requirements are listed below in bold face<br />
italics.<br />

A map of the existing and proposed Landfill boundaries on a 7.5 degree USGS<br />
topographic map (Hazen Quad) is shown on Figure 2.1.<br />
• Section IV(d)<br />
The size ofthe proposed facility, including, but not limited to the useable airspace<br />
abol'e ground level, and the life expec:Janey oftheproposed facility;<br />
The landfill's permitted area is proposed to be axpanded by 140 acres. The expansion<br />
will create an additional airspace volume of approximately 25 million cubic yards. Based on the<br />
2009 disposal rate for the Landfill, and assuming this rate continues, the estimated remaining life<br />
ofthe Landfill will be more slightly more than 100 years after expansion.<br />
• Section IV(e)<br />
Description ofthe geo-politicaljurisdic:Jiom to be served by the disposal facility<br />
including population e.ftimate.f by jurisdiction;<br />
The Landfill currently serves the entire CARSWMD and surrounding<br />
counties/communities in central-eastern <strong>Arkansas</strong>. The CARSWMD counties/cities served by the<br />
referenced facility include but are not limited to:<br />

2.3 Section VIII Requirements<br />
The following sections address each of the CARSWMD specific requirements for<br />
securing a Class 1 landfill CON as detailed in Section VIII - Criteria for Review.<br />
• Section VII/(a)<br />
Is consistent with the regional pllUlning strtJtegy adopted bythe CARSWMD in the<br />
<strong>Regional</strong> Needs Assessment,<br />
The requested increase in permitted capacity is consistent with the general solid waste<br />
management needs enumerated in the 2010 CARSWMD Needs Assessment. The Landfill is<br />
committed to providing convenient and environmentally conscious solid waste disposal for the<br />
CARSWMD and surrounding areas, in accordance with the mission and purpose of the <strong>District</strong><br />
• Section VIII(b)<br />
A review ofany needs assessment thtJt has been preptJTed for the proposed facility.<br />

The March 2010 (Revised July 2010) CARSWMD Needs Assessment was reviewed in<br />
July 2010. Sections of the Needs Assessment related to disposal facilities were particularly<br />
noted.<br />
• Section VI//(i)<br />
Whether theproposed facility provides landfill disposal capacity needed within the<br />
CARSWA-ID;<br />
Based on information provided "lith this petition, the Landfill feels that the proposed<br />
expansion is in the best interest of the CARSWMD and surrounding communities. As such, by<br />
issuing a CON for an increase in the facility's permitted capacity, the useful life of the facility<br />
will be extended to better serve the long-term needs of the CARSWMD.<br />
• Section VIII(c)<br />
Whether theproposedfacility conflicts with existing comprehensive land use plans of<br />
any local governmental entity;<br />
There is no known comprehensive countywide land use plan associated with the<br />
unincorporated areas ofPrairie County, <strong>Arkansas</strong>. The Landfill is located outside the City of<br />
Hazen which is the closest incorporated municipality.<br />
• Section VI//(d)<br />
Whether the proposedfacility disturbs an archaeological site as recognized by the<br />
<strong>Arkansas</strong> Archaeological Survey, or a Rare and Endangered Species habitat as<br />
recognized by the <strong>Arkansas</strong> Game and Fish Commission or the U.S. Fish and Wildlife<br />
Senice or any other similar federal, state or local agency;<br />
Letters were submitted 10 the <strong>Arkansas</strong> Historic Preservation Program and the U.S. Fish<br />
and Wildlife Service to notify them concerning the proposed Landfill expansion. Responses from<br />
these agencies indicate that the proposed expansion will not disturb an archaeological site or a<br />
rare and endangered species habitat. Applicable correspondence is provided in Appendix B.<br />

