New Board Members Elected<br />

FYBA welcomed two new members to its Board of Directors during the FYBA<br />

Annual Meeting - Bob Denison, president of Denison <strong>Yacht</strong> Sales, and Whit<br />

Kirtland of Bradford Marine <strong>Yacht</strong> Sales. They join FYBA’s current Board<br />

members: Bob Zarchen, Ardell <strong>Yacht</strong> & Ship <strong>Brokers</strong>; Crom Littlejohn, Merle<br />

Wood & Associates; Lon McCloskey, The Marine Group; Jonathan Burkard,<br />

Allied Marine; Bruce Schattenburg,Y.CO; Gary Smith, Sarasota <strong>Yacht</strong> & Ship;<br />

Jeff Erdmann, Bollman <strong>Yacht</strong>s; Paul Flannery, HMY <strong>Yacht</strong> Sales, and Bob<br />

Bob Denison’s grandfather, Frank Denison, and father,<br />

Kit, founded Broward Marine and Denison Marine,<br />

respectively. Thanks to this great family heritage, Bob has<br />

held a variety of jobs in the yachting industry. A graduate<br />

of the University of Miami with a degree in Business<br />

Management, Bob began working with two visionary<br />

entrepreneurs in the e-commerce and aerospace fields.<br />

In 2002 Bob assumed all management roles of Denison<br />

<strong>Yacht</strong> Sales. Since that time. he has overseen the<br />

company’s steady growth and expansion to four marina<br />

offices in Fort Lauderdale, Fla.; Marina del Rey, Calif.; Old Saybrook, Conn., and San<br />

Carlos, Mexico. Bob also oversees Denison’s new boat sales with the support of<br />

Denison’s 32 licensed and bonded yacht brokers.<br />

Denison <strong>Yacht</strong> Sales is currently an active member of the FYBA, MIASF and CYBA.<br />

Bob has served on several FYBA committees, including Seminars and Legislation.<br />

Bob also serves on the 2011/<strong>2012</strong> MIASF FLIBS Committee.<br />

Whit Kirtland has brokered all sizes of yachts over the<br />

past 28 years; both power and sail. Along the way he also<br />

has represented Dutch, French, and Italian yacht builders<br />

in marketing and sales. He is the third generation of his<br />

family to work in the maritime business - his grandfather<br />

was a master shipwright and his father was a broker and<br />

head of Merrill-Stevens’ Miami yard - and it’s his first<br />

love. Whit learned the maritime business the hard way;<br />

working in every shop at Merrill-Stevens, serving as a<br />

ship mate on an ocean-going tug, and as mate aboard a<br />

110’ Feadship. He also sailed on the racing circuit as a<br />

“grinder” aboard a 51-foot Swan.<br />

Due to Whit’s in-depth experience, he is well respected in the brokerage business. In<br />

addition to serving on the FYBA Board of Directors, he also is a three-time past FYBA<br />

President. He’s also on the Board of the International Superyacht Society, participates<br />

in the Marine Industries <strong>Association</strong> of South <strong>Florida</strong> and the National <strong>Yacht</strong> <strong>Brokers</strong>’<br />

Certification program, and has served on the Certification Advisory Council of the<br />

Certified Professional <strong>Yacht</strong> <strong>Brokers</strong>’ program.<br />

2011 Broker of the Year: Bob Zarchen<br />

After 19 years of membership in FYBA, our Broker of the Year truly needs no<br />

introduction. Bob was president and CEO of an engine service company in<br />

New England prior to moving to <strong>Florida</strong> in 1984. Once here, he worked as<br />

a professional Captain, earning his 500 GT Master Oceans License. Bob joined<br />

Merrill-Stevens in 1987 and remained there for 22 years, serving as a Broker and<br />

later as Managing Broker. He recently joined Ardell <strong>Yacht</strong> & Ship <strong>Brokers</strong>.<br />

A graduate of Yale University with a degree in Mechanical Engineering, Bob was<br />

one of the first <strong>Brokers</strong> in the nation to achieve Certified Professional <strong>Yacht</strong> Broker<br />

status in 2002. A Director of FYBA since 1993, he also has served as a past<br />

President and Secretary of the organization. He has been FYBA Treasurer since<br />

