IS IT BOAT SHOw SeASOn ALreAdy?<br />

Hot and humid, humid and hot! This is South <strong>Florida</strong> in<br />
August! The summer doldrums! Maybe next summer<br />
I’ll take a trip to Alaska. Those brokers who head up north for<br />
the summer know what they’re doing! But it’s already back<br />
to school for kids though, and back to work for the rest of<br />
us, especially with boat show season quickly approaching.<br />
<strong>Boat</strong> show season will begin with Cannes on September<br />
11-16 for the FYBA. For any members going over to the<br />
Med, we will have a booth in the <strong>Florida</strong> Pavilion thanks<br />
again to Enterprise <strong>Florida</strong>. We would also like to welcome<br />
Larry Bernaski who has taken over Julie Balzano’s position<br />
as Regional Manager of International Trade Development &<br />
Marine Industry Export Marketing for Enterprise <strong>Florida</strong>. Our booth will be located just in<br />
front of the Gare Maritime at the corner of the north dock at the Vieux Port (Old Port). All<br />
members are welcome to come by!<br />
Then it will be on to the Monaco <strong>Yacht</strong> <strong>Show</strong> for a couple of days, no booth but lots of<br />
walking the docks!<br />
The Fort Lauderdale International <strong>Boat</strong> <strong>Show</strong>, commonly known to our members as<br />
FLIBS, will be just around the corner after the Med shows on October 25-29. The FYBA will<br />
have a new location and new booth for FLIBS! Other surprises are to come, and all will be<br />
revealed in the next issue of COMPASS.<br />
Fall also means seminar season and we have them lined up for you! On September 11th, there will be the West Coast <strong>Yacht</strong> Sales Summit in Sarasota. It promises to be as much of<br />
a success as the East Coast <strong>Yacht</strong> Sales Summit was in June.<br />
The <strong>Yacht</strong> Sales and The Law seminar takes place on October 3rd , followed by the<br />
Charter Seminar on October 10th . Both of these seminars will be held at the Bahia Mar.<br />
Watch for our email blasts with more details. The Seminar Committee and Charter<br />
Professionals Committee hope that all members will clear their calendars for these dates<br />
as they are working hard to bring interesting speakers and topics.<br />
Not to be too idle for too long, we are organizing a Third Thursday Open House once<br />
again in Palm Beach. This will take place on October 18th .<br />
Last but not least, FYBA has finally gone mobile! Thanks to our new app, you may now<br />
access the member’s directory, events, and much more from your mobile phones. Go to the<br />
fyba.org website on your phone, then save the FYBA Mobile icon to your phone for easy<br />
reference. For your information, the FYBA website had almost 5,000 hits in July, with over<br />
24,000 pages viewed! I would like to continue to urge all members to use the site as we are<br />
constantly updating it with interesting articles.<br />

