8. The work to be performed under these <strong>Consent</strong> <strong>Order</strong>s, if done in compliance with<br />
the <strong>Consent</strong> <strong>Order</strong>s <strong>and</strong> the plans approved therein, will be consistent with Chapter 3<br />
<strong>of</strong> the Coastal Act.<br />
9. On February 15, 20<strong>13</strong>, an authorized signatory for Respondent signed <strong>Consent</strong> <strong>Cease</strong><br />
<strong>and</strong> <strong>Desist</strong> <strong>Order</strong> <strong>No</strong>. <strong>CCC</strong>-<strong>13</strong>-CD-02 <strong>and</strong> <strong>Consent</strong> Restoration <strong>Order</strong> <strong>No</strong>. <strong>CCC</strong>-<strong>13</strong>-<br />
RO-02, a copy <strong>of</strong> which is attached to this staff report as Appendix A. Respondent<br />
agreed not to contest commencement <strong>of</strong> proceedings to issue these <strong>Consent</strong> <strong>Order</strong>s,<br />
<strong>and</strong> agreed to issuance <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s, without first receiving written notice<br />
<strong>of</strong> intent to commence cease <strong>and</strong> desist order <strong>and</strong> restoration order proceedings<br />
pursuant to Sections <strong>13</strong>181 <strong>and</strong> <strong>13</strong>191, respectively, <strong>of</strong> the Commission’s<br />
administrative regulations.<br />
10. Respondent does not object to recordation by the Executive Director <strong>of</strong> a notice <strong>of</strong><br />
violation, pursuant to PRC section 30812(b). Accordingly, a notice <strong>of</strong> violation will<br />
be recorded after issuance <strong>of</strong> these <strong>Consent</strong> <strong>Order</strong>s.<br />
11. Impacts to coastal resources resulting from the unpermitted development described in<br />
finding #2 will continue until the requirements <strong>of</strong> the <strong>Consent</strong> <strong>Order</strong>s are carried out.<br />
Staff recommends that the Commission issue <strong>Consent</strong> <strong>Cease</strong> <strong>and</strong> <strong>Desist</strong> <strong>Order</strong> <strong>No</strong>. <strong>CCC</strong>-<br />
<strong>13</strong>-CD-02 <strong>and</strong> <strong>Consent</strong> Restoration <strong>Order</strong> <strong>No</strong>. <strong>CCC</strong>-<strong>13</strong>-RO-02 attached hereto as<br />
Appendix A.<br />