2006 and is the founder of the FYBA Seminar Programs.<br />

Bob richly deserves the honor of being named FYBA Broker of the Year both<br />

for his professionalism and for his tireless service to this organization and the<br />

yachting industry as a whole.<br />

2011 Charter Broker of<br />

the Year: Robin O’Brien<br />

One of the yachting industry’s very first female<br />

First Officers, Robin O’Brien served aboard large<br />

charter yachts in the Med and the Caribbean<br />

from 1991 to 1994. This experience provided her with<br />

an intimate knowledge of both the usual and the unusual<br />

charter destinations in the world.<br />

After graduating from Temple University in Philadelphia,<br />

Pennsylvania, Robin headed south to Fort Lauderdale to embark on what was<br />

supposed to be one year of working onboard yachts. Many years and thousands<br />

of sea miles later, she now calls Fort Lauderdale home.<br />

Robin became a charter broker in 1997. In 2001, she joined Fraser <strong>Yacht</strong>s, where<br />

she still works today. When not booking charters, you may find her at the dog<br />

park with her faithful boxer, Tallulah, or volunteering for a local animal rescue<br />

program. She and her husband also like to spend time exploring the mountains<br />

on their motorcycles.<br />

“I am always in search of the next great spot to visit, either by sea or land,” she said.


A Note from Your Executive Director<br />

Now that the holidays are behind us (thank goodness), the FYBA office has picked<br />

up speed again with the organization of events. As I write this note to you, the first<br />

Charter Open House and Third Thursday of the year already have taken place. Both of these<br />

events started out strong with some yachts even having to be put on a waitlist (not fun for<br />

Randi and Shay, who have to juggle all this with the Bahia Mar, but do it superbly).<br />

The Annual Dinner also has come and gone. For those of you who joined us, I hope you<br />

had a great time and enjoyed the theme of Hollywood Glam and music by Breeze. Once<br />

again, thank you to our faithful sponsors: Westport, Moore & Co. and U.S. Trust (Bank of<br />

America). Congratulations to our two <strong>Brokers</strong> of the Year: Charter Broker, Robin O’Brien<br />

(Fraser <strong>Yacht</strong>s) and Sales Broker, Bob Zarchen (Ardell <strong>Yacht</strong> & Ship <strong>Brokers</strong>).<br />

More good news—the new FYBA website will be launched in the very near future! We<br />

eliminated Flash animation; created a new Home Page with easy access to links, such as<br />

the DBPR for broker license info, the event calendars, and updated legislative information.<br />

The Members Only section now has a Bulletin Board (or two) to give you the opportunity<br />

to post updates and news. You will soon be receiving an e-mail to check your contact<br />

information and update it if necessary. Please do not hesitate to send in your comments<br />

about the website as it is the “FYBA window to the web”, as well as your association<br />

information tool.<br />

Last but not least, do come by the FYBA stand at the <strong>Yacht</strong> & Brokerage Show in<br />

Miami Beach, <strong>Feb</strong>ruary 16-20. We will be located at <strong>Yacht</strong> Pavilion 24-25, ramp 13. The<br />

stand will provide internet, fax, printer, and a friendly reception to all FYBA members.<br />

And oh, how could I forget – Welcome to the New FYBA Board members!<br />

that Roy Sea has joined the global yachting firm as a <strong>Florida</strong> and<br />

» ArDELL YACHT & SHIP BrOKErS (AY&SB) has five boats<br />

attending the <strong>2012</strong> Miami <strong>Yacht</strong> & Brokerage Show, including LORA,<br />

STAR SAPPHIRE, INDIGO, UNREEL, and BIG FISH. They will<br />

all be located at the northeast end of the show, just south of Ramp 1.<br />

LORA is an 80’ 2002 Northern Marine Series 8000. She has a<br />

5,000-mile range and cruises comfortably at 10 knots. She feature three<br />

staterooms, plus crew accommodations.<br />

STAR SAPPHIRE is a 117’ 2007 Bilgin Motor <strong>Yacht</strong>. Featuring<br />

