Senator Hernandez Affordable Care Act 

Implementation Bills Go to Governor 

SACRAMENTO – Landmark 

legislation implementing 

the federal Affordable Care Act 

was approved by the California 

State Senate and sent to the 

Governor. Authored by California 

State Senator Ed Hernandez, 

O.D. (D – West Covina), the 

legislation establishes minimum 

health benefits and provides 

important consumer protections 

for all Californians purchasing 

health insurance. 

SB 951 sets the minimum 

standards for health benefits that 

insurers offer, including doctor 

visits, hospitalization, prescription 

drugs, emergency-room 

treatment, mental health services 

and vision and dental care 

for children. SB 961 prevents 

insurance companies and health 

plans from denying coverage or 

charging excessive premiums 

on those who have preexisting 

health conditions, and requires 

that insurance premiums be 

based solely on age, geography, 

and family size. 

These two bills implement in 

California law some of the most 

transformative and popular 

components to President 

Obama’s Affordable Care Act 

(ACA). 

Under the ACA, states must

“SB 951 establishes a strong,

said Hernandez. “This bill will 

finally put an end to the sale of 

‘junk insurance’ that is marketed 

as coverage but offers 

consumers little or no value.” 

SB 961 reforms California’s 

health insurance market and 

implements strong consumer 

protections by eliminating the 

use of preexisting condition exclusions 

and establishing a 

“modified community rating.” 

This means the factors that can 

be used to establish premium 

rates are limited to age, geography 

and family size. 

The bill also requires the guaranteed 

issue of health insurance, 

ending the practice of 

conditioning coverage and the 

cost of that coverage on a 

person’s medical history, ge- 

netic information or other factors. 

By incorporating these elements 

of the ACA into state 

law, SB 961 allows state regulators 

to enforce these protections 

for all Californians. 

“SB 961 represents the heart 

of the consumer protections 

provided by the ACA,” 

Hernandez stated. “This bill improves 

access to health coverage 

for all Californians by preventing 

insurance companies 

from engaging in discriminatory 

practices and pricing that have 

kept people with preexisting 

conditions from getting health 

coverage.” 

Both SB 951 and SB 961 now 

await Governor Brown’s signature. 

The Governor has signaled 

support for the Affordable Care 

Act reforms in the past, leaving 

Senator Hernandez hopeful the 

bills will be signed. 

“California has embraced federal 

health care reform and leads 

the nation in the implementation 

of this landmark law,” 

Hernandez stated. “These bills 

make the ACA’s most critical 

reforms and protections a reality 

for all Californians. I am 

confident that they will have the 

Governor’s support.” 

City Welcomes DSW Back To West Covina 

POMONA - The Forest Service, 

working in partnership 

with other agencies, will hold 

the "America's Great Outdoors" 

exhibit featuring education and 

fun for kids of all ages, at the 

Los Angeles County Fair here, 

from Aug. 31-Sept. 30. 

The site offers a fire lookout 

tower, log sawing and branding, 

the Paul Cash Magic Show, 

tree seedling giveaway, a home 

defensible space display, fire- 

discounts to returning customers. 

DSW was previously located 

at the Lakes Shopping Center. 

After closing its doors, DSW 

was determined to find another 

location in the community. 

DSW is replacing the former 

Old Navy storefront at Eastland 

Center. The City of West 

Covina provided business assistance

and obtaining the necessary entitlements 

to complete the

La Verne and Glendora Suspect Charged

LA VERNE/GLENDORA - 

Bail has been set from $225,000 

to over $2 Million, 

$2,050,000.00 to be exact for 

46-year-old Donell Bell, a male 

black from Montclair. Bell had 

just turned 46 on August 12. 

Back on August 17, Bell went 

on a crime spree where residents 

in the communities of La 

Verne and Glendora were terrorized. 

Around 7:30 p.m., Bell was 

in a stolen car that crashed in 

the 1900 block of 5th St., in La 

Verne. It is believed that a number 

of people, including Bell, ran 

from the vehicle. 

Bell attempted to carjack another 

vehicle. While in the process 

of pulling a gun on the victim, 

he shot himself in the leg. 

The victim of that attempt 

carjacking stopped to assist Bell 

after the crash. The driver was 

able to get away. 

Bell then tried to break into a 

house and was unable to. He 

then went after another driver 

and attempted to carjack that 

vehicle. That driver was able to 

get away as well. 

Again, Bell, tried breaking 

into another home and was able 

to get in and then stole the 

resident's car. 

