FISCAL YEAR 2010
U. S. DEPARTMENT OF TRANSPORTATION
49 CFR PART 26
PART I. GENERAL OVERVIEW
Introduction
The City of St. Petersburg is the owner and operator of the Albert Whitted Airport (SPG), and, as
such, contracted The LPA Group Incorporated (the Consultant) to prepare the fiscal year (FY)
2010 DBE Goal based upon anticipated engineering design, construction, and professional service
contracts in accordance with the United States Department of Transportation (DOT) 49 CFR Part
26, "Participation by Disadvantaged Business Enterprise in DOT Programs".
Applicability
SPG is the recipient of FAA funds (e.g. Airport Improvement Plan Funding (AIP)), entitlement
and discretionary, authorized under 49 U.S.C. 47101, et seq. To date, SPG has received no
funding related to federal funds authorized under the American Recovery and Reinvestment Act
(ARRA) of 2009 (Public Law 111-5), which are to be used for airport improvement funding.
However, if any funding changes with regard to ARRA of 2009 occur which may impact SPG
funding, then the FY 2010 DBE Goal will be appended as required.
Definitions of Terms
The terms used in this program have the meanings defined in 49 CFR 26.5 (appended).
Objectives / Policy Statement (26.1, 26.23)
The City of St. Petersburg has established a Disadvantaged Business Enterprise (DBE) program
for the Albert Whitted Airport in accordance with regulations of the U.S. Department of
Transportation (DOT), 49 CFR Part 26. The City of St. Petersburg has received Federal financial
assistance from the Department of Transportation for SPG, and as a condition of receiving this
assistance, The City of St. Petersburg has signed an assurance that it will comply with US DOT
funding requirements.
It is the policy of the City of St. Petersburg to ensure that DBEs, as defined in Part 26, have an
equal opportunity to receive and participate in DOT-assisted contracts. It is also our policy:
• To ensure nondiscrimination in the award and administration of DOT assisted contracts;
• To create a level playing field on which DBEs can compete fairly for DOT assisted contracts;
• To ensure that the DBE Program is narrowly tailored in accordance with applicable law;
• To ensure that only firms that fully meet 49 CFR Part 26 eligibility standards are permitted to
participate as DBEs;
• To help remove barriers to the participation of DBEs in DOT assisted contracts; and
ALBERT WHITTED AIRPORT
DISADVANTAGED BUSINESS ENTERPRISE GOAL
FISCAL YEAR 2010
SUBPART C – GOALS, GOOD FAITH EFFORTS AND COUNTING
Section 26.43 Set-asides or Quotes
The City of St. Petersburg does not use quotas in any way in the administration of this DBE
program for the Albert Whitted Airport.
I. Amount of Goal
The City of St. Petersburg herewith proposes a DBE-participation goal of 6.82% for fiscal
year 2010 design and construction projects associated with the Albert Whitted Airport. It is the
intent of The City of St. Petersburg to attain this goal through a Race-Neutral Program.
However, based upon historic DBE participation on similar type projects, it is anticipated that
at least a portion of the DBE goal will be achieved using race or gender conscious measures.
• Race-Neutral measures or programs are those programs used to assist all small
businesses and include gender-neutrality.
• Race-Conscious programs or measures are those that are specifically focused on
assisting only DBE firms, including women-owned firms.
Yet, any participation by a DBE subcontractor beyond the established race/gender conscious
goal, including as a prime contractor, is considered race and gender neutral. Further, The City
of St. Petersburg Business Assistance Center aids small businesses within the region by
providing classes in starting a business, bidding and construction, financing your business, etc.
Given the amount of DOT-assisted contracts that The City of St. Petersburg expects to let
during this fiscal year on airport related projects (approximately $1,832,000), the City of St.
Petersburg has set a goal of expending a minimum of $124,970.24 or 6.82% of total funding
to disadvantaged business enterprise firms.
