the mode of tr<str<strong>on</strong>g>an</str<strong>on</strong>g>smissi<strong>on</strong> of the power which is to be passed <strong>on</strong> <str<strong>on</strong>g>an</str<strong>on</strong>g>d, c<strong>on</strong>sequently, the<br />
mode of the electi<strong>on</strong> by which this tr<str<strong>on</strong>g>an</str<strong>on</strong>g>smissi<strong>on</strong> takes place.<br />
Any law, moreover, related to the order of the universal Church, exceeds by its very nature<br />
the scope of <str<strong>on</strong>g>an</str<strong>on</strong>g>y power less th<str<strong>on</strong>g>an</str<strong>on</strong>g> the supreme power. But the electi<strong>on</strong> of the supreme<br />
bishop pertains without doubt to the order of the universal Church. It is, therefore, reserved,<br />
by its very nature to the determinati<strong>on</strong> of him to whom the care of the entire community<br />
was committed by Christ. And indeed it is inc<strong>on</strong>trovertible that these c<strong>on</strong>clusi<strong>on</strong>s are valid in<br />
normal circumst<str<strong>on</strong>g>an</str<strong>on</strong>g>ces. Let us now investigate, nevertheless, how the law would apply if<br />
perch<str<strong>on</strong>g>an</str<strong>on</strong>g>ce <str<strong>on</strong>g>an</str<strong>on</strong>g> extraordinary situati<strong>on</strong> were to arise in which it was necessary to proceed to<br />
the electi<strong>on</strong> of a p<strong>on</strong>tiff while it was no l<strong>on</strong>ger possible to comply with the c<strong>on</strong>diti<strong>on</strong>s<br />
determined by previous p<strong>on</strong>tifical law; as some think was the case at the time of the Great<br />
Schism in the electi<strong>on</strong> of Martin V.<br />
Well, <strong>on</strong>ce we gr<str<strong>on</strong>g>an</str<strong>on</strong>g>t the occurrence of such circumst<str<strong>on</strong>g>an</str<strong>on</strong>g>ces, it is to be admitted without<br />
difficulty that the power of electi<strong>on</strong> would devolve up<strong>on</strong> a general council. For the natural<br />
law itself prescribes that in such cases the attribute of a superior power descends, by way of<br />
devoluti<strong>on</strong>, to the power immediately below insofar as it is indispensably necessary for the<br />
survival of the society <str<strong>on</strong>g>an</str<strong>on</strong>g>d for the avoid<str<strong>on</strong>g>an</str<strong>on</strong>g>ce of the tribulati<strong>on</strong>s of extreme lack. “In case of<br />
doubt, however (e.g. when it is unknown if some<strong>on</strong>e be a true cardinal or when the Pope is<br />
dead or uncertain, as seems to have happened at the time of the Great Schism which beg<str<strong>on</strong>g>an</str<strong>on</strong>g><br />
under Urb<str<strong>on</strong>g>an</str<strong>on</strong>g> VI), it is to be affirmed that the power to apply the papacy to a pers<strong>on</strong> (the due<br />
requirements having been complied with) resides in the Church of God. And then by way of<br />
devoluti<strong>on</strong> it is seen that this power descends to the universal Church, since the electors<br />
determined by the Pope do not exist” (Cajet<str<strong>on</strong>g>an</str<strong>on</strong>g>, ibidem). This, I say, is understood without<br />
difficulty if the occurrence of the case be admitted. But whether, in fact the case has ever<br />
occurred is a completely different questi<strong>on</strong>. For indeed it is now held as more or less certain<br />
am<strong>on</strong>g learned men that the electi<strong>on</strong> of Martin V was not d<strong>on</strong>e <strong>on</strong> the private authority of<br />
the Council of C<strong>on</strong>st<str<strong>on</strong>g>an</str<strong>on</strong>g>ce, but by faculties expressly gr<str<strong>on</strong>g>an</str<strong>on</strong>g>ted by the legitimate P<strong>on</strong>tiff<br />
Gregory XII before he had renounced the papacy, so that Cardinal Fr<str<strong>on</strong>g>an</str<strong>on</strong>g>zelin correctly <str<strong>on</strong>g>an</str<strong>on</strong>g>d<br />
appropriately says: that there is “reas<strong>on</strong> for us with humble praise to w<strong>on</strong>der at the<br />
providence of Christ the King, the spouse <str<strong>on</strong>g>an</str<strong>on</strong>g>d head of the Church, by which He calmed those<br />
huge crowds of men driven <str<strong>on</strong>g>an</str<strong>on</strong>g>d sustained by covetousness <str<strong>on</strong>g>an</str<strong>on</strong>g>d ignor<str<strong>on</strong>g>an</str<strong>on</strong>g>ce, with all laws<br />
being observed to the letter; most clearly dem<strong>on</strong>strating that the indefectibility of the rock<br />
up<strong>on</strong> which He built His Church, so that the gates of Hell would not prevail against Her, is<br />
supported not by hum<str<strong>on</strong>g>an</str<strong>on</strong>g> effort, but by the divine fidelity in promises <str<strong>on</strong>g>an</str<strong>on</strong>g>d omnipotence in<br />
