Visas for students under 18 years of age<br />

If you are under 18 years of age, you will need<br />

permission from your parents or your legal<br />

custodian to apply for a student visa.<br />

You will not be allowed to study in Australia while<br />

you are under 18 years of age unless:<br />

n you are accompanied by a parent or legal<br />

custodian, or<br />

n you stay with a relative, or<br />

n Monash University provides a written<br />

statement saying that your accommodation,<br />

support and general welfare arrangements<br />

are appropriate.<br />

Parents can apply for a student guardian visa to<br />

accompany you. If you are not staying with a<br />

parent or nominated relative, you must comply<br />

with the accommodation and welfare<br />

arrangements as defined by Monash.<br />

Make sure you allow sufficient time to make<br />

appropriate arrangements. You must complete<br />

and return all of the required documentation<br />

relating to your accommodation and welfare<br />

arrangements, received in your offer pack,<br />

before Monash can issue your Confirmation<br />

of Enrolment (CoE).<br />

Education Services for<br />

Overseas Students (ESOS) –<br />

ESOS Act 2000<br />

The Australian Government wants international<br />

students in Australia to have a safe, enjoyable<br />

and rewarding study experience. Australia’s laws<br />

promote quality education and consumer<br />

protection for international students. These laws<br />

are known as the ESOS Framework and they<br />

include the Education Services for Overseas<br />

Students (ESOS) Act 2000 and the National<br />

Code 2007.<br />

Your rights<br />

The ESOS framework protects your rights,<br />

including:<br />

n your right to receive current and accurate<br />

information about the courses, fees, modes<br />

of study and other information before enrolling<br />

n your right to sign a written agreement (your<br />

Monash ‘International Student Course<br />

Agreement’) with your provider before or as<br />

you pay fees, setting out the services to be<br />

provided, fees payable and information about<br />

refunds of course money. You should keep a<br />

copy of your written agreement with Monash<br />

n your right to get the education you paid for.<br />

The ESOS framework includes consumer<br />

protection that will allow you to receive a<br />

refund or to be placed in another course if<br />

your provider is unable to teach your course<br />

Your responsibilities<br />

As an overseas student on a student visa you must:<br />

n comply with your student visa conditions<br />

(see page 4)<br />

n comply with the terms of your written<br />

agreement with Monash<br />

n if attendance is recorded for your course,<br />

follow the Monash attendance policy<br />

n seek permission from Monash if you wish to<br />

transfer to another tertiary institution before<br />

you have completed six months of the<br />

principal course of study.<br />

The University is obliged to advise the<br />

Government if your enrolment status changes<br />

(eg if you complete your course early, transfer<br />

courses, intermit your studies or discontinue your<br />

course) and report you if you breach your visa<br />

conditions relating to academic progress. The<br />

University is also obliged to report students who<br />

do not commence study under the new Tuition<br />

Protection Service (TPS) requirements. As your<br />

education provider, Monash University may<br />

disclose personal information about you to<br />

relevant government bodies in accordance<br />

with the ESOS Act and National Code.<br />