Based upon historic participation on similar pavement construction and design projects (FY
2000, runway and taxiway pavement overlay projects, and FY 2006, IGAC terminal apron and
helipad projects), it is estimated that, in meeting the overall goal of 6.82%, approximately
0.38% will be from race-neutral participation and 6.44% through race conscious measures
based upon actual past participation on similar projects (see Section IV, Race Conscious and
Race Neutral Breakout Participation). Therefore, based upon the goal of $124,970.24, The
City of St. Petersburg expects to expend at least $481.14 ((0.38%/6.82%)*$124,970.24)) in
race-neutral participation and the remaining $124,489.10 in race-conscious participation.
2. Normal Market Area:
• Definition: A Normal Market Area is defined as an area or combination of areas
where at least 70/75% of all historical contract dollars for similar projects as well as
DBE contractors/subcontractors and non-DBE contractors/subcontractors are
located.
• Professional Services: Based upon historic data as well as the specialty
requirements for aviation related design, architectural and environmental services,
the entire state of Florida was designated as the market area for Professional
Services. Professional services associated with planned FY 2010 projects include:
• Engineering and Support Services (NAICS 54133)
• Geotechnical and Testing Services (NAICS 54138)
• Land Survey/Mapping (NAICS 54136)
• Other Professional Services (NAICS 54199)
• Other Services: The airport’s market area for other services, which include
administrative support, construction, traffic management and building supplies, was
based upon historic activity related to similar projects. The market area for
anticipated FY 2010 projects was determined from airport project bid tab
information and actual subcontractor participation provided by prime contractors.
In evaluating similar historic projects, approximately 83 percent of contractor
participation was from Hillsborough, Manatee and Pinellas Counties as shown in

3. Percentage Breakout by NAICS Codes:
To provide an evaluation of available contractors and subcontractors within the required
work areas, the City of St. Petersburg Midtown Economic Development and Business
Assistance Center provided a list of certified Small Business Enterprises (see Appendix A)
to assist in the development of the FY 2010 DBE goal for the Albert Whitted Airport.
Information on ready, willing and available DBE and Non-DBE contractors related to the
type of services required was also obtained from the US Census Bureau
(www.CenStats.gov), State of Florida Department of Transportation Office of Equal
Opportunity Directory (July 2009), and historic contractor data provided by the City of St.
Petersburg and the airport’s project bid list and project close-out documentation. Only
disadvantaged business enterprises certified by member agencies in the Florida Unified
Certification Program designated as UCP-DBE are considered ready, willing and available
to perform work at the airport according to FDOT and US DOT. The FDOT UCP
Directory may be downloaded from the Florida Department of Transportation Website
(http://www.dot.state.fl.us/equalopportunityoffice).
The data for total firms available (denominator) and the DBE firms available (numerator)
were extracted based upon the airport’s historic market area associated with similar historic
projects as well as the NAICS activity expected for the FY 2010 projects. The breakdown
by market area and NAICS codes is provided in Table 4, Available DBE and Non-DBE
contractors within the Project Market Area for FY 2010.
Step 1: Determine Base Figure for Relative Availability of DBEs (26.45(c))
a. Weighted Based Figure Calculation
In order to provide a more accurate measurement of anticipated DBE participation, the
base goal was established using a weighted project methodology. This methodology
breaks down the anticipated contractor participation based upon a percentage of the total
fee as shown in Table 5. This percentage is then applied to the willing and available
contractors identified in Table 4 to provide a logical estimate of contractor participation
on anticipated DOT funded projects.
The base figure is calculated as follows:
Base Figure = ((% of contract dollar amount x (#DBEs in 1st NAICs)/#All Firms in
1st NAICS)) + ((% of contract dollar amount * (#DBEs in 2nd NAICs)/#All Firms in
2nd NAICS)) + etc.) x 100%
Thus, based upon the projects outlined in Table 1, the following weighted base goal was
determined as shown in Table 6.
