Actually, the theologi<str<strong>on</strong>g>an</str<strong>on</strong>g>s have c<strong>on</strong>sidered various hypothetical cases <str<strong>on</strong>g>an</str<strong>on</strong>g>d their teachings sufficiently<br />
clarify the situati<strong>on</strong>.<br />
C<strong>on</strong>sider firstly the teaching of St. Robert Bellarmine.<br />
If there were no papal c<strong>on</strong>stituti<strong>on</strong> <strong>on</strong> the electi<strong>on</strong> of the Supreme P<strong>on</strong>tiff; or if by some<br />
ch<str<strong>on</strong>g>an</str<strong>on</strong>g>ce all the electors designated by law, that is, all the Cardinals, perished simult<str<strong>on</strong>g>an</str<strong>on</strong>g>eously,<br />
the right of electi<strong>on</strong> would pertain to the neighbouring bishops <str<strong>on</strong>g>an</str<strong>on</strong>g>d the Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> clergy, but<br />
with some dependence <strong>on</strong> a general council of bishops.<br />
In this propositi<strong>on</strong>, there does not appear to be universal agreement. Some think that,<br />
exclusive of positive law, the right of electi<strong>on</strong> would devolve <strong>on</strong> a Council of Bishops, as<br />
Cajet<str<strong>on</strong>g>an</str<strong>on</strong>g>, tract. De Potestate Papae & C<strong>on</strong>cilii, cap. 13 & 21 & Fr<str<strong>on</strong>g>an</str<strong>on</strong>g>cis Victoria, relect. 2. quest.<br />
2. De potestate Ecclesiae. Others, as Sylvester relates s.v. Excommunicatio, 9. sec. 3, teach<br />
that in that case the right of electi<strong>on</strong> pertains to the Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> clergy. But these two opini<strong>on</strong>s<br />
c<str<strong>on</strong>g>an</str<strong>on</strong>g> be rec<strong>on</strong>ciled. Without a doubt, the primary authority of electi<strong>on</strong> in that case pertains to<br />
a Council of Bishops; since, when the P<strong>on</strong>tiff dies, there is no higher authority in the Church<br />
th<str<strong>on</strong>g>an</str<strong>on</strong>g> that of a general Council: <str<strong>on</strong>g>an</str<strong>on</strong>g>d if the P<strong>on</strong>tiff were not the Bishop of Rome, or <str<strong>on</strong>g>an</str<strong>on</strong>g>y other<br />
particular place, but <strong>on</strong>ly the general Pastor of the whole Church, it would pertain to the<br />
Bishops either to elect his successor, or to designate the electors: nevertheless, after the<br />
P<strong>on</strong>tificate of the world was joined to the bishopric of the City [posteaquam unitus est<br />
P<strong>on</strong>tificatus orbis Episcopatui Urbis], the immediate authority of electing in that case would<br />
have to be permitted by the bishops of the whole world to the neighbouring bishops, <str<strong>on</strong>g>an</str<strong>on</strong>g>d to<br />
the clerics of the Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> Church, which is proved in two ways.<br />
First, because the right of electi<strong>on</strong> was tr<str<strong>on</strong>g>an</str<strong>on</strong>g>sferred from all the neighbouring bishops <str<strong>on</strong>g>an</str<strong>on</strong>g>d the<br />
Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> clergy to the Cardinals, who are a certain part of the bishops <str<strong>on</strong>g>an</str<strong>on</strong>g>d clergy of the<br />
Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> Church; therefore, when the Cardinals are lacking, the right of electi<strong>on</strong> ought to<br />
return to all the bishops <str<strong>on</strong>g>an</str<strong>on</strong>g>d clergy of the Rom<str<strong>on</strong>g>an</str<strong>on</strong>g> Church.<br />
Sec<strong>on</strong>d, because this is a most <str<strong>on</strong>g>an</str<strong>on</strong>g>cient custom (as we showed above from Cypri<str<strong>on</strong>g>an</str<strong>on</strong>g>), that the<br />
neighbouring bishops, in the presence of the clergy, should elect both the Bishop of Rome<br />
<str<strong>on</strong>g>an</str<strong>on</strong>g>d others also. And it is unheard of that the Bishops or Archbishops of the whole world<br />
should meet for the electi<strong>on</strong> of the Supreme P<strong>on</strong>tiff, except in a case where it is doubtful<br />
