Switzerland: Changes to social insurance as of January 1, 2024<br />
Since the AHV pension will not be increased until January 1, 2025, the key figures in social insurance will not change in 2024:<br />
Maximum full pension per month: CHF 2,450<br />
BVG coordination deduction: CHF 25,725<br />
Maximum pensionable salary for BVG: CHF 88,200<br />
Maximum insured salary for ALV and UVG: CHF 148,200<br />
The AHV reform (AHV21) comes into force on 1.1.2024, which includes the introduction of a reference age of 70 for men. The<br />
retirement age remains the same. This means that if a person has already reached retirement age but still wishes to work<br />
after this age, they will continue to pay AHV contributions until they reach the reference age. The reference age for women<br />
will not be adjusted until 2025.<br />
China: Simplification of the visa process<br />
The Chinese government has been working on simplifying the visa application process since October. In the meantime, it<br />
has also successfully implemented this in some countries. One part of the simplification is that people no longer must<br />
submit their visa application in person but can do so by post or online. In addition, the number of previous trips has been<br />
reduced, as has information on the level of education.<br />
Finally, the number of countries whose nationals can travel through without a visa for up to 6 days has been increased to<br />
54 countries. These include 25 countries from the Schengen area, including Switzerland.<br />
Saudi Arabia: Significant reduction in fines for labour market violations<br />
Fines have been reduced by the Ministry of Human Resources and Social Development (MHRSD) by up to 90% in some<br />
cases. We have listed some of the adjusted fines below:<br />
Hiring a foreigner without a valid work permit: SAR 10'000 (approx. CHF 2'302 / approx. EUR 1946)<br />
Employment of a foreigner not in the specified job according to the work permit: SAR 300 to SAR 1,000 (approx. CHF 69<br />
to CHF 230 / approx. EUR 73 to EUR 243)<br />
Employment of a foreigner for a job for which only Saudi Arabian nationals may be employed: SAR 2,000 to SAR 8,000<br />
(approx. CHF 460 to CHF 1,841 / approx. EUR 486 to EUR 1,946)<br />

Schweiz: Änderungen per 1. Januar 2024 im Sozialversicherungsbereich<br />
Aufgrund dessen, dass die AHV-Rente erst per 1. Januar 2025 angehoben werden, ändern sich die Eckwerte in der<br />
Sozialversicherung in 2024 nicht:<br />
Maximale Vollrente pro Monat: CHF 2‘450<br />
Koordinationsabzug BVG: CHF 25‘725<br />
Maximal anrechenbarer Lohn bei der BVG: CHF 88‘200<br />
Maximal versicherter Lohn bei ALV und UVG: CHF 148‘200<br />
Per 1.1.2024 tritt die AHV-Reform (AHV21) in Kraft, welche unter anderem die Einführung eines Referenzalters von Alter 70<br />
für Männer mit sich zieht. Das Rentenalter bleibt bestehen. Dies bedeutet, dass wenn eine Person bereits das Rentenalter<br />
erreicht hat, jedoch danach noch arbeiten möchte, sie bis zum Erreichen des Referenzalters noch rentenbildend AHV-<br />
Beiträge bezahlen. Das Referenzalter für Frauen wird erst ab 2025 angeglichen.<br />
China: Vereinfachung des Visums-Prozesses<br />
Seit Oktober ist die chinesische Regierung bereits daran, den Beantragungsprozess eines Visums zu vereinfachen. Dies hat<br />
sie auch in der Zwischenzeit in einigen Ländern erfolgreich durchgesetzt. Ein Teil der Vereinfachung besteht darin, dass<br />
Personen nicht mehr persönlich das Visumsgesuch einreichen müssen, sondern dies postalisch oder online vornehmen<br />
können. Des Weiteren ist die Angabe der Anzahl von vorherigen Reisen gekürzt worden sowie Angaben in Bezug auf den<br />
Ausbildungsgrad.<br />
Letztendlich wurde auch die Anzahl der Länder, deren Staatsangehörige ohne ein Visum für bis zu 6 Tage durchqueren<br />
können, auf 54 Länder erhöht. Hierzu zählen unter anderem 25 Länder aus dem Schengenraum, inklusive der Schweiz.<br />
Saudi-Arabien: Erhebliche Reduktion der Bussen bei Arbeitsmarktverletzungen<br />
Die Bussen wurden teilweise um bis zu 90 % von dem Ministerium für Arbeitsmarkt und Sozialentwicklung (MHRSD)<br />
reduziert. Nachfolgend haben wir einige der angepassten Bussen aufgelistet:<br />
Anstellung eines Ausländers ohne eine gültige Arbeitsbewilligung: SAR 10‘000 (ca. CHF 2‘302 / ca. EUR 1946)<br />
Anstellung eines Ausländers nicht in dem angegebenen Job gemäss der Arbeitsbewilligung: SAR 300 bis SAR 1‘000 (ca.<br />

