8.6 Direction to export given by any other authority shall constitute an offense and shall<br />

be punishable un<strong>de</strong>r Item 10.<br />

8.7 Any export point official who authorizes the export of a shipment of firearms or re<strong>la</strong>ted<br />

materials, ammunition, or explosives on the basis of a representation ma<strong>de</strong> un<strong>de</strong>r<br />

subsection (6), above, shall be guilty of an offense punishable un<strong>de</strong>r Item 10.<br />

8.8 If the irregu<strong>la</strong>rity consists of a sanctionable activity i<strong>de</strong>ntified in item 10, the firearms<br />

or re<strong>la</strong>ted materials, ammunition, or explosives as the case may be shall be embargoed and<br />

subject to forfeiture in accordance with <strong>la</strong>w.<br />

9. Prohibitions on Exports of Firearms and Re<strong>la</strong>ted Materials, Ammunition and Explosives<br />

Commentary<br />

Each country will have <strong>de</strong>veloped <strong>la</strong>ws and policies that would prohibit the export of<br />

firearms and re<strong>la</strong>ted materials, ammunition and explosives in particu<strong>la</strong>r circumstances<br />

usually i<strong>de</strong>ntified in the commitments assumed when the country has ratified a particu<strong>la</strong>r<br />

international treaty. The authority responsible for reviewing and issuing export control<br />

licenses (the Office of Export Controls) would refuse to issue a license whenever it <strong>de</strong>termined<br />

that the application did not meet published criteria.<br />

In view of the nature of these cases, refusals should be confirmed by the official responsible<br />

for the Office of Export Controls.<br />

Text<br />

9.1 The official responsible for the Office of Export Controls shall, pursuant to a governmental<br />

directive, refuse to grant licenses for and prohibit the export of firearms or re<strong>la</strong>ted<br />

materials, ammunition or explosives if he has reason to believe that the export of those<br />

products will, or seriously threaten to:<br />

a) Result in acts of genoci<strong>de</strong> or crimes against humanity;<br />

b) Vio<strong>la</strong>te human rights contrary to international <strong>la</strong>w;<br />

c) Lead to the perpetration of war crimes contrary to international <strong>la</strong>w;<br />

d) Vio<strong>la</strong>te a United Nations Security Council embargo or other multi<strong>la</strong>teral sanctions<br />

to which the country adheres, or that it uni<strong>la</strong>terally applies;<br />

e) Support or encourage terrorist acts;<br />
