“License” or “licensing” means the license required for a person to perform brokering<br />

activities pursuant to Article 4.<br />

“Parts and components” means, in re<strong>la</strong>tion to firearms, those elements that are essential<br />

to their operation.<br />

“Person” inclu<strong>de</strong>s natural and legal persons.<br />

“Registration” means the registration of a natural or legal person as a broker in accordance<br />

with Article 3.<br />

“Serious crime” means conduct constituting an offense punishable by a maximum <strong>de</strong>privation<br />

of liberty of at least four years or a more serious penalty.<br />

(What constitutes a “serious crime” may differ from country to country, and in other countries,<br />

may not be <strong>de</strong>fined in national <strong>la</strong>w. In these Regu<strong>la</strong>tions, the expression is used in<br />

Articles 3 and 4 for the purpose of <strong>de</strong>termining an applicant’s eligibility for registration and/<br />

or licensing, with the i<strong>de</strong>a of rejecting applicants convicted of a type of crime that would make<br />

it un<strong>de</strong>sirable that they engage in arms brokering, for example, an offense that suggests a connection<br />

to organized crime. The same <strong>de</strong>finition is used in the United Nations Transnational<br />

Organized Crime Convention.)<br />

Article 2<br />

National Authority<br />

1. The National Authority for the registration or licensing of brokers shall be the Office<br />

of ________, situated in the Ministry of ___________.<br />

2. The National Authority shall <strong>de</strong>signate the officials authorized to conduct the registration<br />

of brokers and/or the licensing of brokering activities in accordance with Articles 3<br />

and 4 respectively.<br />

3. The National Authority shall make avai<strong>la</strong>ble the name of the officials authorized to<br />

carry out licensing or registration to national authorities of other member states upon<br />

request.<br />

(The sharing of the i<strong>de</strong>ntity of officials of the National Authority referred to in paragraph (3)<br />

is for purposes of effecting cooperation among countries to facilitate exchanging information<br />

about brokers.)<br />

Registration<br />

(Registration is <strong>la</strong>rgely viewed as an additional and optional element of brokering controls.<br />
