Any person, department of State or registering authority desiring to operate a<br />

testing station shall apply in the prescribed manner to the MEC concerned for the<br />

registration of such testing station.<br />

39 Registration and grading of testing station<br />

If, upon receipt of an application referred to in section 38, the MEC is satisfied<br />

that the prescribed requirements for registration of the testing station concerned have<br />

been met, he or she shall register and grade such testing station on the conditions and in<br />

the manner prescribed, and shall give notice of such registration in the Provincial<br />

Gazette: Provided that the MEC may provisionally register and grade a testing station<br />

operated by a registering authority, on the conditions and in the manner prescribed.<br />

40 Suspension or cancellation of registration of testing station<br />

The MEC may, if a registered testing station no longer complies with the<br />

requirements contemplated in section 39, suspend, for such period as he or she may deem<br />

fit, or cancel the registration of such testing station or regrade the testing station in the<br />

prescribed manner.<br />

41 Appointment of national inspectorate of testing stations<br />

(1) The Minister shall appoint a person, an authority or a body as a national<br />

inspectorate of testing stations.<br />

(2) The powers and duties of the inspectorate contemplated in subsection (1) in<br />

relation to the inspection and the control of standards, grading and operation of testing<br />

stations shall be as prescribed.<br />

(3) The Minister may, in order to defray the expenditure incurred by or on behalf<br />

of that inspectorate for the purposes of performing its functions, prescribe fees to be paid<br />

in respect of every examination conducted or test carried out regarding the<br />

roadworthiness of a motor vehicle.<br />

42 Certification of roadworthiness required in respect of motor vehicle<br />

(1) No person shall operate a motor vehicle which is not in a roadworthy<br />

condition on a public road.<br />

(2) No person shall operate a motor vehicle on a public road unless the<br />

requirements in respect of a certification of roadworthiness contemplated in subsection<br />

(4) in relation to such motor vehicle are complied with, and except in accordance with the<br />

conditions of such certification of roadworthiness.<br />

(3) No person shall operate a motor vehicle on a public road unless the<br />

requirements in respect of a roadworthy certificate contemplated in subsection (4) in<br />

relation to such motor vehicle are complied with, and except in accordance with the<br />

conditions of such roadworthy certificate.<br />
