members-only section. I would also like to encourage you<br />

As any website is a work in progress, please do not<br />

hesitate to send me any comments about it as we will be<br />

constantly working on improving graphics and content<br />

as well as back-office administration to make it easier for you to sign up for events,<br />

seminars, and open houses.<br />

FROM THE DESK OF THE PRESIDENT<br />

Greetings, fellow members. It has been five years since I joined the FYBA Board of<br />

Directors and never did I think I would serve this long, much less become your president.<br />

Before I went to my first meeting, I do remember asking one veteran broker and early<br />

board member about his time at FYBA. He stated that FYBA gave him the opportunity to give<br />

back to the industry that had given him so much and that he wanted to help the industry<br />

itself become more professional. I think that his summation is what has driven me and many<br />

other board members, and it is a mantra for FYBA’s mission statement: “To help promote<br />

professionalism and cooperation amongst its members”. This year’s board is no exception for<br />

giving their time and effort to the cause. Five directors live at least an hour away by car and one<br />

comes from west coast of <strong>Florida</strong> and often flies here. We are also fortunate to have four past<br />

FYBA presidents sitting on the board. Talk about dedication!<br />

During these last five years, there have been several notable accomplishments and changes<br />

at FYBA of which we are very proud. We have highlighted these in the new COMPASS and<br />

during the seminars, as well as at other FYBA events. People have taken notice and our voice<br />

has been heard. There is more yet to come and we stand ready to tackle the unexpected. We<br />

do need and want your input, so please send in your ideas and suggestions. Most importantly<br />

there is strength in numbers, so we encourage you to be an advocate for FYBA membership<br />

on a daily basis. Membership is easy and effortless with access to the (new and improved)<br />

website and the benefits are numerous. We currently have 1,100 members divided between 600<br />

professional broker members and 500 affiliate members. <strong>Brokers</strong> have voting rights, yet there<br />

are1,900 licensed brokers registered with the State of <strong>Florida</strong> who are not FYBA members, so<br />

there is a need to enlist their membership. Affiliates also benefit greatly from their membership<br />

as it gives them a chance to participate in FYBA’s many educational and networking events, and<br />

they in turn help to give us a broader reach within the industry.<br />

As many of you know, FYBA and Show Management own the <strong>Yacht</strong> and Brokerage Show in<br />

Miami Beach and we are pleased to announce that it was one of the largest shows ever. FYBA’s<br />

partnership with Show Management will stretch another 30 years, not only ensuring a quality<br />

event in Miami for exhibitors but also a pleasant experience for the end consumer. The South<br />

<strong>Florida</strong> boat shows continue to be marquee events so important to stimulating and promoting<br />

our industry and we are constantly working on ways to make these events better and more<br />

FYBA Legislative Affairs Committee Changes<br />

Its Name but Keeps its Focus on Helping <strong>Florida</strong>’s<br />

Marine Industry Recover and Grow<br />

<strong>Florida</strong>’s <strong>2012</strong> legislative season has come and gone quietly for boating industry interests.<br />

With the end of the regular session on <strong>March</strong> 9, state legislators still are scheduled to<br />

reconvene this spring in special session. However, they’re only allowed to tackle one bill<br />

in special session, and their focus is certain to be on state redistricting.<br />

While we didn’t face the legislative battles that dominated our activities the last two years,<br />

FYBA’s government relations efforts continue unabated. At this point, I’d like to update you on<br />

some important changes and legislative issues that face us going forward.<br />

First, the FYBA Legislative Affairs Committee has changed its name to the Public Affairs<br />

Committee. We feel this change more accurately reflects the current focus of our efforts, which<br />

not only include legislative issues and lobbying at the state and federal level, but also public<br />

relations and promoting boating and the modifications to public policy that make it more<br />

enjoyable and affordable in <strong>Florida</strong>.<br />

The committee’s overarching goal continues to be to help <strong>Florida</strong>’s marine industry recover<br />

and grow by attracting, retaining and maintaining boats in <strong>Florida</strong>. We also are committed to<br />

promoting <strong>Florida</strong> nationally and internationally as a boating and marine tourism destination.<br />