Police who were in the area 

because of the other crimes 

soon saw the stolen vehicle and 

gave chase down Arrow Highway 

heading towards Glendora. 

During the chase, the police lost 

the vehicle but Police happened 

to drive up on a crashed vehicle 

at Barranca and Arrow Highway. 

This crash involved the 

stolen car. Bell ran from that 

crash and attempted to carjack 

a minivan which was disable. 

Bell then went to a liquor 

store and attempted to rob a 

man leaving the store and this 

man was able to get away. Bell 

again tried another carjacking as 

police arrived in the area and he 

abandoned that vehicle and the 

police saw him and arrested the 

dangerous suspect. 

Bell was taken to the hospital 

for his gunshot wound and then 

processed and charged. The 

D.A. has charged him with 

carjacking, seven counts of attempted 

carjacking, three 

counts of making criminal 

threats, burglary, residential robbery, 

evading an officer, attempted 

robbery and unlawful 

taking of a vehicle. 

Bell has a long arrest record 

including prior convictions for 

robbery in 1986, 1989 and 1992 

along with a host of other 

crimes. It is expected that the 

3rd Strike Law will allow in this 

case. Under California's Three 

Strikes law, any third felony 

can earn a repeat offender a 

minimum sentence of 25 years 

in prison. It appears that Mr. 

Bell has earned this. 


WEST COVINA - Assemblyman 

Roger Hernandez's DUI 

trial is over and the jury found 

him "Not Guilty" on one charge 

and a hung jury on the second 

charge of driving with an alcohol 

level of .08 or better. 

However, there was a twist 

at the outcome that had a few 

shaking their heads. It had been 

stated that the jury foreman had 

made comments that this should 

have never come to trial, but 

"plea bargain" instead. This 

made some who were close to 

the case that this was a clear 

indication that they in fact knew 

what Hernandez had done, but 

side stepped the law feeling that 

the trial should have been 

avoided and Hernandez be offered 

to make a plea. They were 

using their opinion rather than 

the law to deliberate. On top of 

that, the mistrial on the other 

charge of driving with an alcohol 

level of .08 or higher 

showed that the jury was deadlocked 

with 6-6 vote, showing 

SACRAMENTO - Two measures 

authored by Senate Republican 

Leader Bob Huff (R- 

Diamond Bar) have received 

the approval and signature of the 

Governor after receiving support 

from both Democrats and 

Republicans during the legislative 

process. Both SB 1364 and 

SB 1137 address key consumer 

protection issues. 

“My thanks to the Governor 

for his recognition and support 

for the student safety and rate 

increase issues that my two bills 

address,” said Senator Huff. 

“I’d also like to thank my colleagues 

in both the Senate and 

the Assembly for their support.” 

SB 1364 seeks to ensure that 

ratepayers served by private 

water companies are not asked 

to pay more for the same service 

than a ratepayer served by 

a public agency without a clear 

understanding of the associated 

costs.

that some felt he was guilty of 

that, but yet they found him not 

guilty with the evidence presented. 

One comment made was that 

"Hernandez was not found innocent" 

but not guilty with the 

evidence presented. 

The DA may retry him on the 

.08 charge, but would have to 

evaluate the case to see if they 

can get a guilty plea. 

It is not known if the DA offered 

Hernandez a Plea Bargain 

or not. 

Hernandez was elated with 

the not guilty finding and 

hugged some of the jury members. 

Back on March 27, around 2 

a.m., police pulled Hernandez 

over for traffic violation. The 

smell of alcohol on Hernandez 

made police the right to give him 

a sobriety test that he failed. His 

attorney argued that the wind 

and uneven ground contributed 

to the field test results. 

Hernandez refused to take the 

breath test in the field or at the 

station and also refused a blood 

test at first. After more than an 

hour, officers said that they 

could restrain him and "take his 

blood" for their investigation and 

at that time he took the test. 

The attorney for Hernandez 

leaned on an issue that the blood 

was not handled correctly, thus 

giving a false reading of .08. 

The DA's argument was that the 

delay that Hernandez caused by 

not cooperating allowed the 

blood alcohol level to drop to 

the .08. Some felt that it could 

have been as high as .12 with 

the Hernandez defense feeling 

that it was a higher reading because 

he just had a drink just 

before he left and his level was 

not that high when he was first 

pulled over and his system had 

not digested the alcohol. The 

later testing showed that his 

system had ingested the drink, 

thus giving a higher reading. 

