Vincent Ferrer Gasser, who was Bishop of Brixen from 1856-79. He was also Relator of the Faith at<br />

the Vatic<str<strong>on</strong>g>an</str<strong>on</strong>g> Council. Pope Pius IX would probably have written him letters, but no particular letter or<br />

published source is provided. The c<strong>on</strong>tent of the quote is less sc<str<strong>on</strong>g>an</str<strong>on</strong>g>dalous th<str<strong>on</strong>g>an</str<strong>on</strong>g> that of the first, but<br />

still clearly err<strong>on</strong>eous.<br />

9. Next we enter the thorny paths of heresy, membership in the Church, jurisdicti<strong>on</strong>,<br />

excommunicati<strong>on</strong>, c<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong> law, <str<strong>on</strong>g>an</str<strong>on</strong>g>d divine law. Fr. Boulet has not c<strong>on</strong>sidered all of the things that<br />

must be c<strong>on</strong>sidered to treat this matter properly. Here is his text.<br />

3.2. Incompatibility between heresy <str<strong>on</strong>g>an</str<strong>on</strong>g>d ecclesiastical jurisdicti<strong>on</strong>: Both Holy Scripture <str<strong>on</strong>g>an</str<strong>on</strong>g>d<br />

Traditi<strong>on</strong> teach clearly that there is a deep incompatibility in radice (in the root) between the<br />

c<strong>on</strong>diti<strong>on</strong> of a heretic <str<strong>on</strong>g>an</str<strong>on</strong>g>d the possessi<strong>on</strong> of <str<strong>on</strong>g>an</str<strong>on</strong>g> ecclesiastical jurisdicti<strong>on</strong>, because a heretic<br />

ceases to be member of the Church. However, such incompatibility is not absolute, that is<br />

why theologi<str<strong>on</strong>g>an</str<strong>on</strong>g>s are using the term in radice (in the root). In the same m<str<strong>on</strong>g>an</str<strong>on</strong>g>ner as a pl<str<strong>on</strong>g>an</str<strong>on</strong>g>t<br />

c<str<strong>on</strong>g>an</str<strong>on</strong>g> still stay green for a while after it had been rooted up, likewise, jurisdicti<strong>on</strong> could be<br />

maintained, in a precarious m<str<strong>on</strong>g>an</str<strong>on</strong>g>ner though, even after the Churchm<str<strong>on</strong>g>an</str<strong>on</strong>g> had fallen into<br />

heresy (cf. Suarez). Theologi<str<strong>on</strong>g>an</str<strong>on</strong>g>s are basing their argumentati<strong>on</strong> mostly <strong>on</strong> C<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong> Law, C<str<strong>on</strong>g>an</str<strong>on</strong>g>.<br />

2314: “All apostates from the Christi<str<strong>on</strong>g>an</str<strong>on</strong>g> faith <str<strong>on</strong>g>an</str<strong>on</strong>g>d each <str<strong>on</strong>g>an</str<strong>on</strong>g>d every heretic <str<strong>on</strong>g>an</str<strong>on</strong>g>d schismatic incur<br />

the excommunicati<strong>on</strong> ipso facto. Unless they respect warnings, they are deprived of<br />

benefice, dignity, pensi<strong>on</strong> office … <str<strong>on</strong>g>an</str<strong>on</strong>g>d if clerics, with the warning being repeated, they are<br />

deposed.” Then, C<str<strong>on</strong>g>an</str<strong>on</strong>g>. 2264 declares unlawful, but not automatically invalid, the acts of<br />

jurisdicti<strong>on</strong> coming from some<strong>on</strong>e who has been excommunicated: “An act of jurisdicti<strong>on</strong><br />

carried out by <str<strong>on</strong>g>an</str<strong>on</strong>g> excommunicated pers<strong>on</strong>, whether in the internal or the external forum, is<br />

illicit; <str<strong>on</strong>g>an</str<strong>on</strong>g>d if a c<strong>on</strong>demnatory or declaratory sentence has been pr<strong>on</strong>ounced, it is also invalid,<br />

without prejudice to c. 2261, §3; otherwise it is valid.” Thus the heretical cleric does not<br />

lose automatically his functi<strong>on</strong>s, but he has to be deposed by the lawful authority. From<br />

this, we c<str<strong>on</strong>g>an</str<strong>on</strong>g> c<strong>on</strong>clude that heresy, even external, does not automatically eliminate<br />

jurisdicti<strong>on</strong>. Against it, it may be argued from C<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong> 188 # 4: “Any office becomes vac<str<strong>on</strong>g>an</str<strong>on</strong>g>t<br />

up<strong>on</strong> the fact <str<strong>on</strong>g>an</str<strong>on</strong>g>d without declarati<strong>on</strong> by tacit resignati<strong>on</strong> recognized by the law itself if a<br />

cleric: 4. publicly defects from the Catholic faith.” Sedevac<str<strong>on</strong>g>an</str<strong>on</strong>g>tists are using this c<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong> as a<br />

weighty proof of their thesis, however, such c<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong> c<str<strong>on</strong>g>an</str<strong>on</strong>g>not be c<strong>on</strong>sidered as a final proof that<br />

a heretical Pope had lost his office. One has to remember that the Pope is always above the<br />

dispositi<strong>on</strong>s of the positive law, as the <strong>on</strong>e of C<str<strong>on</strong>g>an</str<strong>on</strong>g>. 188. Such argument would be final <strong>on</strong>ly if<br />

it was being proved that the c<str<strong>on</strong>g>an</str<strong>on</strong>g><strong>on</strong>ical dispositi<strong>on</strong> of C<str<strong>on</strong>g>an</str<strong>on</strong>g>. 188 bel<strong>on</strong>gs to the divine-positive<br />

law of the Church. One would have also to prove that this divine-positive law applies<br />

properly to the specific case of the Pope. But, it is precisely <strong>on</strong> that matter that the greatest<br />

theologi<str<strong>on</strong>g>an</str<strong>on</strong>g>s have been in disagreement for centuries.<br />

Having admitted, following da Silveira, that there is a radical incompatibility between the status of<br />

heretic <str<strong>on</strong>g>an</str<strong>on</strong>g>d the possessi<strong>on</strong> of habitual jurisdicti<strong>on</strong>, Fr. Boulet makes the startling comment that<br />
