Additional powers to Bodoland<br />

Territorial Council<br />

It is pertinent to note that Sixth Schedule to the<br />

Constitution (Amendment) Act, 1995 inserted two<br />

special provisions in the Sixth Schedule granting more<br />

autonomy to the BTC.<br />

Paragraph 20BA was also inserted in the Sixth<br />

Schedule to the Constitution (Amendment) Act<br />

authorizing the Governor of Assam to exercise<br />

his discretionary power on various matters while<br />

acting under the provisions of the Sixth<br />

Schedule.<br />

(Amendment) Act, 2003, also inserted paragraph 3B<br />

whereby powers were conferred on the Bodoland<br />

Territorial Council to make laws on forty additional<br />

subjects.<br />

Thus, as on date, there are following three District<br />

Councils in the State of Assam:<br />

1. North Cachar Hills Autnomous Council<br />

2. Karbi Anglong Autonomous Council<br />

3. Bodoland Territorial Council<br />

It is pertinent to note that none of them use the<br />

term District Councils, but rather use either<br />

Autonomous Councils or Territorial Councils.<br />

Autonomous Councils Functioning Under State<br />

Legislation. It may be noted apart from the aforesaid<br />

three autonomous councils functioning in the state of<br />

Assam under the provision of Sixth Schedule to the<br />

Constitution, there are three other autonomous<br />

councils which have been established with the plain<br />

tribes community under different legislations passed<br />

by the state legislature. They are:<br />

1. Missing Autonomous Council<br />

2. Rabha Hasong Autonomous Council<br />

3. Lalung (Tiwa) Autonomous Council.<br />

Recently two further bills constituting<br />

autonomous council for Deori and Sonowal plain<br />

tribes of Assam have been passed by the legislature<br />

and the assent of Governor is waited. They are;-<br />

1. The Deori Autonomous Council Bill, 2005<br />

2. The Sonowal Kachari Autonomous<br />

Bill, 2005.<br />