Challenges as Well as Great Opportunity<br />
It’s hard to believe, but the fall boat show season is once again upon us. While the<br />
U.S. economy remains mired in a slow, but steady growth pattern, many markets<br />
in Europe are in recession. Elsewhere, the once hot-growth Asian economies -<br />
especially in China and India - are beginning to show signs of slowing down.<br />
All this, naturally, is having an impact on worldwide demand for yachts and<br />
megayachts. While most FYBA members say the market is better than it was two<br />
or three years ago, especially in the charter segment, yacht buyers remain cautious.<br />
That means brokers have their work cut out for them as the fall boat show season<br />
approaches.<br />
As always, advance planning is key. Major boat shows, such as the Fort<br />
Lauderdale International <strong>Boat</strong> <strong>Show</strong> (FLIBS), which this year runs from Oct. 25-29,<br />
offer huge opportunities to generate sales and meet new customers. But you can’t<br />
just show up with a display full of hot offerings and expect prospects to flock to<br />
your booth.<br />
Now is the time to start reaching out to past clients and current prospects,<br />
and engage in some aggressive pre-show marketing and promotions. And, as Bob<br />
Saxon, President of IYC <strong>Yacht</strong>s and current FYBA Board Member, suggests in the<br />
Q&A that follows, it pays to maintain a positive attitude.<br />
In addition to discussing IYC’s plans for the upcoming fall boat show season,<br />
Saxon offers some tips that the brokerage community might find helpful.<br />
fyBA: For this year’s fall boat show season, do you plan to display as many boats<br />
as in previous years, or are you cutting back?<br />
Saxon: IYC has exactly the same number of slips and display configuration as we<br />
had last year. We’ve not cut back at all. In fact, we have made numerous changes to<br />
our display that will enhance the boat show experience for our customers.<br />
fyBA: In terms of promotions, are you doing anything special this year to drive<br />
sales?<br />
Saxon: We’ve reached out to some of the emerging markets with our advertising,<br />
and we are running ads in local upscale publications in order to drive the affluent<br />
resident sector to our display. We tend to forget that there is a lot of wealth between<br />
the Fort Lauderdale and Palm Beach regions and expect them to attend without<br />
prompts. We’re hoping this strategy will get them excited about attending.<br />
fyBA: Are you inviting more prospects to shows, especially FLIBS, this year?<br />
Saxon: All of our salespeople are inviting their “A” lists of qualified customers, but<br />
that is not a shift in marketing strategy at all. We do it every year.
The Monaco <strong>Yacht</strong> <strong>Show</strong> is one of the major events on the fall boat show calendar.<br />
fyBA: Overall, how has 2012 looked as compared to last year?<br />
Saxon: It’s a down market, according to the market analysis statistics disseminated<br />
throughout the industry, but we’ve seen some recent activity, and charter has livened<br />
up considerably. Chartering is often the entry portal, and we see this as a good sign.<br />
fyBA: Is the ongoing Euro-crisis having a negative impact on business?<br />
Saxon: There are so many factors impacting our market presently that I can’t point the<br />
finger at the Euro-crisis as the single element having an adverse effect. It’s become<br />
a cliché, but it’s all about ‘uncertainty.’ Our stock market has peaked out and well<br />
beyond where it was five years ago, yet high-end buying is somewhat drowsy. I feel<br />
that once we are past the Presidential election, regardless of the outcome, business<br />
will pick up because our clients will have a sense of certainty about where our country<br />
is headed, even if it’s a bitter pill they have to swallow. Nobody likes uncertainty.<br />
fyBA: What’s the most important advice you’d offer brokers right now heading into<br />
the fall shows?<br />
Saxon: Maintain a positive attitude and always speak to your clients in terms of their<br />
being validated for having the wherewithal to charter, build, or buy. They’ve worked<br />
hard to get where they are, and they deserve the incredible rewards that the yachting<br />
experience can deliver.<br />

The ABC’s of SEO<br />
How to Make Your Website More Searchable<br />
Search Engine Optimization (SEO) is the art and science of<br />
developing your website so it performs well in searches<br />
on Google and other search engines online. The ABC’s<br />
are three basic strategies designed to give your website the best<br />
chance for search success!<br />
A – ArCHITeCTUre<br />
The Architecture or technical design of your website will affect<br />
how easy it is for the automated search engine “spiders” to read<br />
your site. Simple html web code is easy for an automated function<br />
like a search engine spider to navigate. If it’s easy for the spider<br />
to read the words and the code on your site, then it will effectively<br />
record words it finds, which is the first step to being shown in a<br />
search result.<br />
If you are designing a new website, the blog software from<br />
Wordpress is an excellent option. The search engine spiders<br />
easily navigate Wordpress; it is a flexible solution for creating<br />
contemporary-looking designs, and anyone can update a<br />
Wordpress website.<br />
On the other hand, one of the worst architectures to use for a<br />
website is a Flash design. Flash is very difficult for the spiders to<br />
read and it is not read by iPhones and iPods.<br />
A final tip for your site architecture is to use keyword phrases<br />
in your site navigation. For example, “internet marketing services”<br />
is better than “services”. You also should include a Site Map page<br />
with links to all of the other pages on your site. This makes it easy<br />
for the spiders to find and read the entire site.<br />
B – BACkLInkS<br />
Backlinks are activated links from other websites to your website.<br />
Each backlink tells the search engines that there is something<br />
worth seeing on your website, a virtual endorsement for your site.<br />
Backlinks from important sites such as industry associations or<br />
media sites are better than links from small sites unrelated to<br />
your industry. Free tools and other compelling content are the<br />
type of things other sites will link to. Can you create a calculator<br />
or a free guide for your industry that bloggers and the media<br />
would refer to via a link? Another great way to get backlinks is to<br />

