As a Conclusion...<br />

Considering the controversial approach of the<br />

main legal systems facing <strong>Europe</strong>,<br />

Even if the “Good Samaritan Law” as a legal<br />

concept, only provides a defence against torts<br />

arising from attempted rescue, in countries in<br />

which the legal system is based on the Common<br />

Law,<br />

Cases in which the Civil Law, on the contrary,<br />

imposes the Duty to Rescue, in countries in which<br />

the legal system is based on the Civil Law,<br />

These two different legal systems abide by the<br />

“Good Samaritan Law” as a universal moral duty,<br />

which is to be legally protected.<br />

Anytime the Common Law legal systems consider<br />

adding Duty to Assist in statute law.<br />

The Civil Law legal systems increasingly institute<br />

specific rules to protect the rescuer, i.e. by creating<br />

an implied contract between the rescuer and the<br />

victim, or, rather unanimously, by admitting the<br />

“Status of Necessity” as a legal defence.<br />

ECC regulation could contribute, in the future, to<br />

unify the legal systems based on the Civil Law,<br />

but until then, the French approach of an implied<br />

contract of reciprocal assistance could be a clever<br />

solution, to protect the interests of all the diving<br />

partners.<br />

Unifying the rules could actually be one of the<br />

easiest solutions, especially when partners come<br />

from different countries, stipulating a written<br />

contract such as:<br />

“By diving all together, we reciprocally engage in<br />

assisting and rescuing those of us in need, and to<br />

be indemnified against damages we may incur”.<br />

The imposition of such a contract belongs to<br />

diving organizations and insurance companies<br />

are to cover such a risk...according to...”The Good<br />

Samaritan...contractual...Law”.<br />