Hernandez was happy to 

prove his case and to be exonerated.

GLENDORA - Police responded 

to a traffic accident 

around 9 p.m. on Wednesday, 

August 29 in the 500 block of 

West Baseline Road. 

It appears that Carlos Garcia, 

33, a male Hispanic from 

Fontana left a parking lot and 

sheared off a fire hydrant with 

his Toyota Tundra pickup truck 

which caused flooding in the 

area as the water gushed 50 to 

60 feet into the power lines. 

When police arrived, they 

found that the suspect driver 

had left the scene 

Officers started to search the 

area following the debris to 

Grand Ave. An officer came 

upon a white pickup in the 1100 

block of Grand Avenue while 

rate increases through a method 

currently used by water utilities, 

which has led to confusion and 

frustration among ratepayers. 

Senator Huff’s legislation gives 

cities and customers advance 

notice on rate increase notifications 

in order to protect them 

from unexpected rate hikes. 

“This bill also subjects water 

corporations with more than 

2,000 service connections to the 

same reporting and auditing requirements 

currently imposed 

on electrical, gas, and telephone 

corporations,” said Senator 

Huff. “It is designed to protect 

ratepayers.” 

Senator Huff introduced SB 

1137 at the request of State 

Superintendent of Public Instruction 

Tom Torlakson. The 

bill addresses needed changes 

in education statutes regarding 

California heritage schools. Defined 

in California’s Education 

Code, heritage schools are privately 

financed, culture-based 

educational entities. In an effort 

to provide an even safer environment 

for students enrolled in 

the heritage school programs, 

SB 1137 specifies that each 

school must register with the 

Superintendent of Public Instruction. 

The measure also prioritizes 

and enhances student safety 

through the electronic registration 

form by requiring the 

acknowledgement that all heritage 

school employees must 

report any and all known child 

abuse. 

“The Governor’s signature 

on SB 1137 means that all heritage 

schools are subject to requirements 

of the Child Abuse 

and Neglect Reporting Act,” 

said Senator Huff. 

Senator Huff serves as the 

Senate Republican Leader and 

represents the 29th Senate District 

covering portions of Los 

Angeles, Orange and San Bernardino 

Counties.

Garcia was inspecting the damage 

to his "wet" truck. 

Upon the officers' investigation, 

it appeared that Garcia was 

drunk and failed the sobriety 

tests in the field. Further investigation 

revealed that Garcia 

was also in possession of methamphetamines. 

He was arrested 

for driving under the influence, 

possession of methamphetamine 

and hit-and-run. Bail was 

set at $15,623 since he also had 

an outstanding warrant. It appears 

that he bailed out of jail 

the next day. Court dates are 

pending.

SAN DIMAS - A gang of 

four juveniles attempted to rob 

two teenagers who were waiting 

for a ride. The boys were 

on Covina Boulevard near the 

57 Freeway when they were 

approached by the gang. 

The gang tried to rob the two 

and beat one of the victims. The 

other victim used his cell phone 

to call police and told the suspects 

that he had called the police 

which at that time the gang 

left.

Teen Gang Attempts 

Robbery, Suspects Arrested 

were able to find two of the 

suspects who were instantly 

arrested. They continued to 

search the area and arrested the 

other two. 

All four male suspects were 

teenagers, ages 15 to 17-yearsold. 

These dangerous suspects 

were not released back to their 

parents, but taken to Los 

Padrinos Juvenile Hall. They 

were not identified because of 

being juveniles but the authorities 

may request that some or 

all of them be tried as adults.

They Never Learn and Still Drive Illegally 

I can't help but shake my 

head when I see people continuing 

to break the law when they 

know better. 

On Friday, I worked at a Vehicle 

Checkpoint and I was 

deeply disappointed that some 

people don't ever learn. There 

were a couple of people driving 

on a suspended or revoked license. 

Why are they still driving? 

There is a good reason 

why many of them have their 

privilege removed, but still, they 

continue to break the law. 

Driving is a "privilege" and 

NOT a right. 

There was only one DUI arrest. 

Twenty years ago, we 

would have as many as 10 in

Over the years, there has been 

a huge drop in these types of 

violations. 

What I observed here was an 

increase of "expired" driver's licenses. 

People are getting a little 

lazy sending in their fees and / 

or getting their privilege renewed. 

I talked with a number of 

people who were watching the 

operation and everyone seemed 

satisfied and approved of this 

type of enforcement. 