four cabins, a gym, crew accommodations and zero-speed stabilizers,<br />

she is powered by two 1,825 horsepower Caterpillar C-32 diesel<br />

engines with low hours.<br />

» NOrDHAVN announces that work continues on the first<br />

hull of the future nordhavn line: the nordhavn 120. delivery<br />

is expected by the end of <strong>2012</strong>.<br />

INDIGO is a 104’ 1998 CBI Navi, full-displacement, long-range<br />

motor yacht. She has three staterooms and five crew luxurious berths.<br />

In 2008, she was repainted, followed by a 2010 mechanical refit and<br />

navigational electronics and communications upgrades in 2011.<br />

UNREEL is a 100’ 2000 Falcon with a large salon for entertaining<br />

family, friends, and business associates. She features four cabins and<br />

three crew cabins, along with many upgrades and a skybridge allowing<br />

360-degree views.<br />

BIG FISH is a 62’ 2003 Ocean <strong>Yacht</strong>s Super Enclosed Bridge. She<br />

can cruise at over 30 knots with standard diesel engines.<br />

AY&SB also announces a price reduction on two of its boats. PRIME<br />

TIME, an 88’ Nordlund 2000, has been reduced from $2,350,000 to<br />

$1,990,999, and WRANGLER, a 2004 Predator, has been reduced from<br />

$247,900 to $227,900.<br />

Randy Greenfield of AY&SB has added two new central listings;<br />

NEVER ENOUGH and BAJAVENTO. NEVER ENOUGH is a 48’


1999 Baia express cruiser with an asking price of $299,000. BAJAVENTO<br />

is a 49’4’’ 2005 Jeanneau cruising sailboat with an asking price of $295,000.<br />

AY&SB reports that Bob Zarchen, formerly of Sparkman & Stevens,<br />

has joined its team of brokers. Bob was with Merrill-Stevens in Miami<br />

for 22 years as a broker and managing broker until December 2008. He<br />

joined Sparkman & Stephens in 2009. Bob brings seven new listing<br />

with him to Ardell including: YA-T, 70’ 1982 Hatteras; VERITAS, 49’<br />

2007 Hunter; SEVENTEEN TOO, 59’2’’ 2001 Carver 570 Voyager;<br />

» CAMPEr & NICHOLSONS’ Walter Sea announces a reduced asking<br />

price for the 34.14m (112’) motor yacht HIDE OUT. Built in 2007 by<br />

Westport, she accommodates eight guests in four luxurious cabins and is<br />

available for purchase at the revised asking price of $6,795,000<br />

» BrADFOrD MArINE YACHT SALES reports the following<br />

okers expect more<br />

crowds and sales at <strong>2012</strong><br />

miami yacht & brokerage show<br />

For yacht brokers, the <strong>Yacht</strong> & Brokerage Show in Miami is one<br />

of the year’s premier events. Hosted by Show Management and<br />

sponsored by FYBA, this year’s show runs <strong>Feb</strong>. 16-20 along<br />

Collins Avenue in Miami Beach in conjunction with the Miami<br />

International Boat Show. More than 500 new and used vessels will<br />

be viewable in-water in 1.2 million square feet of space.<br />

<strong>Brokers</strong> are heading into this year’s show with a greater sence of<br />

