Most of the people consider that this parable<br />

illustrates that compassion must be a universal<br />

moral duty, and that fulfilling the spirit of the Law is<br />

just as important as fulfilling the letter of the Law.<br />

The Good Samaritan Law is then in fact a universal<br />

moral concept according to whatever the legal<br />

system is, it has to support and encourage people<br />

to assist and rescue those in need. But, usually,<br />

such moral concepts, cannot be invoked in Court.<br />

The legal systems then have to integrate specific<br />

rules in order to encourage in assisting those in<br />

need, and to reduce the bystander’s hesitation in<br />

assisting, for fear of being sued or prosecuted for<br />

unintentional injury or wrongful death.<br />

Two main legal systems exist in <strong>Europe</strong> : The<br />

English common Law, and the Civil Law originally<br />

based on the Napoleonic Code that has been<br />

impacting so many <strong>Europe</strong>an legal systems.<br />

Let’s have a look at these two primary legal<br />

systems in order to appreciate how the <strong>Europe</strong>an<br />

legal systems deal with the “Good Samaritan Law”.<br />