With these goals in mind, Jason Dunbar and I recently attended a regional forum of The<br />

Department of Economic Opportunity’s Division of Strategic Business Development, which is<br />

designed to help gather information related to the creation of <strong>Florida</strong>’s <strong>2012</strong>-2017 Statewide<br />

Strategic Plan for Economic Development. The purpose of this forum is to review and prioritize<br />

goals, objectives and strategies for implementation by state government that would assist <strong>Florida</strong>’s<br />

regions with economic development and job creation. Tourism is a part of their mission, which<br />

is the largest industry in <strong>Florida</strong>. The marine industry is a huge driver of tourism in the state.<br />

Legislatively, FYBA made progress in that yacht brokers were not included in a new version<br />

of the deregulation bill that surfaced this year. State legislators have to come to realize the value<br />

of supporting the <strong>Florida</strong> <strong>Yacht</strong> & Ship <strong>Brokers</strong> Act and licensing yacht brokers to insure the<br />

highest level of professionalism and ethical conduct.<br />

Finally, despite some initial concerns to the contrary, there was no attempt by legislators to<br />

scuttle the $18,000 sales tax cap on boat sales, which became law on July 1, 2010. Thanks to our<br />

research, which clearly shows the overwhelmingly positive impact the cap has had on driving<br />

boat sales and protecting marine and other related jobs in the state, most legislators have come<br />

appreciate the cap’s benefits – at least for now.<br />

In <strong>March</strong>, we issued a press release on the results of a study of member brokers and state<br />

tax revenue information. It found that, thanks to the cap, <strong>Florida</strong> took in nearly 10 times as much<br />

sales tax revenue on the sale of tax-capped boats than was projected by the state in the first year<br />

following its implementation. (Please see story next page.)<br />

WIN-WIN fOr fLOrIdA<br />

<strong>Florida</strong> took in nearly 10 times as much sales tax revenue on the sale of tax-capped<br />

boats than was projected by the state in the first year following implementation of the<br />

Maritime Full Employment Act provisions of a major jobs bill signed into law in 2010,<br />

according to a study just released by the <strong>Florida</strong> <strong>Yacht</strong> <strong>Brokers</strong> <strong>Association</strong> (FYBA) and the<br />

Marine Industries <strong>Association</strong> of South <strong>Florida</strong> (MIASF).<br />

The new law puts an $18,000 sales-and-use tax cap on boats purchased or brought into<br />

<strong>Florida</strong>. Research indicated that <strong>Florida</strong>’s marine industry was losing sales to nearby states<br />

and foreign countries with lower or no sales taxes at all.<br />

The new sales-and-use tax cap generated in excess of $13.46 million in direct sales tax<br />

revenue for the state, compared to a $1.5 million first-year loss that had been projected by a<br />

<strong>Florida</strong> legislative staff analysis. Thomas J. Murray and Associates <strong>Inc</strong>. conducted the initial<br />

research and subsequent survey.<br />

Prior to July 1, 2010, all boats sold and or delivered in <strong>Florida</strong> were subject to a 6 percent<br />

sales-and-use tax, unless specifically exempt. A new 34-ft. powerboat costing $400,000, for<br />

example, would cost $24,000 more in taxes. In comparison, South Carolina has a $300 sales<br />

tax cap on boats and in North Carolina the cap is $1,500. No sales taxes are levied in the U.S.<br />

and British Virgin Islands as well as the Cayman Islands. As a result, more than six out of 10<br />

buyers of boats sold by <strong>Florida</strong> brokers were registering and operating their boats outside of<br />

<strong>Florida</strong> in order to legally avoid paying <strong>Florida</strong>’s sales tax.<br />

