FROM THE DESK OF THE PRESIDENT
Greetings, fellow members. It has been five years since I joined the FYBA Board of
Directors and never did I think I would serve this long, much less become your president.
Before I went to my first meeting, I do remember asking one veteran broker and early
board member about his time at FYBA. He stated that FYBA gave him the opportunity to give
back to the industry that had given him so much and that he wanted to help the industry
itself become more professional. I think that his summation is what has driven me and many
other board members, and it is a mantra for FYBA’s mission statement: “To help promote
professionalism and cooperation amongst its members”. This year’s board is no exception for
giving their time and effort to the cause. Five directors live at least an hour away by car and one
comes from west coast of Florida and often flies here. We are also fortunate to have four past
FYBA presidents sitting on the board. Talk about dedication!
During these last five years, there have been several notable accomplishments and changes
at FYBA of which we are very proud. We have highlighted these in the new COMPASS and
during the seminars, as well as at other FYBA events. People have taken notice and our voice
has been heard. There is more yet to come and we stand ready to tackle the unexpected. We
do need and want your input, so please send in your ideas and suggestions. Most importantly
there is strength in numbers, so we encourage you to be an advocate for FYBA membership
on a daily basis. Membership is easy and effortless with access to the (new and improved)
website and the benefits are numerous. We currently have 1,100 members divided between 600
professional broker members and 500 affiliate members. Brokers have voting rights, yet there
are1,900 licensed brokers registered with the State of Florida who are not FYBA members, so
there is a need to enlist their membership. Affiliates also benefit greatly from their membership
as it gives them a chance to participate in FYBA’s many educational and networking events, and
they in turn help to give us a broader reach within the industry.
As many of you know, FYBA and Show Management own the Yacht and Brokerage Show in
Miami Beach and we are pleased to announce that it was one of the largest shows ever. FYBA’s
partnership with Show Management will stretch another 30 years, not only ensuring a quality
event in Miami for exhibitors but also a pleasant experience for the end consumer. The South
Florida boat shows continue to be marquee events so important to stimulating and promoting
our industry and we are constantly working on ways to make these events better and more
SALES TAX
It’s the unofficial finale to the winter
boat show season: The Palm Beach
International Boat Show, scheduled
for March 22-25, 2012. As we report
in our Palm Beach International
Boat Show Preview, with the overall
economy showing stronger signs of
improvement, exhibitors are guardedly
optimistic that sales and leads coming
from this year’s show could well
exceed expectations.
There is a lot more good news in
this issue. Our wrap-up of the Yacht
& Brokerage Show in Miami Beach,
which is owned by FYBA, reports
that the number of exhibitors, boats
on display and attendees were all up
from last year. The Annual Boat Show
Kickoff Party raised a large amount
of money for Shake-A-Leg Miami.
In addition, our summary of a recent
independent study on the results of
the Florida Sales-and-Use Tax Cap on
Boats proves what FYBA predicted
when we went to lobby the Florida
State Legislature for it in 2010: The
Tax Cap has been wildly successful –
both for the Florida yachting industry
and for the state itself.
As you peruse the pages of this
issue of COMPASS, we once again
invite readers to submit news items
of interest, as well as comments and
suggestions, to the FYBA staff – Ann
Update on
PUBLIC AFFAIRS
FYBA Legislative Affairs Committee Changes
Its Name but Keeps its Focus on Helping Florida’s
Marine Industry Recover and Grow
By Jeff Erdmann, Chair, FYBA Public Affairs Committee
Florida’s 2012 legislative season has come and gone quietly for boating industry interests.
With the end of the regular session on March 9, state legislators still are scheduled to
reconvene this spring in special session. However, they’re only allowed to tackle one bill
in special session, and their focus is certain to be on state redistricting.
While we didn’t face the legislative battles that dominated our activities the last two years,
FYBA’s government relations efforts continue unabated. At this point, I’d like to update you on
some important changes and legislative issues that face us going forward.
First, the FYBA Legislative Affairs Committee has changed its name to the Public Affairs
Committee. We feel this change more accurately reflects the current focus of our efforts, which
not only include legislative issues and lobbying at the state and federal level, but also public
relations and promoting boating and the modifications to public policy that make it more
enjoyable and affordable in Florida.
The committee’s overarching goal continues to be to help Florida’s marine industry recover
and grow by attracting, retaining and maintaining boats in Florida. We also are committed to
promoting Florida nationally and internationally as a boating and marine tourism destination.