FISCAL YEAR 2010
Step 2. Adjust the Base Figure (26.45(d))
After calculating a base figure for the relative availability of DBEs, evidence was examined to
determine what adjustment was needed to the base figure in order to arrive at the overall goal. Thus,
in order to reflect as accurately as possible DBE participation expected in the absence of
discrimination, the weighted base DBE goal was adjusted using historic actual DBE participation on
similar projects.
a. We chose not to use disparity studies or other area information because of the following:
In November 1999, the City Council of St. Petersburg repealed the City’s Minority Business
Enterprise Program based upon the findings of the Minority Business Enterprise Disparity Study.
The Disparity Study documented that there was no longer any legally justified basis to continue
race-specific procurement policies with regard to minority and women-owned businesses located
within the domicile of St. Petersburg.
Thus, in March 2001, the City of St. Petersburg established a race and gender-neutral program called
the Small and Disadvantaged Business Enterprise (SDBE) Assistance Program. The program is
intended to enhance contracting and procurement opportunities for small and disadvantaged business
enterprises. The procurement opportunities include construction, contractual services, professional
consulting services, and commodities.
Based upon discussion with the City of St. Petersburg Midtown Economic Development/Business
Assistance Division, it was determined that the City established S/DBE program did not apply to the
airport. Therefore, it was determined that using the actual median DBE past participation associated
with projects completed in FY 2000 and 2006 to adjust the base SDBE goal for fiscal year 2010
provides the most accurate goal assessment for the airport.
b. The reason we chose to adjust our figure using this data was because of the following:
Adjustment to the base figure is required as a result of the limited number of Minority Owned
Businesses in the local market area. As a result, a combination of historical and base figure results
was used to determine a probable DBE requirement in the absence of discrimination for The City of
St. Petersburg in regards to the Albert Whitted Airport.
We have summarized information about barriers to entry or competitiveness of DBEs in our
programs from the following sources:
• FDOT DBE Directory and U.S. Census Bureau-County Business Pattern Data
• DBE and non-DBE contractor information from bidders lists, and
• Historic DBE and non-DBE participation on similar federally funded projects.
The airport’s history of actual DBE participation on similar projects was 13.30% based upon
the median actual DBE participation for the years 2000 and 2006 as illustrated in Table 7.
Note, at the time of this writing, actual 2009 DBE participation was not available. Therefore,
the 2009 DBE goal and actual participation were not included in the determination of historic
2. Final Adjustment of Base DBE Goal for FY 2010:
According to current information provided in the FDOT DBE Directory, dated July 2009,
and current US Census Data, the total number of available DBE and total contractors within
the established market area is 37 and 9,036 1 , respectively. This resulted in a weighted DBE
goal of 0.343%.
Thus based upon the historic adjustment for like projects as shown in Table 7, the final DBE
goal for fiscal year 2010 consist of the average of the weighted DBE Goal for FY 2010 and
the actual, historic median DBE participation on historically similar projects. As a result, the
adjusted DBE goal is 6.82%.
Adjusted DBE Goal = (FY 2010 Weighted Goal + Median Actual Participation)/2
Adjusted DBE Goal = (0.343% + 13.30%)/2
Adjusted FY 2010 DBE Goal = 6.82%
1 Total DBE and non-DBE contractor information is based upon total statewide contractors for professional services and the
market area (Hillsborough, Manatee and Pinellas Counties) for local materials, administrative support, traffic management
and construction services.

DISADVANTAGED BUSINESS ENTERPRISE GOAL
FISCAL YEAR 2010
In accordance with Section 26.45(f), The City of St. Petersburg will typically submit its overall
goal to FAA on August 1 of each year. The City of St. Petersburg in establishing an overall goal
has provided for public participation. This participation included:
1. Consultation with minority, women’s and general contractor groups, community organizations,
and other officials and organizations which provided information concerning the availability of
disadvantaged and non-disadvantaged businesses, the effects of discrimination on opportunities
for DBEs and our efforts to establish a level playing field for the participation of DBEs. The
list of organizations in which the airport, via the consultant, contacted is listed in Table 11,
Pinellas County Community Organizations.
