Certa<strong>in</strong>ly, a lot has been written about what <strong>in</strong>telligence is. The author’s own works arecontributions toward clarify<strong>in</strong>g this question. 125 It is also useful to note Michael Warner’sanalysis regard<strong>in</strong>g <strong>the</strong> difficulties <strong>in</strong>volved <strong>in</strong> conceptualiz<strong>in</strong>g <strong>in</strong>telligence, which concludes:<strong>Intelligence</strong> is someth<strong>in</strong>g that is: dependent upon confidential sources andmethods for full effectiveness; performed by officers of <strong>the</strong> state for state purposes(this implies that those officers receive direction from <strong>the</strong> state’s civilianand military leaders); focused on foreigners — usually o<strong>the</strong>r states, but oftenforeign subjects, corporations, or groups (if its objects are domestic citizens,<strong>the</strong>n <strong>the</strong> activity becomes a branch of ei<strong>the</strong>r law enforcement or governance);...Hereis my def<strong>in</strong>ition: <strong>Intelligence</strong> is secret, state activity to understandor <strong>in</strong>fluence foreign entities. 126Although as time goes by it becomes more debatable whe<strong>the</strong>r to def<strong>in</strong>e <strong>in</strong>telligence <strong>in</strong>terms of secrets, more than a secret activity, it is an activity with secrets, given <strong>the</strong> greatamount of open <strong>in</strong>formation sources typical of <strong>the</strong> “<strong>in</strong>formation age,” that <strong>in</strong>clude <strong>the</strong> Internet,scientific networks, and <strong>the</strong> like, and <strong>the</strong> <strong>in</strong>creas<strong>in</strong>g need to resort to outsiders — academiciansor researchers <strong>in</strong> topics of <strong>in</strong>terest, <strong>the</strong> <strong>in</strong>creas<strong>in</strong>g availability of public <strong>in</strong>formationand academic activity relative to <strong>in</strong>telligence — <strong>the</strong>re is no doubt that <strong>in</strong>telligence cont<strong>in</strong>uesand presumably will cont<strong>in</strong>ue to be characterized by secrets. This is because <strong>the</strong>re will alwaysbe some th<strong>in</strong>gs that a State will want to keep o<strong>the</strong>rs from know<strong>in</strong>g; what a State wants toknow about o<strong>the</strong>r States is <strong>the</strong> same <strong>in</strong>formation that <strong>the</strong> first State seeks to keep secret.Let us now exam<strong>in</strong>e <strong>the</strong> mean<strong>in</strong>g of <strong>in</strong>telligence <strong>in</strong> Lat<strong>in</strong> American countries.Brazil’s law number 9,883 (1999) — <strong>the</strong> first sanctioned, organic law on <strong>in</strong>formation and<strong>in</strong>telligence <strong>in</strong> Lat<strong>in</strong> America s<strong>in</strong>ce <strong>the</strong> Cold War — <strong>in</strong>stituted a <strong>National</strong> <strong>Intelligence</strong> Systemand established <strong>the</strong> pr<strong>in</strong>ciple of parliamentary control over <strong>in</strong>telligence.
