Parents should arrange for the work to be collected and returned and the school<br />

must ensure that it is marked and that further work is provided until the pupil<br />

returns to school. Letters to parents informing them of the exclusion must include<br />

the arrangements for setting and marking work.<br />

Appeals process<br />

The Headteacher’s exclusion letter should inform the relevant person of the<br />

procedures should they wish to make representation or appeal against the<br />

exclusion to the Discipline Committee of the Governing Body. Subsequently there<br />

is a right of appeal to an Independent Appeals Panel for permanent exclusions<br />

and again, the relevant person should be fully informed at the appropriate time.<br />

The relevant person as defined in regulations means:-<br />

• The parent if the pupil was aged 10 or below on the day before the beginning<br />

of the school year in which he/she was excluded<br />

• Both the parent and pupil if the pupil is of compulsory school age and was<br />

aged 11 or above on the day before the beginning of the school year in which<br />

he/she was excluded<br />

• The pupil if aged over compulsory school age (normally 16)<br />

Therefore this gives all excluded pupils the right to be notified formally of their<br />

exclusion and enable them to appeal.<br />

Where a child has been permanently excluded from two or more schools, his/her<br />

parents can still express a preference for a school place but the requirement to<br />

comply with that preference is removed for a period of two years from the date on<br />

which the latest exclusion took place. There are some exceptions to this and for<br />

Arrangements for the provision of education<br />

in schools outside <strong>Torfaen</strong><br />

At schools maintained by another authority<br />

Parents/carers are expected to apply to the Director of Education of the Authority<br />

concerned.<br />

At schools not maintained by another authority<br />

Financial assistance to attend schools not maintained by another education<br />

Authority may be given to the children of service personnel in overseas countries<br />

where satisfactory educational facilities are not available.<br />

Arrangements for transfer between schools<br />

Changing schools is a serious step for your child to take and should be given a<br />

great deal of thought.<br />

and guidance if appropriate, which will need to be returned to the address on the<br />

form.<br />

(N.B.) While the transfer is being processed your child must attend his/her present<br />

school. Non attendance will be recorded as unauthorised and could be referred to<br />

the Education Welfare Officer. Parents/Carer should be aware that transport would<br />

only be provided in accordance with the Authority’s transport policy.<br />

PLEASE REMEMBER TRANSFERS MUST BE APPROVED BY THE LA.<br />