• Section VlJJ(e)<br />
Will not adversely affect the public use ofany local, state, orfederalfacility, including<br />
but not limited to parks and Wildlife management areas.<br />
A lener was submitted to the <strong>Arkansas</strong> Department of Parks and Tourism and <strong>Arkansas</strong><br />
Game and Fish Commission (AG&F) regarding the proposed Landfill expansion. Both the<br />
AG&F Commission the Department ofParks and Tourism indicate that there are no conflicts<br />
with the proposed expansion ofthe Rolling Meadows Landfill. Applicable correspondence is<br />
provided in Appendix B.<br />
• Section VlJJ(f)<br />
Whether the proposedfacility conflicts with the requirements ofstate or federalla,.,s<br />
and regulations on the location ofdisposal facilities;<br />
Current State (<strong>Arkansas</strong> Regulation 22) and Federal (EPA, 4{) CFR 258) regulations<br />
outline specific requirements for sitting municipal solid waste landfills in "restricted areas". As<br />
such, municipal solid waste landfills are required to address airport safety, seismic impact, fault<br />
impact, unstable conditions, flood plains, and wetlands. As the Landfill is an existing operating<br />
Class J disposal facility, demonstrations of compliance associated with these location restriction<br />
standards are on file with ADEQ. The existing demonstrations were evaluated and updated as<br />
necessary to consider the design modifications and the addition of new landfill capacity as part<br />
ofthe Permit Modification Application.<br />
• Section VlII(g)<br />
Iftheproposed facility is located within the 100 year floodplain, whether it restricts the<br />
flow ofthe 100 year flood, reduces the temporary water storage capacity ofthe<br />
floodplain, or could Tt!SU/J in washout ofsolid waste which could pose a hazard to<br />
human health or the environment;<br />
A section ofa 1985 FEMA Flood lnsurance Rate Map (Panel 050459 0125B) is shown as<br />
Figure 2.2. The proposed landfill boundary is shown on this map and indicates that a small<br />
leading edge of the Zone A J00 year floodplain is located at the northern most portion of the<br />
I ()() acre expansion property.<br />

<strong>Arkansas</strong> Regulation 22.403 requires that all operations and facility design plans at<br />

Class 1 landfills cannot reduce the water storage capacity or restrict the flow ofa 100 year flood<br />
or result in a washout of solid waste from a landfill area. Any landfill design or future activities<br />
that will take place in this area will be addressed in the landfill design approved by ADEQ <strong>Solid</strong><br />
<strong>Waste</strong> <strong>Management</strong> Division.<br />
• Section VIJI(h)<br />
Whether theproposed facility is oppropriaJely 10caIed given the needs ofCARSWMD<br />
including a review ofthe road system service area;<br />
The Landfill is an active pennitted waste disposaJ facility that has been in service since<br />
the late \9805. Ute Landfill is centraJly located within the CARSWMD and is conveniently<br />
situated near Interstate 1-40 and <strong>Arkansas</strong> State Highway II. The location provides convenient<br />
access to the City ofHazen, Prairie County and surrounding communities. There are no problems<br />
regarding access to the site via the current road system. AdditionaJly, the proposed landfill<br />
expansion in itself will not significantly increase traffic to the Landfill above current levels.<br />
• Section VIIIOJ<br />
The detailed history ofthe applicant's record and thaI ofthe stockholders and officers<br />
with respect to violations ofenvironmenta/laws and regulations ofthe United StaJes or<br />
any staJe or political subdivision ofany staJe;<br />
There are no criminaJ violations regarding WCA stockholders, officers, or WCA<br />
employees on record with respect to violations of environmental laws and regulations.<br />
WCA has entered into two Consent Administrative Orders (CAO) in their history of<br />
operations in <strong>Arkansas</strong>. One CAO was between WCA and the ADEQ Air Division and was not<br />
directly related to the solid waste operations at the LandfilL The items in the CAO were resolved<br />
to the satisfaction of both the WCA and ADEQ. The second CAO was related to daily cover and<br />
odor issues at the Rolling Meadows Landfill and was successfully resolved between WCA and<br />
ADEQ in 2008.<br />