I am sure you have heard this 

before, but remember "Don't

Man Stabbed to Death in Covina 


COVINA - On Thursday, 

August 30th, around 2:00 p.m., 

the Covina police and L.A. 

Sheriff's deputies responded to 

the reports of a man who was 

stabbed in the 3600 block of 

Shedyglen Drive in the county 

area of Los Angeles. When 

they arrived, they found a male 

Latino, Gonzalo Robles, a 38 

years old Covina man stabbed 

to death in his own backyard. 

Geoffrey Brooks, 68, a friend 

lived in a front house and Robles 

was his roommate. 

Louis Alberto Villaneda, 32 a 

male Latino, lived in a back 

house. While working and 

painting on the front house, 

Brooks, Robles, Villaneda and 

another man were doing okay 

when Robles and Vallaneda be-

came involved in a verbal altercation 

over "respect". Vallaneda 

armed himself with a knife and 

started stabbing Robles. Robles 

in attempting to defend himself, 

was able to get a knife as 

well. 

But when Robles fell to the 

ground because of his wounds, 

Vallaneda continued stabbing 

him and killed him. Villaneda and 

the other man fled by jumping 

a back fence. 

Deputies and officers quickly 

set up a perimeter of the area 

which is near two schools. The 

schools, Royal Oak Middle 

School and Sierra Vista, were 

placed on lockdown while deputies 

and officers conducted a 

search for the suspects. After 

an hour, the lockdown was 

lifted as the suspect was located 

and arrested. He was treated at 

a hospital for his stab wounds 

and charged with murder. The 

bail set was one million dollars.

On Thursday - August 23, 

2012, Council member Mike 

Touhey walked out of the West 

Covina Oversight Board meeting 

that was being held in the 

West Covina City Council 

chambers. The meeting was 

not over and Mr. Touhey walked 

out because he disagreed that 

CalTrans was going to make a 

slide presentation to the Oversight 

Board. 

The members of the Oversight 

Board and many members 

of the audience in attendance 

were surprised by Mr. Touhey's 

action. 

When there are many West 

Covina redevelopment dollars at 

stake, one should think twice 

about what they say and do at 

these meetings. Not only was 

Mr. Touhey's action uncalled 

for, it was rude to everyone in 

attendance. 

Ken Eliasberg definitely has 

freedom of speech in his apparent 

anti-gay beliefs, as noted in 

his Aug. 16-22 column in the 

Examiner. But he takes an extremist 

position when he calls 

Rahm Emmanuel a fascist. 

Eliasberg has always taken 

extreme right wing positions on 

the issues. I am just hoping that 

no one is listening! His buddies 

are Rush Limbaugh and Sean 

Hannity...the Fox News chan- 

After reading Charles Bayer's 

article on "Who is afraid of the 

NRA?", I thought I'd share my 

answers and opinion about it. 

The politicians, whether 

Democrats or Republican, who 

understand the consequences 

of trampling on our 2nd Amendment 

Rights are afraid of the 

NRA. 

Fellow "Americans" who try 

to undermine the 2nd Amendment 

Rights of Free Americans 

are afraid of the NRA. 

"A well regulated Militia, being 

necessary to the security of 

a free State, the right of the 

people to keep and bear Arms, 

shall not be infringed." 

By regulating what "Arms" 

we could or could not have is 

already an infringement on our 

right. Neither does the 2nd 

Amendment mention that 

"Arms" are to be use only for 

hunting. The 2nd Amendment 

is not about hunting. It is to 

defend the Constitution of the 

United States against all enemies, 

foreign and domestic, 

and that includes politicians who 

try to take away our rights and 

criminals who do harm unto us

Touhey Needs To Be Replaced On The West Covina Oversight Board 

Mike Lee is an employee of 

the City of West Covina and also 

a member of the West Covina 

Oversight Board. If Mr. Lee 

had walked out for the same 

reason that Mr. Touhey did and 

Mike Touhey had stayed at the 

meeting, I am sure that Mr. Lee's 

supervisors would not have 

been very happy with Mr. Lee's 

behavior. He probably would 

be given a verbal or written reprimand 

or be disciplined in any 

of a number of ways for being 

"unprofessional and rude". 

That would be a decision his 

supervisors would have to 

make. So why shouldn't Mr. 

Touhey get the same treatment 

by the West Covina City Council.

amendment still protects us

The Aurora, Colorado shooting 

was a tragedy that could 

have been avoided. The theater 

had a "No Guns Allowed" policy 

and a sign on their entrance. If 

the gunman had only obeyed the 

sign, this would not have happened. 

