THE “HOW-TO” ON ARRESTING A VESSEL<br />

The Arrest of a vessel, whether she is private or commercial, is part of the process by<br />

which a Court in Admiralty gains jurisdiction over the subject matter of a law suit. These<br />

lawsuits are known as "in rem" actions, meaning that the action is against a thing, rather<br />

than against a person.<br />

Generally, the vessel, itself, is responsible for payment of liens, mortgages or any other<br />

maritime lien that may arise. When the owner encumbers a vessel with a First Preferred<br />

Ship's Mortgage, it is the vessel that guarantees payment, rather than the owner. However,<br />

the owner may be personally liable if they signed a personal promise or guaranty to pay.<br />

An arrest action is filed in Federal District Court, along with the filing fee and a $2,500<br />

check payable to the U.S. Marshal for their services. The U.S. Marshal’s will not act on<br />

the Judge’s Order to arrest the vessel without this payment.<br />

An arrest of a vessel is the prerequisite for the court to establish jurisdiction. If the vessel<br />

cannot be seized within the jurisdiction of that particular Federal District Court, then the<br />

court may have no right to arrest the vessel. In the United States, the arrest is the physical<br />

process by which a U.S. Marshal goes aboard the vessel and physically takes charge of<br />

it, removing all crew, owner and guests. The Marshal posts a Notice of Arrest on the vessel.<br />

Soon thereafter the arrest of the vessel, notice must be published in a newspaper<br />

authorized to publish legal notices. Actual notice must be given to all other lien holders<br />

who claim an interest in the vessel.<br />

Once seized, the court, through the U.S. Marshal's service or substitute custodian, maintains<br />

possession of the vessel and the owner loses all control. To avoid this situation and<br />

its effect on commerce, the court will allow the owner to post a bond or other suitable<br />

security for the amount of the claim plus two years of interest. Once the security is accepted,<br />

the vessel is returned to the owner and the litigation continues with the security as the<br />

subject of execution of judgment.<br />

If a vessel is not released by the posting of security, the court may order an interlocutory<br />

sale. An interlocutory sale means a sale prior to the completion of the litigation and the<br />

entering of a judgment. As a general rule, the sale will not be allowed for four months.<br />

The rules provide for the sale if the arrested property is perishable, liable to deterioration,<br />

or if the cost of keeping it is excessive or disproportionate.<br />

When Regardless as whether the sale is interlocutory or a judgment sale, the buyer at the<br />

auction does not have any right in the vessel, until the sale is confirmed by the court. If a<br />

higher bid is received within three days by the court, the court has the option of voiding<br />

the auction and ordering a new sale. Once confirmation is received, the buyer receives title<br />

which extinguishes all other liens and provided him with a clear title. An "in rem" action<br />

resolves claims, both nationally and internationally, against the vessel and no lien for past<br />

debts can be created or asserted.<br />

The proceeds of the sale are paid into the court and are used to satisfy any expenses incurred<br />

by the keeping of the vessel and fees to the U.S. Marshal. The balance is paid to the<br />

claimants and any balance left over is paid to the owner. Unless the plaintiff who seized<br />

the vessel acts in bad faith, the owner of the vessel may not recover damages due to the<br />

arrest or for loss of profits.<br />

FOR LARGE BOATS SOLD TO NON RESIDENTS<br />

Effective July 1, <strong>2009</strong>, a nonresident purchaser may purchase a boat of 5 net tons of admeasurement<br />

or larger (a qualified boat) exempt from tax and keep the qualified boat in <strong>Florida</strong><br />

for a period of 180 days under certain conditions, rather than 90 days as previously allowed.<br />

As greater technological tools have become available for the<br />

exploration of the sea’s surface, increasing numbers of salvors<br />

and explorers have met with success in uncovering underwater<br />

assets, such as historic shipwrecks and artifacts.<br />

Naturally, with these discoveries have come disputes over<br />

ownership. These disputes are between two groups: governments/archeologists<br />