offer to write guest articles and blog posts for prominent websites<br />
in your industry. Make sure to include your site link with your<br />
author byline.<br />
Google also is rewarding sites with a new type of backlink<br />
called “social signals” – when someone on Facebook “Likes”<br />
something on your website, “Tweets” about you or uses another<br />
signal from a social site, this is a new type of link or endorsement.<br />
C – COnTenT<br />
The C in SEO is creating lots of great Content for your website.<br />
Google reads up to 1,000 words per page and the best way to<br />
be found by a user searching for a word phrase is to include<br />
that word phrase on your site. For example, I won’t be found for<br />
“internet marketing agency” if I don’t have the word phrase on my<br />
site. I recommend creating a page named with an important word<br />
phrase. The title of the page should use the target phrase, and<br />
the phrase should be repeated two or three times in the copy on<br />
the page. In addition, you could name a photo using your target<br />
phrase (Google can’t ‘see’ photos but it can read the name and<br />
alt-tag). Plus, you can use the phrase in navigation and links from<br />
other pages on the site.<br />
Google’s search spokesperson Matt Cutts has a great tip<br />
for content creation. He calls it the “apple a day” method. The<br />
old expression “an apple a day keeps the doctor away” refers to<br />
eating healthy fruits and vegetables. Adding a page of content to<br />
your site every day (or at least several pages per month) allows<br />
you to add several new targeted phrases on a regular basis,<br />
and it tells Google your site is alive and fresh. Adding newsletter<br />
articles, press releases and new product description pages is a<br />
great way to “apple a day” your site.<br />

The world is getting smaller. And you are going global in<br />
places like Italy, Germany, Brazil, Singapore, Australia and<br />
China. You’ve been dealing in these countries for almost<br />
20 years. After all, that’s the nature of the yacht brokerage<br />
business. It’s inherently international.<br />
But have you stopped to ask yourself what the ramifications<br />
are for you and your client with regard to the different laws that<br />
apply country to country?<br />
As we progressively move toward<br />
a more international business model,<br />
we rarely take notice of the fact that<br />
each country we step into has a<br />
different set of laws and regulations<br />
with very different remedies, and<br />
consequences than we may be<br />
accustomed to.<br />
Let’s take China as an example.<br />
Doing business there is very<br />
appealing. The lure of labor arbitrage,<br />
quick builds, and cheap prices on<br />
the front end of a transaction can<br />
persuade savvy purchasers to enter<br />
Chinese waters. But the path to happiness on a Chinese deal is<br />
never on the front end; it’s on the back end.<br />
Protecting yourself in any business transaction is important.<br />
However, when the stakes are high and the deal is in a country<br />
like China, it becomes even more important to take proper<br />
precautions.<br />
Notable risks include the use of exotic financing instruments<br />
for the purchase and/or construction of vessels, such Letters of<br />
Credit, which allow a U.S. purchaser to forestall ultimate payment<br />
until the end of the construction period, but also run the risk<br />
of coming due even though your vessel was not constructed.<br />
One way to protect yourself when using a Letter of Credit is to<br />
secure a valid, highly rated, verified Performance Bond to cover<br />
a construction default.<br />
Also consider utilizing deal-specific escrow accounts, as<br />
well as currency hedging. Deals should be done with proper<br />
due diligence and should include a provision for an owner’s<br />

