J ito, -The Constable or Oincer, when summoning,
requires no witnesses. His written return of theexe-,
cution shall be htid to be sufficient evidence thereof.
i^/o, In cases where bail has been found, either to
appear t.t a certain diet, or to appear when notice is
given to the party or cautioner, and no appearance is
made, the Judge may declare the tail bond forfeited,
and the money recovered in consequence thereof, is to
go to the fund for fines, or to the private party for
es, or part each purpose, after deducting what is
nectssary for defraying the expenses, according to the
nature of the complaint, and as the Judge may determine.
The money to be recovered in the same way
as fines o. damages themselves would be recoverable.
