15.5. Lazada reserves the right to impose Order value and/or<br />
Transaction limits (either a minimum limit or a maximum<br />
limit) on some or all Customers or the Seller relating to the<br />
value of any Transaction, the cumulative value of all<br />
Transactions during a period of time, or the number of<br />
Transactions per day or other period of time. Lazada will<br />
not be liable to the Seller:<br />
a. If Lazada does not proceed with an Order or Transaction<br />
that would exceed any limit established by Lazada, or<br />
b. If Lazada permits a Customer to withdraw from a<br />
Transaction because the Platform or the Goods are<br />
unavailable following the commencement of a Transaction.<br />
15.6. The Seller shall be responsible for all relevant taxes, duties,<br />
fees and other charges arising out of or associated with the<br />
Payments, and the Seller undertakes to Lazada that it shall<br />
pay all such taxes, duties, fees and other charges on time.<br />
To the extent required by the applicable Law, Lazada shall<br />
be entitled to withhold any and all taxes in connection with<br />
the Payments. In the event that Lazada is held liable for<br />
any taxes in connection with in connection with the<br />
Payments, the Seller shall indemnify Lazada for such tax<br />
liability irrespective of when such tax liability is assessed.<br />
15.5. Lazada berhak untuk menerapkan batasan nilai Pesanan<br />
dan/atau Transaksi (baik batasan minimal atau batasan<br />
maksimal) pada beberapa atau seluruh Pelanggan atau<br />
Penjual sehubungan dengan nilai Transaksi, nilai kumulatif<br />
dari seluruh Transaksi pada periode tertentu, atau dari<br />
jumlah Transaksi per hari atau periode waktu lainnya.<br />
Lazada tidak akan bertanggung jawab kepada Penjual,<br />
dalam hal berikut:<br />
a. Apabila Lazada tidak memproses Pesanan atau Transaksi<br />
yang dapat melebihi batas yang ditentukan Lazada, atau<br />
b. Apabila Lazada mengizinkan Pelanggan untuk<br />
membatalkan suatu Transaksi karena Platform atau Barang<br />
tidak tersedia setelah dimulai suatu Transaksi.<br />
15.6. Penjual bertanggung jawab atas seluruh pajak, pungutan,<br />
biaya dan ongkos lainnya yang timbul dari atau terkait<br />
dengan Pembayaran, dan Penjual menjamin Lazada bahwa<br />
Penjual akan membayar seluruh pajak, pungutan, biaya<br />
dan ongkos tersebut tepat waktu. Selama dizinkan oleh<br />
Hukum yang berlaku, Lazada memiliki hak untuk<br />
memungut setiap dan seluruh pajak sehubungan dengan<br />
Pembayaran. Dalam hal Lazada diwajibkan untuk<br />
bertanggung jawab atas pajak manapun sehubungan<br />
dengan Pembayaran, Penjual wajib mengganti kewajiban<br />
pajak yang dibayarkan Lazada tersebut tanpa<br />
memperhitungkan kapan pajak tersebut dikenakan kepada<br />
Lazada.<br />
16. Default Fee Policy 16. Kebijakan Biaya Pelanggaran<br />
16.1. Any violation of the General Terms and Conditions and / or<br />
Special Terms and Conditions of this Agreement and/or the<br />
16.1. Setiap pelanggaran terhadap Syarat dan Ketentuan Umum<br />
dan/atau Ketentuan Khusus dari Perjanjian ini dan/atau –<br />
terms and condition in Default Fee Policy of syarat dan ketentuan dalam Kebijakan Biaya Pelanggaran<br />
Lazada(“Default Fee Policy”), entitles Lazada to charge to<br />
the Seller Default Fee (“Default Fee”) in accordance with<br />
the Default Fee Policy of Lazada, related to the service<br />
provided and to be provided by Lazada to the Seller by<br />
Order. Lazada reserves the right to change the Default Fee<br />
Policy at any time without prior notice to the Seller but<br />
Lazada will still subsequently notify the official changes of<br />
the Default Fee Policy to the Seller.<br />
Lazada (“Kebijakan Biaya Pelanggaran“), memberikan hak<br />
kepada Lazada untuk menagihkan Biaya Pelanggaran<br />
(“Biaya Pelanggaran“) kepada Penjual sesuai dengan<br />
Kebijakan Biaya Pelanggaran Lazada, terkait dengan<br />
layanan yang disediakan dan yang akan disediakan oleh<br />
Lazada kepada Penjual berdasarkan Pesanan. Lazada<br />
berhak untuk mengubah Kebijakan Biaya Pelanggaran<br />
sewaktu-waktu tanpa pemberitahuan terlebih dahulu<br />
sebelumnya kepada Penjual namun Lazada akan tetap<br />
memberitahukan perubahan resmi atas Kebijakan Biaya<br />
Pelanggaran tersebut kepada Penjual.<br />
The Seller’s continued use of the Platform shall indicate the<br />
Seller’s approval and agreement to submit to the changes<br />
notified to it.<br />
16.2. Lazada will charge the Seller the Default Fee as<br />
applicable.The charging will be informed to the Seller and<br />
will include the following data: number and date of the<br />
Order, Object and detailed Activity Fees or any other<br />
required data.<br />
Dengan terus menggunakan Platform, Penjual<br />
mengindikasikan persetujuan dan kesepakatan Penjual<br />
untuk tunduk terhadap perubahan-perubahan yang telah<br />
diberitahukan kepadanya tersebut.<br />
16.2. Lazada akan menagih Biaya Pelanggaran kepada Penjual<br />
sebagaimana berlaku. Pembebanan akan diberitahukan ke<br />
Penjual dan sudah termasuk data mengenai: nomor dan<br />
tanggal Pesanan, Objek dan rincian Biaya Aktivitas atau<br />
data lain yang diperlukan.<br />
