Well, but, in all events, these are the only representations that you 9 are aware of in respect of Mr. Mahony's lands in itself? 10 A Yes. 11 Q 48 And isn't it possible that those 2,530 representations really arise from 12 earlier objections that were made and were sent, if you are correct, were sent 13 in again because of the figures that we gave that we saw earlier about having 14 24,000 objections or representations for the first display and 24,500 for the 15 second display? It's very unlikely, is it not, that 2,530 new people objected 16 on the second display in respect of Mr. Mahony's lands? 17 A I would agree it's unlikely. They probably were a re-statement of the original 18 objections to the proposed rezoning of the Baldoyle lands but when the second 19 display occurred, these lands would have been included as a proposal and that 20 would have generated the representations. 21 Q 49 Thank you very much. 22 23 THE WITNESS WAS CROSS-EXAMINED AS FOLLOWS BY MR. MONTGOMERY: 24 25 Q 50 MR. MONTGOMERY: Giles Montgomery for the estate of Cyril Gallagher, deceased. 26 I have only one question. The document to your left on screen, the one dealing 27 with the 2,530 representations, can you give us an indication as to when that 28 document would have been prepared and typed? 29 A This report? 30 Q 51 The one on the left hand screen?
11 1 A Probably a couple of days before the meeting. 2 Q 52 Which meeting? 3 A This meeting that it was considered at, Chairman, it's not shown there, but I 4 think it would have been around late 1993? 5 Q 53 I am looking at the document which, on its face, indicates to me perhaps 6 incorrectly that it is a minute prepared subsequent to the meeting of the 24th 7 April of 1993. 8 A No, this minute here relates to the meeting, the special meeting of the County 9 Council which, I don't recall the date, but it would have been much later in 10 1993, this is the minute where the actual decision is made to rezone the lands, 11 so it would have been later, towards the end of the year. 12 Q 54 Then what is the significance of the two dates set out, one on the top of the 13 sheet and another halfway down? 14 A The first minute C/314/93, that would have referred back to a meeting of that 15 date. 16 Q 55 And when would that have been prepared? This is the point. I am putting it to 17 you, Mr. McGlynn, and I am not trying to confuse you or whatever, the point 18 that I'm trying to make to you is that this would appear to me that it was a 19 minute prepared contemporaneously with the holding of the meeting, it had to 20 be, presumably at the meeting there was a secretary taking notes? 21 A Oh yes. 22 Q 56 And if the secretary taking notes in dealing with minute C/314/93 and that 23 minute refers on its face to representations of the 28th April 1993, I find it 24 difficult to understand as to how at that meeting it can be said that those 25 representations weren't in place because if they are mentioned in the minute, 26 they had to be in place. 27 A No, sorry, just to give an indication of what occurs here. This report of the 28 manager would have related to the meeting that was being held, I think, later 29 in the year, as I said. The manager's report just sets out there the minute of 30 the previous meeting. Now, when a meeting is held by the council, a report is