But we all know criminals 

don't care about signs, 

much more about gun laws. So 

why do you think adding more 

gun laws would prevent tragedies 

like what happened in 

Colorado? 

We do have laws that prohibit 

"mental defects" and criminals 

from buying and possessing 

guns, it just needs to be enforce.

was surprised and embarrassed 

for our city by Mr. Touhey's 

action. I feel that West Covina 

residents would be better served 

if the City Council advised Mr. 

Touhey that his behavior was 

unacceptable as an elected representative 

of West Covina. 

The City Council should admonish 

Mr. Touhey and replace him 

on the Oversight Board.

been the filibuster, which has 

been employed more often than 

in all the rest of American history. 

The rules of that august 

body have been shaped so that 

the filibusterers don't even need 

to show up in order to hold the

Successes Of The Tea Party - 2010 And Counting 

Before continuing with my 

assault on the Republican Party, 

lest any one think that this is an 

act of blatant apostasy, let me 

make it clear - this is an act of 

terminal frustration. I have been 

a Republican for some 20 years, 

and I shall remain a Republican; 

there simply is no other choice. 

Clinton helped me see the light, 

and not because of his acts of 

infidelity; heck, with a wife like 

Hillary, philandering is more like 

a jail break than a moral misstep. 

No, having retired, I could 

really examine the American 

political scene, and was free to 

make choices. Before that, I 

voted out of a sort of conditioned 

reflex, i.e. I'm a Jew, I'm 

a Democrat. That's why the 

Dems have gotten over 70% of 

the Jewish vote in most elections 

(the only voter constituency 

more reliable than the black 

vote). Why? That's for a number 

of reasons that are beyond 

It's Even Worse Than It Looks 

Since I have returned to the 

political world I have both read 

and listened carefully to what 

is going on. I've spent time with 

both Fox News and msnbc, as 

well as with intelligent articles 

and books from widely divergent 

political advocates. A 

month ago an old friend put me 

on to a book which blew my 

mind.("It's Even Worse Than it 

Looks-How the American Constitutional 

System Collided with 

the New Politics of Extremism" 

Basic Books, Philadelphia 

2012) It was written by two 

men who come from diverse 

political perspectives. Thomas 

Mann is a resident scholar at the 

Brookings Institute-a liberal 

think tank. Norman Ornstein 

is a resident scholar at the 

American Enterprise Institutea 

conservative think tank. Had 

this book been penned by Chris 

Matthews, Rachael Maddow or 

some other card-carrying liberal, 

I would not have taken it 

as seriously. 

The thesis of these two reputable 

scholars has sent a shock 

wave wherever it has been read. 

Their thesis is that pundits who 

try to be even-handed have it 

wrong. While there has been a 

consistent effort to blame both 

political parties, that perspective 

denies the reality. Mann and 

Ornstein state that the blame 

(even though he would be reelected 

today in a heart beat), 

that it gave me pause to examine 

the reasons behind my loyalty 

to his Party. And, on reflection, 

I could think of few, if any, 

that had any binding effect on 

me. Bear in mind, that, not only 

had I been a Democrat from the 

time I could first vote (and before), 

but, also, that I had 

served (albeit in a low level position) 

in the Kennedy Administration. 

Now there was a president 

- and a family - that made 

Bill Clinton look like a choir boy. 

The much lionized Ted 

Kennedy, the intellectual runt of 

the litter, was a cowardly murderer, 

who, if a member of any 

other family, might still be doing 

jail time - not to overlook 

the fact that he was a drunk, a 

glutton, and a skirt chaser)

for the Dems in a later column. 

Having become a Republican 

floor. All they now need to do 

is say boo!! And the Democrats, 

short of a super majority, 

just throw in the white flag. 

Having now a majority in the 

House, the Republican tactic has 

been a bit different. The President 

sends up either directly or 

through his surrogates, legislative 

proposals to solve, say, the 

unemployment crisis. Such proposals 

have been before the 

House for months. But the majority 

simply ignores any Administration 

effort to solve the problem. 

Why? Getting some handle 

on jobs would be counter to the 

announced priority of the Party. 

If there is some easing in the 

unemployment rate, that would 

be good for the President. But 

the Republicans would rather 

something be bad for the country 

even if it good for the President. 

Having blocked the 

Administration's effort to attack 

this problem, the Republicans 

can sit back and criticize the 

President for not solving it. 