3.0 ADEQ REQUIREMENTS FOR A CON PETITION (§22.205(B))<br />
The ADEQ Certificate of Need Requirements are detailed in <strong>Arkansas</strong><br />
Regulation 22.205. There are five specific requirements listed in this regulation pertaining to the<br />
petition for CON to the regional solid waste board. These five items have been adopted verbatim<br />
by the CARSWMB in their document titled "Policies, Procedures, and Criteria for Certificate of<br />
Need Review for <strong>Solid</strong> <strong>Waste</strong> Landfill Facilities". Specifically, the ADEQ requirements are<br />
covered under the response for Section VIII (a, c -f).<br />

addresses the planned expansion of the Rolling Meadows landfill (RMl) located near<br />
Hazen, <strong>Arkansas</strong>. The permit modification will involve an increase in the permitted area<br />
and waste disposal capacity at the RML<br />
Enclosed with this letter are two maps. Figure 1 shows the general location Of the RML<br />
on an <strong>Arkansas</strong> State Highway map. Figure 2 shows the boundaries of the existing and<br />
proposed landfill site including latitude/longitude information on a 7.5 minute quadrangle<br />
map (Hazen Quad). There is a 40 acre and a 100 acre section of property proposed for<br />
expansion of the Class 1 landfill as evident in Figure 2. The additional acreage will be<br />
permitted and used for the disposal of Class 1 solid waste. The existing 105 acre RMl<br />
facility is currently regulated by the <strong>Arkansas</strong> Department of Environmental Quality<br />
(ADEQ) and operates under the authority of <strong>Solid</strong> <strong>Waste</strong> Permit #253-S1-R5 and<br />
General Stormwater Permit ARG 160000.<br />
WCA is required to notify the United States Fish and Wildlife Service (USF&W)<br />
regarding the landfill expansion in order to secure a CON from the CARSWMD. In<br />
addition, the CARSWMD will require a letter from the USF&W regarding the existence<br />
of threatened or endangered species or habitat (if any) in the vicinity of the planned<br />
expansion.<br />

Public Hearing Minutes<br />
October 13, 2010<br />
Rolling Meadows Landfill Certificate of Need<br />
A public meeting was held at the Hazen City Hall on October 13, 2010.<br />
The meeting began at 2:00 pm, The meeting was called to order and Leigh<br />
Ann Pool of <strong>Central</strong> <strong>Arkansas</strong> <strong>Regional</strong> <strong>Solid</strong> <strong>Waste</strong> <strong>Management</strong> <strong>District</strong><br />
explained that the purpose of the meeting was to take public comment on<br />
the proposal they had received from WCA to expand the Rolling Meadows<br />
Landfill in Hazen,<br />
There were several present from the community. There was Discussion on<br />
current permitted cells verses proposed. One resident commented that he<br />
would like to see expansion to take place further from his home which<br />
would go south to cell 17, 16, 21 and 22. Paul Crawford, engineer from<br />
FTN and Associates, mentioned that the tree line buffer would continue.<br />
The Jones' stated that they can hear the activity from the landfill from inside<br />
their home, especially when the trees lose their leaves. Todd Self, from the<br />
Landfill, stated that he is really not the one who decides where they will<br />
start the next cell.<br />
Mr. Self explained that the landfill gets as many permits as they can at one<br />
time because it is so expensive.<br />
The residents also stated that they had concerns about the oil drillings. Mr.<br />
Self advised them that it is treated as garbage not cover.<br />
The engineer explained that the landfill is designed to be there for the next<br />
75 years, The Landfill has a proposed gas collection system that will<br />
greatly reduce the smell from the landfill. There is a company that wants to<br />
purchase the system which would then take the generated gas and offer it<br />
locally as a alternative means of energy.<br />
The engineer asked if all their questions were answered sufficiently. The<br />
residents stated "yes" and they appreciated the explanations. The<br />
engineer stated that there will be another hearing when the application is<br />
sent to the state (<strong>Arkansas</strong> Department of Environmental Quality).<br />
Being no other comments, the meeting was adjourned.