and salvors. In the cases that have been<br />

decided, each of these groups uses different legal theories to<br />

present their respective, opposing cases.<br />

The salvors have primarily used admiralty law and filed admiralty<br />

claims in federal courts in the United States arguing that<br />

the law of “finds” entitles them ownership to abandoned historic<br />

shipwrecks and their cargo. Additionally, they have<br />

argued that salvage awards should be granted for the act of<br />

rescuing the yachts of yore (and their booty) from “marine<br />

peril” and returning them to the stream of commerce. The<br />

governments/archeologists have used a variety of laws to try<br />

to defend against the unregulated pillaging of submerged cultural<br />

property. These laws come in two categories. First, they<br />

have used claims of ownership rights (when they are governments<br />

and the vessels are within their territorial waters).<br />

Second, they have used preservation laws and permitting regulations.<br />

A brief look at the relevant cases and legal doctrines<br />

is illustrative of how all of these polar arguments have fared.<br />

One landmark case, Treasure Salvors v. The Unidentified<br />

Wrecked and Abandoned Sailing Vessel, 569 F.2d 330 (5th<br />

Cir. 1978) (“Treasure Salvors”) held that the Outer<br />

Continental Shelf Lands Act (43 USC 1331, et seq.) only<br />

extended United States jurisdiction to the outer continental<br />

shelf for purposes of exploration and exploitation of its natural<br />

resources, not for purposes of controlling salvaged abandoned<br />

historic shipwrecks. Thus, the salvors have continued<br />

to use maritime law to assert salvage claims to submerged cultural<br />

property.<br />

State governments have claimed ownership of submerged cultural<br />

property via the Abandoned Shipwreck Act of 1987<br />

(“ASA”). The ASA exercises federal sovereign prerogative<br />

over abandoned shipwrecks and transfers title to them to the<br />

states in which the abandoned shipwrecks are resting. This<br />

allows state governments to assert title to and manage these<br />

abandoned shipwrecks as against salvors. However, the ASA<br />

applies only to wrecks within three nautical miles of the<br />

shores of U.S. states and territories, and the ASA only protects


wrecks that are “abandoned” – sometimes a difficult definition<br />

to prove. See Deep Sea Research, <strong>Inc</strong>. v. The Brother Jonathan,<br />

883 F. Supp. 1343 (N.D. Cal. 1995), and Columbus-America<br />

Discovery Group v. Atlantic Mut. Ins., 974 F. 2d 450 (4th Cir.<br />

1992). Thus, salvors can argue the distance precludes protection,<br />

or that the wreck salved was not sufficiently abandoned.<br />

The federal government has asserted title to submerged cultural<br />

property through permitting regulations, and has met with<br />

more success using this strategy. The National Marine<br />

Sanctuary Act, 16 U.S.C. 1431, et seq. (“NMSA”) provides<br />

that the Secretary of Commerce has the authority to manage<br />

and designate “certain areas of the marine environment possess[ing]<br />

conservation, recreation, ecological, historical,<br />

research, education, or aesthetic qualities which give them special<br />

national significance.” In Motivation, <strong>Inc</strong>. v. The<br />

Unidentified, Wrecked and Abandoned Vessel, CITE, the U.S.<br />

claimed that since the salvors did not obtain a permit under the<br />

NMSA, and since such permitting would have regulated the<br />

salvage activities and prevented damages to sanctuary<br />

resources. The Court decided in favor of the United States and<br />

against the salvors. Thus, the NMSA can be helpful in regulating<br />

salvage activities - and it has a large scope, because it protects<br />

submerged cultural property located in waters all the way<br />

out to the 200-nautical mile “exclusive economic zone” of the<br />

United States.<br />

The Antiquities Act of 1906, the Archaeological Resources<br />

Protection Act, the National Historic Preservation Act all provide<br />

some protections of submerged cultural property, but are relatively<br />

narrow in scope to constitute comprehensive protection.<br />

LEGAL BATTLES<br />

Internationally, protection of submerged cultural property is<br />

even less comprehensive. Many yachts of yore are open to<br />

unlimited, unregulated plunder. The international conventions<br />

that do exist (The Law of the Sea Convention, UNESCO conventions,<br />

etc.) simply do not presently provide coherent coverage.<br />

Of most recent note vis-à-vis salvage of submerged cultural<br />

property in international waters is the ongoing case of<br />

Odyssey Marine Exploration, <strong>Inc</strong>. v. Kingdom of Spain Case<br />

No. 8:07-CV-614 (M.D. Fla., filed April 9, 2007), in which the<br />

classic dispute that pits salvors against sovereigns is now being<br />

waged in a <strong>Florida</strong> court. Odyssey discovered and made claim<br />

to an historic shipwreck and its treasure in international waters<br />

about 100 miles west of the Straits of Gibraltar. The Kingdom<br />

of Spain laid claim to the 17-ton coin hoard of gold and silver,<br />

demanding its return to Spain. The salvors claim ownership to<br />

the salvaged artifacts and, in the alternative, assert claim to a<br />

salvage award. U.S. Federal Court Magistrate Judge Mark<br />

Pizzo recently declared that the Court lacked jurisdiction in the<br />

case, and that the site of the treasure find is subject to sovereign<br />

immunity. While the tide has presently turned in the direction<br />

of the sovereign, the Court’s Judge Merryday has not yet<br />

determined which position will ultimately prevail.<br />

Considering the value of submerged cultural property and the<br />

fragmented nature of the regulations applying to the salvage of<br />

such types of property, a coherent international regulatory framework<br />

is needed to both protect submerged cultural property and<br />

the beneficial services provided by archeologists and salvors.<br />

NEWPORT Charter Show Recap<br />

The Newport Spring Charter Show , June 24-26, consisted of only 3 full<br />

days and was moved to the Newport <strong>Yacht</strong>ing Center due to the fact that<br />

