preservation <strong>of</strong> CSS <strong>and</strong> SMC as outlined in these <strong>Consent</strong> <strong>Order</strong>s. Any development<br />
subject to Coastal Act permitting requirements that is not specifically authorized under<br />
these <strong>Consent</strong> <strong>Order</strong>s requires a coastal development permit (“CDP”). <strong>No</strong>thing in these<br />
<strong>Consent</strong> <strong>Order</strong>s guarantees or conveys any right to development on the subject property<br />
other than the work expressly authorized by these <strong>Consent</strong> <strong>Order</strong>s. Through the execution<br />
<strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s, Respondent agrees to comply with these <strong>Consent</strong> <strong>Order</strong>s,<br />
including the following terms <strong>and</strong> conditions.<br />

Impacted Area: The 1.15-acre area <strong>of</strong> CSS <strong>and</strong> SMC on the subject property impacted by<br />
the unpermitted development described in Section 7, as generally depicted on Exhibit 1<br />
<strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s.<br />
HRMP: The Habitat Restoration <strong>and</strong> Management Program that Respondent was required<br />
to prepare, pursuant to Special Condition <strong>No</strong>. 4 <strong>of</strong> Coastal Development Permit <strong>No</strong>. A-5-<br />
DPT-05-306 (“the CDP”), the purpose <strong>of</strong> which was to restore, maintain, <strong>and</strong> preserve a<br />
minimum <strong>of</strong> 1.9 acres <strong>of</strong> CSS <strong>and</strong> SMC that rises to the level <strong>of</strong> Environmentally<br />
Sensitive Habitat Area (“ESHA”) on the subject property, as fully described in Special<br />
Condition #4 <strong>of</strong> the CDP <strong>and</strong> generally depicted on Exhibit 1 <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s.<br />
Most <strong>of</strong> the 1.15-acre Impacted Area is within the 1.9-acre area to be restored pursuant to<br />
the HRMP. Impacted Areas within <strong>and</strong> outside the 1.9-acre HRMP restoration area, but<br />
not within the footprint <strong>of</strong> the development approved pursuant to the CDP, will be<br />
restored pursuant to the Exp<strong>and</strong>ed HRMP, defined below.<br />
Exp<strong>and</strong>ed HRMP: The version <strong>of</strong> the HRMP submitted pursuant to Section 4.4, below,<br />
which is a revision <strong>of</strong> the original HRMP designed to include restoration <strong>of</strong> all portions<br />
<strong>of</strong> the Impacted Area outside the footprint <strong>of</strong> the development approved pursuant to the<br />
CDP, as well as the original 1.9-acre HRMP restoration area addressed by the CDP,<br />
which is also addressed under these <strong>Order</strong>s, much <strong>of</strong> which overlap, but each <strong>of</strong> which<br />
covers some areas not covered by the other. The area subject to the Exp<strong>and</strong>ed HMRP is<br />
generally depicted in Exhibit 2 <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s.<br />
Unpermitted Objects: All unpermitted development, <strong>and</strong> objects on the subject property<br />
resulting therefrom, that are required to be removed from the subject property by these<br />
<strong>Consent</strong> <strong>Order</strong>s, consisting <strong>of</strong>: all s<strong>and</strong>bags, rip-rap <strong>and</strong> concrete rubble, <strong>and</strong> plastic tarps<br />
on the subject property, subject to Section 4.3.A.2.<br />