Especially hard hit by the Great Recession, the state’s $18 billion marine industry which<br />

employs 220,000 Floridians, sought help from the <strong>Florida</strong> legislature pointing out that the<br />

state’s 6 percent sales-and-use tax was counterproductive. Small business owners argued<br />

that it provided an incentive for Floridians to purchase boats out of state and maintain and<br />

provision them elsewhere, resulting in a loss of jobs and economic activity in <strong>Florida</strong>. The<br />

hefty use tax also discouraged non-residents from bringing their boats to <strong>Florida</strong> for service<br />

and provisioning.<br />

Among the survey’s findings:<br />

• The average sales price for post-cap transactions in <strong>Florida</strong> was $907,002 - nearly<br />

double the pretax value of closings taking place in <strong>Florida</strong> prior to the cap.<br />

• In the post-cap era, transactions for which either no sales tax was paid, or the closing<br />

was conducted out-of-state, dropped from 21.5 percent in the pre-cap era to an estimated<br />

12.8 percent following implementation of the sales tax cap.<br />

“The results of our survey research demonstrates beyond a doubt that setting a reasonable<br />

tax basis for high dollar purchases provides an incentive for more boats to be purchased,<br />

provisioned and kept plying the waters of <strong>Florida</strong>,” said FYBA spokesman Jeff Erdmann,<br />

owner of Bollman <strong>Yacht</strong>s of Fort Lauderdale.<br />

“More boats sold and registered in <strong>Florida</strong> means more business and jobs for Floridians,”<br />

he added. Erdmann singled out state Sens. Don Gaetz (R-Destin) and Ellyn Setnor Bogdanoff<br />

(R-Fort Lauderdale) as well as Reps. Tom Grady (R-Naples) and Will W. Weatherford (R-Wesley<br />

Chapel) for pushing the sales and-use tax cap through the legislative labyrinth and helping to<br />

preserve jobs in <strong>Florida</strong>’s marine industry.<br />

“I especially want to thank those legislators who were willing to listen to reason and<br />

research when it would have been much easier to stereotype the marine industry,” said<br />