With these goals in mind, Jason Dunbar and I recently attended a regional forum of The
Department of Economic Opportunity’s Division of Strategic Business Development, which is
designed to help gather information related to the creation of Florida’s 2012-2017 Statewide
Strategic Plan for Economic Development. The purpose of this forum is to review and prioritize
goals, objectives and strategies for implementation by state government that would assist Florida’s
regions with economic development and job creation. Tourism is a part of their mission, which
is the largest industry in Florida. The marine industry is a huge driver of tourism in the state.
Legislatively, FYBA made progress in that yacht brokers were not included in a new version
of the deregulation bill that surfaced this year. State legislators have to come to realize the value
of supporting the Florida Yacht & Ship Brokers Act and licensing yacht brokers to insure the
highest level of professionalism and ethical conduct.
Finally, despite some initial concerns to the contrary, there was no attempt by legislators to
scuttle the $18,000 sales tax cap on boat sales, which became law on July 1, 2010. Thanks to our
research, which clearly shows the overwhelmingly positive impact the cap has had on driving
boat sales and protecting marine and other related jobs in the state, most legislators have come
appreciate the cap’s benefits – at least for now.
In March, we issued a press release on the results of a study of member brokers and state
tax revenue information. It found that, thanks to the cap, Florida took in nearly 10 times as much
sales tax revenue on the sale of tax-capped boats than was projected by the state in the first year
following its implementation. (Please see story next page.)
The FYBA Board would like to sincerely thank YachtWorld.com along with 39 of our
member firms for their assistance in compiling data to aid our reporting efforts in the evaluation
of the tax cap results.

Florida took in nearly 10 times as much sales tax revenue on the sale of tax-capped
boats than was projected by the state in the first year following implementation of the
Maritime Full Employment Act provisions of a major jobs bill signed into law in 2010,
according to a study just released by the Florida Yacht Brokers Association (FYBA) and the
Marine Industries Association of South Florida (MIASF).
The new law puts an $18,000 sales-and-use tax cap on boats purchased or brought into
Florida. Research indicated that Florida’s marine industry was losing sales to nearby states
and foreign countries with lower or no sales taxes at all.
The new sales-and-use tax cap generated in excess of $13.46 million in direct sales tax
revenue for the state, compared to a $1.5 million first-year loss that had been projected by a
Florida legislative staff analysis. Thomas J. Murray and Associates Inc. conducted the initial
research and subsequent survey.
Prior to July 1, 2010, all boats sold and or delivered in Florida were subject to a 6 percent
sales-and-use tax, unless specifically exempt. A new 34-ft. powerboat costing $400,000, for
example, would cost $24,000 more in taxes. In comparison, South Carolina has a $300 sales
tax cap on boats and in North Carolina the cap is $1,500. No sales taxes are levied in the U.S.
and British Virgin Islands as well as the Cayman Islands. As a result, more than six out of 10
buyers of boats sold by Florida brokers were registering and operating their boats outside of
Florida in order to legally avoid paying Florida’s sales tax.
Especially hard hit by the Great Recession, the state’s $18 billion marine industry which
employs 220,000 Floridians, sought help from the Florida legislature pointing out that the
state’s 6 percent sales-and-use tax was counterproductive. Small business owners argued
that it provided an incentive for Floridians to purchase boats out of state and maintain and
provision them elsewhere, resulting in a loss of jobs and economic activity in Florida. The
hefty use tax also discouraged non-residents from bringing their boats to Florida for service
and provisioning.
Among the survey’s findings:
• The average sales price for post-cap transactions in Florida was $907,002 - nearly
double the pretax value of closings taking place in Florida prior to the cap.
• In the post-cap era, transactions for which either no sales tax was paid, or the closing
was conducted out-of-state, dropped from 21.5 percent in the pre-cap era to an estimated
12.8 percent following implementation of the sales tax cap.
“The results of our survey research demonstrates beyond a doubt that setting a reasonable
tax basis for high dollar purchases provides an incentive for more boats to be purchased,
provisioned and kept plying the waters of Florida,” said FYBA spokesman Jeff Erdmann,
owner of Bollman Yachts of Fort Lauderdale.
“More boats sold and registered in Florida means more business and jobs for Floridians,”
he added. Erdmann singled out state Sens. Don Gaetz (R-Destin) and Ellyn Setnor Bogdanoff
(R-Fort Lauderdale) as well as Reps. Tom Grady (R-Naples) and Will W. Weatherford (R-Wesley
Chapel) for pushing the sales and-use tax cap through the legislative labyrinth and helping to
preserve jobs in Florida’s marine industry.
“I especially want to thank those legislators who were willing to listen to reason and
research when it would have been much easier to stereotype the marine industry,” said
Erdmann.
