CITY OF GLENDORA CONSOLIDATED ANNUAL PERFORMANCE AND EVALUATION REPORT<br />

PUBLIC HEARING MEETING LOCATION AND DATE<br />

The City of Glendora is requesting public review and comment on its Community Development Block<br />

Grant Program Consolidated Annual Performance and Evaluation Report for the July 1, 2008 to June 30,<br />

20<strong>09</strong> reporting period. The draft report is available for a review period, which will commence on <strong>September</strong><br />

3, 20<strong>09</strong> and continue until <strong>September</strong> 22, 20<strong>09</strong>. The Glendora City Council will conduct a public hearing to<br />

review the Consolidated Annual Performance and Evaluation Report (CAPER) for submittal to the U.S.<br />

Department of Housing and Urban Development (HUD), at 7:00 P.M., at its <strong>September</strong> 22, 20<strong>09</strong> City<br />

Council meeting. The City Council meeting is being held in the Glendora City Council Chambers at 116 East<br />

Foothill Boulevard, Glendora, California.<br />

In compliance with the American with Disabilities Act, if you need special assistance to participate in the<br />

meeting, please contact the City of Glendora's City Clerk's Office at (626) 914-8210. Notification 48 hours<br />

prior to the <strong>September</strong> 22, 20<strong>09</strong> City Council meeting will enable the City to make reasonable arrangements<br />

to ensure accessibility to the meeting.<br />

BACKGROUND<br />

The 2008-20<strong>09</strong> One-Year Action Plan is a planning document, which is required by the U.S. Department<br />

of Housing and Urban Development for cities to receive annual HUD funding, such as Community<br />

Development Block Grant funds. The One-Year Action Plan is part of the Consolidated Plan, which is a<br />

master document that regulates federal funding for the five-year period of 2008-2013. The One-Year Action<br />

Plan is evaluated for consistency and compliance with the goals and objectives established in the Consolidated<br />

Plan for the 2008-20<strong>09</strong> fiscal year.<br />

The Consolidated Plan goals are to (1) Provide decent housing; (2) Provide a suitable living environment<br />

by improving the safety and livability of neighborhoods; (3) Expanding economic opportunities, job creation<br />

and retention, establishing, stabilization, and expansion of small business. The 2008-20<strong>09</strong> One-Year Action<br />

Plan is reviewed to ensure compliance with these goals.<br />

PUBLIC REVIEW AND COMMENT PERIOD<br />

The Consolidated Annual Performance and Evaluation Report present and describe the City of Glendora's<br />

CAPER projects for the fiscal year ending June 30, 20<strong>09</strong>.<br />

Comments from the public hearing and those submitted to staff during the comment period will be<br />

addressed in the final draft of the 2008-20<strong>09</strong> CAPER to the U.S. Department of Housing and Urban<br />

Development. Comments and questions regarding the 2008-20<strong>09</strong> Consolidated Annual Performance and<br />

ESTABLISHMENT AND INCREASE OF CERTAIN DEVELOPMENT-RELATED<br />

AND OTHER USER FEES<br />

NOTICE IS HEREBY GIVEN that at 7:30P.M. on <strong>September</strong> 15, 20<strong>09</strong>, or as soon thereafter as possible,<br />

in the City Council Chambers of the City of Covina, located at125 E. College St, Covina, CA 91723, a<br />

public hearing pursuant to California Government Code, Sections 66016 and 66018 will be held by the City<br />

of Covina ("City") to consider the Cost Allocation Plan and User Fee Study and updates (defined in the next<br />

paragraph) and the approval of a resolution establishing and increasing certain development-related and<br />

In connection with the establishment and increase of Fees, the City has commissioned Maximus<br />

Consulting (Consultant) to prepare a "Cost Allocation Plan and User Fee Study" for the City of Covina,<br />

California" and the City of Covina staff have prepared updates to reflect current costs of the City for<br />

providing development-related and other user services (collectively, "Fee Study"), pursuant to Government<br />

Code, Section 66001, et. seq.,. The Fee Study contains a summary of the proposed Fees, as well as (i) the<br />

purpose of the proposed Fees, (ii) the use to which the Fees will be put, (iii) a reasonable relationship between<br />

the Fees' use and the types of projects on which the Fees are imposed, and (iv) a reasonable relationship<br />

between the amount of the Fees and the cost of the City's Services attributable to the applications on which<br />

the Fees are imposed.<br />

The City plans to adopt a Notice of Exemption finding that the establishment and increase of Fees is<br />

statutorily and categorically exempt from the requirements of the California Environmental Quality Act<br />

("CEQA") because the setting of development-related Fees merely establishes a funding mechanism for<br />

the provision of future projects and, as such, the adoption of the resolution described herein is not "an<br />

essential step culminating in action which may affect the environment" and environmental review required<br />

under CEQA will be performed when projects funded by the Fees are chosen and defined (Kaufman & Broad-<br />

South Bay, Inc. v. Morgan Hill Unified School District, (1993) 9 Cal.App.4th 464.).<br />

At the public hearing, the City shall consider all evidence and testimony for and against the Fee Study,<br />

adoption of the Notice of Exemption and approval of the resolution establishing and increasing Fees. At any<br />

time prior to the public hearing, any person may file in writing with the City a statement of his or her<br />

objections to the Fee Study, adoption of the Notice of Exemption and/or approval of the resolution<br />

establishing and increasing Fees.<br />

Persons who challenge the Fee Study and updates, adoption of the Notice of Exemption and/or approval<br />

of the resolution establishing and increasing Fees in court may be limited to raising only those issues they<br />

or someone else raised at the public hearing described in this Notice, or raised in written correspondence<br />

delivered to the City at, or prior to, the public hearing.<br />