Erdmann.<br />

The Captain’s on the Hook: How Do You Handle<br />

Non-Customary Customs Reporting?<br />

Given South <strong>Florida</strong>’s proximity to the Caribbean, many<br />

members of the yachting community enjoy short, often<br />

spontaneous, trips to nearby island nations. Five years ago, the<br />

United States Customs and Border Protection (CBP) made such island<br />

adventures even more convenient by<br />

creating the Local Boater Option<br />

program (LBO). The LBO allows<br />

U.S. citizens to pre-register with<br />

CBP and, thereafter, clear customs<br />

upon re-entry to the United States<br />

by simply phoning into their port<br />

of entry to announce their arrival.<br />

Recently, CBP further supplemented<br />

the LBO with the Small Vessel<br />

Reporting System (SVRS), which<br />

allows participating LBO members<br />

to report their intended arrival from<br />

foreign countries to the CBP online.<br />

Many South <strong>Florida</strong> boaters are<br />

aware of, and participate in, the LBO,<br />

so customs reporting may become a routine habit for fishing trips to<br />

the Bahamas. However, what happens when Bernie, the boat owner’s,<br />

brother, Joe, visits from Madison, or when Tony, a client from Dallas,<br />

comes along for the ride?<br />

The LBO registers individual boaters, not the vessels in which they<br />

ride. Therefore, assuming Joe and Tony do not participate in the LBO,<br />

they will not be able to breeze through customs with Bernie and the<br />

rest of the boaters on the trip. This is not a big deal, however. The LBO<br />

is a voluntary program, and no penalties exist if one or more members<br />

of a boating party do not participate. Non-participants will simply need<br />

to comply with the standard entry and reporting requirements. In this<br />

scenario, Joe and Tony each will need to personally visit the CBP at<br />

their port of entry to report their re-entry into the United States within<br />

24 hours of their arrival.<br />

So long as Joe and Tony complete the minor (although inconvenient)<br />

task of reporting in person to CBP officials, the story should end with<br />

Bernie, Joe, and Tony having a cold beer at the yacht club and a cooler<br />

full of fresh fish. But, what happens if Joe and Tony enjoy their cold<br />

beer and fresh fish so much that they forget to stop by the CBP office<br />

after their re-entry?<br />

Contrary to what one might imagine, Bernie, Joe, and Tony can<br />

continue frying their fresh fish without concern. It is Bernie’s captain,<br />

Harold, who is on the hook for Joe and Tony’s carelessness. The master<br />

of a vessel entering a U.S. port bears full responsibility for ensuring<br />

that all passengers on the vessel comply with the CBP’s entry and<br />

reporting requirements. Thus, even if Captain Harold instructed Joe<br />

and Tony as to the proper entry and reporting requirements, and even<br />

if Joe and Tony represent to Captain<br />

Harold that they visited the CBP<br />

office within 24 hours of arrival, and<br />

he had no knowledge that they did<br />

not, Captain Harold is liable for their<br />

failure to comply with the CBP’s<br />

entry and reporting requirements.<br />

So, what happens to Captain<br />

Harold if Joe and Tony fail to comply<br />

with the CBP’s entry and reporting<br />

requirements?<br />

Captain Harold may face civil<br />

penalties in the form of fines. More<br />

seriously, if CBP officials determine<br />

that Captain Harold intentionally<br />

violated the reporting requirements,<br />

he could face criminal penalties, including fines and imprisonment.<br />

Additionally, even if Captain Harold escapes civil and criminal penalties,<br />

the incident would be documented as an immigration violation on<br />

Captain Harold’s records. As a consequence, CPB could, and likely<br />

would, deny him admission to other programs that facilitate simplified<br />

re-entry procedures, such as the Global Entry Program or the Global<br />

Online Enrollment System (GOES).<br />

So, how can boat owners keep their captains off the hook in<br />

uncustomary customs reporting situations?<br />

Ultimately, captains themselves need to fully appreciate the<br />

responsibility they undertake when piloting a vessel to and from foreign<br />

ports. Accordingly, the captains need to take all feasible measures to<br />

guarantee that their passengers comply with the applicable CBP entry<br />

and reporting requirements, and they need to document their passengers’<br />

compliance. However, boat owners can aid their captains by imposing<br />

upon their guests the necessity of strict compliance with all entry and<br />

reporting procedures.<br />

boat show<br />

Apositive sign for the yachting industry, the 27 th Anniversary<br />

Palm Beach International Boat Show has expanded<br />

northward to encompass 40 more in-water slips at Palm<br />

Harbor Marina, and will have a larger land display than in previous<br />

years. The boat show, which is scheduled for <strong>March</strong> 22-25 in West<br />

Palm Beach, Fla., also will feature more yachts over 100 feet in<br />

length than ever before.<br />

“The location along Flagler Avenue is fabulous and the addition<br />

of city’s permanent docks and Palm Harbor’s two megayacht docks<br />

will really create a boat show for all interests” said FYBA President<br />

Lon McCloskey, president/director of The Marine Group, which is<br />

headquartered nearby in Palm Beach Gardens.<br />

“This is looking to be a very strong show,” said Dane Graziano,<br />

senior vice president and COO of Show Management, which<br />

produces the Palm Beach International Boat Show. “Exhibitor<br />

feedback from the <strong>Yacht</strong> & Brokerage Show in Miami Beach was<br />