» INTerNATIONAL YACHT COLLeCTION (IYC) announces that
Frank Grzeszczak and Barbara Stork Landeweer are the company’s 2011
Yacht and Charter Brokers of Year, respectively. In a yacht sales and
chartering year that was tepid for many global firms, IYC increased
market share over 2010, enjoying its best year since its inception and
making the Sales Broker and Charter Broker of the Year designation all
that more remarkable.
Having built an extraordinary 25-year career in yacht sales—both
pre-owned and new construction—Frank Grzeszczak has been with IYC
since 2007.
Barbara Stork Landeweer’s remarkable career as a charter agent
includes seven years at The Sacks Group Yachting Professionals,
establishing and managing the Charter Division at Allied Richard
Bertram for 10 years, and spending four years at Fraser Yachts. She
obtained her Yacht Salesperson’s license in 2000.
IYC launched its new website—www.iyc.com—in February just
in time for the Yacht & Brokerage Show in Miami Beach. The new site
further positions IYC’s global brand, which the company presented initially
during the Fort Lauderdale International Boat Show in October 2011.
The website’s new look, feel and tone emphasizes that IYC represents an
international clientele and supports these efforts with offices and personnel
in ports across the seas. Further, the core message IYC sends is to position
yachting as a lifestyle choice and experience.
The Captain’s on the Hook: How Do You Handle
Non-Customary Customs Reporting?
Given South Florida’s proximity to the Caribbean, many
members of the yachting community enjoy short, often
spontaneous, trips to nearby island nations. Five years ago, the
United States Customs and Border Protection (CBP) made such island
adventures even more convenient by
creating the Local Boater Option
program (LBO). The LBO allows
U.S. citizens to pre-register with
CBP and, thereafter, clear customs
upon re-entry to the United States
by simply phoning into their port
of entry to announce their arrival.
Recently, CBP further supplemented
the LBO with the Small Vessel
Reporting System (SVRS), which
allows participating LBO members
to report their intended arrival from
foreign countries to the CBP online.
Many South Florida boaters are
aware of, and participate in, the LBO,
so customs reporting may become a routine habit for fishing trips to
the Bahamas. However, what happens when Bernie, the boat owner’s,
brother, Joe, visits from Madison, or when Tony, a client from Dallas,
comes along for the ride?
The LBO registers individual boaters, not the vessels in which they
ride. Therefore, assuming Joe and Tony do not participate in the LBO,
they will not be able to breeze through customs with Bernie and the
rest of the boaters on the trip. This is not a big deal, however. The LBO
is a voluntary program, and no penalties exist if one or more members
of a boating party do not participate. Non-participants will simply need
to comply with the standard entry and reporting requirements. In this
scenario, Joe and Tony each will need to personally visit the CBP at
their port of entry to report their re-entry into the United States within
24 hours of their arrival.
So long as Joe and Tony complete the minor (although inconvenient)
task of reporting in person to CBP officials, the story should end with
Bernie, Joe, and Tony having a cold beer at the yacht club and a cooler
full of fresh fish. But, what happens if Joe and Tony enjoy their cold
beer and fresh fish so much that they forget to stop by the CBP office
after their re-entry?
Contrary to what one might imagine, Bernie, Joe, and Tony can
continue frying their fresh fish without concern. It is Bernie’s captain,
Harold, who is on the hook for Joe and Tony’s carelessness. The master
of a vessel entering a U.S. port bears full responsibility for ensuring
that all passengers on the vessel comply with the CBP’s entry and
reporting requirements. Thus, even if Captain Harold instructed Joe
and Tony as to the proper entry and reporting requirements, and even
if Joe and Tony represent to Captain
Harold that they visited the CBP
office within 24 hours of arrival, and
he had no knowledge that they did
not, Captain Harold is liable for their
failure to comply with the CBP’s
entry and reporting requirements.
So, what happens to Captain
Harold if Joe and Tony fail to comply
with the CBP’s entry and reporting
requirements?
Captain Harold may face civil
penalties in the form of fines. More
seriously, if CBP officials determine
that Captain Harold intentionally
violated the reporting requirements,
he could face criminal penalties, including fines and imprisonment.
Additionally, even if Captain Harold escapes civil and criminal penalties,
the incident would be documented as an immigration violation on
Captain Harold’s records. As a consequence, CPB could, and likely
would, deny him admission to other programs that facilitate simplified
re-entry procedures, such as the Global Entry Program or the Global
Online Enrollment System (GOES).
So, how can boat owners keep their captains off the hook in
uncustomary customs reporting situations?