While it may be hard to believe 

that party politics has sunk 

to that level, Mann and Ornstein 

posit that is exactly what has 

happened. The authors are short 

on suggestions as to how this 

deplorable system might be 

remedied. They hint that there 

are flaws is in our Constitution 

system which seek to protect

with a lot of time on my hands, 

and thanks to a bit of prodding 

from my wife, who tired of my 

screaming at the T.V. set over 

some Clinton outrage, I went 

down to Republican headquarters 

and offered up my services, 

which I have, with growing 

frustration, continued to provide 

for the past 2 decades. 

Why am I frustrated? Ask yourself 

this question, why, if we 

have a center-right country 

(and we most certainly do), do 

we continue to get center-left 

government?? And the answer 

is quite simple - because we put 

up with it; it's the silent majority 

that Richard Nixon spoke of, 

which will evolve into the repressed 

majority and then the 

oppressed majority, unless they 

get off their couch and stand 

up for America (which is exactly 

what the Tea Party is doing). 

Actually, there's something 

any strong minority party. What 

has happened is perfectly legaljust 

as legal as multi-millionaires 

sheltering tons of money in tax 

avoidance schemes and rightly 

claiming that what they have 

done is perfectly legal. In a Parliamentary 

system the majority 

has the right to govern until it is 

tossed out. But that is not our 


else as well that explains how 

the left wins when they have a 

minority of voters who share 

their ideology. They want it 

more than the Republicans do. 

You've heard that old saying that 

it ain't the size of the dog in the 

fight, it's the size of the fight in 

the dog. Their dog always has 

lots of fight (they'll do anything 

to win, even cheat, and they 

have the left-wing media to 

cover their tracks); the Republican 

dog is not just lacking in 

fight, frequently you wonder if 

it's even in the fight. Also, in this 

vein, have you noticed that the 

most effective Republicans are 

ex-Democrats, e.g. Reagan, 

Charleton Heston, Bill Bennett, 

Linda Chavez, the Neo-Conservatives, 

and, a man for whom I 

have the greatest admiration and 

respect, David Horowitz. That's 

because Dems take politics 

more seriously and are on duty 

24/7. The Dems are passion- 

system and the only solution 

seems to lie with an election in 

which the governing party takes 

the House and has 60 solid votes 

in the Senate. But nobody I 

know thinks that will happen in 

November. So we may be stuck 

with a disastrous next four

The Importance Of This 

Friday's Employment Report 

In Friday's Jackson Hole 

speech, Federal Reserve Chairman 

Ben Bernanke made a 

forceful case for further largescale 

asset purchases, or quantitative 

easing. It is clear the Fed 

Chairman wants Quantitative 

Easing 3, but he still has to convince 

a skeptical Open Market 

Committee. Next Friday's employment 

report will be a key 

data point if it is going to happen 

this year. 

THE SPEECH 

Bernanke talked about the 

effectiveness of the extraordinary 

policy pursued by the Fed 

since the crisis, and in particular 

touted Fed analysis which 

found the first two QE rounds 

boosted GDP by three percent 

and boosted employment by 

two million jobs. The Bank of 

England found a proportionate 

result in their analysis of their 

own QE programs, he said. (He 

warned that these estimates 

may not be entirely accurate, as 

any estimate of what might have 

happened is just that, an estimate.) 

By linking QE to jobs, 

Bernanke forcefully reminded us 

of the Fed's mandate. The Fed 

exists to pursue stable prices 

and full employment. 

Bernanke ran through a cost 

benefit analysis in which he 

listed four major objections to 

QE. 

1. The functioning of the securities 

markets could be impaired. 

2. A further expansion of the 

Fed's balance sheet could undermine 

faith in the ability to exit 

accommodation, thereby increasing 

inflation expectations. 

3. If too many investors 

chase yield, they may take inappropriate 

risks, undermining 

financial stability. (Though he 

noted this is always a risk with 

monetary stimulus.) 

4. The Fed could suffer financial 

losses if the value of 

assets on its balance sheet falls. 

But, he said, "In light of the 

policy actions the FOMC has 

taken to date, as well as the 

economy's natural recovery 

mechanisms, we might have 

hoped for greater progress by 

now in returning to maximum 

employment." He blamed a still 

weak housing sector (despite 

some recent improvement), restrictive 

fiscal policy, especially 

at state and local levels and 

strains in credit and financial 

markets. He emphasized tight 

borrowing conditions, but failed 

to draw the obvious link to 

tough new regulations designed 

to prevent many of the loans 

common a few years ago. 