As part of the outreach effort, e-mails and letters were sent in July 2009 to obtain information
concerning the availability of disadvantaged and non-disadvantaged businesses, the effects of
discrimination on opportunities for DBEs and the airport’s and City’s efforts to establish a
level playing field for the participation of DBEs. Below is a copy of the body of the letter and
e-mail to the organizations identified in Table 11 of this report.
E-Mail/Letter Message:
The City of St. Petersburg is in the process of establishing a Disadvantaged Business
Enterprise Goal for Fiscal Year 2010 with regards to projects associated with Albert
Whitted Airport. Please note that the City of St. Petersburg has not received any funding
for airport related projects at Albert Whitted Airport associated with the American
Recovery and Reinvestment Act of 2009.
The administrative portion of the program in addition to the goal and its methodology
were developed per the provisions set forth in 49 CFR Part 26. The proposed DBE Goal
for FY 2010 based upon anticipated projects is 6.82 percent. This year, The City of St.
Petersburg/Albert Whitted Airport is planning to provide bid opportunities to DBE and
Non-DBE contractors related, but not limited to, civil engineering, geotechnical services,
materials testing, heavy construction, excavation and site preparation, traffic markings,
utilities, and hauling/trucking. In researching the Florida Department of Transportation
Disadvantaged Business Enterprise Directory, July 2009, ready, willing and able DBEs
(identified as UCP-DBEs) located within the airport's historic market area based upon
similar projects that are qualified to bid on the proposed contracts as either a prime or
sub contractor were identified. The contracting area represents more than 81 percent of
where historic bid applications and contracts were awarded.
For fiscal years 2009 and 2010, the Florida Department of Transportation has an overall
race neutral DBE goal of 8.1 percent related to all planned transportation projects (rail,
highway, airports, etc.) including those funded under the American Recovery and
members of your organization have documentation of any existing social or economic
barriers which may be currently preventing minorities and/or women from offering
construction related services at the airports? In addition, do you know of any other
impediments which have or may impact minorities and/or women from effectively
competing on transportation related projects?
We would appreciate your replying with any information you could offer. Please if you
have any comments or questions, do not hesitate to contact Tricia Fantinato at (813)
any viable information becomes available, it is to be included in the airport's DBE
program and FY 10 Goal Determination and submitted to the Federal Aviation
Administration as required by federal regulations (49 CFR Part 26).
2. Additional consultation shall also be provided during any pre-bid/pre-proposal meetings the
City and airport conducts throughout the year which is opened to interested parties.
3. According to data provided by the City of St. Petersburg Business Assistance Center, the City
of St. Petersburg has instituted a number of programs to assist DBE organizations in obtaining
the airport, City and FDOT will accept comments on the goals and methodology for a period of
45 days from the date of the advertisement. Any comments received will be reviewed and
incorporated into the goal report documentation. If data becomes available that could impact
the goal, a modification to the goal and associated report will be developed and resubmitted to
the City of St. Petersburg, FAA and FDOT for review.
IV. RACE NEUTRAL AND RACE CONSCIOUS BREAKOUTS (Section 26.51)
The City of St. Petersburg will meet the maximum feasible portion of its overall goal by using
race-neutral means of facilitating DBE participation. The City of St. Petersburg uses the following
race-neutral means to increase DBE participation:
Race-neutral means include, but are not limited to the following (ref.: 26.51(b):
1. Arranging solicitations, times for the presentation of bids, quantities, specifications and
delivery schedules in ways that facilitate DBE and other small business participation. For
example, this could include unbundling large contracts to make them more accessible to
small businesses; requiring or encouraging prime contractors to subcontract portions of
work that they might otherwise perform on their own;
2. Providing assistance in overcoming limitations such as inability to obtain bonding or
financing. For example, this could include such means as simplifying the bonding process;
reducing bonding requirements; eliminating the impact of surety costs from bids, or
providing services to help DBEs and other small businesses obtain bonding and financing;
3. Providing technical assistance and other services;
4. Carrying out information and communications programs on contracting procedures and
specific contract opportunities. For example, this could include ensuring the inclusion
of DBEs and other small businesses on recipient mailing lists for bidders, ensuring the
dissemination to bidders on prime contracts of lists of potential subcontractors, including a
provision for the dissemination of information in languages other than English, where
appropriate;
5. Implementing a supportive services program to develop and improve immediate and
long-term business management, record keeping and financial and accounting
responsibility;
6. Providing services to help DBEs and other small businesses improve long-term
development; increase opportunities to participate in a variety of kinds of work; handle
increasingly significant projects and achieve eventual self-sufficiency;
7. Establishing a program to assist new start-up firms, particularly in fields in which DBE
participation has been historically low;
8. Ensuring distribution of your DBE directory through print and electronic means to the
widest feasible universe of potential prime contractors; and,
9. Assisting DBEs and other small businesses to develop their capability to utilize
emerging technology and conduct business through electronic media.