Ultimately, captains themselves need to fully appreciate the
responsibility they undertake when piloting a vessel to and from foreign
ports. Accordingly, the captains need to take all feasible measures to
guarantee that their passengers comply with the applicable CBP entry
and reporting requirements, and they need to document their passengers’
compliance. However, boat owners can aid their captains by imposing
upon their guests the necessity of strict compliance with all entry and
reporting procedures.
bigger footprint for the
2012 palm beach international
boat show
Apositive sign for the yachting industry, the 27 th Anniversary
Palm Beach International Boat Show has expanded
northward to encompass 40 more in-water slips at Palm
Harbor Marina, and will have a larger land display than in previous
years. The boat show, which is scheduled for March 22-25 in West
Palm Beach, Fla., also will feature more yachts over 100 feet in
length than ever before.
“The location along Flagler Avenue is fabulous and the addition
of city’s permanent docks and Palm Harbor’s two megayacht docks
will really create a boat show for all interests” said FYBA President
Lon McCloskey, president/director of The Marine Group, which is
headquartered nearby in Palm Beach Gardens.
“This is looking to be a very strong show,” said Dane Graziano,
senior vice president and COO of Show Management, which
produces the Palm Beach International Boat Show. “Exhibitor
feedback from the Yacht & Brokerage Show in Miami Beach was
very positive and we expect Palm Beach to follow suit.”
The show is very popular with many yachting industry members,
who find it to be more manageable and intimate than some of the
larger Florida boat shows.
“We continue to hear that brokers and clients really enjoy the
convenience of the Palm Beach show, and many who did not attend
or display in Miami will be here,” McCloskey said, adding, “Many
out-of-state clients have called to confirm attendance. Palm Beach
brings boaters and buyers who do not travel to Miami or Fort
Lauderdale.”
The mood among many Florida brokers in advance of the show
was optimistic, he said. “There are some positives in the economy;
the car business and the money markets are doing well, which
historically have been good for our business. The last time the
Dow was at 13000, the economy and yacht business were really
prospering.”
McCloskey advised brokers with boats on display at the show
to be proactive. “There are plenty of boat deals to be made and Palm
Beach will have some of the most sellable inventory. If it seems like
a deal, it probably is and will be gone tomorrow so being aggressive
to make the deal will pay off,” he said. “I also encourage our brokers
to get around the show and inspect as many boats as possible.”
2012 Miami Yacht & Brokerage
show RepoRt
The Yacht & Brokerage Show in Miami Beach
reports Strong results
Reports from the Yacht & Brokerage Show in Miami
Beach, which ran Feb. 17-21, point to a stronger show
than the past several years. The number of exhibitors
and boats on display were both up 9 percent over 2011.
Attendance, based on concession sales and number of people using
show transportation at the free-to-the-public event, was up more than 7
percent. Most importantly, numerous builders and brokerages reported
notably strong sales activity.
“The show was a tremendous success this year,” said Andrew Doole,
senior vice president and COO of Show Management. “We had more
exhibitor participation and the reports are of more qualified buyers
than recent years, both signs of a strong industry and a strong show.
This year’s Yacht & Brokerage Show was the busiest Miami show
Denison Yacht Sales has ever had,” said owner, Bob Denison. “We
introduced the Monte Carlo 76 to the U.S. market and our displays in
TrawlerPort and at Beneteau Gran Turismo were slammed every day.
Two Beneteau Swift Trawlers and eight Gran Turismos were sold at
the show.
For sale at this year’s show were two of the largest yachts ever
offered at The Yacht & Brokerage Show: a 200' Benetti, DIAMONDS
ARE FOREVER, and a 191' Trinity, CARPE DIEM. Both garnered
attention from qualified buyers.
Added Alan Murphy, Jr., vice president of Pioneer Linens Yacht
& Estates Division and a show sponsor: “The show brought us many
Why Do I Need To Use A Yacht Insurance Specialist?
By Tom Gresh, Senior Client Advisor at Celedinas Insurance Group
A yacht insurance policy is a complex contract with many
customizable details depending on the yacht owner’s needs.
Many agents can write yacht policies for their clients, though they
may not fully understand essential details contained in the policy,
including the conditions and warranties that may leave yacht owners
exposed to unnecessary risks. Yacht policies demand different
considerations than personal insurance lines and require specialized
coverage for a broad number of risks, such as personal liability
and liability extended to crew. A yacht insurance specialist has the
expertise necessary when customizing and building a yacht policy
that works for the owner’s individualized needs.
