SUMMARY OF STAFF RECOMMENDATION<br />
Proposed <strong>Consent</strong> <strong>Order</strong>s<br />
Staff recommends that the Commission approve <strong>Consent</strong> <strong>Cease</strong> <strong>and</strong> <strong>Desist</strong> <strong>Order</strong> <strong>No</strong>.<br />
<strong>CCC</strong>-<strong>13</strong>-CD-02 <strong>and</strong> <strong>Consent</strong> Restoration <strong>Order</strong> <strong>No</strong>. <strong>CCC</strong>-<strong>13</strong>-RO-02 (“<strong>Consent</strong> <strong>Order</strong>s”).<br />
These <strong>Consent</strong> <strong>Order</strong>s address the unpermitted grading <strong>of</strong> roads, removal <strong>of</strong> major<br />
vegetation, placement <strong>of</strong> s<strong>and</strong>bags, <strong>and</strong> installation <strong>of</strong> a l<strong>and</strong>slide buttress consisting <strong>of</strong><br />
fill, earthen berms, retention basins, <strong>and</strong> drains (“Exhibit 2”) resulting in damage to<br />
Environmentally Sensitive Habitat Areas (“ESHA”), that occurred on the western portion<br />
<strong>of</strong> a vacant property at 32354 Caribbean Drive, Dana Point; Orange County 1 (“subject<br />
property”) (Exhibit 1).<br />
The unpermitted development that is the subject <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s was originally<br />
undertaken by a previous owner <strong>of</strong> the subject property. 2 The current owner, Caribbean<br />
Dana Point Investors LLC (“Respondent”), took title to the subject property in December<br />
2012.<br />
In April 2012, when the property was owned by Mehrdad Safari, the Commission<br />
approved Coastal Development Permit <strong>No</strong>. A-5-DPT-05-306 (“the CDP”) (“Exhibit 3”),<br />
which authorized construction <strong>of</strong> a single-family residence on the subject property. The<br />
permit was approved subject to conditions that had to be satisfied before the permit could<br />
be issued, some <strong>of</strong> which have not yet been satisfied, so the permit has not yet been<br />
issued. In approving the CDP, the Commission found that unpermitted development had<br />
occurred on the subject property, including the grading, vegetation removal <strong>and</strong><br />
installation <strong>of</strong> a l<strong>and</strong>slide buttress that is the subject <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s. The<br />
Commission action also authorized revegetation <strong>of</strong> some <strong>of</strong> the areas impacted by the<br />
unpermitted development.<br />
In the findings that the Commission adopted in conjunction with that permit approval, the<br />
Commission further noted that “Additional steps necessary to fully address the<br />
unpermitted development will be considered by the Commission’s enforcement unit, <strong>and</strong><br />
h<strong>and</strong>led as a separate matter.” These <strong>Consent</strong> <strong>Order</strong>s are intended to fully resolve the<br />
violations on the subject property identified herein by, amongst other things, providing a<br />
requirement that Respondent, independent <strong>of</strong> whether the CDP is issued, both restore<br />
<strong>and</strong>\or revegetate areas <strong>of</strong> the property impacted by unpermitted development, as more<br />
fully described in this staff report, <strong>and</strong> restore, maintain, <strong>and</strong> preserve additional native<br />
habitats in coastal Orange County to <strong>of</strong>fset temporal loss <strong>of</strong> habitat resulting from the<br />