10. Other: ____________________________________________________________
If the City must rely on contract goals to meet some portion of our overall goal, then such goals will
be submitted to the DOT for approval before issuing a contract solicitation.
The City of St. Petersburg will adjust the estimated breakout of race-neutral and race-conscious
participation as needed to reflect actual DBE participation (see 26.51(f)) and will track and report
race-neutral and race-conscious participation separately.
DISADVANTAGED BUSINESS ENTERPRISE GOAL
FISCAL YEAR 2010
For reporting purposes, race-neutral DBE participation includes, but is not necessarily limited to, the
following:
• DBE participation through a prime contract a DBE obtains through customary competitive
procurement procedures;
• DBE participation through a subcontract on a prime contract that does not carry a DBE goal; DBE
participation on a prime contract exceeding a contract goal; and
• DBE participation through a subcontract from a prime contractor that did not consider a firm's
DBE status in making the award.
We will maintain data separately on DBE achievements in those contracts with and without contract
goals, respectively.
In order to meet the maximum feasible portion of the overall goal using race/gender-neutral means of
facilitating DBE participation, the following considerations were evaluated.
1. The Amount by which Albert Whitted Airport and the City of St. Petersburg exceeded past
goals on similar projects:
The amount by which City of St. Petersburg exceeded overall construction goals in past years for
Albert Whitted Airport is useful in determining the race/gender neutral participation in the future.
Based upon the historical goal participation for the Fiscal Years 2000 and 2006, the airport
exceeded its median goal by approximately 0.38%.
2. Past Participation by DBE Prime Contractors
Past participation through the use of DBE prime contractors should be considered race/gender
neutral and, therefore, can be used as a basis for estimating a similar level of race/gender-neutral
participation in the next program year. In the past 10 years, however, there has been no
participation by a DBE Prime Contractor on the City of St. Petersburg airport projects. This may
be the result of limited number of DBE contractors located within the local area of Pinellas,
Hillsborough and Manatee Counties. As a result, this was not considered as part of the
race/gender-neutral split evaluation.
3. Past Participation by DBE Subcontractors on Contracts without goals
Past participation of DBE Subcontractors on contracts without DBE goals should be considered
race/gender-neutral and, therefore, can be used as a basis for estimating a similar level of
race/gender neutral participation in the next program year. To date, however, The City of St.
Petersburg has not had any DBE subcontractor participation on contracts without DBE goals.
Therefore, this was not considered in the development of the race/gender-neutral split. However,
if in the future, such a contract does occur, it will be included in the estimate of future race/genderneutral
participation.
Following the guidelines outlined in §26.51 for determining the minimum estimated race-neutral
and race-conscious goal for Fiscal Year 2010, the median percentage of race-neutral participation
and race-conscious participation were determined as shown in Table 13.
We will establish contract goals only on those DOT-assisted contracts that have subcontracting
possibilities. We need not establish a contract goal on every such contract, and the size of the contract
goals will be adapted to the circumstances of each such contract (e.g., type and location of work,
availability of DBEs to perform the particular type of work, etc).
We will express our contract goals as a percentage of the total amount of the DOT-assisted contract,
