approved by the Executive Director pursuant to SPECIAL<br />
CONDITION NO. 2, Final Project Plans, <strong>and</strong> SPECIAL<br />
CONDITION NO. <strong>13</strong>, conformance with geotechnical<br />
recommendations, <strong>of</strong> this permit;<br />
(4) Planting <strong>of</strong> native vegetation <strong>and</strong> other restoration activities<br />
beyond what’s approved by this permit, if approved by the<br />
Commission as an amendment to this Coastal Development Permit<br />
or a new Coastal Development Permit; <strong>and</strong><br />
(4 5) If approved by the Commission as an amendment to this Coastal<br />
Development Permit or a new Coastal Development Permit,<br />
(a) construction <strong>and</strong> maintenance <strong>of</strong> public hiking trails; <strong>and</strong><br />
(b) construction <strong>and</strong> maintenance <strong>of</strong> roads, trails, <strong>and</strong> utilities<br />
consistent with existing easements.<br />
(c) repair <strong>and</strong> maintenance <strong>of</strong> structures identified in 8.A.3,<br />
above.<br />
B. PRIOR TO THE ISSUANCE BY THE EXECUTIVE DIRECTOR OF THE<br />
NOI FOR THIS COASTAL DEVELOPMENT PERMIT, the applicant shall<br />
submit for the review <strong>and</strong> approval <strong>of</strong> the Executive Director, <strong>and</strong> upon such<br />
approval, for attachment as an Exhibit to the NOI, a formal metes <strong>and</strong> bounds<br />
legal description <strong>and</strong> graphic depiction, prepared by a licensed surveyor, <strong>of</strong> the<br />
portion <strong>of</strong> the subject property affected by this condition, as generally described<br />
on Exhibit #7 attached to the findings in support <strong>of</strong> approval <strong>of</strong> this permit.<br />

Additionally, the applicant has proposed voluntarily <strong>of</strong>fered to restore native scrub habitat that<br />
was impacted by prior alleged unpermitted grading (see Unpermitted Development section for<br />
further discussion <strong>of</strong> alleged violation). The applicant states that he will restore <strong>and</strong> enhance<br />
1.90 acres <strong>of</strong> native scrub habitat on-site with higher quality CSS <strong>and</strong> Maritime Chaparral/SS<br />
that rises to the level <strong>of</strong> ESHA, which has been verified by our Staff Biologist. In addition to the<br />
habitat restoration <strong>and</strong> enhancement, the applicant has also <strong>of</strong>fered to preserve an existing 8.6<br />
acre area <strong>of</strong> habitat on site that includes ESHA. The total area to be preserved will include the<br />
8.6 acre area <strong>and</strong> the restored/enhanced 1.9 acre area, for a total <strong>of</strong> 10.5 acres.<br />