the Newport Shipyard was full with many mega-yachts in port. The<br />

weather this year was not too cooperative as it rained for the first few<br />

days, but did not hinder much of the activities and was just a nuisance.<br />

We all prevailed and made the best of it. The sun finally began to shine<br />

on us the last few days of the show and the show was a success.<br />

This year’s show included 30+ quality power and sailing yachts with<br />

11 yachts being over 100’ and the largest being the 132’ NORTHERN<br />

LIGHTS. Over 100 + brokers, managers, press and exhibitors were in<br />

attendance from various parts of the country and world. The NYM<br />

Welcome Cocktail party was held on Wednesday at 5:00 PM and then<br />

the first <strong>Yacht</strong> Hop was hosted for yachts 90’ and over beginning at<br />

6:30 PM, so everyone enjoyed a full evening of fabulous food and drink<br />

aboard all participating yachts with “themed” events, from the “Super<br />

Bowl” to “Pirates of the Caribbean”. On Thursday the second <strong>Yacht</strong><br />

Hop was conducted for smaller yachts and all sailing yachts and it started<br />

off with the S/Y TITAN inviting all to a “Garden Party”.<br />

Wednesday also hosted the Distinctive <strong>Yacht</strong>s Annual Charter Chowder<br />

Fest conducted by Jane Potter. This year it was limited to 20 yachts<br />

and has proved to be a “grand slam” for this show. The 1st Place winning<br />

chowder went to Chef Merrilie Insch of M/Y ESSENCE for a<br />

Thai inspired chowder with curry and prawns. The Chef’s Competition<br />

was held on Thursday with a local Purveyor giving the chefs who<br />

participated a “Mystery Basket” filled with New England regional ingredients<br />

of which were delivered to the yachts in the morning and they had<br />

to make a dish and be judged on it. Chef Patrick Roney of M/Y<br />

KAPALUA took 1st Place. All dishes consisted of oysters, clams,<br />

chorizo, scallions, and a pineapple. So it was quite challenging and all<br />

chefs were awarded their plaques at the evening award ceremony. The<br />

event was sponsored by Newport <strong>Yacht</strong> Management, The Captain’s<br />

Concierge and <strong>Yacht</strong>ing Magazine.<br />

There were various seminar’s conducted during the 3 days of the show<br />

to include the USSA Seminar/Captain’s Briefing, AYCA Meeting,<br />

KVH Seminar and the American <strong>Yacht</strong> Charter <strong>Association</strong> Seminar<br />

which was attended by 60+ brokers, managers, lawyers, magazine reps<br />

and many more. Bob Saxon, Gary Carroll and Captain Peter Pexton<br />

were all key speakers.<br />

Although the show was shortened to just 3 days and at a new location<br />

it proved to be a very successful show and we are looking forward to<br />

seeing each and every one of you at next year’s show being held at The<br />

Newport <strong>Yacht</strong>ing Center June 22-25, 2010.<br />

The <strong>Florida</strong> Inland Navigation district has the Hurricane<br />

Preparedness Manuals for Marine Interests available in each coastal<br />

county of East <strong>Florida</strong>. Each manual contains generic information<br />

that all marine interests need to know. These manuals are free and<br />

available in any quantity for distribution to your customers. The<br />

manuals describe how to prepare your vessel or marine facility prior<br />

to a hurricane season and for an approaching hurricane. Internet<br />

<strong>2009</strong> ST. THOMAS<br />

YACHT SHOW<br />

OFFERS NEW EVENTS<br />

The St. Thomas Fall <strong>Yacht</strong> Show, November 10-12, will be offering<br />

new events for attendees. On Tuesday, November 10th, there will be<br />

transportation from YHG for all brokers to Catherineberg for the<br />

Official Governors Reception. Wednesday evening will find everyone<br />

on the docks listening to musicians and sampling the fine wines and<br />

champagnes as they visit and enjoy appetizers aboard the host yachts.<br />

Thursday, all <strong>Yacht</strong>s attending have offered a berth and bunks for brokers<br />

invitation to all visiting broker. 'A Taste of St Thomas Land and<br />

Sea' event will feature live music and dancing,food samplings as well<br />

as a culinary competition involving all of our participating yacht<br />

chefs. <strong>Yacht</strong> Haven Grande has graciously offered to purchase the neccessary<br />

SAIL FOR A CURE<br />

On Saturday, Sept 26th <strong>2009</strong> join in for fun and madness on the<br />

intracoastal waterway of Palm Beach while raising money for breast<br />

cancer research. 20 boats will participate in a 3-hour motorboat and<br />

sailboat cruise from Jupiter to West Palm Beach. 100% net proceeds<br />

will benefit <strong>Florida</strong> Breast Cancer Coalition Research Foundation.<br />