Liability should be considered the most important part of a yacht
policy. While the value of a yacht is a known variable, yacht owner
liabilities can be significantly larger than the value of the vessel. The
potential liability arising from pollution or fuel spills can be large
and is sometimes underestimated. In the event of a fuel spill, yacht
owners are responsible for cleanup costs, fines, penalties, and any
damage caused to the natural habitat and property. These fines can
be extremely costly, especially if damage affects environmentally
protected areas or sanctuaries.
Yacht crew are the owner’s employees and are protected under
Maritime Law and the Jones Act. The Jones Act provides generous
amounts of protection not normally provided to land-based
employees. Provisions extended to crew can include maintenance
and cure, protection and indemnity damages, and loss of wages.
When recently asked to review a customer’s yacht policy, I
found that some of the warranties pertaining to the crew were not
being met and could result in the exclusion of the crew liability
coverage. The warranty required “private health insurance policies
to be in place for crew members at all times” or no coverage
would be provided. The owner and yacht manager were quite
surprised, as they were unaware of the warranty, and no health
policies were in place for the crew. A yacht specialist can certify
that such warranties are fully explained and also can negotiate with
the insurance company to amend the coverage to fit the owner‘s
requirements.
Conditions or warranties can apply to almost any part of a yacht
policy, and if not complied with, coverage can be denied. One of
the most common yet overlooked conditions occurs when a yacht
enters a shipyard and a contract is signed to include clauses,
such as “hold harmless”, “waiver of subrogation”, and/or “limit of
liability”. Most yards do this to limit their own liability and lower their
insurance costs. Yacht insurance policies prohibit the policyholder
from assigning additional liability onto the insurer without their
consent. Breaching this condition of the policy can lead to denial of
coverage. Before entering a shipyard or marina, the yacht owner’s
insurance agent should be notified. In most cases, the agent will be
Italian Berthing Tax Update
By J. Luise & Sons Ltd. – Naples, Italy, March 1, 2012
Thanks to the continuous commitment and dedication of
the Federagenti Association - Yacht Division (the national
association of maritime agents dedicated to the yachting industry)
and various other associations in Italy, we are pleased to announce
today that the amendment which modifies the recent “Berthing
Tax” law supposed to be enforced on May 1st next, has passed.
This tax will now only be applied to Italian owned vessels and
not foreign owned vessel's, private or commercial, chartering and
cruising in the Italian waters.
Specifically the new law is aimed at Italian owners and
passenger as follows:
• Italian owners will now be required to pay an annual fee
according to the vessel’s LOA and no longer on a daily basis while
in Italian waters; The specific daily cost of this tax will now be
calculated by dividing the annual tax rate (based on the vessels
LOA) by 365 which will then be multiplied by the number of
days which the vessel remains in Italian waters.
• Any yacht, regardless of the flag, that hosts Italian guests on
board will be required to pay the tax (unless they can confirm that
they are guests of the vessel’s owner and can provide proof that
the foreign owner is on board during the cruise).
The American Superyacht Forum – Focusing on the Future
On May 21, 2012, the American Superyacht
Forum (ASF) will return to Fort
Lauderdale to celebrate its 10th anniversary.
Over the past decade, this major conference
has attracted a significant audience of
business leaders and industry professionals
who have found unrivalled value in gathering
for three days to debate and discuss the
future of the American superyacht industry.
The industry has seen incredible change with
the impact of the 2008 economic slowdown
and in turn the pressure we have taken to
ride through the economic storm, therefore
we cannot slow our commitment and energy
in focusing on the future.
America is still home of the superyacht
market’s biggest client base, with more
potential than any other global market. It is
not about capitalism, but about capitalizing
on this land of opportunity. Therefore, as part
of the 2012 program, ASF will be analyzing
and exploring better ways of building the
U.S. industry. Specific focus will form part
of the program. Are we creating the right
yachts for the market? Are we introducing
the most effective and efficient technology?
Are our business practices and profitability
adding
to3D
a new
to
dimension
at the right levels and do the authorities and
governments understand the implications
and value of re-building our industry?
ASF’s organizers, the Superyacht Events
team, are confident that following on from
last year’s incredible discussions and action
plans, they can continue the momentum and
everyone who participates in May this year
will be a part of this dynamic change. As a
FYBA member, they encourage you to attend,
not only to gather insight and increase your
knowledge and vital network, but also to add
your views and ideas for the future.
ASF is offering all members of the Florida
Yacht Brokers Association a discounted rate
of $1,165.50 (a 10% discount) to attend this
important three-day event. This includes all
conference and social activities and unique
access to The Superyacht Group’s business
intelligence and market information.