"As we assess the benefits 

and costs of alternative policy 

approaches, though, we must 

not lose sight of the daunting 

economic challenges that confront 

our nation," he said. "The 

stagnation of the labor market 

in particular is a grave concern 

not only because of the enormous 

suffering and waste of 

human talent it entails, but also 

because persistently high levels 

of unemployment will wreak 

structural damage on our 

economy that could last for 

many years." 

The Chairman is clearly hoping 

for another QE round, but 

the rest of the Committee is divided. 

Next Friday's employment 

report is likely to decide 

whether anything is done at the 

September meeting. Remember, 

too, that not taking action in 

September does not rule it out 

later. In 2010, the second round 

of QE hinted at in August was 

not announced until November. 

The 2010 speech 

The lead-up to Friday's Jackson 

Hole speech was punctuated 

by repeated reminiscences 

of Jackson Hole 2010. It was 

there Bernanke tipped his hand 

and signaled QE2. Or at least, 

that's the way many of my colleagues 

remember it. But it 

didn't really happen that way. As 

is so often the case when investors

Fed action, the speech alone 

would not have given anything 

away if not for the context provided 

by events leading up to it. 

It's worth a quick review because 

understanding what happened 

two years ago provides 

useful context for understanding 

potential outcomes this year. 

>In July 2010, private payrolls 

rose 71,000, a disappointingly 

small gain made worse because 

it followed increases of 

just 51,000 in May and 31,000 

in June. Employment growth 

was stalling. 

>At the August 10 FOMC 

meeting, the Committee chose 

to reinvest the cash from mortgage 

principal payments (prepays) 

into longer-term Treasury 

securities. This was primarily a 

reaction to a report from Brian 

Sack at the New York Fed 

showing how mortgages were 

unexpectedly melting off the 

Fed's balance sheet due to low 

interest rates, but it was perceived 

as easing. 

>On August 24, three days 

before the Jackson Hole speech, 

Jon Hilsenrath at The Wall Street 

Journal published a tell-all account 

of the August 10 FOMC 

meeting. The article named 

names and spilled details so precise 

they would not even make 

it into the minutes published a 

week later. Eventually, the article 

spurred the Fed to adopt 

new communication guidelines 

for officials, but at the time they 

revealed a fractured FOMC and 

- for the first time - clearly revealed 

Bernanke as the most 

dovish of them all. 

As for the speech itself, 

Bernanke talked about easing in 

the context of what global central 

banks had done in the past 

and what the Fed still could do 

to help the economy. Then he 

said the FOMC had not decided 

to do anything else. He did, however, 

offer two conditions 

which would justify further easing: 

a credible threat of deflation 

or a credible threat of recession. 

The bond market started pricing 

in QE in early August, after 

the July employment report. 

The speech had very little impact 

on yields. But the stock 

market, which had been falling 

for two weeks, bottomed on the 

day of the speech and rallied 

through year end. So perhaps 

some investors did hear the 

speech as tipping-off the second 

round of QE. But it is also 

noteworthy that the Fed did not 

announce it in an FOMC statement 

until November, though 

New York Fed President Bill 

Dudley made it pretty apparent 

in an October 1 speech. Then, 

just two weeks later, the New 

York Fed surveyed the primary 

dealers to determine how big it 

should be, further tipping its 

hand. 

Bernanke's leadership of a 

newly-fractured board made his 

comments about QE in 2010 all 

the more potent. The market 

started paying much more attention 

to how he expressed his 

own views, even perhaps when 

he said he wasn't speaking for 

the Fed. Until then, there had 

not been a hint of dissent since 

the financial crisis erupted in 

2008. As Hilsenrath explained it, 

disagreement at the Fed was so 

heated, even the decision to reinvest 

mortgage prepays at the 

August meeting was controversial, 

passing only because 

Bernanke was masterful in managing 

the debate. 

Divergence at the Fed today 

If anything, the divergence 

FINANCIAL / CONSUMER 

of views within the Fed is even 

more pronounced today than it 

was two years ago. 

Fed hawks who opposed QE 

two years ago are frustrated 

because they believe their primary 

fears about QE were 

borne out but ignored. Richard 

Fisher in particular seems frustrated 

that QE caused massive 

swings in the value of the dollar 

and in the cost of commodities, 

appears to have benefited 

asset markets only temporarily 

and left the Fed with a $2 trillion 

bond portfolio to manage. 

