The will proceeds on the narrative of the testa<strong>to</strong>r's being resolved <strong>to</strong><br />
settle his worldly affairs, and goes on, in the first place, <strong>to</strong> ratify and confirm<br />
his contract of marriage with his beloved [second] wife, Frances,<br />
dated the i6th of March 1747, in all its parts, and the provisions thereby<br />
made both for his said wife and children [of his former marriage]. Then<br />
for the love and favour he bears <strong>to</strong> his said wife, and <strong>to</strong> his children afterwards<br />
mentioned, and considering that his son, William Thomas, inherits<br />
a good estate by the last will of the testa<strong>to</strong>r's uncle, Sir James Wishart,<br />
therefore he assigns, etc., <strong>to</strong> Janet, Ann, Jean, and Margaret, his daughters,<br />
equally among them, and, failing any of them, <strong>to</strong> the survivor or survivors,<br />
in equal portions, and failing all of them by decease without issue of any<br />
of their bodies, <strong>to</strong> his dear son, William Thomas, and heirs of his body,<br />
whom failing, <strong>to</strong> his beloved wife, Frances, his dear brother, Mr. George<br />
Wishart, and his dear sister, Cordelia Wishart alias Moncreiff, and their<br />
heirs and assignees, by equal portions, all his moveable goods and gear of<br />
whatever kind and denomination (heirship moveables included), that<br />
should belong <strong>to</strong> him at his death, <strong>to</strong>gether with all debts and sums of<br />
money that should be due or addebted <strong>to</strong> him by any person at his death.<br />
The testa<strong>to</strong>r next nominates his said daughters <strong>to</strong> be his sole execu<strong>to</strong>rs<br />
and universal lega<strong>to</strong>ries; but subject <strong>to</strong> a power <strong>to</strong> him <strong>to</strong> alter, etc., and<br />
he at present burdens them '<strong>to</strong> give and deliver <strong>to</strong> my beloved wife,<br />
Frances (besides the snms and other things disponed <strong>to</strong> her by the con-<br />
tract of marriage above mentioned), her gold watch, her diamond rings,<br />
with all her wearing jewels and ornaments, and all her wearing apparel;<br />
the new<br />
the two pictures of herself, and the large and small pictures of me ;<br />
sewed bed and window curtains, partly her own work ; six silver spoons ;<br />
with all the money or bank-notes, and all the pieces of gold that shall be<br />
in her or my cus<strong>to</strong>dy at my death ; <strong>to</strong>gether with her own collection of<br />
books contained in a catalogue or catalogues, numbered and signed by<br />
Item, <strong>to</strong> give and deliver <strong>to</strong> my said son, William Thomas, the old<br />

sewed bed, window curtains, and chair slips, partly his mother's work the<br />

walnut-tree bureau, with the model of a ship in the upper part of it, that<br />
stands in my closet set with<br />

two large pictures of Sir James, and my Lady Wishart ; the family picture<br />
done by Mr. Alexander ; my gold watch, chain, and seal ; my ring, with<br />
a green emerald in it; my amber-headed cane and ; my Bayle's Dictionary,<br />
in French, left <strong>to</strong> me by Sir James White, all these <strong>to</strong> be kept for him by<br />
my beloved wife, Frances, who is <strong>to</strong> have the use of them till he comes <strong>to</strong><br />
the years of majority, or marries and in case of his decease before ; any<br />
of these times, I appoint the bureau in my bed-chamber <strong>to</strong> be given <strong>to</strong><br />
my said beloved wife ; the bureau in my closet, the late Emperor's picture,<br />
my gold watch, chain, and seal, my emerald ring, and my amber-headed<br />
cane, <strong>to</strong> be given <strong>to</strong> my dear brother, Mr. George Wishart, and the rest of<br />
the things above left <strong>to</strong> my son <strong>to</strong> be given <strong>to</strong> my eldest daughter, Janet :<br />
Item, my saids execu<strong>to</strong>rs are <strong>to</strong> give <strong>to</strong> my said eldest daughter the large<br />
picture of my first dear wife, her mother, the coloured print of Sir James<br />
