J ito, -The Constable or Oincer, when summoning,<br />

requires no witnesses. His written return <strong>of</strong> theexe-,<br />

cution shall be htid to be sufficient evidence there<strong>of</strong>.<br />

i^/o, In cases where bail has been found, either to<br />

appear t.t a certain diet, or to appear when notice is<br />

given to the party or cautioner, and no appearance is<br />

made, the Judge may declare the tail bond forfeited,<br />

and the money recovered in consequence there<strong>of</strong>, is to<br />

go to the fund for fines, or to the private party for<br />

es, or part each purpose, after deducting what is<br />

nectssary for defraying the expenses, according to the<br />

nature <strong>of</strong> the complaint, and as the Judge may determine.<br />

The money to be recovered in the same way<br />