very positive and we expect Palm Beach to follow suit.”<br />

The show is very popular with many yachting industry members,<br />

who find it to be more manageable and intimate than some of the<br />

larger <strong>Florida</strong> boat shows.<br />

“We continue to hear that brokers and clients really enjoy the<br />

convenience of the Palm Beach show, and many who did not attend<br />

or display in Miami will be here,” McCloskey said, adding, “Many<br />

out-of-state clients have called to confirm attendance. Palm Beach<br />

brings boaters and buyers who do not travel to Miami or Fort<br />

Lauderdale.”<br />

The mood among many <strong>Florida</strong> brokers in advance of the show<br />

was optimistic, he said. “There are some positives in the economy;<br />

the car business and the money markets are doing well, which<br />

historically have been good for our business. The last time the<br />

Dow was at 13000, the economy and yacht business were really<br />

prospering.”<br />

McCloskey advised brokers with boats on display at the show<br />

to be proactive. “There are plenty of boat deals to be made and Palm<br />

Beach will have some of the most sellable inventory. If it seems like<br />

a deal, it probably is and will be gone tomorrow so being aggressive<br />

to make the deal will pay off,” he said. “I also encourage our brokers<br />

to get around the show and inspect as many boats as possible.”<br />

The <strong>Yacht</strong> & Brokerage Show in Miami Beach<br />

reports Strong results<br />

Reports from the <strong>Yacht</strong> & Brokerage Show in Miami<br />

Beach, which ran Feb. 17-21, point to a stronger show<br />

than the past several years. The number of exhibitors<br />

and boats on display were both up 9 percent over 2011.<br />

Attendance, based on concession sales and number of people using<br />

show transportation at the free-to-the-public event, was up more than 7<br />

percent. Most importantly, numerous builders and brokerages reported<br />

notably strong sales activity.<br />

“The show was a tremendous success this year,” said Andrew Doole,<br />

senior vice president and COO of Show Management. “We had more<br />

exhibitor participation and the reports are of more qualified buyers<br />

than recent years, both signs of a strong industry and a strong show.<br />

This year’s <strong>Yacht</strong> & Brokerage Show was the busiest Miami show<br />

Denison <strong>Yacht</strong> Sales has ever had,” said owner, Bob Denison. “We<br />

introduced the Monte Carlo 76 to the U.S. market and our displays in<br />

Why Do I Need To Use A <strong>Yacht</strong> Insurance Specialist?<br />

A yacht insurance policy is a complex contract with many<br />

customizable details depending on the yacht owner’s needs.<br />

Many agents can write yacht policies for their clients, though they<br />

may not fully understand essential details contained in the policy,<br />

including the conditions and warranties that may leave yacht owners<br />

exposed to unnecessary risks. <strong>Yacht</strong> policies demand different<br />

considerations than personal insurance lines and require specialized<br />

coverage for a broad number of risks, such as personal liability<br />

and liability extended to crew. A yacht insurance specialist has the<br />

expertise necessary when customizing and building a yacht policy<br />

that works for the owner’s individualized needs.<br />

Liability should be considered the most important part of a yacht<br />

policy. While the value of a yacht is a known variable, yacht owner<br />

liabilities can be significantly larger than the value of the vessel. The<br />

potential liability arising from pollution or fuel spills can be large<br />

and is sometimes underestimated. In the event of a fuel spill, yacht<br />

owners are responsible for cleanup costs, fines, penalties, and any<br />

damage caused to the natural habitat and property. These fines can<br />

be extremely costly, especially if damage affects environmentally<br />

protected areas or sanctuaries.<br />

<strong>Yacht</strong> crew are the owner’s employees and are protected under<br />

