Maximum patron capacity<br />

The Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Liqour <strong>an</strong>d<br />

Gambling Regulation (<strong>VCGLR</strong>) has a maximum<br />

patron capacity policy that guides how patron<br />

capacity is determined f<strong>or</strong> a liqu<strong>or</strong> <strong>licence</strong>.<br />

Maximum patron capacity is the maximum<br />

number of patrons allowed on a licensed premises<br />

at <strong>an</strong>y one time. This is to prevent overcrowding<br />

inside the venue <strong>an</strong>d to minimise impacts on local<br />

amenity. Patron capacity may be used to calculate<br />

the <strong>an</strong>nual <strong>licence</strong> fee payable by each licensee.<br />

Applic<strong>an</strong>ts will be required to provide specific<br />

documentation in <strong>or</strong>der f<strong>or</strong> the <strong>VCGLR</strong> to<br />

determine <strong>an</strong>d end<strong>or</strong>se maximum patron capacity<br />

f<strong>or</strong> a premises.<br />

Under the Liqu<strong>or</strong> Control Ref<strong>or</strong>m Act 1998 the<br />

<strong>VCGLR</strong> c<strong>an</strong> set a maximum patron capacity as a<br />

condition of a liqu<strong>or</strong> <strong>licence</strong>. This is enf<strong>or</strong>ceable,<br />

<strong>an</strong>d penalties apply f<strong>or</strong> licensees who do not<br />

comply.<br />

Which <strong>licence</strong>s have a maximum<br />

patron capacity?<br />

Maximum patron capacity will be end<strong>or</strong>sed in<br />

respect of applications f<strong>or</strong> the following new<br />

<strong>licence</strong>s:<br />

• general<br />

• on-premises<br />

• restaur<strong>an</strong>t <strong>an</strong>d cafe<br />

• late night (on-premises <strong>an</strong>d general)<br />

• full club<br />

• restricted club.<br />

Some <strong>existing</strong> <strong>licence</strong>s may also be end<strong>or</strong>sed with<br />

maximum patron capacities.<br />

Maximum patron capacities may also be required<br />

on some maj<strong>or</strong> event <strong>licence</strong>s where appropriate.<br />

What documents need to be<br />

provided?<br />

Three documents are required in <strong>or</strong>der to<br />

determine the maximum patron capacity:<br />

FEBRUARY 2012<br />

1) The maximum patron capacity allowed under<br />

the pl<strong>an</strong>ning <strong>permit</strong>.<br />

2) A rep<strong>or</strong>t from a registered building survey<strong>or</strong> that<br />

states:<br />

• the area in square metres available to the<br />

public f<strong>or</strong> the whole of the internal premises<br />

(excluding toilets, passageways <strong>an</strong>d the like)<br />

<strong>an</strong>d (if applicable) f<strong>or</strong> <strong>an</strong>y external areas such<br />

as courtyards <strong>or</strong> decks, <strong>an</strong>d<br />

• the number of patrons that may be<br />

accommodated on the internal premises <strong>an</strong>d<br />

(if applicable) on <strong>an</strong>y external areas of the<br />

premises based on a ratio of 0.75 square<br />

metres per person. The basis of the calculations<br />

must be included in the rep<strong>or</strong>t.<br />

3) The patron capacity prescribed on <strong>an</strong><br />

occup<strong>an</strong>cy <strong>permit</strong>. If this <strong>permit</strong> c<strong>an</strong>not be<br />

supplied, then the rep<strong>or</strong>t from the building<br />

survey<strong>or</strong> must also include patron calculations<br />

on the same basis as per <strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong><br />

under the Building Act 1993.<br />

Note: Please ensure that the building survey<strong>or</strong><br />

registration number is displayed<br />

on the rep<strong>or</strong>t.<br />

Why are three calculations<br />

required?<br />

Patron capacity as calculated on the registered<br />

building survey<strong>or</strong>’s rep<strong>or</strong>t, the pl<strong>an</strong>ning <strong>permit</strong><br />

<strong>an</strong>d the occup<strong>an</strong>cy <strong>permit</strong>, may differ, as each is<br />

determined acc<strong>or</strong>ding to different criteria <strong>an</strong>d f<strong>or</strong><br />

different purposes.