Best Practice<br />
The accompanying family is often forgotten<br />
Although we are all aware that the family is very important, especially in the context of assignments, it is often forgotten.<br />
The still very high number of aborted assignments due to family issues should not be ignored.<br />
When planning a foreign assignment, the focus is placed on the employee, as there are already several discussion points and<br />
legal clarifications that need to be made. Only after the remuneration package including all allowances has been put<br />
together, the assignment contract signed, and the work permit obtained can the actual foreign assignment begin.<br />
Example<br />
Drinks AG, based in Zurich, would like to send its employee Reto Meier to the USA for two years. His wife and two children as<br />
well as his mother-in-law are to accompany him.<br />
HR has already prepared everything for Mr. Meier but has completely overlooked the fact that his wife and children will also<br />
be accompanying him.<br />
What needs to be done for the family so that they can accompany Mr. Meier to the USA?<br />
Solution<br />
The first step would be to apply for a residence permit for the wife and the two children within the framework of family<br />
reunification in the USA. In addition, it should be clarified to what extent the mother-in-law can also obtain a residence<br />
permit for the USA for two years. If this is not the case, alternatives should be examined. The costs of the residence permit for<br />
the family are usually paid by the employer. Depending on the definition of family, this includes the costs for the mother-inlaw's<br />
residence permit.<br />
If the two children are of school age, the second step should be to look for a school that meets their needs. An international<br />
or German school may be a good option, with the understanding that both children will return to Switzerland after two years<br />
and continue their school career here. The school costs incurred are often covered by the employer during the assignment<br />
abroad.<br />
In a third step, the wife's situation should be examined more closely. If the wife wishes to work in the USA during the<br />
assignment abroad and the corresponding diplomas are required, it should be checked whether the existing Swiss diplomas<br />
are recognized in the USA.<br />

Best Practice<br />
Often the spouses are gainfully employed in their home country before the assignment abroad and have to give up their jobs.<br />
In some cases, the employee also requests that the loss of the spouse's income should be compensated by the employer. We<br />
recommend paying a lump sum (spousal support), which the spouse can then use to attend further training courses in the<br />
country of assignment, for example. This also promotes the spouse's integration into the country of assignment.<br />
The fourth step, and one of the most important, is about family insurance coverage.<br />
As part of the international health insurance taken out for the employee, the accompanying family, including the mother-inlaw,<br />
can usually be included without further ado.<br />
Depending on the social security agreement, it must be checked whether the accompanying family is also insured under the<br />
AHV/IV during the assignment abroad. By the provisions of the social security agreement between the USA and Switzerland,<br />
co-insurance of the non-working family is included. The employer should take care of the necessary formalities and<br />
clarifications so that the insurance coverage can be clearly defined during the assignment abroad.<br />
However, this does not include the mother-in-law. This means that she would have to be considered separately and,<br />
depending on her situation and age, apply for continued insurance voluntarily.<br />
If the wife takes up gainful employment in the USA, co-insurance is not possible. Here, too, there is the possibility of<br />
reviewing continued insurance voluntarily.<br />
Finally, the accompanying family should also be granted one flight home per year so that the connection to the home<br />
country is maintained.<br />