Maritime Law and the Jones Act. The Jones Act provides generous<br />

amounts of protection not normally provided to land-based<br />

employees. Provisions extended to crew can include maintenance<br />

and cure, protection and indemnity damages, and loss of wages.<br />

When recently asked to review a customer’s yacht policy, I<br />

found that some of the warranties pertaining to the crew were not<br />

being met and could result in the exclusion of the crew liability<br />

coverage. The warranty required “private health insurance policies<br />

to be in place for crew members at all times” or no coverage<br />

would be provided. The owner and yacht manager were quite<br />

surprised, as they were unaware of the warranty, and no health<br />

policies were in place for the crew. A yacht specialist can certify<br />

that such warranties are fully explained and also can negotiate with<br />

the insurance company to amend the coverage to fit the owner‘s<br />

requirements.<br />

Conditions or warranties can apply to almost any part of a yacht<br />

policy, and if not complied with, coverage can be denied. One of<br />

the most common yet overlooked conditions occurs when a yacht<br />

enters a shipyard and a contract is signed to include clauses,<br />

such as “hold harmless”, “waiver of subrogation”, and/or “limit of<br />

liability”. Most yards do this to limit their own liability and lower their<br />

insurance costs. <strong>Yacht</strong> insurance policies prohibit the policyholder<br />

from assigning additional liability onto the insurer without their<br />

consent. Breaching this condition of the policy can lead to denial of<br />

coverage. Before entering a shipyard or marina, the yacht owner’s<br />

insurance agent should be notified. In most cases, the agent will be<br />

able to negotiate with the insurance company to allow you to enter<br />

into a contract with the yard, or offer a specialized policy that will<br />

provide coverage for the yacht while it is under the yard contract.<br />

Choose a yacht insurance specialist who has direct<br />

access to all markets, in depth knowledge of policy details<br />

and a well-trained support staff. Not all policies are created<br />

equal. Working with a yacht specialist provides the yacht owner<br />

with the expertise and guidance necessary for protection from<br />

unforeseen scenarios.


Annual Boat Show Kickoff Party Raises<br />

Nearly $15,000 for Shake-A-Leg Miami<br />

More than 300 people attended the Second Annual Kickoff Party<br />

for the <strong>Yacht</strong> & Brokerage Show in Miami Beach, hosted this<br />

year by FYBA and the Fort Lauderdale Mariners Club (FTLMC).<br />

With the festive theme of Mojitos, Mambo and the Macarena!, the<br />

event was held on Wednesday, February 15 from 6 to 9 p.m. at the<br />

show’s Cocktail Barge #1 on Collins Avenue. Partygoers enjoyed live<br />

music, drinks and appetizers while supporting a great cause.<br />

Nearly $15,000 was raised for the benefit of Shake-A-Leg<br />

Miami, a charitable organization that helps disabled people of<br />

all ages overcome their handicaps by learning and engaging in<br />

the fun and rewarding discipline of sailing. Boat Show Kickoff<br />

Italian Berthing Tax Update<br />

Thanks to the continuous commitment and dedication of<br />

the Federagenti <strong>Association</strong> - <strong>Yacht</strong> Division (the national<br />

association of maritime agents dedicated to the yachting industry)<br />

and various other associations in Italy, we are pleased to announce<br />

today that the amendment which modifies the recent “Berthing<br />

Tax” law supposed to be enforced on May 1st next, has passed.<br />

This tax will now only be applied to Italian owned vessels and<br />

not foreign owned vessel's, private or commercial, chartering and<br />

cruising in the Italian waters.<br />

Specifically the new law is aimed at Italian owners and<br />

passenger as follows:<br />

• Italian owners will now be required to pay an annual fee<br />

according to the vessel’s LOA and no longer on a daily basis while<br />

in Italian waters; The specific daily cost of this tax will now be<br />

calculated by dividing the annual tax rate (based on the vessels<br />

LOA) by 365 which will then be multiplied by the number of<br />

days which the vessel remains in Italian waters.<br />

• Any yacht, regardless of the flag, that hosts Italian guests on<br />

board will be required to pay the tax (unless they can confirm that<br />

they are guests of the vessel’s owner and can provide proof that<br />

the foreign owner is on board during the cruise).<br />

On May 21, <strong>2012</strong>, the American Superyacht<br />

Forum (ASF) will return to Fort<br />

Lauderdale to celebrate its 10th anniversary.<br />
