By virtue of the law, there is a mutual obligation<br />
between certain persons (parents and children, marriage<br />
or civil union spouses), under which one may<br />
claim support from the other, in other words, the<br />
amounts necessary for the person’s subsistence (food,<br />
housing, clothing, health care, etc.).<br />
The present discusses child support, which can be<br />
defined as money one parent pays to the other parent<br />
for the benefit of the child or children.<br />
When parents separate, they are still both required<br />
to contribute to the needs of their child or children.<br />
Married or not, this obligation applies.<br />
How do you apply for child support?<br />
There are two ways:<br />
The two parents can reach an agreement. They<br />
can then have it approved by a court officer called a<br />
‘special clerk.‘ This clerk has some of the powers of a<br />
judge. Parents are not obliged to have an agreement<br />
approved by the special clerk, but there are advantages<br />
to this. For example, if an agreement is approved,<br />
Revenu Québec makes sure that child support is paid.<br />

OR<br />
Either parent can go to court to ask for child support.<br />
Parents can hire a lawyer to prepare and file the<br />
request — called a “motion” — or they can do this<br />
on their own.<br />