optimism about the future.<br />

“The economy is looking much better and depressed prices are on<br />

the rise,” said Jon Burkard, president of Allied Marine, in Stuart,<br />

Fla. “I think most buyers know that waiting for a better deal is not<br />

an option. Demand has been outstripping supply, and has been for<br />

some time.”<br />

As a result, Burkard said Allied will have a larger presence at the show.<br />

“We will be showing a few more boats at this year’s Miami Show<br />

in comparison to years past,” he said. “We have set goals to increase<br />

the average size of our brokerage transactions in order to get them<br />

more in line with the luxury brands that we sell on the new side of<br />

our business. Another major goal of ours is to become the premier<br />

brokerage company for the resale of the new Ferretti Group brands<br />

that we represent.”<br />

FYBA President, Cromwell Littlejohn, is equally positive, saying<br />

that his agency, Merle Wood & Associates, expects sales to improve<br />

this year over last.<br />

“Charter bookings are increasing, which is always a great indicator,”<br />

he said. “The inventory of well-maintained, quality product is high<br />

with sellers having had plenty of time to think about their final<br />

selling price expectations.”<br />

When it comes to pricing, brokers say sellers remain somewhat<br />

“optimistic”.<br />

“As I’ve been saying for several years, the asking price should simply<br />

be considered a “For Sale” sign; an indicator at which the owner will<br />

sell,” Littlejohn said. “The final selling price of a yacht, more often<br />

than not, rests a substantial distance from the posted asking price.”<br />

However, he said a knowledgeable and informed broker earns his<br />

keep by being able to provide prospective buyers with the right mix<br />

of information on comparable boat sales to help them determine<br />

the proper asking price. “(Buyers) are smart business people and,<br />

with the right information, can present an offer at a fair price that<br />

will receive a respectful response,” Littlejohn said.<br />

Burkard agreed.<br />

“I think we get some disparity in what sellers and buyers think<br />

about pricing and values from time to time, but the great thing<br />

about a free market is that these differences do work themselves<br />

out,” he said. “It is the sales executive’s job to make sure he/she<br />

educates both buyers and sellers as to present market conditions<br />

related to values and all that goes along with them.”<br />

Tender and Toy Orientation<br />

A Good Practice Everywhere—but Especially in <strong>Florida</strong><br />

does florida’s little known “livery statute” require a<br />

yacht’s crew to conduct a pre-ride safety orientation<br />

before guests operate the yacht’s tender or water toy?<br />

short answer: we think it does, and that’s a good thing.<br />

First, a “livery” offers vehicles, such as automobiles or boats, for hire. In the<br />

yachting industry, many businesses meet this definition. There is a littleknown<br />

<strong>Florida</strong> statute that says:<br />

“A livery may not knowingly lease, hire, or rent a vessel, with a motor of 10<br />

horsepower or greater, to any person. . . unless the livery provides pre-rental<br />

or pre-ride instruction that includes, but need not be limited to:<br />

1. Operational characteristics of the vessel to be rented.<br />

2. Safe vessel operation and vessel right-of-way.<br />

3. The responsibility of the vessel operator for the safe<br />

and proper operation of the vessel.<br />

4. Local characteristics of the waterway where the vessel<br />

will be operated.”<br />

Any person providing this information must have successfully completed a<br />

boater safety course approved by the National <strong>Association</strong> of State Boating<br />

Law Administrators (NASBLA) and the State of <strong>Florida</strong>.<br />

<strong>Florida</strong> courts have held that a violation of this statute is negligence per<br />

se and renders a rental company’s otherwise valid exculpatory clause<br />

unenforceable. See Straw v. Aquatic Adventures Management Group, <strong>Inc</strong>.,<br />

2011 WL 5008359 (N.D. Fla. Oct. 20, 2011).<br />

Essentially, under <strong>Florida</strong> law, anyone renting a boat, personal watercraft<br />

(PWC) or similar vessel is required to provide a comprehensive orientation<br />

before the rental or ride commences. Failing to do so means that if a renter is<br />

injured, the person or company renting the item to the renter will be deemed<br />

negligent, even if they did not actually contribute to the injury in any way,<br />

and even if the renter has signed an otherwise enforceable liability waiver.<br />

This statute could be applied when a yacht charterer or guest is injured on<br />

one of the yacht’s toys without receiving the required orientation.<br />

a recent case<br />

In a recent <strong>Florida</strong> case, a woman was injured when she was thrown from a<br />

PWC she rented as part of a guided tour of Panama City Beach. She sued<br />

the rental company on claims of negligence, violation of statutory duties,<br />

and vicarious liability.<br />

Before renting the PWC, the woman (and later the plaintiff ) had executed<br />

a release entitled “Assumption and Acknowledgement of Risks and Release<br />

of Liability Agreement.” The release identified specific risks, such as tides,<br />

currents, wave action, wakes, collisions, equipment failure, and so on. It also<br />

provided that she had “agree[d] to assume responsibility for all the risks<br />

of the activity, whether identified or not and EVEN THOSE ARISING<br />

OUT OF THE NEGLIGENCE OF [the rental company].”<br />

The rental company moved for summary judgment, contending that the<br />

release barred her claims. She countered that that the company breached<br />

the <strong>Florida</strong> livery statute – <strong>Florida</strong> Statute 327.54(e)(I) – and that the<br />

release was therefore invalid.<br />

In this case the rental company argued that it complied with the statute by<br />

having her review and sign a “PWC Renter Orientation Checklist.” The<br />

checklist covered a variety of subjects and included detailed instructions<br />

concerning “protective clothing and equipment,” three items for “PWC<br />

controls,” and three items on “Avoid[ing] Collisions.” The final item asked<br />