representative to remain onsite at all times during any build<br />
or construction period. And, while we all know that brokerage<br />
commissions should be received up front, it is imperative for<br />
the health of your long term relationship with the purchaser that<br />
your are not completely absent from the deal moving forward.<br />
So proceed with caution.<br />
Another notable risk is the perceived inability to perform<br />
due diligence on the yard and/or<br />
construction because it is taking<br />
place on Mainland China. To counter<br />
this risk, insist on arranging for your<br />
client and an expert to visit the yard,<br />
inspect its capabilities and verify its<br />
prior work and operations. Finally, be<br />
sure to hire an owner’s representative,<br />
capable of conversing in Mandarin<br />
and English, who can remain onsite<br />
during the build.<br />
Asking tough questions up front<br />
will protect you (and your client) on<br />
the back end. Not only do you want<br />
to protect your commission, your<br />
relationship with your client, and your exposure to possibly<br />
being sued for negligent referral, but you also want to preserve<br />
your reputation.<br />
Another potential risk in dealing with China is that there are limited<br />
remedies should a breach occur. Contract provisions that simply call<br />
for a venue in <strong>Florida</strong> and for the application of <strong>Florida</strong> law are simple<br />
but flawed because U.S. judgments cannot be enforced in China.<br />
More intricate structures, sometimes involving arbitration tribunals<br />
and predetermined escrowed funds can be used.<br />
China is a robust economy with tremendous opportunity, but<br />
it must be met with a degree of caution and a legal process to<br />
adequately protect you from the inherent risk of a cross-border<br />
transactions. Knowledge of the laws and regulations in China is<br />
an important part of the due diligence process in any deal.<br />

AMVer: How The yacht world Can Save Lives<br />
On October 4, 1980: a fire broke out in the engine room<br />
of the Dutch-flagged cruise ship MS PRINSENDAM,<br />
in the Gulf of Alaska. Over 500 passengers and crew<br />
members were onboard and in clear and present danger. In<br />
response, the Coast Guard orchestrated a massive response<br />
in which nearby vessels of all sizes and classes arrived at the<br />
scene within hours to take on survivors.<br />
The vessel sank soon after, but by then, every single person<br />
who had been on board just hours beforehand was alive,<br />
accounted for, and safe. In large part this great success story<br />
was due to the close proximity of cruise ships in the Alaskan<br />
trade.<br />
This incident was also the entrance of AMVER to the global<br />
media but this was not the first use of this little known system in<br />
recovery effort on the high seas. Established in 1958 at the NYC<br />
Customs House, the Automated Mutual-Assistance Vessel<br />
Rescue System or AMVER has always been in a league of its<br />
own as a worldwide ship reporting system. Today AMVER’s<br />
goal aFFIlIatE is still the same: aSSocIatE to arrange for assistance to persons and<br />
vessels in distress at sea. Time and time again it has served as<br />
a valuable asset to search and rescue authorities across the<br />
world, locating nearby vessels that are able and willing to help<br />
in a particular situation.<br />
It began as an experiment, confined to the waters of the<br />
North Atlantic for its first few years. As maritime computer<br />
technology advanced, so did the program. Its computer-based<br />
software produces surface pictures, which display all AMVERparticipating<br />
ships near any given area of the ocean. With<br />
this technology, it became much simpler and easier to locate<br />
not only a ship in distress, but also any other vessels in its<br />
vicinity. Furthermore, radio stations from California to Sweden<br />
joined the network, increasing the system’s already-expansive<br />
coverage.<br />
AMVER has orchestrated assistance in a variety of<br />
situations, ranging from crew injuries or passenger medical<br />
emergencies to fires and floods onboard. Specifically, a<br />
nearby vessel may have a doctor on board, or the capacity<br />
to take in survivors, as in the case of MS PRINSENDAM. In<br />