Best Practice<br />
Die begleitende Familie geht häufig vergessen<br />
Obwohl uns allen bewusst ist, dass die Familie gerade im Rahmen von Entsendungen sehr wichtig ist, geht diese doch häufig<br />
vergessen. Die nach wie vor sehr hohen Zahlen von Entsendungsabbrüchen, basierend auf der Familie, sind nach wie vor<br />
nicht ausser Acht zu lassen.<br />
Bei der Planung eines Auslandseinsatzes wird der Fokus auf den Mitarbeiter gesetzt, denn schon hierzu gibt es eine Vielzahl<br />
von Diskussionspunkten sowie auch rechtliche Abklärungen, welches zu treffen gilt. Erst nachdem das Vergütungspaket<br />
inklusive aller Zulagen geschnürt, der Entsendungsvertrag unterschrieben und die Arbeitsbewilligung eingeholt ist, kann der<br />
eigentliche Auslandseinsatz beginnen.<br />
Beispiel<br />
Die Drinks AG mit Sitz in Zürich möchte ihren Mitarbeiter Reto Meier für 2 Jahre in die USA entsenden. Seine Ehefrau und<br />
seine beiden Kinder sowie seine Schwiegermutter sollen ihn begleiten.<br />
Für Herrn Meier hat das HR bereits alles vorbereitet, aber es ist dabei vollkommen untergegangen, dass seine Frau und die<br />
Kinder ihn ebenfalls begleiten.<br />
Was müsste für die Familie getan werden, damit sie Herrn Meier in die USA begleiten können?<br />
Lösung<br />
In einem ersten Schritt müsste für die Ehefrau und die beiden Kinder eine Aufenthaltsbewilligung im Rahmen des<br />
Familiennachzugs für die USA beantragt werden. Zudem müsste abgeklärt werden, inwieweit die Schwiegermutter ebenfalls<br />
eine Aufenthaltsbewilligung für die USA für die zwei Jahre erhalten kann. Sollte dies nicht der Fall sein, sollten Alternativen<br />
geprüft werden. Die Kosten für die Aufenthaltsbewilligung für die Familie werden in der Regel vom Arbeitgeber bezahlt. Dies<br />
schliesst, je nach Definition von Familie, die Kosten für die Aufenthaltsbewilligung der Schwiegermutter mit ein.<br />
Sofern die beiden Kinder schulpflichtig sind, sollte in einem zweiten Schritt eine Schule gesucht werden, die den<br />
Bedürfnissen entspricht. Möglicherweise ist eine internationale oder deutsche Schule eine gute Option, mit dem, dass die<br />
beiden Kinder nach 2 Jahren wieder zurück in die Schweiz kommen werden und hier ihre Schulkarriere weiterführen. Die<br />
anfallenden Schulkosten werden häufig vom Arbeitgeber während des Auslandseinsatzes übernommen.<br />
In einem dritten Schritt sollte die Situation der Ehefrau genauer angeschaut werden. Für den Fall, dass die Ehefrau während<br />
des Auslandseinsatzes in den USA arbeiten möchte und dafür entsprechende Diplome notwendig sind, sollte geprüft werden,<br />
ob die vorhandenen Schweizer Diplome in den USA anerkannt werden.<br />

Best Practice<br />
Häufig sind die Ehepartner vor dem Auslandseinsatz im Heimatland erwerbstätig und müssen ihre Arbeitsstelle aufgeben. In<br />
einigen Fällen kommt der Mitarbeiter auch mit dem Wunsch, dass der Verlust des wegfallenden Einkommens des<br />
Ehepartners, vom Arbeitgeber ausgeglichen werden soll. Wir empfehlen, eher die Zahlung einer Pauschale (Spousal Support),<br />
mit der der Ehepartner dann bspw. an Weiterbildungskursen im Einsatzland teilnehmen kann. Dies fördert dann auch<br />
gleichzeitig die Integration des Ehepartners im Einsatzland.<br />
Der vierte Schritt und der mit aus wichtigstem Schritt dreht sich um den Versicherungsschutz der Familie.<br />
Im Rahmen der internationalen Krankenversicherung, welche für den Mitarbeiter abgeschlossen wird, kann die begleitende<br />
Familie und hier auch die Schwiegermutter in der Regel ohne weiteres eingeschlossen werden.<br />
Je nach Sozialversicherungsabkommen ist zu prüfen, ob die begleitende Familie während des Auslandseinsatzes im Rahmen<br />
der AHV/IV mitversichert ist. Gemäss den Regelungen des Sozialversicherungsabkommens zwischen den USA und der<br />
Schweiz ist die Mitversicherung der nicht erwerbstätigen Familie eingeschlossen. Die notwendigen Formalitäten und<br />
Abklärungen sollten vom Arbeitgeber übernommen werden, sodass der Versicherungsschutz auch während des<br />
Auslandseinsatzes klar definiert werden kann.<br />
Allerdings schliesst dies die Schwiegermutter nicht mit ein. Dies bedeutet für sie müsste separat dies angesehen werden und<br />
je nach Situation und Alter die Weiterversicherung auf freiwilliger Basis beantragt werden.<br />
Sofern die Ehefrau in den USA eine Erwerbstätigkeit aufnehmen würde, ist die Mitversicherung nicht möglich. Auch hier<br />
besteht die Möglichkeit der Prüfung der Weiterversicherung auf freiwilliger Basis.<br />
Letztendlich sollte der begleitenden Familie auch ein Heimflug pro Jahr gewährt werden, sodass die Verbindung zum<br />
Heimatland aufrechterhalten bleibt.<br />