whether the renter had any questions about the PWC or its operation. The<br />

plaintiff had signed the checklist and initialed each of these items.<br />

The court noted that waivers relieving a party of liability for its own<br />

negligence are generally disfavored but are valid if the waiver is clear<br />

and unequivocal. The court noted that the waiver was presumptively<br />

valid. However, while the livery statute did not expressly require the<br />

rental company to give the customer live instructions or an interactive<br />

presentation, there were questions about whether the checklist satisfied the<br />

statute. Therefore, the rental company’s motion for summary judgment was<br />

denied.<br />

conclusion<br />

<strong>Florida</strong>’s little-known livery statute could cause problems for charterers<br />

who provide tenders, PWCs and other “toys” for the use of guests. At<br />

the same time, companies offering charters or operating vessels for hire<br />

can insulate themselves from liability to a degree by requiring that guests<br />

receive orientation on this equipment prior to use. The orientation should<br />

cover the four areas listed by the statute: operational characteristics of<br />

the vessel to be rented, safe vessel operation and right-of-way, operator<br />

responsibilities, and navigation information about the waters where the<br />

vessel will be operated.<br />

This is a good idea from a liability point of view, and it helps increase the<br />

safety and welfare of the guests onboard.<br />

Attendance Strong for FYBA Annual Meeting at Pier 66<br />

Awards, Food, Music and Fun Headline a Highly Successful Event<br />

Hollywood Glam was the theme of the Annual Dinner this<br />

year, and guests arriving at the Hyatt Regency Pier 66 for<br />

the event felt as if they had stumbled onto the Red Carpet<br />

at the Oscars instead. Fancy dresses<br />

and gowns, feather boas, sequins, rhinestones and<br />

pearls set the tone for the evening, along with<br />

many tuxes and dapper bowties.<br />

The festivities began, appropriately, with<br />

cocktails on the Panorama Ballroom Terrace<br />

overlooking Pier 66 Marina as sunset lit the<br />

white yachts in their berths. After networking<br />

over drinks and delicious passed hors d’oeuvres,<br />

the members were ushered inside for the short<br />

and succinct <strong>2012</strong> Annual Meeting, emcee’d by<br />

FYBA Secretary Gary Smith of Sarasota <strong>Yacht</strong><br />

& Ship.<br />

Smith introduced new FYBA Executive Director Ann Vernon, who<br />

joked as she took the podium, “I’d like to thank the Academy.”<br />

All joking aside, however, FYBA had its own prestigious awards to<br />

present at the Annual Meeting. The audience burst into appreciative<br />

applause as Bob Zarchen of Ardell <strong>Yacht</strong> & Ship <strong>Brokers</strong> was named<br />

<strong>2012</strong> Broker of the Year. A longtime FYBA member, former President<br />

and current Treasurer, Zarchen said, “I’ve seen FYBA grow from a<br />

hundred members with no permanent home to<br />

the organization it is today.”<br />

The <strong>2012</strong> Charter Broker of the Year Award<br />

went to Robin O’Brien of Fraser <strong>Yacht</strong>s. A<br />

former luxury charter yacht crew member<br />

for more than a decade, O’Brien knows the<br />

industry she serves inside and out. (For bios of<br />

the <strong>2012</strong> Charter Broker of the Year and Broker<br />

of the Year, please see page 4).<br />

With official business out of the way, it<br />

was time for the FYBA members to play.<br />

The party venue moved next door to the<br />

Panorama Ballroom, which was exquisitely<br />

decorated in black and gold in true<br />

Hollywood Glam style. Dinner, featuring<br />

perfectly prepared filet mignon, was followed<br />

by dancing to the exciting rhythms of the<br />

Breeze Band, as silk and feathers swished<br />

and swirled around the floor. Especially<br />

popular was the Photo Booth, where many a<br />

broker “vogued” for the camera and emerged<br />

with a strip of hilarious keepsake images.<br />

This highly memorable evening would<br />

not have been possible without the support<br />

The year <strong>2012</strong> started off strong for<br />

FYBA with over 100 people attending<br />

the <strong>Brokers</strong> Open House on <strong>Jan</strong>uary<br />