yachtswoman Florence Arthaud after her trimaran capsized,<br />
resulting in the program’s exposure on NBC’s “Today <strong>Show</strong>”<br />
and other network television programs. A similar incident shortly<br />
thereafter landed AMVER in a National Geographic magazine<br />
feature. Yet, the system is still undersubscribed by Vessels that<br />
could do so much to respond and save life at sea. Thus, the<br />
purpose of this article: Enrolling the <strong>Yacht</strong> World.<br />
It can be easily understood that the success of the program<br />
is directly tied to participation. The more enrolled Vessels, the<br />
greater the chance of search and rescue authorities locating a<br />
vessel nearby to help, and the more effective AMVER becomes.<br />
Luckily, there are plenty of incentives to register: enrolling<br />
in AMVER is free, voluntary, and open to vessels of all flags.<br />
Vessels incur no additional obligation to respond to a distress<br />
call than what already exists under international law of the sea.<br />
All information is protected and only used in true emergency<br />
situations. A vessel simply sends a sail plan electronically to<br />
AMVER, reporting its location every 48 hours until arriving at its<br />
destination. With this basic information, the system can predict<br />
vessel locations at any given time, and greatly improve chances<br />
of quick aid in the case of an emergency by finding the best ship<br />
to respond to a situation and allowing all others to continue their<br />
voyage.<br />
Today, over 22,000 vessels from over 100 nations are<br />
enrolled in AMVER. Around 4,000 are on plot each day, and<br />
these numbers are only growing but the yacht world is under<br />
represented. Enrollment was originally limited to merchant ships<br />
only, but has been recently expanded to allow cruise ships,<br />
research vessels, FPSO’s, fish processors, and private yachts<br />
to participate.<br />
More than 3,000 lives have been saved by AMVERparticipating<br />
ships in the past decade. The program has been<br />
lauded worldwide, with many governments actively encouraging<br />
participation. For more information, or to register your or your<br />

com and click on “Enrollment”.<br />

the program, and AMVER will be there anytime you or someone<br />

The New Year Will Bring<br />
Changes to MARPOL Annex V<br />

Revisions to the International Convention for the Prevention<br />
of Pollution from Ships (MARPOL) Annex V (Garbage)<br />
will come into force on January 1, 2013. The revisions were<br />
adopted through Resolution MEPC.201(62) during 62nd session<br />
of The Marine Environment Protection Committee (MEPC) of<br />
the International Maritime Organization (IMO), which was held<br />
in July 2011.<br />
The most notable of these revisions is that the discharge of<br />
all garbage into the sea will be prohibited, except as provided<br />
otherwise in Regulations 4, 5, 6, and 7. This means that items<br />
such as dunnage, lining, metal, bottles, and other items can no<br />
longer be thrown overboard, regardless of the vessel’s distance<br />
from shore; which may require some creative storage solutions<br />
for smaller vessels.<br />
In addition, 10.2 of Annex V will require that every vessel of 100<br />
gross tons (GT) and above, and every vessel which is certified<br />
to carry 15 or more persons, have a Garbage Management<br />
Plan. This lowers the tonnage requirement from its current level<br />
of 400 GT, which will have implications for a large number of<br />
smaller vessels; such as offshore supply vessels (OSV), tugs,<br />
and yachts.<br />
The establishment of the Garbage Management Plan may be<br />
challenging for the yachting community given that there may<br />
be a learning curve for many owners, crews, and managers<br />
whose yachts fell below the 400 GT requirement. Guidance on<br />
how to properly create and implement a Garbage Management<br />
Plan can be found in Resolution MEPC.220(63).<br />
Other changes have also been made to Annex V, including<br />
updates of definitions, the addition of regulations pertaining to<br />
the discharge of animal carcasses, and an expansion of the<br />
requirements for placards onboard. Comprehensive guidelines<br />
for implementing the revised MARPOL Annex V can be found<br />
in Resolution MEPC.219(63).<br />
Although these revisions may be relatively minor when<br />
compared to other pending regulations affecting the industry,<br />
it is good to be aware and prepared in advance of the New<br />
Year. Please visit the IMO’s website (www.imo.org) to obtain<br />
additional information and guidance that can help in their<br />
proper implementation aboard your yacht.