Wall Street's understanding 

of the economic expansion has 

changed, both inside and outside 

the Fed. Most people, including 

Bernanke, expected a 

pretty typical recovery in 2010. 

No one thinks that now. To 

some, that is justification for 

more aggressive monetary 

policy. To others, it is proof that 

the very remedies we have 

adopted are holding back the 

recovery. 

Bernanke must convince at 

least some people from each of 

these camps to endorse QE if it 

is going to happen. 

WHY FRIDAY'S REPORT 

IS A BIG DEAL 

The August FOMC minutes 

showed broad support for easing 

unless the data turned decidedly 

better for a sustained 

period, but as James Bullard told 

CNBC after their release, "The 

minutes are a bit stale since we 

have some data since then that 

has been somewhat stronger." 

He went on to say that it is one 

thing to talk hypothetically about 

what it would take to justify 

easing. It is another altogether

continues to be consistent with 

2% growth, he said, it isn't going 

to happen. Wall Street agrees 

that he is probably right. 

That's why the August employment 

report this week is 

such a big deal. It does not have 

to be strong to justify the 

FOMC remaining on hold. Job 

growth of 150k is ample to do 

that, despite being a disappointment 

to the sustainable-growth 

crowd. Anything between 100k 

and 150k is likely to result in 

more vigorous debate but no 

ease and only a sub- 100k number 

is likely to prod the Fed into 

action. 

Some economists say a 

higher unemployment rate could 

move the Fed. The rate bottomed 

in April at 8.1% and has 

since risen to 8.3%, part of a 

two-and-a-half year old pattern 

stretching back to the start of 

the recovery. Every year, the 

rate has fallen rapidly in the fall 

and winter and risen a few 

tenths in the spring and summer. 

The 2010 low was in June, 

the 2011 low was in March, and 

this year's was in April. Another 

tenth or two is easily dismissed 

as part of a seasonal issue 

Bernanke talked about in February. 

As a result, Wall Street 

talks about the importance of 

the employment report, but the 

really important thing is nonfarm 

payrolls. 

There were no industries that 

weakened by more than a few 

thousand in July. There are two 

ways to think about this. An 

optimist might argue the balance 

of change - the stuff going on 

at the margins - was all good. 

But a pessimist might point out 

that the number of industries 

which grew and the number that 

shrunk was about the same in 

July as in June. But the handful 

of industries which skewed 

from the recent norm all skewed 

the same way, allowing a few 

small improvements to add up 

to what looked like a big change 

for the better. 

We won't know until Friday 

and the August report if this 

pickup in activity is sustainable 

or, perhaps, the harbinger of a 

broader-based improvement. 

But again it raises the stakes 

because a weak employment 

report in August would signifi-

The United Singles holds a

2012 reporting period. The draft report is available for a review period, which will commence on September 

10, 2012 and continue until September 25, 2012. The Glendora City Council will conduct a public hearing to 

review the Consolidated Annual Performance and Evaluation Report (CAPER) for submittal to the U.S. 

Department of Housing and Urban Development (HUD), at 7:00 P.M., at its September 25, 2012 City

master document that regulates federal funding for the five-year period of 2008-2013. The One-Year Action 

Plan is evaluated for consistency and compliance with the goals and objectives established in the Consoli- 

dated Plan for the 2011-2012 fiscal year. 

The Consolidated Plan goals are to (1) Provide decent housing; (2) Provide a suitable living environment 

by improving the safety and livability of neighborhoods; (3) Expanding economic opportunities, job creation 

and retention, establishing, stabilization, and expansion of small business. The 2011-2012 One-Year Action 

Plan is reviewed to ensure compliance with these goals. 

PUBLIC REVIEW AND COMMENT PERIOD 

The Consolidated Annual Performance and Evaluation Report present and describe the City of Glendora's 

CAPER projects for the fiscal year ending for June 30, 2011.

Creating the Right Environment for Health 

Would practicing alternative 

medicine allow her to spend 

more time with patients and, 

thus, lead to an environment 

more conducive to healing? 

This final question came 

from a young lawyer turned 

physician who, like me, attended 

a recent RAND Corporation 

meeting on alternative 

health care. It really spoke to 

the heart of the conversation 

that night and what both physicians 

and patients are seeking 

today - a better environment 

for health and healing.

read), scientists, physicians, 

researchers, even the man on 

the street are discussing new

the best health care. It's 

the man/woman on the street 

(the public), in fact, that is 

showing the most interest in

variety of "alternative" methodologies
