n conformitate cu Legea nr. 38-XVI din 2008.02.29 privind protecţia mărcilor, cererea de înregistrare
a mărcii se depune la AGEPI de către solicitant, personal sau prin intermediul unui reprezentant.
O cerere trebuie să se refere la o singură marcă şi trebuie să conţină documentele prevăzute în art. 30 din
Lege.
Orice persoană interesată în termen de 3 luni de la data publicării datelor cu privire la cererea depusă
poate prezenta în scris la AGEPI observaţii motivate privind necesitatea de a refuza înregistrarea
mărcii conform art. 7 şi/sau să formuleze o opoziţie la înregistrarea mărcii pe motiv că înregistrarea
acesteia ar trebui refuzată în baza prevederilor art. 8 din Lege.
I
n accordance with the Law No. 38-XVI of 2008.02.29 on the Protection of Trademarks an application
for registration of a trademark shall be filed with the AGEPI in person or through a representative.
The application shall concern only one trademark and shall contain the documents provided in Art. 30
of the Law.
Any person concerned may present, within three months following the date of publication of the data
concerning the filed apllication, with the AGEPI written reasoned observations concerning the refusal
of the registration of a trademark in accordance with Art. 7 of the Law and/or formulate an opposition
against the registration of a trademark on the ground of provisions of Art. 8 of the Law.
